A. Approval of the Minutes from the March 26°i Special Called Meeting and the
March 27 &April 10, 2001 Regular Meetings.
Approval of Ordinances
1. Consider and act upon approval of an ordinance of the City of Wylie, Texas,
establishing a sinking fund for the funding of those certain agreements by and
between the City, Collin County and the Kansas City Southern Railway
Company; providing for the levying and collection of a sufficient tax to pay the
interest on such obligation; pledging such for the payment of said amount;
containing other incidental and related matters; providing a severability clause;
repealing all conflicting ordinances; and providing an effective date.
2. Consider and act upon an Ordinance annexing all of a certain 359.66 acre tract
of land being a part of the J.G. Jouett Survey, Abstract No. 475 and the Aaron
West Survey, Abstract No. 979; generally located on the south side of Stone Road
and east of Troy Road.
3. Consider and act upon an Ordinance annexing all of a certain 1.00 acre tract of
land being a part of the Francisco de la Pina Survey, Abstract No. 688; generally
located on the north side of State Highway 78.

4. Consider and act upon adopting the Water and Waste Water Master Plan

recommended by the Impact Fee Advisory Board Committee and consider
adoption of the 10-Year Capital Improvements Program (2001-2010) and
consider and act upon an ordinance of the City of Wylie, Texas amending the
Impact Fees.

Mayor Mondy read the proclamation declaring Wednesday, March 28, 2001 as Student Government Day. Wylie
High School Seniors were present to accept. The students were also asked to sit at the bench with their Council
counterparts.

situated in Collin County, Texas and being a part of the J.G. Jouett Survey, Abstract No. 475 and
the Aaron West Survey,Abstract No.979,and being part of those certain tracts conveyed to Joanne
Vanderweele, Successor Independent Administratrix, as described in Executor's Deed as recorded
in Collin County Clerk's File Number 95-0005773 and being all that certain tract of land described
in Quitclaim deed to Silas M. Hart and Charlene H. Hart, a called 69.25 acre tract of land as
recorded in County Clerk File No. 96-0091287, Deed Records, Collin County, Texas, said tract
being more particularly described by metes and bounds as in Exhibit A.
Mr. Mike Sferra, Director of Development Services addressed this item. Mr. Sferra provided Council with a brief
description and location of the land proposed for annexation. The applicant, Skip Klinefelter of the Red Group
Development Services was present to address any questions or concerns from Council. Mr. Klinefelter stated that
it is their intention, if the annexation is approved, to develop the area into a Master Plan community of oversized
lots and provisions for open space. Mr. Klinefelter was appreciative of the response he has received from the City
of Wylie staff.
The Mayor then opened the Public Hearing and asked that anyone wishing to speak either in favor or in opposition
of the annexation to come forward, state their name and address for the record and limit their comments to three
minutes. With no response,the Mayor then closed the Public Hearing.
2. Hold the first of two Public Hearings for the Annexation of land being all that certain lot,tract or
parcel of land situated in the FRANCISCO DE LA PINA SURVEY,ABSTRACT NO. 688,City of
Wylie, Collin County, Texas, and being a part of that 2.939 acres tract of land as described in a
Warranty deed from Rockwall Lot Leveling & Grading, Inc. to Paul C. Merritt and Richard A.

Mr. Mike Sferra was present to address this item. Mr. Sferra stated that it was staff's understanding that this
property had previously been annexed,however,it was recently discovered that due to an error it was not annexed.
The proposed action will rectify the error, should Council chose to approve the request. Mr. Sferra stated that the
applicant was not present.
The Mayor then opened the Public Hearing and asked that anyone wishing to speak either in favor or in opposition
of the annexation to come forward, state their name and address for the record and limit their comments to three
minutes. With no response,the Mayor then closed the Public Hearing.
At 7:23 p.m.,the Mayor then called for a fifteen minutes recess prior to adjourning into Work Session.
•Discussion regarding future meeting dates for the Wylie City Council.
There was some discussion between the Council regarding the possibility of changing the start time of the regular
meetings. Currently the Council meets at 7 p.m. After considerable discussion, it was determined that with proper
notification the future meeting times would begin at 6:00 p.m. There was also some discussion of changing the
day from Tuesday to Monday, however,most had a preference for Tuesdays.
It was stressed that city staff notify all news media and use the citizens newsletter and the city's website for
notification purposes. It was also suggested that to accommodate the citizens,the participation should be moved to
the end of the meeting. The new start time would be effective with the April 10,2001 meeting.
•Discussion of future tax abatement packages brought by the Wylie Economic Development Corp.
•W.P.Carrey(Atrium Company—Extruders Division)
•Carlisle Coatings&Waterproofing Inc.—Hardcast Division
Mr. Sam Satterwhite, Director of the Wylie Economic Development provided Council with a brief history and
status of a future tax abatement package for the W.P. Carrey (Atrium Company/Extruders Division) as well as the
Carlisle Coatings&Waterproofing, Inc(Hardcast Division). Mr. Satterwhite provided a handout for Council that
detailed the history as well as incentive and revenue analysis projections for the next five years. Mr. Satterwhite
stated that these tax abatement requests would be brought before Council for their approval within the next few
weeks.

Council Present: Mayor John Mondy, Councilman Joel Scott, Councilwoman Reta Allen, Councilman Merrill
Young,Councilman J.C. Worley and Councilman Chris Trout. Councilman Hogue was absent.

After calling the meeting to order, the Mayor then adjourned into Executive Session in accordance with Chapter
551, Government Code,Vernon's Texas Code Annotated (Open Meeting Act), Section 551. 072 Deliberation
Regarding Real Property; to deliberate the purchase, exchange, lease, or value of real property (100 & 200 Block
of North Jackson); Section 551.071 Consultation with Attorney; on a matter(Kansas City Southern) in which the
duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the
State Bar of Texas clearly conflicts with this chapter.
Rev Eric Hartman,First Baptist Church of Murphy was present to give the Invocation and Councilman Trout was
asked to lead the Pledge of Allegiance.
There were no citizens that came forward for participation.
A. Approval of the Minutes from the Regular Meeting of March 13,2001.
Councilman Scott made a motion to approve the minutes from the regular meeting of March 13, 2001.
Councilman Trout seconded the motion. A vote was taken and the motion was approved, 5-0. Councilman Young
was excused during the Executive Session and Councilman Hogue was absent.
1. Consider and act upon a Development Plan/Preliminary Plat for the Estates at Creekside Addition,
proposed by Campbell/Wylie Partners, for the property generally located south of Parker Road
(FM 2514)and east of McCreary Road (CR 245),being all of a certain 45.192 acre tract situated in
the Lewis M.Marshall Survey,Abstract No.594,City of Wylie,Collin County,Texas.
Ms. Mindy Manson, Assistant City Manager addressed this item. Ms. Manson provided Council with a brief
history of the request. She stated that the applicant was present to address any of the Council's questions or
concerns.
Mr.Gary Defrain,8235 Douglas Avenue,Dallas,Texas
Mr. Defrain stated that the concept plan for this development was approved by the Council in November and the
proposed plan is in compliance with the subdivision ordinances of the City of Wylie. Mr. Defrain was then
available for questions from Council.

Mr. Defrain stated that he has had discussion with the City Manager regarding the proposed sewer extension to the
Creekside property, extended by D.R.Horton to service their property. Mr. Defrain stated that he is extending the
sewer through the North half of Creekside Estates through the 105 acre Parker parcel in order to access this parcel.
He stated that although he would like to service the entire parcel, he will at a minimum service the lots that back
up to the flood plain,for environmental reasons. Mr. Defrain concluded that he is not extending sewer to another
jurisdiction, he is only extending through another jurisdiction to get to this development. He stated that he will be
working with staff prior to beginning the engineering phase. Mr. Defrain was then available for questions from
Council.
Councilman Scott asked about sewer connection agreements with some Parker Road property owners, to which
Mr. Defrain volunteered to read into the record.
Mr. Defrain stated that on the North East corner of the tract, he will be providing 4" sewer services and has agreed
to build a fence at the rear of lots 1, 2,and 3 of Block C. Said fence will match the existing fence of the property
owner. At the Northwest corner, he stated he has visited with Mr. Duncan and agreed to provide 4" sewer
services and not remove any of the trees along the common property line. He has agreed also to increase the rear
building line on lots 9-12 Block A from 25'to 30'.
A motion was made by Councilman Worley to approve the Development Plan/Preliminary Plat for the Estates at
Creekside Addition, proposed by Campbell/Wylie Partners, for the property generally located south of Parker

•Recognition of Star Students—Character Traits"Honesty
The following students were present to receive recognition from the Mayor for their display of the character trait,
Honesty. Sean Ragsdale, Akin Elementary; Morgan Wood, Birmingham Elementary and Emily Klingbeil,
Hartman Elementary. Not present, but also honored, were Dillon Johnson, Dodd Elementary; Logun Liening,
Wylie Intermediate School and Michelle Hollingsworth, Wylie Junior High.
*Comprehensive Annual Financial Report
Mr. Jim Curry, representing the auditing firm of Pattillo, Brown and Hill, provided Council with a brief overview
of the Comprehensive Annual Financial Report concluding that they have given the City of Wylie a favorable
opinion with regard to our financial standings. Mr. Curry provided brief explanations from the Comprehensive
Annual Financial Report.
•Presentation of The Certificate of Achievement for Excellence in Financial Reporting by the
Government Finance Officers Association.
Mayor Mondy presented Mr. Brady Snellgrove, Finance Director, a plaque for Excellence in Financial Reporting
by the Government Finance Officers Association. This marks the eleventh year the Finance Department has
received this award.

