CONSENT AGENDA ITEM
1. Consider and act upon approval of the Minutes from the April 30, 2001
Special Work Session and the May 1, 2001 Regular Meeting.
A motion was made by Commissioner Ahrens and seconded by Commissioner Porter to
approve the minutes from the April 30 and May 1 meetings. The motion passed, 7—0.
ACTION AGENDA
1. Consider and act upon approval of a Site Plan for a 1.351 acre retail center in the
northwest corner of F.M. 544 and Springwell Parkway, being Lot 2, Block A of
the FM 544/Springwell Addition, situated in the Moses Sparks Survey, Abstract
No. 849, City of Wylie, Collin County, Texas.
Commissioner Phillips excused himself from deliberation of this request, due to a
possible conflict of interest.
Staff reported that the proposed site plan was for property located at the northwest corner
of F.M. 544 and Springwell Parkway. The proposed uses include a convenience store
with pump islands and future retail. A minor plat will be processed for this lot and the lot
to the west, which also establishes the shared access easement and driveway on F.M. 544.
Jim Dewey of JDJR Engineers and Consultants, 2505 Texas Drive, Suite 109, Irving,
Texas was present, representing the owners. Commissioners questioned the location and
nature of the landscaping. Mr. Dewey responded that the landscaping will include trees
and shrubbery and is located in the front and east side of the property. In addition there is
a grassy area on the north side of the property that will be landscaped, but is not included
in the totals reflected in the site plan.
Commissioner Ahrens questioned the location of the 4 parallel parking spaces on the
southeast corner of the property, and expressed concern that they would present
maneuvering problems for the gas pumps. Mr. Dewey indicated that those spaces could
be accommodated on the north side of the site.
Commissioner George addressed the elevation of the building, with questions regarding
the brick. He asked if they would consider raised columns in the front and side, along
with some type of articulation in the front of each retail space, such as awnings or
covered entrance. The applicant indicated that he did not believe that would be a
problem.
Discussion followed regarding the pole sign and the possibility of providing a monument
sign, as is being discussed with proposed code amendments. The applicant stated that
they would be willing to look at monument signs, if there are defined requirements, and if
there is assurance that other businesses would be held to the same standard.
Commissioner Snider made a motion to approve the Site Plan with the following
conditions:
1. That articulation, including the raised brick columns and some type of
awning be provided on the front and side of the project; and
2. The parallel parking at the southeast corner of the site be relocated to the
back of the property; and
3. A masonry, double columned sign be provided.
Commissioner Ahrens seconded the motion. The vote was 6 —0 for approval.
At this point, Commissioner Phillips rejoined the meeting.
2. Consider a recommendation to the City Council regarding a Final Plat for the
Shiloh Baptist Church Addition, located at 840 East Brown Street, east of State
Highway 78, being all of a certain 2.001 acre tract situated in the Francisco de la
Pina Survey, Abstract No. 668, City of Wylie, Collin County, Texas.
Staff reported that this is the final plat for the Church, and is in compliance with the
Preliminary Plat and the Subdivision Regulations. This will establish a lot of record and
enable the church to begin work on improvements to the property, including bringing two
moved in buildings up to code.
Todd Nivens, Senior Pastor for Shiloh Baptist Church was present. Commissioners
asked about the electric line that was present on the property. Mr. Nivens responded that
they have spoken with TxU and that the 3-phase line is no longer in use and will be
removed, negating any need for an easement.
A motion was made by Commissioner Ahrens to recommend to the City Council the
approval of the plat. Commissioner Chapman seconded the motion. The vote was 7 — 0
for approval.
3. Consider a recommendation to the City Council regarding a Final Plat for the
Twin Lakes Phase IV Addition, including a partial waiver of alleys, generally
located south and north of Alanis Drive and east of South Ballard Avenue (F.M.
2524), to the east of Twin Lakes Phase I, being all of a certain 32.782 acre tract
situated in the Allen Atterberry Survey, Abstract No. 23, City of Wylie, Collin
County, Texas.
Staff reported that a partial alley waiver for the Final Plat of Twin Lakes Phase IV was
recommended for approval by the Planning Commission during their May 1, 2001
meeting. This waiver affects Lots 16—30, Block L, and Lots 78 — 97, Block E. An alley
waiver is not necessary for Lots 1 — 21, Block N because of the adjacent drainage
easement, which was also reflected in the Preliminary Plat.
A motion was made by Commissioner Snider to recommend to the City Council the
approval of the plat. Commissioner Ahrens seconded the motion. The vote was 7 — 0 for
approval.
PUBLIC HEARING AGENDA
1. Hold a public hearing and consider a recommendation to the City Council
regarding a change in zoning from Retail (R)District to Business-2 (B-2)
District, for a 4.703 acre tract generally located south of State Highway 78
and south of West Kirby Street(F.M. 544), situated in the E.C. Davidson
Survey, Abstract No. 267 and being Lot 1, Block 1 of the Wylie Shopping
Village No. 1 Addition, City of Wylie, Collin County, Texas. (Zoning Case
No. 01-06)
Staff reported that the proposed zone change request was to accommodate a proposed
gasoline service station. Discussion followed regarding a previous request for B-2
zoning in the same location. At that time, there were concerns regarding access and
parking. Staff indicated that it has been determined on preliminary review of a site plan,
that adequate parking will remain for the grocery store after the proposed gas station is
built. However, specific issues such as provision of parking and access will be addressed
at the time of site plan review.
Discussion turned to the proposed B-2 zoning district. Commissioner Ahrens expressed
concerns that the B-2 district permits a wide variety of uses which would not be desirable
on an entryway. Commissioner Phillips agreed, stating that the B-2 district is a very
heavy commercial district and allows uses such as car repair. Commissioners questioned
why the B-1 district was not proposed. Staff explained that the existing zoning pattern in
the area consisted of B-2 zoning directly adjacent to this property and retail zoning on the
subject property. Introducing yet another commercial zoning district could be construed
as spot zoning.
Jim Reilly of Brockett Davis was present representing Brookshires Grocery. He stated
that the intended use was for a gasoline station and that they were willing to go with the
B-1 zoning, with the assurance that the proposed use was allowed in that district.
Commissioners questioned Mr. Reilly about the driveway access to the property. Mr.
Reilly stated that TxDOT was closing the north driveway access off of S.H. 78 as a part
of the widening project.
Chairman George opened the public hearing. No one was present to speak.
A motion was made by Commissioner Porter to recommend approval of the B-1 zoning
district to Council. Commissioner Phillips seconded the motion. The vote was 7 — 0 for
approval of the B-1 district.
2. Hold a public hearing and consider a recommendation to the City Council
regarding a change in zoning from Agriculture (A) District to Planned
Development (PD) District for Church Related Activities, for a 15.00 acre
tract generally located at the northwest corner of Country Club Road (F.M.
1378) and McMillen Road (C.R. 298), situated in the William Patterson
Survey, Abstract No. 716, City of Wylie, Collin County, Texas. (Zoning Case
No. 01-07)
Staff reported that the proposed PD is for the purpose of building a church. Although the
current zoning permits churches by right, there are limitations which prompted the
applicant to seek the PD. Specifically, the current zoning options require height
limitations of 36' and no more than one main building may be built on a single lot of
record. The Special Conditions of the PD establish the underlying zoning of SF-10 with
the additional height limitation of 60', special reference to the exterior finish, and
establishing accessory church functions as land use limitations.
Autrey Perkins of HH Architects was present, representing the applicant. Commissioner
Ahrens asked about the proposed drainage of the property. Mr. Perkins stated that the
civil engineering was just being completed. Staff stated that the detailed engineering,
including drainage would be reviewed through the platting process, which will also come
before the Commission.
Commissioners questioned the phasing of the project. Mr. Perkins stated that the Multi-
Purpose building would be built first, followed by the Sanctuary. The phasing of the
additional buildings has not yet been determined.
Considerable discussion followed regarding the proposed exterior finish. Commissioners
discussed the merits of stucco versus eface. The exterior of the building is proposed as a
combination of a stucco-type finish and masonry.
Chairman George opened the public hearing.
Mr. Tom Langston of 1355 Country Club Road spoke in opposition to the request. He
stated that a letter had been sent via certified mail with the signatures of five property
owners in the affected area in opposition, in addition, individual letters had been mailed.
Mr. Langston indicated that they were not against the proposed church, but were very
concerned about the need for PD zoning and opening up the area to possible future
rezonings with commercial uses. Mr. Langston stated that he did not see the need to
change from the existing Agricultural zoning.
Mr. Matthew Butschek of 1755 Country Club Road also spoke in opposition to the
request. He stated that he was also concerned about establishing a PD zoning and wanted
to see the area developed as is set out in the Comprehensive Plan.
At that time Chairman George read into the record the names of the individuals who had
signed the certified letter, a copy of which was provided by Mr. Langston: Tom
Langston, 1355 Country Club Road; Mario Aguilar, 1720 McMillen Road; Pat and Debra
Jojoka, 1730 McMillen Road; Gary and Barbara Weberg, 1740 McMillen Road; and
Robert and Joann Washburn, 1710 McMillen Road.
A motion was made by Commissioner Ahrens to recommend approval of the Planned
Development District to the City Council. Commissioner Chapman seconded the motion.
The motion was approved by a vote of 7—0.
WORK SESSION
1. Consider revisions to the Comprehensive Zoning Ordinance.
No workshop was held.
ADJOURNMENT
A motion was made to adjourn by Commissioner Ahrens and seconded by Commissioner
Chapman. The motion was approved 7—0. The meeting adjourned at 9:30 p.m.

