CITIZEN PARTICIPATION No one appeared to speak. CONSENT AGENDA ITEM 1. Consider and act upon approval of the Minutes from the July 3, 2001 Regular Meeting. Thompson stated that the rezoning Case Number 01-05, Public Hearing Action 1, was approved with the stipulation that lots 11 and 12 of Block C be changed to face the longer rather than shorter street. P &Z Commission July 17, 2001 Page 2 of 4 Motion was made by Commissioner Chapman, seconded by Commissioner Snider to approve the minutes with the change noted. Motion passed 6—0. ACTION ITEMS 1. Consider and act upon approval of a Site Plan for Millenium Motorsports, being a 2.03 acre tract located at 1315 Century Way, being all of existing Lots 3 and 4 of Block C of the Century Business Park Addition, City of Wylie, Collin County, Texas, and being a tract described in the deed to Charles D. Wood, Jr. recorded under Clerk's File No. 01-0052708 of the Deed Records of Collin County, Texas. Thompson stated that the intention of the applicant is to combine Lots 3 and 4 into one Lot, on which to construct a 24,158 square feet building to be used for a specialty automotive restoration business. The Site Plan illustrates that the building will be somewhat centered between two major drives. Staff did have some concerns about the drive on the south being too close to the existing drive on the neighboring property, but understands that the proposed circulation pattern will allow large trucks to come in from the south and circulate through the building. There is also a significant grade change at the property line and street, which is too steep for an entry drive. The fire lane enters at these drives but goes to the east of the building in order not to conflict with truck circulation. The circulation pattern allows large auto-haulers to come straight through the overhead door on the south and out the overhead door on the north, then out the drive. Staff recommends a variance from the Code on the distance between the two major drives and believes that the proposal meets all other appropriate technical requirements and recommends approval. Thompson stated further that a Replat to connect these two properties will be considered in tonight's agenda also, and a utility and access easement will be platted on those lots by that action. Mr. Henry Luman, 5105 Greensboro, Sachse, Texas, president of Concrete Walls, represented David Wood the owner of the property. Commissioners expressed some concerns regarding the screening used on the east side of the property. The Zoning Ordinance requires a 20-foot setback and six-foot masonry or wood fence be constructed on an industrial property line when it is adjacent to a residential district such as on the southeast. Mr. Luman requested for live screening be allowed along the residential area instead of a wall in order not to damage the existing trees. Commissioner Phillips recommended that the Zoning Board of Adjustment consider the variance of screen type. Thompson stated that the Ordinance is somewhat limited to what can be considered by the Zoning Board of Adjustment, concluding that the Commission can approve a waiver of the variance of screen materials as a stipulation of Site Plan approval. P & Z Commission July 17, 2001 Page 3 of 4 Mr. Luman stated that a retaining wall would be put up along the back of the property where required by the change in topography. However, if he puts a solid footing for a retaining wall all along the property line, the retaining wall would have to be set back to accommodate the existing power easement. Mr. Luman stated further that the wall would be more toward the west and the building so not to interrupt the existing trees. The grade will be up against the west side of the building rather than the east, and that area landscaped. On the Site Plan, a chain link fence is shown outside the retaining wall. The intent was, after discussion, to put the chain link fence on top of the retaining wall. Commissioner George expressed concern regarding the north side of the property. Mr. Luman stated the chain link fence would be on all sides of the property for security. The Commission suggested that the fence along Century Way not be a chain link fence, but rather some aesthetic material such as wrought iron. Mr. Luman stated he would discuss the use of wrought iron with the owner but the type of screen has not yet been finalized. Commissioner George asked what the building would look like. Mr. Luman stated the building would have the same structure as the building across street, which is a metal building with brick on the front and sides visible from the street. The roof will have a 1: 12 pitch. Motion was made by Commissioner Phillips, seconded by Commissioner Chapman, to approve the Site Plan with live screening to the southeast and decorative fencing along the front. Motion passed 6—0. 2. Consider a recommendation to the City Council regarding a Final Plat of Lot 3B of Block C, Century Business Park Addition, being a replat of Lots 3 and 4 of Block C of the Century Business Park Addition, and being a 2.03 acre tract situated in the Duke Strickland Survey, Abstract No. 841, City of Wylie, Collin County, Texas. Thompson stated that this Final Plat will be a replat of Lots 3 and 4 of Block C to create the single Lot 3B, totaling 2.03 acres. The new Lot will accommodate the previous discussed Site Plan for Millennium Motorsports. The property is zoned Industrial and meets all the technical requirements and subdivision regulations. Staff recommends approval. There was no further discussion. Motion was made by Commissioner Carter to approve the Final Plat, seconded by Commissioner Wiseman. Motion passed 6-0. P & Z Commission July 17, 2001 Page 4 of 4 WORK SESSION 1. Discuss status of revisions to Zoning Ordinance and July 24 work session with City Council. Thompson reminded Commissioners that the City Council begins a 6:00 p.m. on Tuesday, July 24th and the work session would begin immediately after the City Council agenda is completed at approximately 7:00 p.m. The Consultant and staff will introduce the draft of the Zoning Ordinance, and Commissioners are encouraged to be present to share their opinions with and receive guidance from the Council. 