2. Hold a public hearing to consider and act upon approval of a request from Dale Powrie for
approval of a zone change from SF-3 (Single Family Residential) District to PD (Planned
Development) District for Retail, Professional Office and Single-Family Residential uses, for a
0.1865 acre tract located at 311 North Ballard Avenue, being all of Lot 17, Block 3 of the Brown
and Burns Addition,City of Wylie,Collin County,Texas. (Zoning Case No.01-01)
Councilman Young returned from his excused absence and was present for the remainder of the meeting.

Ms. Mindy Manson, Assistant City Manager addressed this item. Ms. Manson provided Council with a brief
history of the zoning request. Ms. Manson stated that the affirmative vote of at least three-fourths of all City
Council members is required to approve the requested zoning change because at least twenty percent of the
property owners within the notification area have responded in protest to the request. There was considerable
discussion with regard to the parking requirements and safety concerns.
The applicant Mr. Dale Powrie, 901 Crestwood, Richardson, Texas, was present to address any questions or
concern of Council. Mr. Powrie stated that they are providing a total of six parking spaces for the proposed
business. Four parking spaces will be located in the rear of the business and two additional spaces would be
provided in the front or the street. He stated that the rear parking would be primarily for residential use only and
that customer access to the business would be through the Ballard Street entrance.
The Mayor then opened the Public Hearing asking that anyone wishing to speak in favor or opposition of the zone
change request to please come forward and state their name and address for the record, limiting their comments to
three minutes.
Mr.Bill Lewis,725 Bennet
Mr. Lewis stated that he is the Birmingham Trust Executive Director. Mr. Lewis expressed his concerns regarding
the parking requirements. He also stated that he feels that if approved, this business would open the doors for
future business development and cause a deterioration of the historic atmosphere. Mr. Lewis also stated that he
felt that this would be considered spot zoning and reiterated his position that he opposes the business use within a
historic atmosphere.
With no further comment,the Mayor then closed the Public Hearing.
Councilman Scott asked Ms. Manson, Assistant City Manager, if this request would be considered spot zoning.
Ms. Manson stated that this would have to be determined by the courts,however, she stated that we would see how
the proposed zoning looked with the Comprehensive Plan and that many factors would be considered, such as is
the zoning contrary to the development in the area. She concluded that the proposed zoning is supported by the
Comprehensive Plan. Ms.Manson also added that the Birmingham House is zoned for office use.
Councilman Worley made a motion to approve the request from Dale Powrie for approval of a zone change from

establishing procedures for the acquisition,by purchase or condemnation,of property.
Mr. Chris Hoisted addressed this item. Mr. Hoisted provided Council with a brief background on the intent of the
Resolution. Mr. Holsted stated that staff is recommending approval in order to establish a public necessity to
acquire property for the Stone Road project.
Councilman Worley made a motion to approve the resolution of the city council of the City of Wylie, Texas,
determining a public necessity to acquire, by purchase or condemnation, certain property; giving notice of an
official determination to acquire property for the stone road paving project; establishing procedures for the
acquisition,by purchase or condemnation,of property. Councilman Trout seconded the motion. A vote was taken
and the motion was approved, 6-0.

4. Consider and act upon acceptance of the Comprehensive Annual Financial Report after
presentation by the audit firm of Pattillo,Brown &Hill
Councilman Scott made a motion to accept the Comprehensive Annual Financial Report. Councilwoman Allen
seconded the motion. A vote was taken and the motion was approved, 6-0.
5. Consider and act upon approval of an amended easement within Community Park and Founders
Park.
Anthony Johnson, City Manager addressed this item. Mr. Johnson explained that Aerie Network Services, Inc., a
telecommunication company,has requested approval of a telecommunication easement within the existing pipeline
easement which runs through both Community and Founders Parks. This easement will not place any additional
limits on the use of the property beyond what already exists from the original pipeline easement and has been
coordinated with the Wylie Independent School District, particularly where it crosses Community Park onto
School District property. The length of the easement through Community Park is 1200' and 2035' through
Founders Park.
Mr. Johnson stated that after discussions, it was agreed that compensation for the easement would be $1 per foot
plus$1 per foot for damages for a total of$6,470.00.
Councilman Worley made a motion to approve the amended easement within Community Park and Founders Park.
Councilman Young seconded the motion. A vote was taken and the motion was approved, 6-0. Councilman
Hogue was absent.

As a result of the Executive Session, Councilman Trout made a motion to authorize the City Manager to enter into
an easement agreement between Kansas City Southern and the City of Wylie, subject to approval by the City
Manager and City Attorney. Councilman Scott seconded the motion. A vote was taken and the motion was
approved, 6-0. Councilman Hogue was absent.

PROVIDING FOR THE LEVYING AND COLLECTION OF A SUFFICIENT TAX TO PAY
THE INTEREST ON SUCH OBLIGATION;PLEDGING SUCH FOR THE PAYMENT OF
SAID AMOUNT; CONTAINING OTHER INCIDENTAL AND RELATED MATTERS;
PROVIDING A SEVERABILITY CLAUSE; REPEALING ALL CONFLICTING
ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City is the owner of that certain tract of real property described on Exhibit
"A"attached hereto and incorporated herein by reference(the "Property");and
WHEREAS, The City, the Kansas City Southern Railway Company ("KCS") and Collin
County,Texas,a corporate political body attic State of Texas,have executed that certain tri-party
agreement dated as of January 26, 1999(the"Original Agreement");and
WHEREAS, the City and KCS have executed three (3) agreements, pursuant to and/or
supplementing the Original Agreement,including(a)a temporary construction easement agreement,
recorded in Volume _, Page of the Real Property Records of Collin County, Texas (the
"Temporary Easement"),pursuant to which KCS constructed a new track connection,in part upon
the Property,(b)an agreement dated February 2000,and(c)a letter agreement dated March 29,
2000(the"Supplemental Agreements");and
WHEREAS, the City placed the Property into the voluntary cleanup program of the Texas
Natural Resources Conservation Commission and has performed certain of its obligations pursuant
to said Original Agreement and Supplemental Agreements;however,the City has not received and
provided KCS with a copy of either a Final Certificate of Completion pursuant to the Voluntary
Cleanup Program or such other documentation indicating that no further action is required or
anticipated,pursuant to applicable state environmental laws and regulations,with respect to the solid
waste landfill (the "Final Certificate");and
WHEREAS, the City and KCS desire to proceed with the closing under the Original
Agreement,without either party waiving any of its rights,or any of either parry's obligations,under
either the Original Agreement or any of the Supplemental Agreements,and such parties desire to
take whatever actions are reasonable and appropriate to assure that the obligations of each of the
parties, including, without limitation, that the City provide the Final Certificate, are valid and
lawfully enforceable; and
WHEREAS,although the parties did not intend or foresee that the terms of the Supplemental
Agreements could or would extend beyond the City's then current fiscal year, due to un.torseen
circumstances the terms of the Supplemental Agreements did so and could potentially extend beyond
such closing and beyond the present(2001-2002)fiscal year;and
'WHEREAS,pursuant to the provisions contained in Article 11,Sections 5 and 7 of the Texas
Constitution,the City may not enter into unfunded debt,i.e.,debt beyond the current fiscal year,for

any purpose without creating a sinking fund of at least two percent(2%)of the amount of such debt
for the payment of said debt;
WHEREAS,at the time long-term debt is created,the City must provide for the assessment
and collection on an annual basis of a sufficient sum of money for payments accruing during any
subsequent budget year.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE,TEXAS,THAT:
SECTION 1
All the above premises are hereby found to be true and correct and are hereby approved and
incorporated into the body of this ordinance as if copies in their entirety.
,SECTION 2
The City does hereby reaffirm its obligations under the Original Agreement and
Supplemental Agreements. From and after the effective date of this Ordinance, the City's Chief
Financial Officer is hereby directed to create and maintain a Sinking Fund for the payment of the
debt created by such Original and Supplemental Agreements. The Sinking Fund shall consist of two
percent(2%)of
SECTION 3
The proceeds placed into the Sinking Fund, for the current fiscal year(2001-2002)and the
aucceeding fiscal years shall be from the City's ad valorem tax and there shall be annually assessed
nd collected in due time, form and manner,a direct and continuing ad valorem tax on all taxable
property within the corporate limits of the City at a rate from year to year, within the limitations
prescribed by law,on each one hundred dollars' valuation of taxable property as will be sufficient
to provide funds to satisfy any obligations under the Original and Supplemental Agreements during
any budget year.
SECTION 4
The City's Chief Financial Officer shall keep and maintain all records relating to the Sinking
Fund and all such other elated documentation and accounts.
SECTION 5
All ordinances,orders or resolutions heretofore passed and adopted by the City Council of
the City of Wylie,Texas,are hereby repealed to the extent that said ordinances,orders or resolutions,
or parts thereof,are in conflict herewith.
SECTION 6
If any section,article,paragraph,sentence,clause,phrase or word in this Ordinance is held
invalid or unconstitutional by a court of competent jurisdiction,such holding shall not affect the
validity of the remaining portions of this Ordinance;and the City Council hereby declares it would
have passed such remaining portions of this Ordinance despite such invalidity,and further declares

that such remaining portions shall remain in full force and effect.
SECTION?
This Ordinance shall take effect and be in fitll force from and after its passage,as provided
' by the Revised Civil Statutes of the State of Texas and the Home Rule Charter of the City of Wylie,
Texas.

Issue
Consider and act upon an Ordinance annexing all of a certain 359.66 acre tract of land
being a part of the J.G. Jouett Survey, Abstract No. 475 and the Aaron West Survey,
Abstract No. 979; generally located on the south side of Stone Road and east of Troy
Road.
Background
In an effort to ensure the goal of protecting the quality of life and the provision of
services within the area, the City of Wylie believes that the property shown on the
attached map should be within its city limits. Should the City Council approve the
proposed annexation, the property will be temporarily zoned as A (Agricultural) until
permanent zoning is established by the City Council. The procedure for establishing the
permanent zoning on annexed territory shall conform to the procedures established by
law for the adoption of zoning regulations.
In accordance with State Law, proper notice and public hearings were conducted
according to the following schedule:

Financial Consideration
The current property tax rate for the City of Wylie is .725 per $100 of valuation.
Other Considerations
Article 1, Section 3 of the Wylie City Charter authorizes the City Council to adjust
boundaries. The City will also be required when the annexation is considered to comply
with the Local Government Code for the provision of services, (please see attached
Service Plan).
This annexation is being conducted in compliance with Sections 43.062 and 43.063 of the
Local Government Code.