The meeting convened at 7:03 PM. Members present were: Carter Porter, Mike Phillips, Gary Wiseman, Mr.
Chapman, and Michael George. Ray Stanland and Janet were also present. Mike Sferra was present for City
staff. (Claude was on vacation).
Stanland passed out Article 6 and 7 of the Zoning Ordinance and called attention to Section 6.3, the
Downtown Historic District.
Page 14, b, 3, base standards for residential structures received considerable discussion, but no consensus or
decision was reached. The item will be discussed again at the next meeting.
Page 15, e, 3 base standards for fencing, was discussed, and it was decided that the"good side" of wooden
fences should face the public's view.
Stanland requested guidance on whether to make the zoning requirements mandatory and possibly
eliminating the point system. The consensus was to make the requirements mandatory, thus eliminating the
point system.
Janet reviewed Section 6.1 and pointed out that the changes recommended from a previous meeting have
been incorporated into the following: page 1, B, 2; page 2, c, 1; page 3, F, 3; and page 5, K.
While discussing landscape requirements on page 7, B, 3, i, Commissioner Phillips suggested and it was
agreed that landscaping should be evaluated each time there is a change of occupancy of a building and not
just in the case that the building may have been vacant for six months.
The Commission agreed that a rain sensor should be a requirement for irrigation systems so that sprinklers
will not operate when it is raining.
The Commission wanted more specific information on dimensions of the visibility triangle as it relates to
landscape requirements.
Interpretation of the Tree Preservation section requires an understanding of what the term "protected tree"
means. Only certain species of trees are considered"protected".
The Commissioners recommended that I forward a copy of Page 12, H, Enforcement, to the Chief of Police
and the Code Enforcement Officer to solicit their input. (Copy forwarded).
Stanland cannot attend the May 21 meeting, but Janet will be present.
May 28 is Memorial Day, so the group decided to meet on May 29.

