the south of Parker and east of McCreary Road
Request: Variance of Section 26.4(2) of the Zoning Ordinance
restricting the size of accessory buildings on lots of
more than two acres to 2,000 square feet
Background:
1. The subject property was annexed into the City of Wylie August 31, 1999. The
applicant/owner stores his large farm equipment on the property (currently
uncovered, open visually and to the weather). No residences exist on the property.
2. The applicant reports that he started construction of a barn in which to store his
farm equipment prior to being annexed into the City of Wylie. The anticipated barn
was allowed by Collin County at that time. Construction on the barn was halted
because of personal reasons. When he recently again started construction, City of
Wylie inspectors required him to stop work and obtain a building permit (staff was
responding to a specific complaint by a neighboring property owner).
3. In July of 1999, the City Council amended Section 26.4(2) of the Zoning Ordinance
to establish that "the maximum square foot area for an accessory building on a lot
size of more than two (2) acres shall be 2,000 square feet". The maximum size of
accessory buildings on lots of two acres or less remains 600 square feet. This
amendment was specifically intended to provide opportunity for larger accessory
buildings on larger lots, and especially those agriculturally-related properties being
newly annexed.

4. Section 32.3 (e) of the Zoning Ordinance provides that the Zoning Board of
Adjustment may permit a variance to the requirements of the development code
where there are unusual and practical difficulties or unnecessary hardships in the
carrying out of these provisions due to an irregular shape of the lot, topographical or
other conditions, provided such variance will not seriously affect any adjoining
property or the general welfare. However, said section does specifically state that
in order to grant a variance, the following conditions shall be documented:
a) That special conditions and circumstances exist which are peculiar to the land,
structure or building involved and which are not applicable to other lands,
structures, or buildings in the same district.
b) That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other properties in the same district
under the terms of this ordinance.
c) That the special conditions and circumstances do not result from the actions of
the applicant.
d) That granting the variance will not confer on the applicant any special privilege
that is denied by this ordinance to other lands, structures, or buildings in the
same district.
e) No nonconforming use of neighboring lands, structures, or buildings in the same
district and no permitted use of lands, structures, or building ins other districts
shall be considered grounds for the issuance of a variance.
f) Financial hardship shall not be considered grounds for the issuance of a
variance.
Considerations:
1. Public Comment Forms were mailed to four (4) property owners within 200 feet
of this request. No Comment Forms have been returned.
2. Several neighboring properties have large accessory buildings, although exact
sizes are unknown and it is assumed were existing complete when the
properties were annexed into the City (therefore, are legally nonconforming).
Some of these accessory buildings are used for the storage of personal
agricultural or property maintenance equipment, while some are used for
nonresidential/nonagricultural uses (specifically that to the immediate west of the
subject property and to the east beyond the recently-approved Estates at
Creekside subdivision).

3. The City Council specifically intended to provide for larger accessory buildings
on such larger, agricultural properties with the 1999 amendment to the Zoning
Ordinance. The maximum area anticipated by the Council was 2,000 square
feet. The requested accessory building is 3,180 square feet, an increase of
1,180 square feet or 59% larger than the size allowed by the amended
Ordinance.

