1. Hold the first of two Public Hearings for the Annexation of: Tract 1, a 49.277 acre tract of land
situated in the Allen Atterberry Survey, Abstract No. 23 and the Aaron West Survey,Abstract No.
979, Collin County Texas; and Tract 2, a 1.041 acre tract of land situated in the Aaron West
Survey, Abstract 979, Collin County, Texas; and generally located east of FM 544 and north of
Wheelis Road.
Ms. Mindy Manson, Assistant City Manager, stated provided a brief background on the request for annexation.
She stated that the applicant was not present this evening, but would be present for the second public hearing
scheduled for tomorrow evening, August 14, 2001.
The Mayor then opened the public hearing and asked that anyone wishing to speak either in favor or opposition of
the annexation request to please come forward, state their name and address for the record and limit their
comments to three minutes. With no response,the Mayor then closed the public hearing.

The Mayor made the presentation of a Proclamation Celebrating the life of Marissa Amaya and Officially
Declaring the Day of August 14, 2001 as Marissa Amaya Day in the City of Wylie. Present to accept the
proclamation were Marissa, her parents and grandparents. Police Chief Jeff Butters and Lt. Mike Davis made a
special presentation to Corporal Curtis Smith, Wylie Police Department, for his role in the efforts that resulted in
saving the life of Marissa Amaya.
A. Approval of the Minutes from the Regular Meeting of July 24,2001.
Councilman Scott asked for an addition to the minutes. He referenced page 3, Item No. 5 of the July 24, 2001
minutes. Councilman Scott asked that we include within Councilman Trout's motion the reference to the
applicant's 30-day waiver. With no further additions or corrections, Councilman Hogue made a motion to approve
the Minutes from the Regular Meeting of July 24, 2001. Councilman Scott seconded the motion. A vote was taken
and the motion was approved, 7-0.
A motion was made to remove Item No. 1 from the table for Council consideration and action.
1. Consider and act upon a Preliminary Plat/Development Plan for the Country Ridge Estates
Addition (Planned Development District 2001-24), generally located west of Country Club Road
(FM 1378)and north of McMillen Road (CR 298),being a 99.7418 acre tract described in the deed
to Fredrick Veninga, Trustee according to the deed recorded in Volume 883,Page 628 of the Deed
Records of Collin County, and being situated in the William Patterson Survey, Abstract No. 716,
City of Wylie, Collin County,Texas.
Mr. Claude Thompson,Planner,provided Council with a brief background of the request. He stated that this item
had been before Council at the July 24,2 001 meeting and was tabled by the City Council at the request of the
applicant.

The approved PD included a Concept Plan,which limits the development to a total of 312 lots, and the Conditions
of the PD establish the minimal width and side yard setback for the lots. The PD Conditions also establish a
minimum house size of 2,000 square feet.
Mr. Thompson stated that staff has reviewed the Preliminary Plat/Development Plan for the Country Ridge
Addition and concludes that it conforms to the Council-approved Concept Plan of the Planned Development
District, and to be in technical compliance with all applicable State subdivision regulations as well as with the
Subdivision Ordinance and all other pertinent regulations of the City of Wylie.
Mr. Thompson stated that at the July 3, 2001, Planning and Zoning Commission meeting, the Commission voted
5-0 to recommended approval of this case subject to street name changes. Staff also recommends approval and
the Department's of Public Works, Fire, and Development Services concur with this recommendation. Mr.
Thomspon was then available for any questions or concerns of the Council.
Councilman Worley made a motion to Preliminary Plat/Development Plan for the Country Ridge Estates Addition