Session Room of the Municipal Complex.

WORK SESSION
1. Consider revisions to the nonresidential districts of the Comprehensive Zoning Ordinance
with the consultant.
Tharp pointed out that an addition has been added to the Residential Adjacency Requirements of
Article 7 (new no. 4 under B on page 1) discussed at the last meeting. This addition will provide
the P&Z Commission the authority and criteria to waive Residential Adjacency Requirements in
planned and other integrated mixed-use developments, such as is anticipated around the Village
Centers. This will better compliment the desired multiple use developments.

Thorp distributed and led a discussion of proposed revisions to Article 7, including standards for
Off-Street Parking, On-Site Loading, Traffic Study and Environmental Performance. She
mentioned that several of these requirements may be placed elsewhere in the final compilation of
the revisions. Some belong in the Subdivision Regulations and/or Engineering Standards while
others may be better handled as nuisance regulations. Thompson suggested that only land use
issues should be included within the Zoning Ordinance, but that the Commission will review
revisions to the Sub. Regs. and Eng. Standards as soon as they complete revisions to the ZO.
The number of off-street parking spaces required for each use is in Section 5 where the uses are
defined. The current discussion relates to design and construction standards for required
parking. The proposal states how on-site parking is to be calculated, and encourages shared
parking and exempts the downtown area completely. The proposal stipulated that required
parking may be allowed on other parcels when under common ownership and within 300 feet of
the principle use and not separated by a street.
Commissioners recommended not allowing a smaller parking space for compact cars (2.b., page
10), but rather require that all be at least 9 feet by 18 feet. It was also recommended that wheel
stops not be allowed, as these tend to shorten the parking space and overhang of sidewalks can
be accommodated by wider walks. Thompson mentioned that the Engineering Design Manual
will also address these requirements and staff will coordinate similar requirements.
Tharp pointed out that the on-site loading regulations did not apply within the downtown area. It
was discussed that loading areas of some existing facilities are visible from streets and need to be
screened, and that all truck circulation and parking needs to be accommodated on-site but not
within required parking spaces and lanes
Tharp suggested that the threshold for requiring a traffic study may need to be reevaluated.
Thompson pointed out that the accepting authority "Department of Transportation" should be
changed to "City Engineer".
Tharp reviewed the several environmental quality regulations, explaining that some of these
goals are difficult to document at the level of zoning change and/or site plan review and many
merely provide the legal basis for response to a complaint when nuisances are reported.
Commissioners recommended that vague language such as "unreasonable" and "plainly audible"
be redefined to more measurable terms, and that such a philosophy needs to be applied
throughout the revisions. Phillips pointed out that these regulations must be coordinated with the
existing code requirements and that adoption of new regulations may even require a charter
amendment.

Thompson said that conflicts with the charter, existing codes and regulations will be investigated
by staff and a repeal clause provided to eliminate conflict and duplication.
Commissioners asked whether it is appropriate to include something about odors, and Tharp
responded that the Consultants will investigate that issue.
2. Next meeting.
Due to Memorial Day, no work session will be held next Monday, May 28. The next work
session will be held on Tuesday, May 29, 2001 at 7:00 p.m.

Chairman George called the Special Work Session to order at 7:15 p.m., in the Council Work
Session Room of the Municipal Complex.

WORK SESSION
1. Consider revisions to the nonresidential districts of the Comprehensive Zoning Ordinance
with the consultant.
Tharp distributed and led a discussion of the Residential Adjacency Requirements of Article 7.
The purpose of these regulations is to protect the integrity of residential developments from
negative characteristics of incompatible nonresidential development by imposing special
development standards on the nonresidential use and construction. Apartments and mobile home
districts are normally considered nonresidential for these standards. Increased setbacks from
residential property lines are required for multi-story buildings, and will in no case be less than
the adjoining residential setback requirement. Tharp noted that several of these regulations are
difficult to measure at the time zoning changes or site plans are reviewed, but will provide legal
support for post-development response to complaints of nuisances.

