Commission Members Present: Staff Members Present: Steve Ahrens Claude Thompson, Planner William Chapman Mindy Manson, Assistant City Manager Michael George Carter Porter Gary Wiseman Commissioners Absent: Toney Snider Phillip Tramell PREMEETING The Premeeting was convened at 6:30 p.m.. Thompson reviewed the Planning Report and addressed questions from the Commissioners. CALL TO ORDER Chairman George called the Meeting to order at 7:00 p.m. PLEDGE AND INVOCATION Commissioner George offered the Invocation and Commissioner Porter led the Pledge of Allegiance. CITIZEN PARTICIPATION Gary Bowland, 700 Westwind Lane, Wylie, 75098 appeared to caution the Commission against establishing strict rules for the preservation and redevelopment of the downtown area. He reported that a lot of private investment has created the current attraction of the downtown area with no public assistance. He believes that there is no need for new regulations and especially no need for a special advisory commission to regulate use and design within the area. P&Z Meeting April 3, 2001 Page 2 Commissioner George commended Mr. Bowland for his continuing investment in the downtown area with his Ballard Street Cafe, and noted that codes and regulations are intended to preserve and encourage just such successful business and design character. He said that rules are required not to change or restrict but to enforce such quality on all properties, thereby protecting the investment of those who voluntarily provide such quality. Commissioner Porter mentioned that current codes would allow designs that may not be compatible with the historic character of the downtown area. He noted that specific regulations or an educated advisory committee would help protect the area against unequal competition from outlying shopping centers. Thompson reported that the Comprehensive Plan recommends that the Historic Downtown be provided special planning and regulation in order to protect its character and value as Wylie's central place. The City Council has retained a consultant to draft revisions to the Zoning Ordinance and that contract includes such special consideration of the downtown area. The best manner to achieve this goal has not yet been determined, but the P&Z will investigate the various options and a public hearing will allow citizen input. No one else appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes of the March 20, 2001 meeting. Motion was made by Commissioner Ahrens, seconded by Commissioner Porter, to approve the minutes, with the correction of the spelling of"work" session on page 8. Motion passed 5-0. ACTION ITEMS 1. Consider and act upon a Site Plan for Carlisle Coating & Waterproofing, Inc., located at 900 Hensley Lane and being all of a certain 8.035 acre tract at the southwest corner of Hensley lane and Sanden Boulevard, being Lot 3, Block B of the Premier Industrial Park South Addition, 1st Revision, City of Wylie, Collin County, Texas. Thompson reported that this Site Plan reflects development of the new facility of Carlisle, who is relocating from their present property on F.M. 544 and consolidating operations of several other plants into this new Wylie facility. He noted that the site presents several challenges which the Site Plan has addressed. The Site Plan complies with all applicable code requirements, and staff recommends approval. P&Z Meeting April 3, 2001 Page 3 Larry Rogers, Centex Construction, 10150 Monroe Drive, Dallas, TX 75229, and Toney Noe, Carlisle Coating, 903 W. Kirby Street, Wylie, TX 75098 were available to address questions by the Commission. Commissioner George asked the location of dumpsters and whether they are to be screened. Noe responded that they to located in the rear of the building beside the loading ramp and would not be screened because they needed to remain accessible to the large disposal trucks. Commissioner Porter noted the use of a hedge to screen the truck loading area in the front, and expressed the desire for a plant other than Red Tip Photinia. Rogers said that alternatives will be investigated and cleared with staff Commissioner Ahrens said that the chain link fencing was not compatible with the major visibility of this location and asked if wrought iron could be considered. Rogers responded that alternative fencing methods have been investigated, but safety required that the chemicals at the complex be fenced securely, and that police/fire authorities as well as legal/insurance sources demand chain link. He suggested that the fence's distance from the road and the difference in elevation would serve to partially obscure the fence. He suggested that they will investigate the possibility of moving the fence back about 3 to 5 feet in order to install a plant hedge to the road side. Commissioner George questioned why the building is located so close to Sanden Boulevard. Noe said that building is oriented to