WHEREAS, the City Council of the City of Wylie, Texas ("City Council") under
the authority of Section 43.021. Local Government Code and the City of Wylie, Texas'
(Wylie) Home Rule Charter, investigated and determined that it would be advantageous
and beneficial to Wylie and its inhabitants to annex the below-described property (the
"Property") to Wylie; and
WHEREAS, prior to conducting the public hearings required under Section
43.063, Local Government Code, the City Council also investigated and determined that
the Property is within the extraterritorial jurisdiction of Wylie and is adjacent and
contiguous to the existing city limits of Wylie; and
WHEREAS, before the publication of the notice of the first public hearing
regarding the annexation of the Property, the City Council directed the appropriate
persons to prepare a service plan that provides for the extension of full municipal services
to the Property to be annexed; and
WHEREAS, the City Council finds that the service plan has been prepared in full
compliance with Section 43.056, Local Government Code, and has been made available
for public inspection and was available for explanation to the inhabitants of the Property
at the public hearings; and
WHEREAS, the City Council finds that the field notes close the boundaries of the
Property being annexed; and
WHEREAS, the City Council has conducted at least two (2) public hearings at
which persons interested in the annexation were given an opportunity to be heard
regarding the proposed annexation and the proposed service plan; and
WHEREAS, the City Council finds that the public hearings were conducted on or
after the fortieth (40th) day but before the twentieth (20th) day before the date of
institution of the annexation proceedings; and
WHEREAS, the City Council finds it has completed the annexation process
within ninety (90) days after the City instituted the annexation proceedings; and
WHEREAS, the City Council finds that all legal notices, hearings, procedures and
publishing requirements for annexation have been performed and completed in the
manner and form set forth by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1: The Property described in "Exhibit A" and all public streets,
roadways and alleyways located within or contiguous to the same is hereby annexed to
Wylie.
SECTION 2: The Service Plan for the Property is attached hereto as "Exhibit B"
and made a part hereof for all purposes.
SECTION 3: That from and after the passage of this Ordinance, the Property shall
be a part of Wylie, and the inhabitants thereof shall be entitled to all the rights and
privileges of all of the citizens of Wylie and shall be bound by all of the ordinances and
regulations enacted pursuant to and in conformity with the City Charter and the laws of
the State of Texas.
SECTION 4: That the official map and boundaries of Wylie are hereby amended
to include the property as part of the City of Wylie, Texas, and that a certified copy of
this Ordinance shall be filed in the County Clerk's office of Collin County, Texas.
SECTION 5: It shall be unlawful for any person, firm or corporation to make use
of the Property in some manner other than as authorized by this Ordinance and
Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto; and it shall
be unlawful for any person, firm or corporation to construct on the Property any building
that is not in conformity with the permissible use under this Ordinance and
Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto.
SECTION 6: Any person, firm or corporation who violates any provision of this
Ordinance and Comprehensive Zoning Ordinance No. 85-23A, and any amendment
thereto, shall be deemed guilty of a misdemeanor and upon conviction shall be fined a
sum not exceeding Two Thousand and 00/100 Dollars ($2000.00), and each and every
day such violation continues shall be considered a separate offense; provided, however,
such penal provision shall not preclude a suit to enjoin such violation.
SECTION 7: Should any part or portion of this Ordinance, or the use created
herein or under Comprehensive Zoning Ordinance No. 85-23A, and any amendments
thereto, be declared unconstitutional or invalid by any court of competent jurisdiction, it
is expressly provided that any and all remaining portions shall remain in full force and
effect.
SECTION 8: All ordinances in conflict with this Ordinance are repealed to the
extent they are in conflict, and any remaining portions of the conflicting ordinance shall
remain in full force and effect.
SECTION 9: The caption of this Ordinance shall be published in accordance with
the law and the City Charter and shall be effective immediately upon its passage or as
required by law.

Municipal Services to the acreage described above shall be furnished by or on behalf of the City
of Wylie, Texas (the "City"), at the following levels and in accordance with the following
schedule:
A. POLICE SERVICE
1. Patrolling, responses to calls and other routine police services, within the limits of
existing personnel and equipment and in a manner consistent with any of the
methods of the City, extends police service to any other area of the municipality,
will be provided within sixty (60) days of the effective date of the annexation
ordinance.
2. As development and construction commence in this area, sufficient police
personnel and equipment will be provided to furnish this area the maximum level
of police services consistent with the characteristics of topography, land
utilization and population density within the area as determined by the City
Council within four and one-half (4-1/2) years from the effective date of the
annexation ordinance, or upon commencement of development within the area,
whichever occurs later.
3. Upon ultimate development of the area, the same level of police services will be
provided to this area as are furnished throughout the City.
B. FIRE SERVICES
1. Fire protection by the present personnel and the present equipment of the Fire
Department, within the limitations of available water and distances from existing
fire stations, and in a manner consistent with any of the methods of the City,
extends fire service to any other area of the municipality, will be provided to this
area within sixty (60) days of the effective date of the annexation ordinance.

2. As development and construction commence in this area, sufficient fire and emergency
ambulance equipment will be provided to furnish this area the maximum level of fire
services consistent with the characteristics of topography, land utilization and population
density within the area as determined by the City Council within four and one-half (4-
1/2) years from the effective date of the annexation ordinance, or upon commencement of
development within the area, whichever occurs later.
3. Upon ultimate development of the area, the same level of fire and emergency ambulance
services will be provided to this area as are furnished throughout the City.
C. ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES
1. Enforcement of the City's environmental health ordinances and regulations,
including but not limited to, weed and brush ordinances, junked and abandoned
vehicle ordinances and animal control ordinances, shall be provided within this
area sixty (60) days of the effective date of the annexation ordinance. These
ordinances and regulations will be enforced through the use of existing personnel.
Complaints of ordinance or regulation violations within this area will be answered
and investigated within sixty (60) days of the effective date of the annexation
ordinance.
2. Inspection services, including the review of building plans, the issuance of
permits and the inspection of all buildings, plumbing, mechanical and electrical
work to ensure compliance with City codes and ordinances will be provided
within sixty (60) days of the effective date of the annexation ordinance. Existing
personnel will be used to provide these services.
3. The City's zoning, subdivision, sign and other ordinances shall be enforced in this
area beginning within sixty (60) days of the effective date of the annexation
ordinance.
4. All inspection services furnished by the City, but not mentioned above, will be
provided to this area beginning within sixty (60) days of the effective date of the
annexed ordinance.
5. As development and construction commence in this area, sufficient personnel will
be provided to furnish this area the same level of Environmental Health and Code
Enforcement Services as are furnished throughout the City.
D. PLANNING AND ZONING SERVICES
The planning and zoning jurisdiction of the City will extend to this area within sixty (60)
days of the effective date of the annexation ordinance. City planning will thereafter
encompass this

E. PARK AND RECREATION SERVICES
1. Residents of this property may utilize all existing park and recreational services,
facilities and sites throughout the City, beginning within sixty (60) days of the
effective date of the annexation ordinance.
2. Additional facilities and sites to serve this property and its residents will be
acquired, developed and maintained at locations and times provided by applicable
plans for providing parks and recreation services to the City.
3. Existing parks, playgrounds, swimming pools and other recreational facilities
within this property shall, upon dedication to and acceptance by the City, be
maintained and operated by the City of Wylie, but not otherwise.
F. SOLID WASTE COLLECTION
1. Solid waste collection shall be provided to the property in accordance with
existing City policies, beginning within sixty (60) days of the effective date of the
annexation ordinance. Residents of this property utilizing private collection
services at the time of annexation shall continue to do so until it becomes feasible
because of increased density of population to serve the property municipally.
Commercial refuse collection services will be provided to any business located in
the annexed area at the same price as presently provided for any business
customer within the City, upon request.
2. As development and construction commence in this property and population
density increases to the property level, solid waste collection shall be provided to
this property in accordance with the current policies of the City as to frequency,
changes and so forth.
3. Solid waste collection shall begin within sixty (60) days of the effective date of
the annexation ordinance.
G. STREETS
1. The City's existing policies with regard to street maintenance, applicable
throughout the entire City, shall apply to this property beginning within sixty (60)
days of the effective date of the annexation ordinance. Unless a street within this
property has been constructed or is improved to the City's standards and
specifications, that street will not be maintained by the City.