Commissioners generally endorsed the recommendations. It was recommended that noise
generated by industrial operations be included under Section F. It was recommended that the
restriction of openings in screen walls be expressed as a percentage and increased to a majority
of the wall in order to create a solid appearance and better reduce vision. Drive-through and
stacking lanes at fast foods restaurants should be regulated as loading areas (Section L, page 5).
Tharp distributed and led a discussion of the Special Purpose and Overlay Districts in Article 6.
Commissioners endorsed retaining the 5-acre minimum for Planned Development Districts.
Thompson noted that PDs are intended to accommodate flexibility and innovation, so suggested
that some of the strict development conditions (B.5. and C.6 & 7) may be lessened or deleted.
Tharp reviewed the proposal for the floodplain overlay, especially the limited uses to be allowed
within these areas. Thompson noted that, while parks are a legitimate use within floodplain, it is
not desirable that the required park land dedication be largely flood prone.
Tharp distributed and discussed the regulations for Nonconforming Uses and Structures in
Article 10. It was noted that conversion from the existing zoning requirements and map to the
new regulations is likely to create substantial nonconformancy, and that these regulations address
how such will be handled. Thompson noted that, except when creating a threat to safety,
nonconforming uses and structures cannot be merely closed down but their fair market value
must be amortized by the City.

Summary:
The Final Plat of The Meadows of Birmingham Addition includes 61.997 acres and will create
216 single-family lots. The Plat will also create two public parks totaling approximately 7 acres,
as well as parts of the Westgate Way and Ann Drive collector streets. The property is zoned
Single Family Residential-3 (SF-3), requiring a minimum lot size of 7,200 square feet. A majority
of the lots exceed the minimum required size.
At their June 1, 1999 meeting, the Planning and Zoning Commission recommended denial of a
Preliminary Plat for the subject property, then identified as Phase I of the Birmingham Farms
Addition, expressing concern for traffic congestion, limited points of ingress/egress, open
drainage, park dedication and thoroughfare screening. However, based on the staff's
recommendation that the Plat complied with all applicable subdivision regulations and other
applicable ordinances of the City of Wylie, the City Council approved the Preliminary Plat on June
22, 1999, as Phase I of the Birmingham Farms Addition. That earlier-approved Preliminary Plat
contained approximately 65.3 acres and created 219 lots, but did not include alleys, nor was
discussion of alleys or a waiver thereof recorded in the Minutes of either the Planning and Zoning
Commission or the City Council.
The Meadows of Birmingham
Section 2.9 of the Paving Standards states that "alleys shall be provided in all residential areas and
shall be paved with concrete. The City Council may waive the residential alley requirement upon
determination by the Council that it is in the best interest of the City." The applicant contends
that the City Council specifically granted a waiver of alleys by its approval of the Preliminary Plat.
The applicant is requesting a waiver of the alley requirement and approval of the Final Plat.
Section 212.005 of the Texas Local Government Code requires that "the municipal authority
responsible for approving plats must approve a plat that satisfies all municipal regulations."
Section 212.009 states that "the municipal authority responsible for approving a plat shall act
upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the
municipal authority unless it is disapproved within that period."
Issues:
1. The Final Plat substantially conforms to the approved Preliminary Plat, including the lack
of alleys. However, as submitted without alleys, the Final Plat does not comply with the
Subdivision Regulations and Paving Standards of the City of Wylie. The applicant must
clearly demonstrate to the Council that the addition of alleys will create a hardship to the
development, as well as that the major functions of alleys (public and private utilities,
drainage and service vehicular access/egress) are adequately accommodated by other
means.
2. The following concerns expressed by the Planning and Zoning Commission during their
June 1999 review of the earlier submittal have been addressed in some way, although each
is subjective and remains open to discussion.
• Traffic congestion will be relieved by construction by this and/or adjacent subdivisions
of the collector streets Westgate and Ann Drive. To accomplish this traffic collector
system, the coordinated phasing of construction of the several subdivisions will be
critical.
• Additional points of ingress/egress will be created by the construction of Westgate
Way and Ann Drive by this and adjacent subdivisions. To accomplish this multiple
access, the coordinated phasing of construction of the several subdivisions will be
critical.
• Open drainage has been approved by the City Engineer, and is currently under review
by the City and U.S. Corps of Engineers. Maintenance of the open drainage will be
the full responsibility of the Homeowners Association or the Corps, and will not
involve the City.
The Meadows of Birmingham
• Public park dedication has been approved by the Parks Board. Although the electric
transmission lines and open drainage occupy portions of the dedicated park land and
limit their use for recreation, the 7-acre park dedication is sufficiently greater than the
required 3.2 dedication.
• Screening of residential lots that back onto a dedicated street is required by Section
5.03 of the Subdivision Regulations, and the earlier approved Preliminary Plat did not
reflect such screening. The Final Plat under current consideration provides easements
for screen walls within the lots backing on to Westgate Way and Ann Drive. In June
of 1999, the applicant agreed to install a 6 feet high wood fence between brick
columns in order to comply with this requirement. This fence will be maintained by
the individual private homeowners or the collective Homeowners Association.
Financial Considerations:
Plat application fees—paid
The applicant is aware that 1997 development impact fees must be paid before the Final Plat can
be filed with Collin County. Water: $151,200 Sewer: $304,992
Staff Recommendation:
Denial. The Final Plat does not comply with the requirement of the Paving Standards that
residential subdivisions provide alleys, and the applicant has not demonstrated that that a hardship
will result by the addition of alleys.
The Department's of Development Services, Public Works and Fire concur with this
recommendation.