accommodate future expansion to the west side without requiring disruption of drives and parking. Commissioner Porter asked how the site will be lighted. Rogers pointed out the pole and wall- mounted lights on the site plan. Commissioner Ahrens asked where the HVAC equipment was located and how it will be screened. Rogers provided a perspective rendering of the proposed building and pointed out that mechanical equipment will be located on the roof and a parapet wall screen it from ground view. Commissioner Ahrens asked how the building design complied with the proposed revisions to nonresidential construction. Thompson pointed out the masonry materials and off-set articulation are requirements being considered for the new requirements. The building plans are current being reviewed by staff for compliance. The consultants were made aware that the City was adopting the updated of the Uniform Building Code. Commissioners George and Porter expressed their agreement with the use of decorative tilt walls. P&Z Meeting Apri13, 2001 Page 4 Commissioner Ahrens asked how the drainage was to be handled. Thompson responded that the significant drainage coming on to the property from the west will be piped under the rear drive and truck parking, and then be carried by a surface swale to the culvert under Sanden Boulevard. The surface drainage will provide sufficient on-site detention. Commissioner George asked about the proposed signage. Noe pointed out the location of the sign on the Site Plan and responded that the sign on the current property will be modified and relocated to this site. Sam Satterwhite, Executive Director of the Wylie Economic Development Corporation, 2000 North Highway 78, spoke in favor of the relocation, which the EDC has facilitated. He reported that Carlisle will be the final business to locate in the Premier Business Park. There was no further discussion. Motion to was made by Commissioner Chapman, seconded by Commissioner Ahrens to approve the Site Plan with the stipulation that the fence along Sanden be setback and a plant screen hedge be added to the outside. Motion passed 5-0. WORK SESSION 1. Discuss revisions to the Zoning Ordinance. Following a short break, Commissioners reconvened in the Wok Session Conference Room at 7:45 p.m.. Ray Stanland, 5207 McKinney Avenue, Dallas, TX proposed revisions to the nonresidential districts of the Zoning Ordinance, specifically Article 4 and 6 which had been distributed at the previous meeting. He led a discussion of the point system and illustrations for architectural design standard. Commissioners expressed support for the requirements of articulation of building facades and limited parking in the front of buildings, and suggested that fountains be added to desirable streetscape elements, landscaping and monument signs. Review of Article 6 suggested narrower boundaries for the special downtown overlay district. He encouraged Commissioners to consider appropriate limits, purpose/uses and just what details are desired to be preserved in the downtown area. It must also be decided what level of public/collective control is desired, ranging from discretionary guidance to absolute regulation. He photographically illustrated potential assets and problems such as height/width ratios, building alignment and compatible and conflicting details in design, windows/doors and signs. P&Z Meeting April 3, 2001 Page 5 Thompson encouraged Commissioners to review all of the draft revisions which have been distributed, so that additional time can be focused on revisions to the Zoning Ordinance and the Subdivision Regulations. Additional meetings on Monday or every Tuesday evening may be required in order to complete the revisions in the next few months. Wright and Dave Jones Location: 2807 West F.M. 544 Existing Zoning: Business (B-2) Summary: The owner/applicant intends to construct a 4,500 square feet building for the shop and office of a specialty automotive restoration and sales business, not open to use by the general public. The subject property is 0.448 acres in size, zoned Business-2 (B-2) and is platted as the Rapin Addition. Section 29A.2 of the Zoning Ordinance requires that a site plan be reviewed and approved by the Planning and Zoning Commission for any development within a nonresidential zoning district. The purpose of the site plan is to ensure harmonious and efficient development of land, compliance with appropriate design standards, safe and efficient vehicular and pedestrian circulation, and provision of utilities and other services. Site plans shall contain sufficient information related to the site design considerations and shall conform to data presented within the building permit application. Issues: 1. Staff has reviewed the proposed site plan for the Vintage Power facility and found it to be in compliance with the requirements of the Zoning Ordinance and other pertinent