2. As development, improvement or construction of streets to City standards
commences within this property, the policies of the City with regard to
participation in the costs thereof, acceptance upon completion and maintenance
after completion, shall apply.
3. The same level of maintenance shall be provided to streets within this property
which have been accepted by the City as is provided to City streets throughout the
City.
4. Street lighting installed on streets improved to City standards shall be maintained
in accordance with current City policies.
H. WATER SERVICES
1. Connection to existing City water mains for water service for domestic,
commercial and industrial use within this property will be provided in accordance
with existing City policies. Upon connection to existing mains, water will be
provided at rates established by City ordinances for such service throughout the
City.
2. As development and construction commence in this property, water mains of the
City will be extended in accordance with provisions of the Subdivision
Regulations and other applicable ordinances and regulations. City participation in
the costs of these extensions shall be in accordance with the applicable City
ordinances and regulations. Such extensions will be commenced within two (2)
years from the effective date of the annexation ordinance and substantially
completed with four and one-half(41/2) years after that date.
3. Water mains installed or improved to City standards which are within the annexed
area and are within dedicated easements shall be maintained by the City of Wylie
beginning within sixty (60) days of the effective date of the annexation ordinance.
4. Private water lines within this property shall be maintained by their owners in
accordance with existing policies applicable throughout the City.
SANITARY SEWER SERVICES
1. Connections to existing City sanitary sewer mains for sanitary sewage service in
this area will be provided in accordance with existing City policies. Upon
connection, sanitary sewage service will be provided at rates established by City
ordinances for such service throughout the City.
2. Sanitary sewage mains and/or lift stations installed or improved to City standards,
located in dedicated easements, and which are within the annexed area and

are connected to City mains will be maintained by the City of Wylie beginning
within sixty (60) days of the effective date of the annexation ordinance.
3. As development and construction commence in this area, sanitary sewer mains of
the City will be extended in accordance with provisions of the Subdivision
Regulations and other applicable City ordinances and regulations. Such
extensions will be commenced within two (2) years from the effective date of the
annexation ordinance and substantially completed within four and one-half (41/2)
years after that date.
J. MISCELLANEOUS
1. Any facility or building located within the annexed area and utilized by the City
in providing services to the area will be maintained by the City commencing
upon the date of use or within sixty (60) days of the effective date of the
annexation ordinance, whichever occurs later.
2. General municipal administrative services of the City shall be available to the
annexed area beginning within sixty (60) days of the effective date of the
annexation ordinance.
3. Notwithstanding, anything set forth above, this Service Plan does not require all
municipal services be provided as set forth above if different characteristics of
topography, land use and population density are considered a sufficient basis for
providing different levels of service.
4. The Service Plan is valid for ten (10) years from the effective date of this
Ordinance.

Issue
Consider and act upon an Ordinance annexing all of a certain 1.00 acre tract of land being
a part of the Francisco de la Pina Survey, Abstract No. 688; generally located on the
north side of State Highway 78.
Background
In an effort to ensure the goal of protecting the quality of life and the provision of
services within the area, the City of Wylie believes that the property shown on the
attached map should be within its city limits. Should the City Council approve the
proposed annexation, the property will be temporarily zoned as A (Agricultural) until
permanent zoning is established by the City Council. The procedure for establishing the
permanent zoning on annexed territory shall conform to the procedures established by
law for the adoption of zoning regulations.
In accordance with State Law, proper notice and public hearings were conducted
according to the following schedule:

Financial Consideration
The current property tax rate for the City of Wylie is .725 per $100 of valuation.
Other Considerations
Article 1, Section 3 of the Wylie City Charter authorizes the City Council to adjust
boundaries. The City will also be required when the annexation is considered to comply
with the Local Government Code for the provision of services, (please see attached
Service Plan).
This annexation is being conducted in compliance with Sections 43.062 and 43.063 of the
Local Government Code.

PROVIDING THAT THE OWNERS AND INHABITANTS OF THE
ABOVE-DESCRIBED TRACT OF LAND SHALL BE ENTITLED
TO THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF
WYLIE AND BE BOUND BY THE ACTS AND ORDINANCES
NOW IN EFFECT AND HEREAFTER ADOPTED; PROVIDING
FOR A PENALTY FOR A VIOLATION OF THIS ORDINANCE
AND COMPREHENSIVE ZONING ORDINANCE NO. 85-23A;
PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY

WHEREAS, the City Council of the City of Wylie, Texas ("City Council") under
the authority of Section 43.021. Local Government Code and the City of Wylie, Texas'
(Wylie) Home Rule Charter, investigated and determined that it would be advantageous
and beneficial to Wylie and its inhabitants to annex the below-described property (the
"Property") to Wylie; and
WHEREAS, prior to conducting the public hearings required under Section
43.063, Local Government Code, the City Council also investigated and determined that
the Property is within the extraterritorial jurisdiction of Wylie and is adjacent and
contiguous to the existing city limits of Wylie; and
WHEREAS, before the publication of the notice of the first public hearing
regarding the annexation of the Property, the City Council directed the appropriate
persons to prepare a service plan that provides for the extension of full municipal services
to the Property to be annexed; and
WHEREAS, the City Council finds that the service plan has been prepared in full
compliance with Section 43.056, Local Government Code, and has been made available
for public inspection and was available for explanation to the inhabitants of the Property
at the public hearings; and
WHEREAS, the City Council finds that the field notes close the boundaries of the
Property being annexed; and
WHEREAS, the City Council has conducted at least two (2) public hearings at
which persons interested in the annexation were given an opportunity to be heard
regarding the proposed annexation and the proposed service plan; and
WHEREAS, the City Council finds that the public hearings were conducted on or
after the fortieth (40th) day but before the twentieth (20th) day before the date of
institution of the annexation proceedings; and
WHEREAS, the City Council finds it has completed the annexation process
within ninety (90) days after the City instituted the annexation proceedings; and
WHEREAS, the City Council finds that all legal notices, hearings, procedures and
publishing requirements for annexation have been performed and completed in the
manner and form set forth by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WYLIE, TEXAS:
SECTION 1: The Property described in "Exhibit A" and all public streets,
roadways and alleyways located within or contiguous to the same is hereby annexed to
Wylie.
SECTION 2: The Service Plan for the Property is attached hereto as "Exhibit B"
and made a part hereof for all purposes.
SECTION 3: That from and after the passage of this Ordinance, the Property shall
be a part of Wylie, and the inhabitants thereof shall be entitled to all the rights and
privileges of all of the citizens of Wylie and shall be bound by all of the ordinances and
regulations enacted pursuant to and in conformity with the City Charter and the laws of
the State of Texas.
SECTION 4: That the official map and boundaries of Wylie are hereby amended
to include the property as part of the City of Wylie, Texas, and that a certified copy of
this Ordinance shall be filed in the County Clerk's office of Collin County, Texas.
SECTION 5: It shall be unlawful for any person, firm or corporation to make use
of the Property in some manner other than as authorized by this Ordinance and
Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto; and it shall
be unlawful for any person, firm or corporation to construct on the Property any building
that is not in conformity with the permissible use under this Ordinance and
Comprehensive Zoning Ordinance No. 85-23A, and any amendments thereto.
SECTION 6: Any person, firm or corporation who violates any provision of this
Ordinance and Comprehensive Zoning Ordinance No. 85-23A, and any amendment
thereto, shall be deemed guilty of a misdemeanor and upon conviction shall be fined a
sum not exceeding Two Thousand and 00/100 Dollars ($2000.00), and each and every
day such violation continues shall be considered a separate offense; provided, however,
such penal provision shall not preclude a suit to enjoin such violation.
SECTION 7: Should any part or portion of this Ordinance, or the use created
herein or under Comprehensive Zoning Ordinance No. 85-23A, and any amendments
thereto, be declared unconstitutional or invalid by any court of competent jurisdiction, it
is expressly provided that any and all remaining portions shall remain in full force and
effect.
SECTION 8: All ordinances in conflict with this Ordinance are repealed to the
extent they are in conflict, and any remaining portions of the conflicting ordinance shall
remain in full force and effect.
SECTION 9: The caption of this Ordinance shall be published in accordance with
the law and the City Charter and shall be effective immediately upon its passage or as
required by law.

Municipal Services to the acreage described above shall be furnished by or on behalf of the City
of Wylie, Texas (the "City"), at the following levels and in accordance with the following
schedule:
A. POLICE SERVICE
1. Patrolling, responses to calls and other routine police services, within the limits of
existing personnel and equipment and in a manner consistent with any of the
methods of the City, extends police service to any other area of the municipality,
will be provided within sixty (60) days of the effective date of the annexation
ordinance.
2. As development and construction commence in this area, sufficient police
personnel and equipment will be provided to furnish this area the maximum level
of police services consistent with the characteristics of topography, land
utilization and population density within the area as determined by the City
Council within four and one-half (4-1/2) years from the effective date of the
annexation ordinance, or upon commencement of development within the area,
whichever occurs later.
3. Upon ultimate development of the area, the same level of police services will be
provided to this area as are furnished throughout the City.
B. FIRE SERVICES
1. Fire protection by the present personnel and the present equipment of the Fire
Department, within the limitations of available water and distances from existing
fire stations, and in a manner consistent with any of the methods of the City,
extends fire service to any other area of the municipality, will be provided to this
area within sixty (60) days of the effective date of the annexation ordinance.

2. As development and construction commence in this area, sufficient fire and emergency
ambulance equipment will be provided to furnish this area the maximum level of fire
services consistent with the characteristics of topography, land utilization and population
density within the area as determined by the City Council within four and one-half (4-
1/2) years from the effective date of the annexation ordinance, or upon commencement of
development within the area, whichever occurs later.
3. Upon ultimate development of the area, the same level of fire and emergency ambulance
services will be provided to this area as are furnished throughout the City.
C. ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES
1. Enforcement of the City's environmental health ordinances and regulations,
including but not limited to, weed and brush ordinances, junked and abandoned
vehicle ordinances and animal control ordinances, shall be provided within this
area sixty (60) days of the effective date of the annexation ordinance. These
ordinances and regulations will be enforced through the use of existing personnel.
Complaints of ordinance or regulation violations within this area will be answered
and investigated within sixty (60) days of the effective date of the annexation
ordinance.
2. Inspection services, including the review of building plans, the issuance of
permits and the inspection of all buildings, plumbing, mechanical and electrical
work to ensure compliance with City codes and ordinances will be provided
within sixty (60) days of the effective date of the annexation ordinance. Existing
personnel will be used to provide these services.
3. The City's zoning, subdivision, sign and other ordinances shall be enforced in this
area beginning within sixty (60) days of the effective date of the annexation
ordinance.
4. All inspection services furnished by the City, but not mentioned above, will be
provided to this area beginning within sixty (60) days of the effective date of the
annexed ordinance.
5. As development and construction commence in this area, sufficient personnel will
be provided to furnish this area the same level of Environmental Health and Code
Enforcement Services as are furnished throughout the City.
D. PLANNING AND ZONING SERVICES
The planning and zoning jurisdiction of the City will extend to this area within sixty (60)
days of the effective date of the annexation ordinance. City planning will thereafter