Dear Richard:
This law firm represents R.H. of Texas, L.P. ("Ryland") in connection with its pending
application for a final plat of the Meadows, which application is in substantial
conformance with the approved preliminary plat for the Meadows. Ryland has been
informed by representatives of the City that subsequent to the approval of the
preliminary plat, the City determined that alleys must be added within the Meadows or
a variance must be obtained.
Requiring alleys will affect the lot dimensions and lot size of every lot within the
approved Meadows subdivision. Consequently, it is our position that such alleys
cannot now be added as a requirement and that a variance is unnecessary.
Nevertheless, please consider this letter as a request by Ryland for such a variance
(which request does not constitute a waiver of Ryland's legal rights in connection with
this matter).

Location: Generally located north of Brown Street and west of
Westgate Way
Existing Zoning: Single-Family(SF-3) Residential
Summary:
The Final Plat of the Birmingham Farms Phase 2A Addition includes 70.383 acres and will create
226 single-family residential lots. The Plat will also create two public parks totaling
approximately 5 acres, as well as parts of the Sanden Boulevard, Westgate Way and Ann Drive
collector streets. The property is zoned Single Family-3 Residential (SF-3), requiring a minimum
lot size of 7,200 square feet. A majority of the lots exceed the minimum required size.
At their June 15, 1999 meeting, the Planning and Zoning Commission recommended denial of a
Preliminary Plat for the subject property, then identified as Phase 2 of the Birmingham Farms
Addition, following the City staffs recommendation of denial. Staff and Commission expressed
concern for traffic congestion, open drainage and park land dedication. However, the City
Council approved the Preliminary Plat on July 13, 1999, as Phase 2 of the Birmingham Farms
Addition. That earlier-approved Preliminary Plat totaled approximately 78.8 acres and included
an additional 64 Two-Family (2F) Residential lots on 23.7 acres as well as 219 Single-Family-3
(SF-3) lots on 55.1 acres. The Final Plat under current consideration is the SF-3 portion of the
approved Preliminary Plat, and the 2F portion of the Preliminary is represented by the proposed
Birmingham Farms Phase 2B Final Plat which is also on the current agenda for the Commission's
consideration.
Birmingham Farms Phase 2A
The Preliminary Plat approved in 1999 did not include alleys, nor was discussion of alleys or a
waiver thereof recorded in the Minutes of either the Planning and Zoning Commission or the City
Council.
Section 2.9 of the Paving Standards states that "alleys shall be provided in all residential areas and
shall be paved with concrete. The City Council may waive the residential alley requirement upon
determination by the Council that it is in the best interest of the City." The applicant contends
that the City Council specifically granted a waiver of alleys by its approval of the Preliminary Plat.
The applicant is requesting a waiver of the alley requirement and approval of the Final Plat.
Section 212.005 of the Texas Local Government Code requires that "the municipal authority
responsible for approving plats must approve a plat that satisfies all municipal regulations."
Section 212.009 states that "the municipal authority responsible for approving a plat shall act
upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the
municipal authority unless it is disapproved within that period."
Issues:
1. The Final Plat substantially conforms to the approved Preliminary Plat, including the lack
of alleys. However, as submitted without alleys, the Final Plat does not comply with the
Subdivision Regulations and Paving Standards of the City of Wylie. The applicant has
requested a waiver of the alley requirement, and must clearly demonstrate to the Council
that the addition of alleys will create a hardship to the development, as well as that alleys
are not necessary because the major functions of alleys (public and private utilities,
drainage and service vehicular access/egress) are adequately accommodated by other
means.
2. The following concerns expressed by the Planning and Zoning Commission during their
June 1999 review of the earlier submittal have been addressed in some way, although each
is subjective and remains open to discussion.
• Traffic congestion will be relieved by construction by this and/or adjacent subdivisions
of the collector streets Sanden Boulevard, Westgate Way and Ann Drive. To
accomplish this traffic collector system, the coordinated phasing of construction of the
several subdivisions will be critical.
• Open drainage has been approved by the City Engineer, and is currently under review
by the City and U.S. Corps of Engineers. Maintenance of the open drainage will be
the full responsibility of the Homeowners Association or the Corps, and will not
involve the City.
Birmingham Farms Phase 2A
• Public park dedication has been approved by the Parks Board. Although the electric
transmission lines and open drainage occupy portions of the dedicated park land and
limit their use for recreation, the 5-acre park dedication is sufficiently greater than the
required 3.4 dedication.
Financial Considerations:
Plat application fees—paid
The applicant is aware that 1997 development impact fees must be paid before the Final Plat can
be filed with Collin County. Water: $158,200 Sewer: $319,112
Staff Recommendation:
Denial. The Final Plat does not comply with the requirement of the Paving Standards that
residential subdivisions provide alleys, and the applicant has not demonstrated that that a hardship
will result by the addition of alleys.
The Department's of Development Services, Public Works and Fire concur with this
recommendation.

