Consider approval of the Minutes of the November 1 , 1997 Called Business Meeting. PUBLIC HEARING 1. Consider an appeal from William S. Orban/Barbara A. Clement for a variance(s) from the Zoning Ordinance, Accessory Building regulations which require a maximum square footage of 600 sqft for any accessory building and a minimum of 5 feet separation between the accessory building and the main building. The applicant (s) are requesting to be allowed to have a 1,680 sqft accessory building and less than 5 feet separation between the accessory building and the main building. This property is located at 2815 W. FM 544. 2. Consider an appeal from David and Jan Morgan for a variance from the Zoning Ordinance, Two Family Residential regulations which require a minimum lot width of 80 feet. The applicant (s) are requesting to be allowed to build a duplex on a corner lot where the lot width is 68 feet. This property is located at 102 S. Fourth Street, Wylie, Texas. 3. Consider an appeal from Chris Trout for a variance(s) from the Zoning Ordinance, Sign Regulations which require a 60 feet separation between another freestanding sign, requirement of a maximum square footage of 100 sqft on advertising and/or identification signs and the requirement of a 20 feet maximum height for an advertising and/or identification sign. Mr Trout is requesting to be allowed to place his sign within 12 feet of another freestanding sign, to have 121 sqft available space on his advertising and/or identification sign and a sign maximum height of 27 feet and 4 inches. Mr Trout's property where the sign will be located is 1950 Hwy. 78 North (CT'S C Store). 4. Consider an appeal from Richard Lane Custom Homes for a variance(s) from the Zoning Ordinance, Single Family Residential regulations which require a rear yard set back of 25 feet. Richard Lane Custom Homes is requesting to be allowed to have a rear yard setback of 181/2 feet on property located at 507 Kreymer Lane, Lot 1 , Block A of Wyndham Estates. 5. Seeking an interpretation of regulation 25.5(2b) contained within the adopted City of Wylie Zoning Ordinance which states: A wall or fence, not less than six feet in height, with self-enclosing and self-latching gates at all entrances, completely encloses either the pool area or the surrounding yard area. Minutes of the Zoning Board of Adjustments The Board of Adjustments Commission met in a Called Business Meeting on November 11, 1996, at 7:00 p.m. in the Council Chambers of the Wylie Municipal Complex, located at 2000 Hwy. 78 North, Wylie, Texas 75098. A quorum was present and a notice was posted in the time and manner required by law. COMMISSION MEMBERS PRESENT: Chairman Gerald Clark, James Smith, Ray Capley, Emily Hartwig and Alternate - Denise Mays. ABSENT: Marilyn Herrera - excused STAFF MEMBERS PRESENT: Planner - Kelley Shaw and Secretary- Rebecca Rogers. ACTION ITEMS ITEM NO. 1: Consider approval of the Minutes of the October 21, 1996 Called Business Meeting. Motion was made by Emily Hartwig and seconded by James Smith to accept minutes as presented. Motion carried, all in favor (5 votes). PUBLIC HEARING Item No. 1: Hold Public Hearing to consider an appeal from Holigan Family Investments, Inc. for a variance(s) to the mobile home regulations of the Wylie Zoning Ordinance. The Community Development Department has recommended denial of the Preliminary Plat as submitted by Holigan Family Investments Inc. because of issues dealing with lot size, re- quired sidewalks and covered parking. The property proposed for this Mobile Home de- velopment is located at FM 544 and Vinson Road and further described as a 34.53 acre tract of land out of the Elisha M. Price Survey, Abstract 1114. Chairman Clark opened the Public Hearing. Will Cole of Boyle Engineering, 6606 LBJ Freeway, Dallas, TX was present to speak on the behalf of Holigan Family Investments Inc. (Holigan). Mr. Boyle began by saying that he would address each request for vari- ance seperatley. The first issue he discussed was in regards to the mobile home requirement of a 25% maximum lot coverage (per lot). Holigan is requesting that they be allowed to have a mobile home park average of 25%. Applicant pointed out that example in ordinance showed a 29% lot coverage. Mr. Cole stated that more people were buying double wide homes and therefore in some cases would exceed the 25% lot coverage re- quirement but that the park would also have single wide homes that would cover less than 25% of the lot. This is the reason that Holigan is requesting the 25% average. The Zoning Board of Adjustments (Board) asked how the setback requirements would be affected. Mr. Cole said that all setback requirements would be met and pointed out the typical site drawing. The Board then asked staff for its input. Staff responded that it 1 would be difficult to determine if 25% average requirement was being maintained. Mr. Cole pointed out that Single Family residences allow much more of a lot coverage. The Board asked staff what were the single family lot coverage requirements. Staff re- sponded that for Single Family residences the maximum lot coverage was 45%. The Board asked if there was any other public comment on this item. Mr. Leo Wiman of 7344 Blairview St, Dallas, Texas, stated that he had property adjacent to the proposed development and that he was against the requested variances. Chairman, for the record, stated that it would take a favorable vote of 4 out of the 5 mem bers present to grant variance. With the absence of a motion to grant the variance, re- quest was denied. Mr. Cole then began discussing the second variance request. He stated that Holigan was requesting that they be allowed to construct