Issue
Consider and act upon adopting the Water and Waste Water Master Plan Update.
Background
The Water and Waste Water Master Plan Update is a document which projects the size and general
location of the water mains and sewer mains required to serve the ultimate projected service area of the
City' utility system. The plans show the sizes and locations of various mains, storage facilities, treatment
plants, pumps and lift stations based on the City's current and ultimate projected area and population.
As the City grows, its current and projected ultimate service area and population will change, making
it necessary to update the Water and Waste Water Master Plan to reflect the current projections.
This update to the Water and Waste Water Master Plan was prepared using the Comprehensive Master
Plan and Land Use Plan, and is necessary to accurately develop the 10-year Capital Improvements Plan
and the Impact Fee report.
Financial Considerations
The Plan establishes the planning basis upon which assumptions for short and long term financing, utility

Issue
Hold a Public Hearing to receive public input regarding the 10-Year Capital Improvements
Program (2001-2010) and Maximum Calculated Impact Fees recommended by the Impact Fee
Advisory Committee and consider adoption of the 10-Year Capital Improvements Program (2001-
2010) and consider and act upon approval of an ordinance of the City of Wylie, Texas amending
the Impact Fees for water and sewer.
Background
The review process for updating the Land Use Assumptions, Capital Improvements Program and Impact
Fees by the Impact Fee Advisory Committee is now complete. The committee has reviewed and made
a recommendation to the City Council for approval of the Land Use Assumptions (2000-2010), Capital
Improvements Program (2001-2010) (CIP) and Impact Fees. The Notice of the Public Hearing to
consider the Land Use Assumptions, CIP and Impact Fees was published more than 30 days prior to the
Hearing and was published for three consecutive weeks.
The final meeting of the Impact Fee Advisory Committee(IFAC) was held on March 12, 2001. At that
meeting, the IFAC reviewed the CIP and determined that all of the projections on the CIP were
appropriate infrastructure improvements for the estimated growth of development in the upcoming ten
years. The IFAC made a recommendation to City Council to adopt the CIP. The City Council must
evaluate the projects listed on the CIP and, if they agree with the IFAC, should adopt the CIP.
The CIP outlines the capital projects required to support the future development in the City based on
the Land Use Assumptions(2000-2010) and the Water and Waste Water Master Plan Update. This CIP,
prepared by The Hogan Corporation, outlines thirteen water projects and twenty-two sewer projects.
The IFAC also recommended adoption of the maximum impact fees allowable. These impact fees were
calculated from the estimated costs of the CIP projects and may be imposed against new development
to generate revenue for funding or recouping the costs for capital improvements or facility expansions
generated by that new development. Council must determine whether the actual impact fee will be
established at or below the maximum calculated impact fee. If the cost of the capital projects is not
recouped through Impact Fee assessment, then alternate funding for those infrastructure requirements
will have to be established. Additional funding requirements would have to be met by issuing bonds that
will be paid for by increasing water and sewer rates, which would spread the burden to all residential and
commercial customers, rather than to the new customers directly responsible for the additional
requirements.
Financial Considerations
Impact fee is defined as "a charge or assessment imposed by a political subdivision against new
development in order to generate revenue for funding or recouping the costs of capital improvements
or facility expansions necessitated by and attributable to the new development". It does not include"the
repair, maintenance, modernization, or expansion of an existing facility to better serve existing
development". The current impact fees charged by the City of Wylie are $700 per LUE for water and
$1412 per LUE for sewer, which were the maximum calculated impact fee when adopted in 1997.
The cost of the capital improvements, which is eligible for inclusion in the impact fee calculation, is
$1,626,585 for water and $7,138,938 for sewer. Attached is a copy of the Capital Improvements Plan
(2001-2010) which details all of the specific water projects (Table 3A) and the sanitary sewer projects
(Table 3B). The tables give a description of the projects, their estimated costs, and the percentages of
the projects which will be directly attributable to new development and therefore to be included in the
calculation of the impact fee.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING ORDINANCE
NOS.90-10,97-2 AND 97-4,REGARDING IMPACT FEES TO BE ASSESSED BY THE
CITY OF WYLIE, TEXAS; PROVIDING FOR REPEALING, SAVINGS AND
SEVERABILITY CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE OF
THIS ORDINANCE.
WHEREAS, the City Council of the City of Wylie, Texas (the "City Council") has previously adopted
Ordinance Nos. 90-10 and 97-4 of the City of Wylie, Texas ("Wylie") establishing an impact fee to be assessed by
Wylie; and
WHEREAS, Wylie has fully complied with Chapter 395, Local Government Code, concerning the notice,
adoption, promulgation and methodology necessary to adopt land use assumptions and a capital improvement plan
establishing impact fees and has properly adopted Ordinance Nos.90-10,97-4,and Resolution 97-2;and
WHEREAS, the City Council desires to amend the land use assumptions and amend the capital
improvement plan and the amount of impact fees for water and sewer;and
WHEREAS, Wylie has reviewed the land use assumptions and capital improvement plan, and the impact
fees for water and sewer adopted under Ordinance Nos. 90-10, 97-4, and Resolution 97-2 of Wylie in compliance
with Chapter 395,Local Government Code;and
WHEREAS, Wylie has,within sixty (60) days after the date it received the proposed land use assumptions,
the capital improvement plan and assessment of impact fees adopted an order setting a public hearing to discuss and
review the same and determine whether to amend them;and
WHEREAS, on or before the date of the first publication of the notice of the hearing on the proposed
amendments,including the amount of the proposed impact fee per service unit, such information was made available
to the public;and
WHEREAS, the City Council held a public hearing to discuss the proposed amendments to the land use
assumptions, capital improvement plan and impact fees for water,sewer and thoroughfares;and
WHEREAS, the Advisory Committee, created under Section 395.058, Local Government Code, filed its
written comments on the proposed amendments to the land use assumptions, capital improvement plan and impact
fees for water, sewer and thoroughfares before the fifth(5th)business day before the date of the public hearing on the
amendments;and
WHEREAS, within thirty (30) days after the date of the public hearing on the proposed amendments to the
land use assumptions,the City Council, is approving amendments to the land use assumptions, capital improvement
plan,and impact fees for water and sewer charged per service unit;and
WHEREAS, Wylie has fully complied with Chapter 395,Local Government Code,to approve the proposed
land use assumptions,capital improvement plan,and impact fees for water and sewer charged per service unit;and
WHEREAS, the City Council finds that it is in the best interest of the citizens of Wylie to adopt such land
use assumptions and capital improvement plan and amend the impact fee for water and sewer.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE,
TEXAS:
SECTION 1: Findings Incorporated/Compliance with Law. The findings set forth above are incorporated
into the body of this Ordinance as if fully set forth herein.
This Ordinance is adopted pursuant to the provisions of Chapter 395, Local Government Code, and Article
11, Section 5, of the Texas Constitution.
The City Council finds that Wylie has fully complied with the notice, adoption, promulgation and
methodology necessary to adopt updated and revised land use assumptions and capital improvement plan and
establish amended impact fees as set forth herein.
SECTION 2: Land Use Assumptions Update. The proposed land use assumptions have been reviewed and
evaluated, and the City Council finds that the proposed land use assumptions, which is attached hereto and
incorporated herein for all purposes as Exhibit"A",should be and are approved.
SECTION 3: Capital Improvements Plan Update. The proposed capital improvements plan has been
reviewed and evaluated,and the City Council finds that the proposed capital improvements plan, attached as Exhibit
"B", should be and is approved.
SECTION 4: Amendment to Ordinance No. 97-4. Ordinance No. 97-4, Section IV is hereby amended to
read as follows :
The proposed impact fees have been reviewed and evaluated, and an impact fee of$ per
service or Living Unit Equivalent(LUE) for water supply, treatment, and distribution facilities is
hereby imposed in accordance with the LUE for water set out in Table 3A, Exhibit`B" attached
hereto and incorporated herein for all purposes. An impact fee of$ per service unit or
LUE for sanitary sewer collection and treatment facilities is hereby imposed in accordance with
the LUE for sanitary sewer set out in Table 3B,Exhibit`B".
SECTION 5: Inconsistent or Conflicting Ordinances. This Ordinance shall be and is hereby declared to be
cumulative of all the Ordinances of Wylie, and this Ordinance shall not operate to repeal or affect any other
Ordinances except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this
Ordinance, in which event, such conflicting provisions, if any, and such other Ordinances or Ordinances are hereby
repealed.
SECTION 6: Severability. Should any section, subsection, clause or phrase of this Ordinance be declared
unconstitutional or invalid by any court of competent jurisdiction,it is expressly provided that any and all remaining
portions of this Ordinance shall remain in full for force and effect. Wylie hereby declares that it would have passed
this Ordinance,and each section,subsection, clauses and phrases be declared unconstitutional or invalid.
SECTION 7:Effective Date. This Ordinance shall become effective , 2001.