Existing Zoning: Two-Family(2F) Residential
Summary:
The Final Plat of the Birmingham Farms Phase 2B Addition includes 22.973 acres and will create
65 two-family residential (duplex) lots. The property is zoned Two-Family Residential (2F),
requiring a minimum lot size of 8,500 square feet. All of the proposed lots significantly exceed
the minimum required size.
At their June 15, 1999 meeting, the Planning and Zoning Commission recommended denial of a
Preliminary Plat for the subject property, then identified as Phase 2 of the Birmingham Farms
Addition, following the City staffs recommendation of denial. Staff and Commission expressed
concern for traffic congestion, open drainage and park land dedication. However, the City
Council approved the Preliminary Plat on July 13, 1999, as Phase 2 of the Birmingham Farms
Addition. That earlier-approved Preliminary Plat totaled approximately 78.8 acres and included
an additional 219 Single-Family-3 (SF-3) lots on 55.1 acres as well as 64 Two-Family (2F)
Residential lots on 23.7 acres. The Final Plat under current consideration is the 2F portion of the
approved Preliminary Plat, and the SF-3 portion of the Preliminary is represented by the proposed
Birmingham Farms Phase 2A Final Plat which is also on the current agenda for the Commission's
consideration.
Birmingham Farms Phase 2B
The Preliminary Plat approved in 1999 did not include alleys, nor was discussion of alleys or a
waiver thereof recorded in the Minutes of either the Planning and Zoning Commission or the City
Council.
Section 2.9 of the Paving Standards states that "alleys shall be provided in all residential areas and
shall be paved with concrete. The City Council may waive the residential alley requirement upon
determination by the Council that it is in the best interest of the City." The applicant contends
that the City Council specifically granted a waiver of alleys by its approval of the Preliminary Plat.
The applicant is requesting a waiver of the alley requirement and approval of the Final Plat.
Section 212.005 of the Texas Local Government Code requires that "the municipal authority
responsible for approving plats must approve a plat that satisfies all municipal regulations."
Section 212.009 states that "the municipal authority responsible for approving a plat shall act
upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the
municipal authority unless it is disapproved within that period."
Issues:
1. The Final Plat substantially conforms to the approved Preliminary Plat, including the lack
of alleys. However, as submitted without alleys, the Final Plat does not comply with the
Subdivision Regulations and Paving Standards of the City of Wylie. The applicant has
requested a waiver of the alley requirement, and must clearly demonstrate to the Council
that the addition of alleys will create a hardship to the development, as well as that alleys
are not necessary because the major functions of alleys (public and private utilities,
drainage and service vehicular access/egress) are adequately accommodated by other
means.
2. The concerns expressed by the Planning and Zoning Commission during their June 1999
review of the earlier submittal apply more to the single-family portion of the Preliminary
Plat (separated to create the Plat for Phase 2A of Birmingham Farms which is also on the
current agenda for consideration) rather than to the two-family portion currently under
consideration, although each of those concerns is somewhat subjective and remains open
to discussion.
3. As currently proposed separated for the larger portion of Phase 2 of Birmingham Farms,
the proposed addition has no access on to either an existing or proposed street and
therefore is not accessible. Access streets are provided with construction of adjacent
subdivisions. To accomplish this street connection and access, the coordinated phasing of
construction of the several subdivisions will be critical.
Birmingham Farms Phase 2B
4. As currently proposed separated from the larger portion of Phase 2 of Birmingham Farms,
the proposed addition provides no public park land dedication.
Financial Considerations:
Plat application fees—paid
The applicant is aware that 1997 development impact fees must be paid before the Final Plat can
be filed with Collin County. Water: $91,000 Sewer: $183,560
Staff Recommendation:
Denial. The Final Plat does not comply with the requirements that residential subdivisions
provide alleys, and public park land, and the applicant has not demonstrated that that a hardship
will result by the addition of alleys. The Final Plat provides no connection to an existing or
currently platted street, and therefore has no point of ingress/egress.
The Department's of Development Services, Public Works and Fire concur with this
recommendation.