Councilwoman Allen made a motion to accept the resignation of Councilman Scott from the Parks and Recreation
Facilities Development Corporation and appoint Mr. Jules Farmer, Parks and Recreation Board Member to the
vacancy created, for a term expiring in July of 2003. Councilman Trout seconded the motion. A vote was taken
and the motion was approved, 7-0.
3. Consider and act upon a request by The Shaddock Companies to waive a portion of the Impact
Fees for the Country Ridge Estates Addition.
City Attorney, Mr. Richard Abernathy, asked that the Mayor authorize an Executive Session pursuant to Local
Government Code 551.074, Consultation with City Attorney, on a matter in which the duty of the attorney to the
governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly
conflicts with this chapter.
The Mayor then convened into Executive Session at 6:19 p.m., in accordance with Local Government Code
551.074,Consultation with the City Attorney.
The Mayor and Council reconvened into open session at 6:35 p.m. for consideration and action on Agenda Item
No. 3.
Mr. Claude Thompson addressed this item, providing a brief background on the waiver requested. Mr. Thompson
stated that staff was recommending denial of the waiver for the following reasons. The applicant has not
demonstrated either 1)error in the procedure used by the City to revise or assess the impact fees, 2) or a hardship
(other than self-imposed economic loss) in complying with the impact fee assessment, 3) or the achievement of
any special public goal which would merit substitution or credit for the fee assessment.
Councilman Scott made a motion to deny the request from the Shaddock Company to waive a portion of the
Impact Fees for the Country Ridge Estates Addition. Councilwoman Allen seconded the motion. A vote was
taken and the motion to deny was approved,7-0.

4. Hold a Public Hearing to consider and act upon approval of a change in zoning from Public (P) to
Retail (R),for a 1.263 acre tract generally located at Williams and Birmingham Streets,situated in
the S.B.Shelby Survey,Abstract No. 820,being part of Lot 1 and all of Lots 2,3,4,5 and 6 of Block
5 of the Calloway Addition, City of Wylie, Collin County, Texas, and being certain tracts conveyed
to the Wylie Independent School District recorded in Volume 337,Page 21; Volume 337,Page 19;
Volume 335, Page 118; Volume 333,Page 160; Volume 337,Page 17 and the remainder of a tract
recorded in Volume 333,Page 48 of the Deed Records of Collin County, Texas. (Zoning Case No.
2001-08)
Mr. Claude Thompson, Planner, provided Council with a brief background on the zone change request. Mr.
Thomson stated that the applicant is requesting rezoning of the subject property in order to expand the banking
facility(American National Bank of Texas) currently located on the adjacent property. He stated that the property
is currently zoned Public (P)District and is occupied by the Transportation Center(bus storage and maintenance)
of the Wylie Independent School District. The property is platted as part of Lot 1 and all of Lots 2, 3, 4, 5 and 6 of
Block 5 of the Calloway Addition,and totals 1.263 acres in size.
Mr. Thompson provided a description of the surrounding properties. He stated that the properties to the north are
zoned for Retail (R) uses and are developed on separate freestanding lots with the bank, a multi-tenant
professional office center and a drive-in restaurant. The property to the east, across Birmingham Street, is zoned
for Single-Family Residential (SF-3) uses and occupied by a church. The property to the south, across Williams
Street, is zoned Public (P)and developed for school uses (the expanding Hartman Elementary). The properties to
the west, across Williams Street, are zoned and developed for Retail (R) and Business-2 (B-2) uses of an
automotive nature. Mr. Thompson stated that of the 23 public comment forms, one form was returned, favoring
the proposed rezoning.
Mr. Thompson stated that the Comprehensive Plan recommends Mixed Uses for the subject property. The Plan
defines the Mixed-Use category as commercial,retail and office, institutional or village centers residential uses or
some combination of these,but allowing no industrial uses. The financial business anticipated by this rezoning is
consistent with this recommendation of the Plan. Although the current Zoning Ordinance contains no provision
for the Public (P) District, this District is used on the Official Zoning Map to indicate school functions and other
public uses such as parks, the library, waste water treatment plant and land fill which are normally allowed by
right in all zoning districts. However, case law has concluded that such single-function, limited user zones are
inappropriate, and the Public District will be eliminated when revisions to the Zoning Ordinance and Map are
adopted. The several lots of the subject property and bank property must be replatted to create a single lot of
record prior to the issuance of any building permits for either a free-standing development confined to the subject
property or expansion of the bank on to these properties.
Mr. Thompson stated that at the August 7, 2001 Planning and Zoning Commission meeting, the Commission
voted 7-0 to approve the zone change request. Staff is recommending approval and the proposed zoning and land
use is consistent with the Comprehensive Plan and compatible with the surrounding existing development and
zoning;The Department's of Development Services,Public Works,and Fire concur with this recommendation.
The Mayor then opened the public hearing asking that anyone wishing to speak either in favor or opposition of the
request, please come forward, state their name and address for the record and limit their comments to three
minutes.
The Mayor stated that Mr. Marvin Fuller was present to address this item,however,his schedule did not allow him
to remain for this item. Mr. Fuller's comments were read into the record. Mr. Fuller asked that the Council
consider and approve the zone change request.