ordinances of the City of Wylie. Location: Generally located south of Alanis Drive and east of South Ballard Avenue (F.M. 2524) Existing Zoning: Single-Family—2 Residential(SF-2) and Single-Family—3 Residential(SF-3) Summary: The Final Plat for Phase IV of the Twin Lakes Addition includes 32.782 acres and will create a total of 103 lots. The portion north of Alanis Drive is zoned Single-Family Residential— 3 (SF- 3) and creates 35 lots of a minimum size of 7,200 square feet. The portion south of Alanis is zoned Single-Family Residential — 2 (SF-2) and creates 68 lots of a minimum size of 8,500 square feet. Most lots significantly exceed these required minimums. Phase I of the Twin Lakes Addition was initially platted and developed prior to 1987, and that phase incorporated alleys. A Preliminary Plat for Phase II, which includes the area currently under consideration as Phase IV, was approved in 1988, but no final plats were approved and no further development occurred at that time beyond the Phase I. Another version of a Phase II Preliminary Plat for the overall tract, very similar to the 1988 version, was approved by the Planning and Zoning Commission in January of 1998 and by the City Council in February of 1998. That 1998 Preliminary Plat included alleys. The subject Final Plat substantially conforms to the Preliminary Plat approved in 1998, except that the current Plat does not include alleys. Final Nat—Twin Lakes Phase IV However, two subsequent Phases of the Twin Lakes Addition have been approved and developed without the required alleys. A smaller Phase II was completed in August of 1998 and Phase III was completed in November of 2000. The infrastructure was accepted by the City and Final Plats were filed with the County for both of the Phases with no alleys. The applicant contends that the City Council specifically granted a waiver of alleys for the Final Plats of both Phase II and Phase III (which were developed and accepted without alleys) as well as the Phase IV (currently under consideration) and a future Phase V (a request to waive alleys in on the current agenda). However, neither the City staff nor the applicant has been able to document the issuance of such an alley waiver. The applicant is requesting a waiver of the alley requirement for the subject Final Plat of Phase IV. Section 2.9 of the Paving Standards states that "Alleys shall be provided in all residential areas and shall be paved with concrete. The City Council may waive the residential alley requirement upon determination by the Council that it is in the best interest of the City." A similar request for a waiver of the alley requirement for the future Phase V of the Twin Lakes Addition is on the current agenda for consideration by the Commission. Issues: 1. As submitted without alleys, the Final Plat does not conform to the approved Preliminary Plat or to the Subdivision Regulations of the City of Wylie, both of which require alleys. 2. No documentation is available to explain why alleys were not required in two phases which have been approved and accepted by the City, although alleys are required by the code, illustrated on the Preliminary Plat supporting these phases, and alleys are included in the Addition's Phase I. Financial Considerations: Plat application fees—Paid The applicant is aware that development impact fees must be paid before a Final Plat can be filed with Collin County. Water: $72,100 Sewer: $145,436 Staff Recommendation: Denial. The Final Plat does not comply with the requirement of the Paving Standards that residential subdivisions provide alleys. The Departments of Development Services, Public Works and Fire concur with this recommendation. As stated previously, I acknowledge that our preliminary plat depicts alleys, however,the City, prior to our first phase of development issued an alley waiver. As requested,we (Zena and Corwin engineering)have reviewed our files and cannot locate any documents related to this issue and assume that your staff was unsuccessful as well. In spite of this, we are confident in our claims that an alley waiver was issued. As evidence of this, it may be noted that the only changes made from the preliminary plat to the final plats has been the deletion of alleys. There has been no re-alignments or layout of lots or right-of-ways on the previous or the current final plats. Furthermore, in reviewing the minutes from previous P&Z and Council hearings I have found no discussions of or data to support the issue at hand. We have also completed those previous phases in succession without notice or discussion of alleys. Additionally,we had a pre-submittal meeting on March 29th, 2001 to discuss any items that may be of concern related to our proposed Phase IV development.At that time there was no discussion of alleys. I understand the purpose of your request and unfortunately cannot produce documentation to