1. Review and Consider a recommendation to the City Council regarding the draft report of
the 2001-2010 Water and Wastewater Capital Improvements Plan and Impact Fee Update
Thompson reported that the draft report, delivered to Committee members for the March 6, 2001
meeting, addresses the concerns and recommendations made by the Committee at their February
6 meeting. The March 6 meeting, when the final review of the draft report was scheduled, was
postponed until tonight because of the lack of quorum on March 6. He said that the report is still
scheduled to be presented to the City Council on Tuesday night, March 13, and invited
Committee members to attend the Council meeting to be recognized. The Council will call a
public hearing for April 24 as prescribed by State law.
Consulting engineer Jim Jenks, of the Hogan Corporation, explained maps and cost tables
illustrating anticipated expansions to water and wastewater systems. Minor modifications since
the previous meeting and review include expanded water services of the CIP in the north central
and northwest. Interest has been added to cost estimates as the Committee recommended, and
the participation ratios to determine the recoverable costs have been recalculated. Based on
these final assumptions, the maximum impact fee for water is $1,212 and for wastewater is
$2,446 or a total of$3,658. These maximum allowed figures will be provided to City Council
who may adopt that fee or any level lower.
Mr. Snider questioned why the fee had now doubled from that currently established. City
Engineer, Chris Hoisted, responded that the major cost is reflected in the new and expanded
treatment facilities, whereas the existing fee established over three years ago reflects largely less
expensive distribution facilities.
Mr. Ahrens asked what size of water meter the fees are based on, and whether the fee accounted
for varied meter sizes. Hoisted responded that the report is based on an average meter size of 3/4
inch. A very complex system is required to charge varied fees for varied meters, so the average
size is normally used.
Mr. Pullium asked what is the relationship between the impact fee and monthly charges. Hoisted
responded that the impact fee is established to recapture development costs and can not recapture
regular operation and maintenance costs.

Mr. George and Mr. Wiseman expressed concern that the population growth assumptions on
which the engineering master plans are based need to be as reliable as possible, and that other
costs and participation ratios will then also be reliable. They expressed concern that the growth
projections are low and should be made higher. Thompson responded that the population and
housing projections are similar to those estimated by the North Central Texas Council of
Governments for the larger region, which largely dictates Wylie's growth. These figures are
conservative, and can be more reliably established when the actual counts of population are
available later from the U.S. Census. Hoisted that the treatment facilities, which represent the
greater portion of the costs, are calculated for the maximum estimated growth, and will not likely
change significantly if population growth changes. The costs and fee schedule can be
recalculated and adopted at any time documented information reflects a need for revision.
Motion was made by Mr. Ahrens, seconded by Mr. Porter, to forward the draft report to the City
Council and to recommend that Council adopt the maximum fee. Motion carried 7-0.

INTRODUCTION
Pursuant to Chapter 395 of The Texas Local Government Code, this document presents
recommendations for a Water and Wastewater Capital Improvements Plan(CIP) for
determination of impact fees for the City of Wylie, Texas. Contained herein is data establishing
criteria for sizing of public water and wastewater system facilities and a description of the water
and wastewater facilities recommended to serve new development projected to occur in the City
over the next 10 years. Cost projections are provided for the proposed CIP, and calculations of
the maximum assessable water and wastewater impact fees are presented. All recommended
improvements, ultimate system configurations,typical usage rates, and capacity criteria conform
to the City of Wylie Water and Wastewater Master Plan, updated in 2001 (Master Plan)as
prepared by The Hogan Corporation.
The City of Wylie is primarily located in southern Collin County,Texas. Small portions of the
City are located in Rockwall and Dallas Counties. Wylie is situated between the City of Murphy
to the west, the City of Rowlett to the south, Lake Ray Hubbard to the east, and Lake Lavon to
the northeast. Figure 1 illustrates Wylie's location.
Figure 2 shows the ultimate land use that is projected for Wylie. It is based on the Ultimate
Land Use Plan that was generated as part of the City's Comprehensive Plan, dated 7/27/99. The
locations where growth is projected to occur from 2001 to 2010 are assumed to develop similarly
to what is displayed in the ultimate land use plan.
The calculated water and wastewater impact fees apply to all new development projected to
occur within the City's existing water and wastewater service areas from 2001 to 2010. The
water system service area is shown in Figure 3A, and the wastewater system service area is
shown in Figure 3B.
DEVELOPMENT PROJECTIONS
The recommended water and wastewater system improvements are those required to serve the
total projected 10-year development as presented in the"Land Use Assumptions for Impact Fees
2001-2010",prepared by the City of Wylie (included in Appendix A). This projected growth is
broken down by land use category in Table 1.
In the City's Land Use Assumptions document, it was projected that the population within the
Wastewater Service Area will increase by approximately 5,300 between 2001 and 2010.
According to City staff,the majority of that increase is expected to inhabit the following areas:
• Between McMillen Road and the north City limits
• East of Southfork Mobile Home Park
• Between West Brown Street, FM 1378 and the City limits
• North of Lakefield Drive
• Between Alanis Lane, Sachse Road, and the City limits
• Between the far east end of Alanis Drive and FM 544
• Between Sachse Road and Pleasant Valley Road

CAPACITY CRITERIA
The minimum requirements of the Texas Natural Resource Conservation Commission(TNRCC)
served as the baseline for identifying needed improvements in water supply, storage, and
pumping capacity. These requirements are presented in Table 2. Water mains were sized based
on the following assumptions:
Average daily per capita demand: 150 gal
Capita per equivalent single family connection: 2.3
Ratio of developable area/total area: 80%
Peak hourly demand: 1.5 gal/min/connection
Needed wastewater line sizes were determined based on the following assumptions:
Average daily per capita wastewater generation: 110 gal
Average daily pier capita inflow/infiltration allowance: 20 gal
Capita per equivalent single family connection: 2.3
Ratio of developable area/total area: 80%
Peaking factor(Babbitt's Formula): M=5/p0.167
where: M=ratio of maximum to average rate of flow; and,
P=contributing population in 1,000's.
(Note: Maximum peaking factor used was 5)
Minimum Flow velocity: 2.0 ft/sec

projects recently designed or constructed:

• New pump facilities at Nortex Water Plant (J)
• Water lines extending from Nortex Water Plant along Westgate Way and FM 544 to the
Decker Court Elevated Storage Tank(P,Q,R)
• Decker Court Elevated Storage Tank(S)
• Water line extending southward from Alanis Drive around Southfork Mobile Home Park(N)
The locations of recommended Water CIP projects are shown in Figure 3A, and cost projections
are presented in Table 3A. For lines sized to provide capacity in excess of what is needed by the
local area served, costs were broken out between a"base"cost(for local service)and an
"oversize"cost(for systemwide service). Segment identifiers are provided on the exhibit map to
aid in cross-referencing to the tabular data. Projects recently designed and/or constructed are
marked with a check mark beside the identifier. Cost information for existing projects was
provided by City staff, and cost projections for proposed projects were generated using unit
prices submitted by contractors for recent similar projects in the area.
Wastewater System
The recommended Wastewater System CIP is comprised of the following projects, which include
projects recently designed or constructed:
• Muddy Creek Regional Wastewater Treatment Plant, Phase I. This phase is being designed
to treat a combined five million gallons per day of wastewater from the Cities of Wylie and
Murphy. (A)
• Wastewater lines from Newport Harbor area and West Brown Street to Muddy Creek
Interceptor(C, D)
• Muddy Creek Interceptor Phase I, and Extensions of same to Alanis Drive and Muddy Creek
Regional Wastewater Treatment Plant(E,F,G,W,X,Y)
• A connected series of wastewater lines, lift stations,and force mains beginning near Old
Highway 78 and Brown Street and extending generally southwesterly to the Muddy Creek
Regional Wastewater Treatment Plant. This includes the new Rush Creek Lift Station
currently being designed. (H,I,J,K,L,M,N,O,P)
• A similarly connected series, beginning near the intersection of the Collin, Rockwall, and
Dallas County lines and extending generally westerly to the Muddy Creek Regional
Wastewater Treatment Plant. (Q;R,S,T,U,V)
The locations of recommended Wastewater CIP projects are shown in Figure 3B and cost
projections are presented in Table 3B. Identification symbology is similar to that for the Water
System CIP. Cost information for existing projects was provided by City staff, and cost
projections for proposed projects were generated using unit prices submitted by contractors for
recent similar projects in the area.

SERVICE UNIT EQUIVALENT
The service unit equivalent for the water and wastewater impact fee is recommended to be
defined as the water demand and wastewater discharge associated with an equivalent single
family residential connection(ESFC). The equivalent densities (related to various types of
residential and non-residential development) are listed in Table 1. Standard population factors
and flow rates associated with the ESFC for water and wastewater are listed in the "Capacity
Criteria" section above.
MAXIMUM IMPACT FEE
The maximum assessable impact fee for water and wastewater is defined as the total projected
CIP cost divided by the total number of service units (ESFC's). Interest costs, eligible under the
law,have been incorporated using information provided by City staff. The maximum water and
wastewater impact fees that can be charged by the City of Wylie are presented below. Detailed
breakdowns of the impact fee calculations are provided in Table 3A and Table 3B.

The City of Wylie currently charges impact fees of$700 per"living unit equivalent" for water
and$1,412 per"living unit equivalent" for wastewater, according to Ordinance No. 98-16,
which, according to the City of Wylie, was signed and adopted June 9, 1998.
IMPACT FEES IN OTHER CITIES
As a point of reference and comparison, a survey of the water and wastewater impact fees
charged by other local cities was performed. Table 4 presents the information that was provided
by those cities.

LAND USE ASSUMPTIONS
FOR DEVELOPMENT IMPACT FEES
2000 - 2010
PURPOSE
Chapter 395 of the Texas Local Government Code authorizes cities in Texas to
assess impact fees against new private development in order to fund or recapture
the public costs of capital improvements or facility expansions required by and
attributed to such new development. The City of Wylie instituted a.development
impact program in June of 1990. Wylie has revised its development impact fee
program periodically as required by the State enabling legislation.
The State legislation requires that the impact feeste based on sound assumptions
of future land use and population growth and that these assumptions be regularly
updated. It is the purpose of this report to document the methodology used for
establishing the land use and population assumptions utilized to set the City of
Wylie's impact fee structure. The report presents a reasoned estimation of Wylie's
future growth and, therefore, demand for public utilities and infrastructure for the
time period from 2000 to 2010. For purposes of determining a fair impact fee
structure, these development growth projections are based on assumptions of the
type, location, quantity and timing of various future land uses in the community.
These assumptions will become the basis for the preparation of capital improvement
plans for water and wastewater facilities which are to be funded by impact fees.
This report investigates several major indicators of physical development and
population growth within the service area of Wylie's water and wastewater systems
and, therefore, the area subject to impact fees. This service area includes the
majority of the area within the present City Limits and a minor part of the City's
Extraterritorial Jurisdictional Area.
BASE DATA INVENTORY
These assumptions of future'land use and population growth take into consideration
several factors influencing development patterns, including:
1. The character, type, density and quantity of existing development.
2. The history and pattern of private development.
3. Existing zoning patterns which direct land use patterns.