Issue
Conduct a public hearing on the proposed tax rate for fiscal year 2001-2002 and provide taxpayers an
opportunity to express their views on the tax rate. At the end of the hearing, the City Council must set
and announce the date, time and place of the meeting at which it will vote on the final proposed tax rate.
Background
In accordance with the "Truth in Taxation" laws of the State of Texas, on August 7, 2001, the City
Council took a roll call vote on the proposed tax rate and scheduled a public hearing on the tax rate for
August 28, 2001. The results of the record vote on the proposed tax rate and the notice of the public
hearing were published in the Wylie News on August 15, 2001. This public hearing has been advertised
in compliance with the publication requirements set forth in the Truth in Taxation Law.
The purpose of the public hearing on August 28, 2001, is to give the taxpayers an opportunity to express
their views on the tax rate. The City Council may not adopt the tax rate at this hearing. Instead, at the
end of the hearing, it must set and announce the date, time and place of the meeting at which it will vote
on the final proposed tax rate. The second public hearing will be on September 11, 2001, to vote on the
final tax rate. After the August 28, 2001, meeting and before the meeting scheduled for the final tax
vote, the City Council must publish a second quarter-page notice, "Notice of Vote on Tax Rate."
The official detailed effective tax rate calculations are available in the office of the Collin County Tax
Assessor/Collector (Kenneth L. Maun) in McKinney. A copy is also maintained in the Finance
Department for the Council and public to view.
Financial Considerations
The proposed budget is based on the proposed tax rate of$0.72 per $100 valuation. This is the rate
previously discussed by the Council. Any change in the proposed tax rate will require revision of the
proposed budget.
Other Considerations
The City is required by law to follow certain meeting and notice (publication) guidelines as shown on
the attached calendar excerpt from the "Truth in Taxation" guide.
Staff Recommendation
It is recommended that the City Council schedule the next required public hearing on the tax rate for
September 11, 2001, after the close of the public hearing.

The City of Wylie will hold a public hearing on a proposal to increase total tax revenues
from properties on the tax roll in the preceding year by 12.13, percent.Your individual
taxes may increase at a greater or lesser rate,or even decrease, depending on the change
in the taxable value of your property in relation to the change in taxable value of all
other property and the tax rate that is, adopted..

wholesale price increase from the North Texas Municipal Water District.
Background
The City of Wylie currently purchases water from the North Texas Municipal Water District (NTMWD)
at $.719 per thousand gallons. The above rate was established in 1993 and has remained unchanged for
nine years. NTMWD notified the City on July 27, 2001 that the rate would be increased to $.80 per
thousand effective on October 1, 2001.
In order to keep the citizens of Wylie informed there will be two press releases to announce the proposed
rate increase. The first announcement will appear in the Wylie News as soon as possible after the
ordinance is passed. A second will appear about one week before the new rates are first billed.

Attached is a summary of the current and the proposed new utility rates. The eight-cent increase is only
applied against water usage greater than one thousand gallons. There is no increase in minimum water
rates. The 2001-02 fiscal year increase in revenue is expected to be $70,000. Residential water customers
with an average usage of 8,000 gallons per month will see an increase of approximately $.48 on their
water bill. Commercial customers will see an estimated increase of$.63 per month based on 15,000
gallons of consumption. This rate increase will be effective on October 1, 2001 and will first appear on
customers' bills in November 2001.