substantiate the previous three years of development in this project. As requested, and in light of this unfortunate circumstance I am formally requesting an "ALLEY WAIVER" for our TWIN LAKES PHASE IV development scheduled for the April 17, 2001agenda. The City Council may waive the residential alley requirement upon determination by the Council that it is in the best interest of the City." The applicant is requesting that this requirement for alleys be waived for the future Phase V of the Twin Lakes Addition. The subject area will be the final phase of the single-family residential development, and will include approximately 24.3 acres and create a total of 62 lots, of which 50 will be SF-1 (minimum 10,000 square feet) and 12 will be SF-2 (minimum 8,500 square feet). Phase I of the Twin Lakes Addition was initially platted and developed at some time prior to 1987, and that phase incorporated alleys. A Preliminary Plat for Phase II, which includes the area currently under consideration for the waiver, was approved in 1988, but no final plats were approved and no further development occurred at that time beyond the initial Phase I. Another version of a Phase II Preliminary Plat for the overall tract, very similar to the 1988 version, was approved by the Planning and Zoning Commission in January of 1998 and by the City Council in February of 1998. That 1998 Preliminary Plat included alleys. Alley Waiver—Twin Lakes Phase V However, two subsequent Phases of the Twin Lakes Addition have been approved and developed without the required alleys. A smaller Phase II was completed in August of 1998 and Phase III was completed in November of 2000. The infrastructure was accepted by the City and Final Plats were filed with the County for both of the Phases. The applicant contends that the City Council specifically granted a waiver of alleys for Final Plats of both Phase II and Phase III (which have been developed and accepted without alleys) as well as the Phase IV (on the current agenda for consideration) and a future Phase V (subject of this request). However, neither the City staff nor the applicant has been able to document the issuance of such an alley waiver. A Final Plat for Phase IV of the Twin Lakes Addition, which also includes a waiver of alleys, is on the current agenda for consideration by the Commission. Issues: 1. The Subdivision Regulations and the Paving Standards of the City of Wylie require that alleys be provided in all residential subdivisions. 2. No documentation is available to explain why alleys were not required in two phases which have been approved and accepted by the City, although alleys are required by the code, illustrated on the Preliminary Plat supporting these phases, and the Addition's Phase I included alleys. Staff Recommendation: Denial. The Subdivision Regulations and Paving Standards require that residential subdivisions provide alleys for utilities and access. The Departments of Development Services, Public Works and Fire concur with this recommendation. As stated previously, I acknowledge that our preliminary plat depicts alleys, however, the City, prior to our first phase of development issued an alley waiver. As requested,we(Zena and Corwin engineering)have reviewed our files and cannot locate any documents related to this issue and assume that your staff was unsuccessful as well. En spite of this, we are confident in our claims that an alley waiver was issued. As evidence of this, it may be noted that the only changes made from the preliminary plat to the final plats has been the deletion of alleys. There has been no re-alignments or layout of lots or right-of-ways on the previous or the current final plats. Furthermore, in reviewing the minutes from previous P&Z and Council hearings I have found no discussions of or data to support the issue at hand. We have also completed those previous phases in succession without notice or discussion of alleys. The subject property contains a total of 99.814 acres of land, and fronts approximately 1,662 feet along Country Club Road. The property is unplatted and is zoned for Agricultural(A) uses. The property to the north of the tract is zoned Planned Development District for Single-Family Residential uses (PD 99-31) and is developing as the Riverchase Addition Phase Two with minimum lots of 7,200 square feet (although most exceed 8,000 sq. ft.). The property to the east across Country Club Road is zoned Single-Family Residential - 2 (SF-2) and currently developing as the Quail Meadow Addition with minimum lots of 8,500 square feet (although most exceed 9,000 sq. ft.), and Single-Family Attached (SF-A) which is currently undeveloped. The adjoining property to the south is undeveloped and zoned for Agriculture (A) uses. The property to the west is undeveloped and is within unincorporated Collin County but is within Wylie's Extraterritorial Jurisdiction. ZC 01-02 