a sidewalk on only one side of the street in- stead of the requirement of sidewalks on both sides of the street. Mr. Cole said that there were very few mobile home parks that he knew of that had sidewalks, much less sidewalks on both sides of the street. The Board asked if this was more of a financial consideration. Mr. Cole responded that in a sense it was because the cost of the sidewalks would have to be passed on to the homeowner. At this point the Chairman asked staff how many notifications were sent out to property owners within 200 feet of this development. Staff responded that notifications were sent out to owners representing 46 properties that met the 200 foot criteria. Two notices were returned as non deliverable. The Chairman asked if there was a motion to grant the variance. In absence of a motion to grant the variance, request was denied. Mr. Cole then began to address Holigan's last request which was to have covered parking be an option to be left up to the homeowner. Mr. Cole referred to the ordinance requiring covered parking and stated that it was not specific as to when the covered parking was to be constructed. Mr. Cole then went on to say that their request was that the covered parking be an option left up to the homeowner or if the board required the covered parking, to clarify when it was to be constructed. Mr. Cole explained that the covered parking would be torn down when a mobile home was being moved on the lot as well as when the home was moved off the lot. The Board agreed that the covered parking need not be standing before the mobile home was moved on the lot but did want the covered parking to be required. The Board then 2 asked staff how would the staff propose that the issue be dealt with as far as when the covered parking was to be erected. Staff responded that it would work with the developer on this issue but would not require the covered parking to be installed before the home was moved on the lot, but require the covered parking to be installed in a time period tied to the final release of utilities to the home or the Certificate of Occupancy being issued, something of that nature. The Board then asked Mr. Cole if that was clarification enough for him and he said that it was. Mr. Cole then thanked the Board for its time and reiterated that he believed the Board was wrong in its decision to deny the 25% lot coverage average request. Frank Kemeny (Holigan Family Investments Inc.) of 7205 Fairvalley Way, Plano, Texas, addressed the Board by stating that with the decisions of the Board on these issues, they were requiring people with lesser income (smaller mobile homes) to come into the park and then have to pay more (money that they didn't have) for their lots because of the required parking and sidewalks. The Chairman then responded to Mr. Kemeny by stating that the Board has very strict criteria that they must base their decisions on and that by what was presented to them, the criteria needed for the granting of a variance was not met. He added that it seemed that the applicant (Holigan Family Investments Inc.) has options available such as increasing the size of their lots for the larger mobile homes which would reduce profit but that was the developers decision. The Chairman then asked for a motion to grant the variance for covered parking to be optional. In the absence of a motion to grant the variance, the request was denied. The motion was then made to close the hearing and was seconded. Discussion was then held between Board members and staff as to when the Board was to meet. It was decided that the Board would have regularly scheduled meetings (but would meet only when a request was filed) on the second Monday of each month at 6:30 p.m. ADJOURNMENT A motion to adjourn the meeting was made by Emily Hartwig and seconded by James Smith. Orban/Barbara A. Clement for a variance(s) from the Zoning Ordinance, Accessory Building regulations which require a maximum square footage of 600 sqft for any accessory building and a minimum of 5 feet separation between the accessory building and the main building. The applicant (s) are requesting to be allowed to have a 1,680 sqft accessory building and less than 5 feet separation between the accessory building and the main building. This property is located at 2815 W. FM 544. Background Mr. Orban's residence is considered a non conforming use because his house is located on a lot zoned as "B-2" Business District. Mr. Orban also has an established home occupation (yard art). The Texas Department of Transportation (TXDOT) is currently in the process of obtaining public right-of-way for the future widening of St. Hwy. 544. Due to this widening, Mr. Orban is losing approximately half of his front yard and drive way. Mr. Orban is requesting a variance from the 600 sqft maximum accessory building requirement because of the following: He currently uses his front yard as space to store his yard art as well as personal and customer parking and he will be losing approximately half of this front yard to public right-of-way. He feels he needs the extra space of the accessory building to store vehicles and yard art. He is requesting permission to construct a 1,680 sqft building. Mr. Orban is requesting a variance from the 5' minimum separation between the main building and the accessory building because of the following: Due to the size of the proposed accessory building it will not possible to have the minimum 5' separation between the accessory building and the main building. Staff Recommendation Staff realizes the loss of property due to the widening of St. Hwy 544 does create a hardship. However, staff recommends the Zoning Board of Adjustment