4. The Comprehensive Plan and recommended Future Land Use.
5. The availability and character of vacant land for future expansion.
6. The capacity of the City to accommodate land uses and population.
LAND USE: Every parcel of land within the water and wastewater service area has
been classified according to its land use. A field survey was conducted in 1990 to
support the initial formulation of impact fees. This information was updated for a
revision to the Impact Fee Land Use Assumptions in 1996 by using City records of
zoning changes and building permits. The land use inventory was again completely
updated in 1999 as a base for preparation of the revised Comprehensive Plan.
Table 1 shows a summary of existing land uses for the service area updated as of
December 2000. The total land within the service area is 10,126 acres. Of this total,
3,097.67 acres, or 37.78 percent of the total -service area, are developed.
Developed land uses are categorized by the type-groups by which impact fees are
charged. A graphic presentation of existing land use patterns is shown on the
Existing Land Use map in the Comprehensive Plan.

BUILDING PERMITS: When Impact Fees were first established in 1990, there were
3,499 dwellings within the Wylie service area, comprised of single-family detached,
duplex, mobile home, apartment and townhouse units. Between 1990 and 1996,
959 building permits for single-family dwellings had been issued, bringing the total
estimated dwelling units to 4,458. Table 2 reflects the steady growth in the issuance
of single-family building permits since that last report of land use assumptions in
1996. Adding these units to the 1996 housing stock, it is estimated that there are
currently a total of approximately 5,838 residential dwelling units within Wylie's
service area. At an average of 2.3 persons per household, these existing dwelling
units can support a current population of approximately 13,427 persons.

In addition to residential land for dwellings, these Wylie residents use additional
other land for work places, shopping, schools and leisure, etc. The current
relationship of land uses to population within Wylie is shown by Table 3, as a ratio of
land used per 100 persons of the existing population.

POPULATION: The U.S. Census provides an accurate count of population every
ten years. Unfortunately, the 2000 Census counts have not been made available at
the time this publication was compiled.
For each year between these census counts, the North Central Texas Council of
Governments estimates population for regional municipalities by compiling the
number of new dwelling units recorded by building permits and multiplying this
number by the average household size as determined by the last census. Wylie
reflects steady growth in population during the last three decades, as have Collin
County and the nine-County North Central Texas region. Wylie's population growth
potential is closely related to and determined by that of the larger area of which it is
a part. NCTCOG estimates the current population of Wylie to be 13,250 persons.
Table 4 illustrates the historic and projected growth of Wylie and the region.

PROJECTIONS
Based upon the basic development-related information discussed above, estimates
of the amount of land which may logically be expected to develop in the near future
as well as the population which that land use can support may be projected with
some confidence. The following discussion reflects the anticipated growth of Wylie
at ultimate or complete build-out as well as the ten-year future target as required by
the Impact Fee enabling legislation.
ULTIMATE PROJECTIONS
In order to provide a basis of calculation for Master Plans for water and wastewater
services to Wylie's potential total population, as well as to ensure that the required
10-year growth and service projections of the Capital Improvements Program do not
exceed the total development potential of the service area at build-out when all of
the developable land within Wylie is utilized, it was necessary to determine the full or
ultimate development potential for the service area. These projections include both
the ultimate development pattern (as recommended by the Comprehensive Plan)
and the population which those land uses will support.

LAND USE: Ultimate land utilization was projected based upon the recommended
patterns and intensities of the Comprehensive Plan. Acreages were calculated for
individual land use categories as proposed on the Future Land Use Map, and
according to the current ratios reflected on Table 1. Floodplain which cannot be
developed was calculated into the Open Space category or into the acreage of the
adjoining uses. These land use projections for the totally developed community at
build-out are shown on Table 5.

POPULATION: The above land use projections estimate that approximately 4,708.6
acres of land will be used for low- and medium-density residential use at build-out.
For purposes of estimating population for this low- and medium-density residential
use, a factor of 4.3 dwelling units per acre is used. The ultimate anticipated high-
density residential use is 749.3 acres, and can be expected to develop at a
maximum of 15 units per acre. The following summarizes the estimated dwelling
unit projections:
Low- and Medium-Density
Residential - 4,708.6 acres at 4.3 units / acre = 20,247 units
High Density
Residential - 749.3 acres at 15.0 units/acre = 11,239 units
Total Units at Build-Out- 31,486 units
The ultimate future population will be dependent upon the number of persons per
dwelling unit or household as well as the number of dwellings developed (31,486).
The current household size of the Wylie population is estimated by NCTCOG to be
2.3 persons per household, and this factor is used for purposes of estimating the
ultimate population holding capacity. The estimated population at build-out using
these factors is 72,418 persons.

TEN-YEAR PROJECTIONS
The State legislation enabling local municipalities to establish development impact
fees requires that land use and population assumptions/projections be calculated for
at least a ten-year future period. The following describes the projections for Wylie to
the year 2010.
POPULATION: During the past ten-year period, Wylie has added an average of
230 single-family dwelling units per year. At the current average household size of
2.3 persons, this past growth represents 5,290 persons. If Wylie continues to grow
at this historic rate, the population in the year 2010 will be 18,540. The North
Central Texas Council of Governments estimates that the 2010 population of Wylie
will be 18,550 persons. This figure reflects approximately a 40 percent increase
over the estimated current population. These:ten-year growth estimates, produced
by different methodologies, compare favorably and are presumed reliable.
Therefore, the NCTCOG estimate of 18,550 will be used to project land use needs
and water and wastewater demands.
LAND USE: The amounts of new land required to serve this year-2010 population
of 18,550 persons is an additional total of 1,542.3 acres. In response to recent
development trends, residential uses are projected at 3 dwellings per acre for low-
and medium-density and 10 dwellings per acre for high-density. All other land uses
are estimated at the utilization ratios of the current population (Table 3). The total
new land development anticipated to be required to serve the year-2010 population
is reflected on Table 6.

Background
The Rules of Procedures for the Planning & Zoning Commission were adopted in 1998. Section
10.2 of the Rules states:
Any Commission member missing three (3) consecutive regularly scheduled meetings
without a valid excuse which includes illness, death in the family, or emergency shall be
subject to dismissal from the Commission.
The City Charter states that "...if any member is absent from three (3) consecutive meetings, his
position is declared vacant..." Board member Phillip Trammel has missed five (5) consecutive
meetings and is therefor subject to replacement.
Other Considerations
Article III of the City Charter gives the City Council the authority to appoint boards and
committees, as it deems necessary. Section 211.007 of the Local Government Code establishes
the authority of municipalities to create and make appointments to the Planning & Zoning
Commission.

Issue
Consider and act upon an appointment of an alternate member to the Zoning Board of Adjustment
Background
As established by the City Charter, the Board of Adjustment consists of five members and two
alternate members. In June of 2000 one of the individuals appointed as an alternate subsequently
resigned the position. The position has remained vacant until this time.
The structure of the Board of Adjustment varies from other bodies in that a vote of 75% of the
membership (four members) is necessary to approve a variance or overturn a staff decision.
While the attendance of the existing Board members has been good, it can present difficulties
when only four members are in attendance. Filling the unexpired term of the alternate member
will assist the Board in being able to effectively carry out their responsibilities.
Other Considerations
Article III of the City Charter gives the City Council the authority to appoint boards and
committees, as it deems necessary. Section 211.008 of the Local Government Code establishes
the authority of municipalities to create and make appointments to the Board of Adjustment.