2. Additional Business A special motion was made by Commissioner Carter, seconded by everyone, to commend and salute Commissioner George on his birthday, which will be on July 21, 2001. B dley, Secretary rift Action Item No. 1 Replat Lot 1, Block A, Century Business Park Addition Planning and Zoning Commission Meeting: August 7, 2001 Owner: Heatley-Moist, Inc. Michael D. Heatley, Trustee Surveyor/Engineer: Sparr Surveys Location: East of State Highway 78 at West Alanis Lane Existing Zoning: Industrial(I) Summary: The Replat under consideration will create two lots from the existing single Lot 1 of Block A of the Century Business Park Addition. This replat is intended to divide the property and create the 2.373 acre Lot 1 A which is to be sold to the adjoining property owner for future expansion of the existing Buckner Boulevard Plumbing facility (old Concrete Walls, Inc.) developed as Lot 5. There are currently no plans for development of the remaining Lot 1 B. The Century Business Park, also creating Alanis Lane and Century Way, was originally platted in 1986, and the subject tract was then a portion of a larger Lot 1 of Block A. The tract as currently configured was created when much of that original Lot 1 was replatted in 1998 as the Highway 78 Business Park. Since that date, several lots have been replatted as both the Century Business Park and Highway 78 Business Park. This replat attempts to redirect the name of the addition back to Century Business Park. The property is currently zoned for Industrial (I) uses. The anticipated expansion of the office/warehouse use is currently allowed within the Industrial District. Replat — Lot 1, Block A, Century Business Park Addition Issues: 1. Section 212.005 of the Texas Local Government Code states that "the municipal authority responsible for approving plats must approve a plat that satisfies all applicable regulations". Section 212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the municipal authority unless it is disapproved within that time period". 2. Staff has reviewed the proposed Replat for Lot 1, Block A, of the Century Business Park Addition and found it to comply with all applicable State subdivision regulations as well as with the Subdivision Regulations and all other pertinent technical ordinances of the City of Wylie. 3. The applicant is aware that prior to issuance of a building permit to develop or use the subject Lot 1 A for development related to the existing plumbing business located on Lot 5, the two lots (1 A and 5)must be replatted to create a single lot of record. 4. The applicant is aware that development impact fees must be paid before the Final Plat can be filed with Collin County. Financial Considerations: Plat application fees—Paid. The property is currently zoned Public (P) District and is occupied by the Transportation Center (bus storage and maintenance) of the Wylie Independent School District. The property is platted as part of Lot 1 and all of Lots 2, 3, 4, 5 and 6 of Block 5 of the Calloway Addition, and totals 1.263 acres in size. The properties to the north are zoned for Retail (R) uses and are developed on separate free- standing lots with the bank, a multi-tenant professional office center and a drive-in restaurant. The property to the east, across Birmingham Street, is zoned for Single-Family Residential(SF-3) uses and occupied by a church. The property to the south, across Williams Street, is zoned Public (P) and developed for school uses (the expanding Hartman Elementary). The properties to the west, across Williams Street, are zoned and developed for Retail(R) and Business-2 (B-2) uses of an automotive nature. ZC 01-08 Public Comment Forms were mailed to twenty-three (23) property owners within 200 feet of this request. One Public Comment Forms has been returned, favoring the proposed rezoning. Issues: 1. The Comprehensive Plan recommends Mixed Uses for the subject property. The Plan defines the Mixed Use category as commercial, retail and office, institutional or village center residential uses or some combination of these, but allowing no industrial uses. The financial business anticipated by this rezoning is consistent with this recommendation of the Plan. 2. Although the current Zoning Ordinance contains no provision for the Public (P) District, this District is used on the Official Zoning Map to indicate school functions and other public uses such as parks, the library, waste water treatment plant and land fill which are normally allowed by right in all zoning districts. However, case law has concluded that such single-function, limited user zones are inappropriate, and the Public District will be eliminated when revisions to the Zoning Ordinance and Map are adopted. 3. The several lots of the subject property and bank property must be replatted to create a single lot of record prior to the issuance of any building permits for either a free-standing development confined to the subject property or expansion of the bank on to these properties. Financial Considerations: Rezoning application fee - Paid Staff Recommendation: Approval. The proposed zoning and land use is consistent with the Comprehensive Plan and compatible with the surrounding existing development and zoning. The Department's of Development Services, Public Works, and Fire concur with this recommendation. I believe that the document is substantially complete except for some scattered minor changes, especially since it must also still go through public hearings and Council review. I recommend that we call a public hearing for September 4 to consider citizen comments on the revisions. This is the earliest date we can have the hearing and still comply with the notification requirements of State law. But this time will also allow us a few more weeks of review for other potential revisions as well as changes to the Map of districts and formulate a transition strategy. Please review the latest draft in whatever depth you feel comfortable. I am returning your review comments of the earlier draft so that you may see how they were addressed in the current version. Again, we are advisory just as the citizen comments from the public hearings, and the City Council will make the final decision. The changes to the Zoning Ordinance and Map will also require some reconsideration of the Comprehensive Plan, and we will also begin review of revisions to the Subdivision Regulations in the next few weeks. However, I am certain that we can accomplish most of this remaining work on our regular meeting nights and will not require too many additional meetings/evenings as we have for the Zoning and Impact Fees.
