Request: Variance of Section 11.4 of the Zoning Ordinance to
allow a one-car garage on a single-family residence
Background:
1. The subject property is zoned Planned Development (PD) District, which allows a
minimum lot size of 6,000 square feet.
2. Section 11.4 of the Zoning Ordinance requires two covered, enclosed parking
spaces for each single-family dwelling within all residential districts.
3. As originally platted in compliance with the Planned Development District zoning,
this 6,000 square feet lot required a minimum front yard setback of 20 feet, a rear
yard setback of 20 feet and a side yard of at least 10 feet between adjacent houses
(or an individual side setback of approximately 5 feet on each lot). The lot also
accommodates utility easements of 5 feet width along the rear and south side. The
City of Wylie later required additional 15 feet wide temporary access easements
across the side of a number of lots, including the subject property, in order to
provide adequate circulation for emergency vehicles prior to completion of the entire
subdivision. As a temporary easement, it was intended to be abandoned when a
secondary point of access is provided with the completion of Lakefield Drive, but the
access easement on this lot has been paved as an alley. No structures can be
constructed within these easements, leaving approximately 3,855 square feet of
buildable area within the subject lot.

4. The applicant proposes to construct a two-story residence, totaling approximately
1,664 square feet of living space on the developable portion of the lot. It is
proposed that the residence will be provided with an attached one-car garage,
because of the narrowed with of the lot caused by the access easement does not
allow the wider two-car garage.
5. Section 32.3(e) of the Zoning Ordinance provides that the Zoning Board of
Adjustment may permit a variance to the requirements of the development code
where there are unusual and practical difficulties or unnecessary hardships in the
carrying out of these provisions due to an irregular shape of the lot, topographical or
other conditions, provided such variance will not seriously affect any adjoining
property or the general welfare. However, said section does specifically state that
in order to grant a variance, the following conditions shall be documented:
a) That special conditions and circumstances exist which are peculiar to the land,
structure or building involved and which are not applicable to other lands,
structures, or buildings in the same district.
b) That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other properties in the same district
under the terms of this ordinance.
c) That the special conditions and circumstances do not result from the actions of
the applicant.
d) That granting the variance will not confer on the applicant any special privilege
that is denied by this ordinance to other lands, structures, or buildings in the
same district.
e) No nonconforming use of neighboring lands, structures, or buildings in the same
district and no permitted use of lands, structures, or building ins other districts
shall be considered grounds for the issuance of a variance.
f) Financial hardship shall not be considered grounds for the issuance of a
variance.
Considerations:
1. Public Comment Forms were mailed to Twenty-eight (28) property owners within
200 feet of this request. No Comment Forms have been returned prior to the
deadline for posting this request.

2. The requested variance will allow construction of a dwelling which is comparable
in size and design to neighboring dwellings, and which conforms to all other
code requirements, except that it will have a one-car rather than a two-car
garage. Similar access easements have been required on one additional lot
within Phase II of Lakeside Estates and on three lots within Phase III of Lakeside
Estates, and at least some of these may result in similar restriction of lot with
and requests for one-car garages. There are currently no other residences
within the subdivision with single-car garages.
3. The undevelopable area cited in support of this request is platted as a temporary
easement, intended to abandoned when access and circulation for the
subdivision are enhanced with the completion of Lakefield Drive. If and when
the access easement is abandoned and the pavement removed, the lot should
be of sufficient developable width to allow the required two-car garage.
Although the timing of the Lakefield extension is unknown at this time, its
construction has recently been incorporated as a stipulation of a change in
zoning by the City Council for the property to the north, and the requested
variance may be premature.

Request: Variance of Section 19.3 of the Zoning Ordinance to

and variance of Section 24.3 (28) of the Zoning
Ordinance to waive required off-street parking
Background:
1. The subject property is platted as the original downtown commercial area. It fronts
27 feet in width along North Ballard Street and is 125 feet deep. A building
previously occupied the lot, but was destroyed and the lot is currently vacant.
2. The applicant proposes to construct a two-story building for retail and office uses. It
is proposed to locate the front of the building at the front property line/sidewalk and
to utilize the existing parking along the street front, in conformance with the historic
pattern of adjacent downtown development. The building which previously occupied
the lot was constructed to the front property line and was served by on-street
parking as is currently proposed.
3. The subject property is zoned Business — 2 (B-2) District. Seotion 11.3(1)(a) of the
Zoning Ordinance requires a front yard and a rear yard of not less than 20 feet each
in the B-2 District. Section 24.3(28) of the Zoning Ordinance requires one off-street
parking space for each 200 square feet of gross floor area for retail uses within all
districts.

4. The Comprehensive Plan, adopted in 1999, recommends that the historic uses and
character of the central downtown area be preserved. Proposed revisions to the
Zoning Ordinance will create a new Downtown Historic (DTH) District intended to
preserve and reconstruct the downtown area as originally developed. These
proposed revisions allow that commercial buildings be placed on the front building
line (Section 6.3.E.4.a) and that parking for nonresidential uses be provided off-site
(Section 6.3.E.4.c). The requested variances comply with these proposals, which
are currently under consideration by the Planning and Zoning Commission and City
Council.

Considerations:
1. Public Comment Forms were mailed to Forty-five (45) property owners within
200 feet of this request. Two Comment Forms have been returned, both
favoring the proposal.
2. The requested variances conform with the existing setbacks and parking
arrangements of neighboring properties along Ballard Street within the historic
downtown area.
3. The proposed construction, including the conditions of the subject request
(waiver of front yard and off-street parking), conform with the proposed revisions
to the Zoning Ordinance for the new Downtown Historic District.