Existing Zoning: Single-Family—2 (SF-2) Residential and
Single-Family-1 (SF-1) Residential
Summary:
The Final Plat of the Birmingham Farms Phase 3A Addition includes 62.885 acres and will create
174 single-family residential lots. The Plat will also create a 5.3-acra public park, as well as part
of the Park Boulevard collector street. The majority of the property is zoned Single Family-2
Residential (SF-2), requiring a minimum lot size of 8,500 square feet. The eastern portion of the
property is zoned Single-Family-1 Residential (SF-1), requiring a minimum lot size of 10,000
square feet.
At their June 15, 1999 meeting, the Planning and Zoning Commission recommended denial of a
Preliminary Plat for the subject property, then identified as Phase 3 of the Birmingham Farms
Addition, following the City staffs recommendation of denial. Staff and Commission expressed
concern for limited ingress/egress and floodplain coverage of lots. However, the City Council
approved the Preliminary Plat on July 13, 1999, as Phase 2 of the Birmingham Farms Addition.
Birmingham Farms Phase 3A
That earlier-approved Preliminary Plat totaled approximately 116.4 acres and included 303
Single-Family - 2 (SF-2) Residential lots and 54 Single-Family-1 (SF-1) as well as 5.3 acres of
public park land. The Final Plat under current consideration is the a portion of the approved
Preliminary Plat, and the remaining portion of the Preliminary is represented by the proposed
Birmingham Farms Phase 3B Final Plat which is also on the current agenda for the Commission's
consideration.
The Preliminary Plat approved in 1999 did not include alleys, nor was discussion of alleys or a
waiver thereof recorded in the Minutes of either the Planning and Zoning Commission or the City
Council. Section 2.9 of the Paving Standards states that "alleys shall be provided in all residential
areas and shall be paved with concrete. The City Council may waive the residential alley
requirement upon determination by the Council that it is in the best interest of the City." The
applicant contends that the City Council specifically granted a waiver of alleys by its approval of
the Preliminary Plat. The applicant is requesting a waiver of the alley requirement and approval of
the Final Plat.
Section 212.005 of the Texas Local Government Code requires that "the municipal authority
responsible for approving plats must approve a plat that satisfies all municipal regulations."
Section 212.009 states that "the municipal authority responsible for approving a plat shall act
upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the
municipal authority unless it is disapproved within that period."
Issues:
1. The Final Plat generally conforms to the approved Preliminary Plat, including the lack of
alleys. However, as submitted without alleys, the Final Plat does not comply with the
Subdivision Regulations and Paving Standards of the City of Wylie. The applicant has
requested a waiver of the alley requirement, and must clearly demonstrate to the Council
that the addition of alleys will create a hardship to the development, as well as that alleys
are not necessary because the major functions of alleys (public and private utilities,
drainage and service vehicular access/egress) are adequately accommodated by other
means.
2. As proposed, the addition provides only a single point of engress/egress (the minor
neighborhood Talladega Drive) for its 174 residences as well as service and emergency
vehicles, rather than the required multiple points of access. This situation is exasperated
by the potential of the additional 149 lots proposed within Phase 3B of the Birmingham
Farms Addition which is also on the current agenda for consideration. There is no current
schedule for the westward extension of Park Boulevard (a section of which is provided on
the subject Plat) to intersect with Country Club Road and provide and additional point of
access.
Birmingham Farms Phase 3A
3. The undevelopable 100-year floodplain currently occupies much of the eastern portion of
the subject property, including several of the proposed residential lots. The applicant
intends to remove the floodplain from a portion of these lots, and that plan is currently
under review by the City and U.S. Corps of Engineers. Maintenance of the open drainage
will be the full responsibility of the Homeowners Association or the Corps, and will not
involve the City.
Financial Considerations:
Plat application fees—paid
The applicant is aware that 1997 development impact fees must be paid before the Final Plat can
be filed with Collin County. Water: $121,800 Sewer: $245,688
Staff Recommendation:
Denial. The Final Plat does not comply with the requirement that residential subdivisions provide
alleys, and the applicant has not demonstrated that that a hardship will result by the addition of
alleys. The Final Plat provides for only a single point of ingress/egress to serve a potential 323
lots and residences.
The Department's of Development Services, Public Works and Fire concur with this
recommendation.

Summary:
The Final Plat of the Birmingham Farms Phase 3B Addition includes 45.182 acres and will create
149 single-family residential lots. The majority of the property is zoned Single Family-2
Residential (SF-2), requiring a minimum lot size of 8,500 square feet. The eastern portion of the
property is zoned Single-Family-1 Residential (SF-1), requiring a minimum lot size of 10,000
square feet.
At their June 15, 1999 meeting, the Planning and Zoning Commission recommended denial of a
Preliminary Plat for the subject property, then identified as Phase 3 of the Birmingham Farms
Addition, following the City stab's recommendation of denial. Staff and Commission expressed
concern for limited ingress/egress and floodplain coverage of lots. However, the City Council
approved the Preliminary Plat on July 13, 1999, as Phase 2 of the Birmingham Farms Addition.
Birmingham Farms Phase 3B
That earlier-approved Preliminary Plat totaled approximately 116.4 acres and included 303
Single-Family - 2 (SF-2) Residential lots and 54 Single-Family-1 (SF-1) as well as 5.3 acres of
public park land. The Final Plat under current consideration is the a portion of the approved
Preliminary Plat, and the remaining portion of the Preliminary is represented by the proposed
Birmingham Farms Phase 3A Final Plat which is also on the current agenda for the Commission's
consideration.
The Preliminary Plat approved in 1999 did not include alleys, nor was discussion of alleys or a
waiver thereof recorded in the Minutes of either the Planning and Zoning Commission or the City
Council. Section 2.9 of the Paving Standards states that "alleys shall be provided in all residential
areas and shall be paved with concrete. The City Council may waive the residential alley
requirement upon determination by the Council that it is in the best interest of the City." The
applicant contends that the City Council specifically granted a waiver of alleys by its approval of
the Preliminary Plat. The applicant is requesting a waiver of the alley requirement and approval of
the Final Plat.
Section 212.005 of the Texas Local Government Code requires that "the municipal authority
responsible for approving plats must approve a plat that satisfies all municipal regulations."
Section 212.009 states that "the municipal authority responsible for approving a plat shall act
upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the
municipal authority unless it is disapproved within that period."
Issues:
1. The Final Plat generally conforms to the approved Preliminary Plat, including the lack of
alleys. However, as submitted without alleys, the Final Plat does not comply with the
Subdivision Regulations and Paving Standards of the City of Wylie. The applicant has
requested a waiver of the alley requirement, and must clearly demonstrate to the Council
that the addition of alleys will create a hardship to the development, as well as that alleys
are not necessary because the major functions of alleys (public and private utilities,
drainage and service vehicular access/egress) are adequately accommodated by other
means.
2. As currently proposed separated from the larger portion of Phase 3 of Birmingham Farms,
the addition provides no point of ingress from or egress to either an existing or proposed
street and therefore is not accessible. Access streets are to be provided with construction
of adjacent subdivisions. To accomplish this street connection and access, the coordinated
phasing of construction of the several subdivisions will be critical.
Birmingham Farms Phase 3B
3. The undevelopable 100-year floodplain currently occupies much of the eastern portion of
the subject property, including several of the proposed residential lots. The applicant
intends to remove the floodplain from a portion of these lots, and that plan is currently
under review by the City and U.S. Corps of Engineers. Maintenance of the open drainage
will be the full responsibility of the Homeowners Association or the Corps, and will not
involve the City.
4. As currently proposed separated from the larger portion of Phase 3 of Birmingham Farms,
the proposed addition provides no public park land dedication.
Financial Considerations:
Plat application fees—paid
The applicant is aware that 1997 development impact fees must be paid before the Final Plat can
be filed with Collin County. Water: $104,300 Sewer: $210,388
Staff Recommendation:
Denial. The Final Plat does not comply with the requirement that residential subdivisions provide
alleys, and the applicant has not demonstrated that that a hardship will result by the addition of
alleys. The Final Plat provides no connection to an existing or currently platted street, and
therefore has no point of ingress/egress.
The Department's of Development Services, Public Works and Fire concur with this
recommendation.