Issue
Consider and act upon a waiver of alleys and a Final Plat for the Twin Lakes Phase IV Addition,
generally located south of Alanis Drive and east of South Ballard Avenue (FM 2524), to the east of
Twin Lakes Phase I, being all of a certain 32.782 acre tract situated in the Allen Atterberry Survey,
Abstract No. 23, City of Wylie, Collin County, Texas.
Background
The Final Plat for Phase IV of the Twin Lakes Addition includes 32.782 acres and will create a total
of 103 lots. The portion north of Alanis Drive is zoned Single-Family Residential-3 (SF-3) and
creates 35 lots of a minimum size of 7,200 square feet. The portion south of Alanis is zoned Single-
Family Residential-2 (SF-2) and creates 68 lots of a minimum size of 8,500 square feet. Most lots
significantly exceed these required minimums.
Phase I of the Twin Lakes Addition was initially platted and developed prior to 1987, and that phase
incorporated alleys. A Preliminary Plat for Phase II, which includes the area currently under
consideration as Phase IV, was approved in 1988, but no final plats were approved and no further
development occurred at that time beyond the Phase I. Another version of a Phase II Preliminary
Plat for the overall tract, very similar to the 1988 version, was approved by the Planning and Zoning
commission in January of 1998 and by the City Council in February of 1998. That 1998 Preliminary
Plat included alleys.
The subject Final Plat substantially conforms to the Preliminary Plat approved in 1998, except that
the current plat does not include alleys. However, two subsequent phases of the Twin Lakes
Addition have been approved and developed without the required alleys. A smaller Phase II was
completed in August of 1998 and Phase III was completed in November of 2000. The infrastructure
was accepted by the City and Final Plats were filed with the County for both of the phases with no
alleys.
The applicant contends that the City Council specifically granted a waiver of alleys for the Final Plats
of both Phase II and Phase III (which were developed and accepted without alleys) as well as the
Phase IV (currently under consideration) and a future Phase V. However, neither the City staff nor
the applicant has been able to document the issuance of such an alley waiver.
The applicant is requesting a waiver of the alley requirement for the subject Final Plat of Phase IV.
Section 2.9 of the Paving Standards states that"Alleys shall be provided in all residential areas and
shall be paved with concrete. The City Council may waive the residential alley requirement upon
determination by the Council that it is in the best interest of the City."
Financial Considerations
The Final Plat application fee has been paid. The applicant is aware that impact fees must be paid
before the Final Plat can be filed with Collin County. Water- $72,100 Sewer - $145,436
Other Considerations
• As submitted without alleys, the Final Plat does not conform to the approved Preliminary Plat or
to the Subdivision regulations of the City of Wylie, both of which require alleys.
• No documentation is available to explain why alleys were not required in two phases which have
been approved and accepted by the City, although alleys are required by the code, illustrated on
the Preliminary Plat supporting these phases, and alleys are included in the addition's Phase I.
Board/Commission Recommendations
At the April 17, 2001 Planning and Zoning Commission meeting, the Commission voted 3-2 to deny
the Final Plat because it conflicts with the City's alley requirements. Also, on this same agenda was
a request for an alley waiver for Twin Lakes Phase V, which was withdrawn by the applicant.
Pursuant to Section 35.5(2) in the City of Wylie's Code of Ordinances, a 3/4 majority vote by the City
Council is required for approval to overturn the recommendation of denial by the Planning
Commission.
Staff Recommendations
Denial. The Final Plat does not comply with the requirement of the Paving Standards that residential
subdivisions provide alleys. The Department of Development Services, Public Works and fire concur
with this recommendation.

Dear Claude,
This letter is in reference to our meeting of April 5, 2001 regardinc2 the issue of alleys within our
Twin Lakes development. As stated previously, I acknowledge that our preliminary plat depicts
alleys, however, the City, prior to our first phase of development issued an alley waiver. As
requested, we (Zena and Corwin engineering) have reviewed our files and cannot locate any
documents related to this issue and assume that your staff was unsuccessful as well. In spite of
this, we are confident in our claims that an alley waiver was issued. As evidence of this, it may be
noted that the only changes made from the preliminary plat to the final plats has been the deletion
of alleys. There has been no re-alignments or layout of lots or right-of-ways on the previous or
the current final plats. Furthermore, in reviewing the minutes from previous P&Z and Council
hearings I have found no discussions of or data to support the issue at hand. We have also
completed those previous phases in succession without notice or discussion of alleys.
Additionally, we had a pre-submittal meeting on March 29th, 2001 to discuss any items that may
be of concern related to our proposed Phase IV development. At that time there was no discussion
of alleys.
I understand the purpose of your request and unfortunately cannot produce documentation to
substantiate the previous three years of development in this project. As requested, and in light of
this unfortunate circumstance I am formally requesting an "ALLEY WAIVER" for our TWIN
LAKES PHASE IV development scheduled for the April 17, 2001agenda.
I also request that you place on the agenda a separate "ALLEY WAIVER" for our final phase of

Background
Assumptions that form the basis of revenue and expenditure projections are made in August preceding
the adoption of the budget in September. The mid-year review process enables the City to determine
the validity or accuracy of the assumptions. The process also contemplates that the City operates in a
dynamic environment and that actions are required to appropriately respond to the change in conditions.
This represents a change to both revenues and expenditures.

NARRATIVE
GENERAL FUND
REVENUES
• $22,000 in Intergovernmental Revenue — COPS Grant. The Federal Government
has awarded the City another COPS grant. A police officer will be added to the force
who will also serve as a part-time School Resource Officer until the second junior
high school is opened and the position will become a full-time School Resource
Officer. Approved by City Council 3/13/2001.
• $7,000 in Transfers in from Economic Development. The City Manager's
Secretary is providing secretarial services to Economic Development at the cost of
$1,000 per month beginning March 1, 2001.
EXPENDITURES
City Manager
• $27,500 for Personal Services. These funds are needed to fund additional costs to
the department as a result of the addition of the Public Information Officer position.
Approved by City Council 3/13/2001.
• $7,000 for Personal Services. The City Manager's Secretary is providing secretarial
services to Economic Development at the cost of$1,000 per month beginning March
1, 2001. Funding for this item is recognized as a revenue transfer from Economic
Development Corporation, see above revenue.
• $2,500 for Supplies. These funds are needed to fund additional miscellaneous
supplies for use by the Public Information Officer. Approved by City Council
3/13/2001.
• $2,500 for Contractual Services. These funds are needed to fund additional
miscellaneous contractual services needed by the Public Information Officer.
Approved by City Council 3/13/2001.
• $30,000 for Purchase of Land. These funds will be used to purchase property on
South Jackson Street for extension of Old City Park. Approved by City Council
2/13/2001.
Police
• $22,000 for Personal Services. The Federal Government has awarded the City

Fire
• $10,000 for Major Tools & Equipment. The Fire Department replaced its pontoon
boat. This was budgeted in FY2000, but not purchased until FY2001. Approved by
City Council 9/12/2001.
Building Inspections
• ($5,500) for Capital Replacement Fees. These fees are for vehicles used by the
Utility Inspectors and the expense is being transferred to the Engineering Department
in the Utility Fund.
Recreation
• ($7,140) for Personal Services. This is the amount that will be saved in the
Recreation Department by the elimination of the part-time Senior Citizens
Coordinator position. The full-time Community Center Coordinator is now handling
this. These savings will help to offset the cost of the Public Information Officer
position.
Library
• $2,000 for Personal Services, These funds are needed to cover extra hours worked
by part-time personnel in the Library to ensure adequate staffing during the hours the
Library is open.
Building Inspections
• $45,000 for Computer Hardware & Software. This hardware and software will be
used to track and record permit and inspection activities on a computer database and
will enable the City to keep much more detailed information and keep problems and
issues from falling through the cracks as construction activity levels continue to
increase.
• $4,900 for Personal Services. This is to provide certification pay for 6 months of
$350 per month plus benefits to two inspectors who have a Texas Plumbing License.
• $700 for Personal Services. This is to provide certification pay to inspectors who
have achieved any of the four following certifications: Building, Mechanical,
Electrical and Plans Examiner. The pay is $25 per month per certification and the
$700 provides pay for 3 inspectors with all 4 certifications for 6 months plus benefits.
• $2,420 for Personal Services. This is the amount needed to reclassify the Permit
Clerk to Permit Technician. The Permit Clerk is now responsible for review and
approving fence permits, lawn irrigation permits and accessory building permits.

EXPENDITURES
Utility Administration
• $38,630 for Personal Services. Original FY2001 Budget did not the include salary
and benefit costs(50%) for the Director of Development Services budgeted position.
• ($130,190) for Personal Services. Transfer of salary and benefit costs for three
utility inspectors to Engineering.
Engineering
• $232,900 for Personal Services, Supplies, Maintenance, Contractual Services and
Capital Outlay. The City Council made a decision to hire a full-time Engineer as of
October 1, 2000. These funds are needed to set up the new department and budget
that includes all expenses for the City Engineer and three Utility Inspectors.
Approved by City Council 9/26/2000.
Utilities
• $4,400 for Personal Services. These funds are needed for the reclassification of an
Equipment Operator in the Utilities Department to Crewleader. With the growth of
the City, an additional crewleader position has now become necessary. The
department will now have one crewleader for Water and one for Wastewater.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE
BUDGET FOR THE FISCAL YEAR 2001 BEGINNING OCTOBER 1, 2000,
AND ENDING SEPTEMBER 30, 2001, BY AMENDING ORDINANCE NO.
2000-18; REPEALING ALL CONFLICTING ORDINANCES; CONTAINING
A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, the City Council has heretofore adopted Ordinance No. 2000-18 adopting a
Budget and appropriating resources for Fiscal Year 2001 (FY2001) beginning October 1, 2000,
and ending September 30, 2001; and,
WHEREAS, the Staff has presented information to the Council concerning the actual
income and expenses for the first half of FY2001 and made comparisons of such information to
the heretofore budgeted projections; and,
WHEREAS,based upon such review the Staff has recommended to the Council that certain
amendments to the Budget, as hereinafter set forth, be made to facilitate operation and
administration of the operations of the City for the balance of FY2001; and,
WHEREAS, the Council has the authority to make amendments to the City Budget under
Article VII, Section 4 of the City Charter, as well as State law; and,
WHEREAS, the Council has determined that the proposed amendments to the FY2001
Budget, with the revenues and expenditures therein contained, is in the best interest of the City
and therefore desires to adopt the same by formal action;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE
CITY OF WYLIE, TEXAS, as follows:
SECTION I
The proposed amendments to the FY2001 Budget of the City of Wylie, as heretofore
adopted by Ordinance No. 2000-18, as summarized in Attachment 1 which is attached hereto and
fully incorporated herein by reference, be, and the same hereby are, completely adopted and
approved as amendments to the said FY2001 Budget.
SECTION II
All portions of the existing FY2001 Budget and Ordinance No. 2000-18, except as
specifically herein amended, shall remain in full force and effect, and not be otherwise affected
by the adoption of the amendatory ordinance.
SECTION III
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of
this ordinance as a whole or any part or provision thereof, other than the part or parts as declared
to be invalid, illegal, or unconstitutional.
SECTION IV
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION V
That all other ordinances and code provisions in conflict herewith are hereby repealed to the
extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not
in conflict herewith shall remain in full force and effect.
SECTION VI
The repeal of any ordinance, or parts thereof, by the enactment of the Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to
accrue, nor as affecting any rights of the municipality under any section or provision of any
ordinances at the time of passage of this ordinance.