TO CONSIDER AN ORDINANCE OF THE CITY OF
WYLIE, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE NO. 85-
23A OF THE CITY OF WYLIE, TEXAS, BY
AMENDING SECTION 26, ACCESSORY BUILDING
REGULATIONS; PROVIDING FOR THE REPEAL OF
ALL ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILTTY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission and the governing body of the
City of Wylie, Texas, in compliance with the laws of the State of Texas with reference to the
amendment of the Comprehensive Zoning Ordinance, have given the requisite notices by
publication and otherwise, and after holding due hearings and affording a full and fair hearing
to all property owners generally and to owners of the affected property, the governing body
of the City is of the opinion and finds that the Comprehensive Zoning Ordinance should be
amended;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS:
SECTION 1.
That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be, and the
same is hereby, amended by amending Section 26.3 and Section 26.4(2), which shall read as
follows:
Section 26.3. An accessory building on a lot size of two (2) acres or less is
restricted in height to 15 feet or the height of the main structure, whichever is less.
An accessory building on a lot size of more than 2 acres is restricted in height
to no more than the height of the main structure or two stories, whichever is
greater.
Section 26.4(2). Area of Building. The maximum square foot area for any an
accessory building on a lot size of two (2) acres or less shall be 600 square feet
or—less. The maximum square foot area for an accessory building on a lot
size of more than two (2) acres shall be 2000 square feet.
SECTION 2.
That all ordinances of the City in conflict with the provisions of this ordinance be, and
the same are hereby, repealed and all other ordinances of the City not in conflict with the
provisions of this ordinance shall remain in full force and effect.
SECTION 3.
Any person, firm or corporation violating any of the provisions of this ordinance or
the Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act and shall
be subject to the general penalty provisions of Section 38 of the Zoning Ordinance, as the
same now exists or is hereafter amended.
SECTION 4.
Should any paragraph, sentence, subdivision, clause, phrase or section of this
ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole or any part or provision thereof, other than the
part so declared to be invalid, illegal or unconstitutional, and shall not affect the validity of
the Comprehensive Zoning Ordinance as a whole.
SECTION 5.
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION 6.
The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall
not be construed as abandoning any action now pending under or by virtue of such ordinance;
nor shall it have the effect of discontinuing, abating, modifying or altering any penalty
accruing or to accrue, nor as effecting any rights of the municipality under any section or
provisions of any ordinances at the time of passage of this ordinance.

To the appeal board of adjustments,
First of all we were not aware that we needed a permit to build a utility barn,because we were told
at the time of annexation that if construction was already under way prior to annexation that it was legal.
The rules you have now do not apply to our situation.We had begun construction before the annexation,
but we got busy with farming and illness,which delayed the finishing of the building. We have now hired
someone to finish it. This property is zoned agriculture and we have parked our farm equipment on it for
years. And like you and everyone else who wants a garage to park his car or even his lawn mower,we
want a building to park our farm equipment.We know that we are in the city limits of Wylie but we are
still in the country. We are on the very edge of the city limits. It is not like we are building a barn in
the residential part of the city.
Please give us this consideration. This hardship is due to the delay of construction. Please grant us
a permit so we can finish this project. We have already been out a large expense on it.Expense that cannot
be recovered.

Request: Variance of Section 10.3(1)(c) of the Zoning
Ordinance to allow a rear yard building setback of
24.6 feet rather than the required 25 feet.
Background:
1. The subject property is zoned Single-Family Residential — 2 (SF-2) District. Section
10.3(1)(c) of the Zoning Ordinance requires a rear yard of not less than 25 feet in
the SF-2 District.
2. A previous owner initiated construction of a single-family residence on the subject
property in the Spring of 1999 with a building permit approved by the City of Wylie.
Construction was stopped later that year due to financial reasons, and the property
and partial construction remained abandoned.
3. The current applicant recently purchased the property and applied for building
permits in order to complete construction. Files of the Building Inspection
Department contained insufficient documentation of the existing construction, and
staff required new surveys and tests. Review of the new documentation revealed
that the garage was a distance of 24.6 feet from the rear property line. This is a
discrepancy of 4.8 inches or 1.6 percent from the required setback.
4. The applicant is requesting the variance from the required 25 feet to 24.6 feet in
order to allow completion of construction of the residence for investment purposes.

Considerations:
1. Public Comment Forms were mailed to seventeen (17) property owners within 200
feet of this request. No Comment Forms have been returned.
2. The identical building footprint has been completed on adjoining lots to the east and
west. Review of Building Inspection Department records indicates that construction
on both of these neighboring lots fully complies with setback requirements,
including the rear yard regulations.
3. The requested modification from the required 25 feet to 24.6 feet is a variance of
4.8 inches or 1.6 percent from the required setback. The existing construction
complies with all other code requirements.