Summary:
The applicant is requesting rezoning of the subject property in order to develop a single-family
residential subdivision. The subject property contains a total of 57.773 acres of land, currently
held in two ownerships. The property fronts approximately 2,074 feet along Kreymer Lane and
690 feet along Brown Street.
The adjacent property to the west of the tract is zoned for Single-Family-2 (SF-2) Residential uses
and developed as the Oak Meadow Addition with lots of approximately 8,500 square feet. The
adjacent property to the northwest is zoned Agriculture (A), owned by the Wylie Independent
school District and planned for school uses. The property to the north across Brown is zoned
Planned Development (PD 94-48) for residential uses and is developed as the Wyndham Estates
Addition with lots of approximately 5,500 square feet. The property to the east across Kreymer is
undeveloped and zoned and is for Agriculture (A) and is sparsely occupied with low-density
single-family residences. The properties to the south are undeveloped and within unincorporated
Collin County.
ZC 01-05
In December of 2000, the Planning and Zoning Commission recommended denial of a previous
request to rezone the property to straight SF 8.5/17. The applicant subsequently withdrew that
earlier request prior to its consideration by City Council. Recently, the applicant proposed a
Planned Development District for Single-Family Residential uses similar to the current request,
the primary purpose of which would be to achieve variance of only the side yard regulations of the
Zoning Ordinance. Staff recommended against the limited-purpose PD, in favor of straight
zoning and full compliance with the new provisions of the Ordinance, as is currently requested.
Public Comment Forms were mailed to forty-seven (47) property owners within 200 feet of this
request. Two Public Comment Forms have been returned, one FOR and one AGAINST the
request.
Issues:
1. The Comprehensive Plan recommends Suburban Residential uses for this property. Suburban
Residential is defined as allowing single-family detached houses on lots ranging in size from a
minimum area of 8,500 square feet to one acre. Dwellings must be within 3,000 feet walking
distance of the retail/institutional Village Center and provided pedestrian linkages to it.
According to the Future Land Use Map, the nearest Village Center to the property is to be
located in the northeast corner of Brown Street and Eubanks Lane. However, the WISD
property, immediately abutting the subject property on the northwest, will serve as the
institutional component of the Village Center. The requested change in zoning, therefore, is in
general compliance with the recommendations of the Comprehensive Plan.
2. However, the Residential District Provisions of the Zoning Ordinance classifies residential lots
of 8,500 square feet as Village Residential Districts, which are intended to be located more
immediately adjacent to the nonresidential Village Centers (no dwelling be more than 1,300
feet distance). The requested zoning change will locate all 8,500 square feet lots within 1,300
feet of the WISD property and 10,000 square feet lots beyond this distance generally complies
with these provisions of the Zoning Ordinance.
3. The Residential District Provisions of the Zoning Ordinance establish a flexible point system in
order to obtain approval for construction. The provisions list certain Base Design Standards
which all developments must meet, and provide several optional Desirable Design Standards
from which the developer may choose in meeting a given required total number of points
before a development may be approved. These points will be reviewed for compliance by the
City staff during review of subdivision plats and engineering and building plans. The applicant
is not required to provide site layout, development plans or tabulation of points at the time of
rezoning, but the applicant has stated that all applicable development codes will be complied
with.

4. The proposal is consistent with existing adjacent development.
5. The applicant is aware that the property must be platted and impact fees paid prior to
initiation of development.

Staff Recommendation:
Approval of the rezoning as requested. The proposal is consistent with the Comprehensive Plan
and the newly-adopted residential standards of the Zoning Ordinance can provide desired quality.
The Departments of Development Services, Public Works, and Fire concur with this
recommendation.