Dear Mr. Johnson:
To assist the City of Wylie in the preparation of its FY 2002 Annual Budget, the District is
providing preliminary estimates of cost for FY 2002.
The Member City Water Rate for the Regional Water System is expected to be adjusted from $.719
to $.80 per 1,000 gallons beginning October 1, 2001. Also, preliminary cost for the Wylie
Wastewater Treatment Plant, Muddy Creek Wastewater Treatment Plant and Wastewater
Pretreatment Program is estimated to be $545,781, $763,333 and $16,170 respectively.
These estimates are based on the best information available to the District at this time and are subject
to change as the District continues to develop its FY 2002 Annual Budget. Upon adoption, the
District will provide a copy of the adopted FY 2002 Annual Budget and a final schedule of payments
to be made during FY 2002.

WHEREAS, the North Texas Municipal District has increased its
wholesale water rate from $.719 per thousand gallons to $.80 per thousand
gallons effective October 1, 2001; and
WHEREAS, the City desires to raise the charges for water services
provided by the City so as to pass along the wholesale water increase to its
customers;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
City of Wylie, TEXAS, as follows,
SECTION 1
The Section 1.02 of Appendix C to the Code of Ordinance of the City of Wylie,
Texas, is hereby amended by deleting the existing section, in its entirety and
substituting the following therefore:
(a) The following monthly water rates, shall apply to all RESIDENTIAL
customers within the corporate limits of the City of Wylie, Texas:

determined as of the fifth day of the month preceding the billing.
(d) The monthly water charge for any customers (residential, commercial,
apartment, mobile home park, or other multi-unit dwelling not individually
metered) located outside the corporate limits of the City of Wylie, Texas
shall be at the rate of one hundred fifteen percent (115%) of the rate
charged customers inside the corporate limits of the City.
(e) Any bulk water customer who desires to withdraw water from a hydrant or
other source not metered and charged directly to them shall fill our a water
application form and sign the form in the same manner as a regular
metered customer. Bulk water rate charges are to be charged in 25-gallon
increments at the same rates as the commercial customers.

SECTION II
The rates herein imposed shall be effective for all water usage occurring after
September 30, 2001.
SECTION III
Should any paragraph, sentence, subdivision, clause, phrase or section of the
ordinance be adjusted or held to be unconstitutional, illegal or invalid the same
shall not affect the validity of this ordinance as a whole or any part or provision
thereof, other than the part or parts as declared to invalid, illegal, or
unconstitutional.
SECTION IV
This ordinance shall be in full force and effect from and after its adoption by the
City Council and publication of its caption as the law and the City Charter provide
in such cases.
SECTION V
That all ordinances and code provisions in conflict or consistency are hereby
repealed and all other provisions of the Wylie City Code not in conflict herewith
shall remain in full force and effect.

Consider and act upon approval of a Replat of Lot 1, Block A, Century Business Park Addition,
being an 8.618 acre tract according to the plat recorded in Volume K, Page 777 of the Map Records
of Collin County, Texas, and being also a part of that tract described in a deed to Heatley-Moist, Inc.
recorded in Clerk's File No. 96-0000740 of the Deed Records of Collin County, Texas, being situated
in the Duke Strickland Survey, Abstract No. 841, City of Wylie, Collin County, Texas.
Background
The Replat under consideration will create two lots from the existing single Lot 1 of Block A of the
Century Business Park Addition. This replat is intended to divide the property and create the 2.373
acre Lot IA which is to be sold to the adjoining property owner for future expansion of the existing
Buckner Boulevard Plumbing facility (old Concrete Walls, Inc.) developed as Lot 5. There are
currently no plans for development of the remaining Lot 1B.
The Century Business Park, also creating Alanis Drive and Century Way, was originally platted in
1986, and the subject tract was then a portion of a larger Lot 1 of Block A. The tract as currently
configured was created when much of that original Lot 1 was replatted in 1998 as the Highway 78
Business Park. Since that date, several lots have been replatted as both the Century Business Park
and Highway 78 Business Park. This replat attempts to redirect the name of the addition back to
Century Business Park.
The property is currently zoned for Industrial (I) uses. The anticipated expansion of the
office/warehouse use is currently allowed within the Industrial District.
Financial Considerations