require Mr. Orban to provide sufficient evidence that a 1,680 sqft building is needed. The Zoning Board of Adjustment may grant staff authority to determine what is acceptable (upon evidence provided) for the size of the accessory building. Staff is willing to discuss this matter and will endeavor to work with Mr. Orban on what size of building will meet, within reason, his needs. Staff Recommendation Staff recommends approval of the variance due to the fact that all lots in the area have the same approximate dimensions and that there are duplexes that exist in the area. The lot was in conformance with two-family lot requirements (65 ft width) up until the most recent Zoning Ordinance. The lot being a corner lot is important because the duplex entrances are on opposite sides of the lot providing adequate entrance space. Erect an advertising sign higher than 20 ft March 10, 1997 Issue Consider an appeal from Chris Trout for a variance(s) from the Zoning Ordinance, Sign Regulations which require a 60 feet separation between another freestanding sign, requirement of a maximum square footage of 100 sqft on advertising and/or identification signs and the requirement of a 20 feet maximum height for an advertising and/or identification sign. Mr Trout is requesting to be allowed to place his sign within 12 feet of another freestanding sign, to have 121 sqft available space on his advertising and/or identification sign and a sign maximum height of 27 feet and 4 inches. Mr Trout's property where the sign will be located is 1950 Hwy. 78 North (CT'S C Store). Background Mr. Trout is currently having new storage tanks put in at his convenience store/gas station and is changing gasoline vendors as well. As a result of the new gasoline vendor name, Mr. Trout is having to replace his sign with the new gas company name. Mr. Trout would like to put the sign back where the original sign was located so as to not create, in his opinion, a traffic hazard. This location is within 60 feet of an existing free standing sign. Both signs are considered to be legal non-conforming signs at their respective locations. He is requesting a variance from the 20 ft maximum height regulation to allow a sign with the height of 27 feet and 4 inches so as to increase the sign's visibility from St. Hwy. 78. The sign that he is wanting to construct has a 121 sqft area which exceeds the 100 sqft maximum area requirement. Staff Recommendation As to the classification of the sign, staff contends that this sign should be classified as an advertising sign which allows for the advertisement of commodities or services and provides for a changeable copy area. The regulations for this type of sign are as follows: Area- 100 sqft max. Height- 20 ft max. Property setbacks- 30 ft (front and side) Sign spacing- 60 ft between signs Staff recommends that the variance from 60 ft separation between signs be granted as the sign was legally located, even though this replacement involves more than normal repairs and maintenance. Staff recommends denial of the requested variance for a sign higher than 20 feet. If Mr. Trout desires better visibility from the blockage of the sign on the property adjacent to him, he has the option of locating it somewhere else on his property. Richard Lane Custom Homes is requesting to be allowed to have a rear yard setback of 181/2 feet on property located at 507 Kreymer Lane, Lot 1, Block A of Wyndham Estates. Background Staff subsequently in inspection duties realized that an oversite was made in the site plan approval process. Krom Address 505 Kreymer Lane Zoning Board of Adjustments #5 Public Hearing Item Re: Interpretation of Regulation 25.5(2b) of the Zoning Ordinance March 10, 1997 Issue Seeking an interpretation of regulation 25.5(2b) contained within the adopted City of Wylie Zoning Ordinance which states: A wall or fence, not less than six feet in height, with self-enclosing and self-latching gates at all entrances, completely encloses either the pool area or the surrounding yard area. Background This item is for clarification and interpretation purposes relating to the requirement in the Zoning Ordinance for self-closing and self-latching gates in the fence enclosure of a swimming pool. A request has been received for a fence permit which includes a gate over a driveway which will become part of an enclosure for a swimming pool. The electric device which will operate the gate will meet the requirements of self-latching and self-closing as required by the Zoning Ordinance. The City of Wylie Zoning Ordinance states in Sec. 25.5(2)(b) "A wall or fence, not less than six feet (6') in height will self-closing and self-latching gates at all entrances, completely encloses, either the pool area or the surrounding yard area." The device would meet the requirements if (1) the releasing mechanism is more than 36" above grade, (2) if the mechanism can be set to close the gate automatically after a duration of time to insure the vehicle is clear of the gate and (3) the gate cannot be opened without engaging the releasing mechanism or a remote device, similar to a garage door opener. The City of Plano Construction Review Board has given an interpretation that these types of devices are acceptable and have established a time limit of 60 seconds for the gate to close automatically without a closing action being taken prior to that time. This is a safety factor to insure the gate closes if the owner were to forget to close it by button activation. Normal operation would be for the operator to open and close the gate by a button on a remote. This item was placed on the agenda to see if the Board had any further input into this interpretation.