Public Comment Forms were mailed to fifteen (15) property owners within 200 feet of this request. One Public Comment Form has been returned in favor of the request. Issues: 1. The Comprehensive Plan recommends Suburban Residential uses for this property. Suburban Residential is defined by the Plan as allowing single-family detached houses on lots ranging in size from a minimum area of 8,500 square feet to one acre, served by urban streets with curbs and gutters and sidewalks. Dwelling units must also be within 3,000 feet walking distance of the retail/institutional Village Center and provide clearly defined, effective pedestrian linkages to it. The requested zoning change is generally consistent with these recommendations of the Future Land Use Plan. 2. However, the recently-revised Residential District Provisions of the Zoning Ordinance classifies single-family residential lots of 8,500 square feet within the Village Residential Districts, which are intended to be located more immediately adjacent to the nonresidential Village Centers (suggesting that no dwelling be more than 1,300 feet distance). Suburban Residential Districts within the new Zoning requires lots of 10,000 square feet or larger. Neither the distance of the property from the nearest village retail center (on Country Club Road at McMillen Road) nor the proposed lower density of the subject request is consistent with this intent of Zoning Ordinance. 3. The newly-adopted Residential District Provisions of the Zoning Ordinance establish a flexible point system with which all developments must comply in order to obtain approval for construction. These provisions list certain Base Design Standards which all developments must meet, and provide several optional Desirable Design Standards from which the developer may choose in meeting a given required total number of points before a development may be approved for construction. The following compares the proposed special development requirements of the Planned Development District with standard provisions of the Zoning Ordinance. a. The minimum lot size proposed by the PD is approximately 9,125 square feet, compared to the 8,500 square feet minimum required by the ZO. b. The minimum house size proposed by the PD is 2,000 square feet, compared to the 1.700 square feet required by the ZO. c. The PD proposal includes some curvilinear streets, which are Desirable elements for which points are achieved within the new ZO criteria. ZC O1-02 d. The PD proposes a landscaped entry feature with landscaped street median as well as a 20 feet wide exterior landscape and lighted buffer for the sidewalk linking the development to the Village Center, which are Desirable elements for which points are achieved within the ZO. e. The PD proposes a Mandatory Homeowners Association for maintenance of all open space and landscaping, whereas HOAs are not a consideration of the ZO (although such are logically required for maintenance of desired common areas). f. The PD proposes 8.5 feet wide interior side yard setbacks and fifteen feet side yards adjacent to streets, whereas the ZO now requires 10 feet for interior side yards and twenty-five feet for side yards adjacent to streets. 4. The only change in the lot configuration requirements between the old SF-2 District and the new SF-8.5 is an increase in the minimum required side yard from seven feet to ten feet. The direct consequence of this change is the decrease in the width of the house building pad in favor of increased side yard open space. The applicant has stated that the development will conform to or exceed all requirements of the new SF-8.5 District except for the side yard width, and is proposing the PD for the primary reason of allowing this change in the side yard regulation. He states that the wider house front allowed by the narrow side yard is required by builders of larger houses and desired by buyers of these larger dwellings, and is therefore an industry standard. 5. The lot sizes, yard setbacks and house sizes of the proposal are consistent with development trends on adjacent properties. 6. Funds will be paid to the City in lieu of land to satisfy the park dedication requirements, in order to avoid the proliferation of small park sites which are less efficient for recreation use and more costly to maintain. A small amenity center will be operated and maintained by the HOA. 7. The stated function of Planned Development Districts is "to permit flexibility in the use and design of land and buildings in situations where PD modification of specific provisions of the Zoning Ordinance are not contrary to its intent and purpose or significantly inconsistent with the planning on which it is based and will not be harmful to the neighborhood." The proposed PD is obviously primarily intended to achieve a variance of the required side yard setback and offers no flexibility or innovation greater than that provided by the standard requirements of the Zoning Ordinance. ZC 01-02 Financial Considerations: Rezoning application fee - Paid The applicant is aware that the property must be platted and impact fees paid prior to initiation of development. Staff Recommendation: Denial. Although the proposal is consistent with the Comprehensive Plan, the requested reduction in side yard width will not create the image of wider lots with greater open space between narrower houses which the recent revisions of the Zoning Ordinance are intended to create. The proposed Conditions of the PD offer little innovation other than the options offered by the provisions of the ZO. The Departments of Development Services, Public Works, and Fire concur with this recommendation. The applicant anticipates operation of up to forty-five video games, as well as various service-products vending machines. Although the complex has been developed and operated as a unified retail center (First Wylie Center), it has never been platted as a single or separate parcel of record, and the center occupies Lots 1A, l B and 2A of the Railroad Addition. The subject property is platted as Lots 1 A and 2A. The subject property is zoned for Retail (R) uses. Indoor and Outdoor Commercial Amusements are allowed within the Retail District with an approved Specific Use Permit. The SUP is intended to establish development and operational conditions for the specific site and use which assure that the operation is "harmonious and adaptable to building structures and uses of abutting property". ZC 01-03 Public Comment Forms were mailed to fourteen (14) property owners within 200 feet of the request. Five Comment Forms have been returned, all five in opposition to the request. Issues: 1. On-site parking is not sufficient to serve both the proposed game room and the current tenants of the retail center. There are 69 existing parking spaces within the center, and the current tenants require 62 spaces. The proposed game room will require an additional 30 spaces. (See attached Analysis of On-Site Parking) 2. The retail center has four drives for access/egress on to State Highway 78 and one on to Fifth Street. The close proximity of these drives does not comply with current design standards, and creates potential for vehicular circulation conflicts both within the center's parking lots and on S.H. 78. The significant additional traffic generated by the proposed game room will aggravate this conflict. 3. The proposed conditions of the Specific Use Permit establish specific limits of the operation, including maximum floor area and number of machines, currency exchange and prize redemption, time of operation and age of participants. Financial Considerations: Rezoning application fee - Paid The applicant is aware of the City of Wylie's annual Coin-Operated Machine Tax of$7.50 per machine. Staff Recommendation: Denial. There shall be attached to each agenda, a report of matters pending further action by the Commission. A copy of the agenda shall be posted in the Municipal Complex as required by law for a period of seventy-two (72) hours. 8.2 All regular and special meetings shall follow, as closely as possible, the printed agenda. 8.3 Agendas may be amended by the Chairperson as to order of items, but not as to content, unless overruled by a majority of the members present. 9.0 Minutes of Meetings 9.1 Minutes of all regular and special meetings shall be kept by the Secretary,designated by the Director of Planning, and are subject to amendment and ratification by the Commission at a regular meeting. 9.2 The minutes of the Commission's proceeding shall show the overall vote,or if absent or failing to vote, shall reflect that fact. 9.3 Minutes need not be kept of committee meetings unless directed so by the City Attorney or Chairperson. 10.0 Regular Meetings 10.1 The Commission shall meet on the first and third Tuesday of each month at 7:00 pm in the Council Chambers of the Wylie Municipal Complex. All meetings shall be open to the public, and the public is encouraged to attend. 10.2 Any Commission member missing three(3)consecutive regularly scheduled meetings without a valid excuse which includes illness, death in the family, or emergency shall be subjected to dismissal from the Commission. 10.3 Under special circumstances the Commission may reschedule regular meeting dates subject to ratification by the City Council. The new dates should be announced at a regularly scheduled meeting, and agendas posted accordingly. 10.4 All regular meetings shall, as closely as possible, follow the posted agenda. The agenda should include, but is not limited to the following: A. Ratification of Minutes; B. Consent agenda (routine items); C. Items for individual consideration; D. Breaks at the discretion of the Chairperson; E. Citizens' participation on items not on the agenda (5 minutes maximum); F.