Development impact fees—Not paid. Water: $20,890.03 Sewer: $42,159.26
Other Considerations
1. Section 212.005 of the Texas Local Government Code states that "the municipal authority
responsible for approving plats must approve a plat that satisfies all applicable regulations".
Section 212.009(a) states that"the municipal authority responsible for approving plats shall act
upon a plat within 30 days after the date the plat is filed. A plat is considered approved by the
municipal authority unless it is disapproved within that time period".
2. Staff has reviewed the proposed Replat for Lot 1, Block A, of the Century Business Park
Addition and found it to comply with all applicable State subdivision regulations as well as with
the Subdivision Regulations and all other pertinent technical ordinances of the City of Wylie.
3. The applicant is aware that prior to issuance of a building permit to develop or use the subject Lot
lA for development related to the existing plumbing business located on Lot 5, the two lots (1A
and 5) must be replatted to create a single lot of record.
4. The applicant is aware that development impact fees must be paid before the Final Plat can be
filed with Collin County.
Board/Commission Recommendation
At the August 7, 2001 meeting, the Planning and Zoning Commission voted 7-0 to approve the
Replat of Lot 1, Block A of the Century Business Park.

The amendment to the Subdivision Regs will be pushed to the Sept 11 meeting because we had not published a
notice for the 28th. We talked to Rebecca Brewer and she said we'd be fine if we publish the notice in the paper
next week notifying the public of the hearing on 9/11.
My thought on the Park Master Plan Task Force is that it can also wait until Sept 11 -in the interim we can contact
the various groups to be represented(WISD, WSA, etc. to get suggested names). I also don't want to rush the
preparation of an agenda communication unnecessarily.
Sept. 11 will also be the date for the annexation ordinance.

Attached please find the draft agenda, revised this morning, that includes all agenda items received to
date. According to the staff meeting on Tuesday, agenda items pending include status on, SH78 Utility

I have also visited with Mr. Diaz regarding the appointment of the task force for the park master plan.
Apparently there is some question as to the actual appointment process. I advised that past procedures
involved placing the action requested on the agenda, and if Council is prepared to make appointments,

is prepared to bring forward an agenda communiction for this item.

Conduct a public hearing on the proposed tax rate for fiscal year 2001-2002 and provide taxpayers an
opportunity to express their views on the tax rate. At the end of the hearing, the City Council must set
and announce the date, time and place of the meeting at which it will vote on the final proposed tax rate.
Background
In accordance with the "Truth in Taxation" laws of the State of Texas, on August 7, 2001, the City
Council took a roll call vote on the proposed tax rate and scheduled a public hearing on the tax rate for
August 28, 2001. The results of the record vote on the proposed tax rate and the notice of the public
hearing were published in the Wylie News on August 15, 2001. This public hearing has been advertised
in compliance with the publication requirements set forth in the Truth in Taxation Law.
The purpose of the public hearing on August 28, 2001, is to give the taxpayers an opportunity to express
their views on the tax rate. The City Council may not adopt the tax rate at this hearing. Instead, at the
end of the hearing, it must set and announce the date, time and place of the meeting at which it will vote
on the final proposed tax rate. The second public hearing will be on September 11, 2001, to vote on the
final tax rate. After the August 28, 2001, meeting and before the meeting scheduled for the final tax
vote, the City Council must publish a second quarter-page notice, "Notice of Vote on Tax Rate."
The official detailed effective tax rate calculations are available in the office of the Collin County Tax
Assessor/Collector(Kenneth L. Maun) in McKinney. A copy is also maintained in the Finance
Department for the Council and public to view.
Financial Considerations
The proposed budget is based on the proposed tax rate of$0.72 per $100 valuation. This is the rate
previously discussed by the Council. Any change in the proposed tax rate will require revision of the
proposed budget.
Other Considerations
The City is required by law to follow certain meeting and notice (publication) guidelines as shown on
the attached calendar excerpt from the"Truth in Taxation" guide.
Staff Recommendation
It is recommended that the City Council schedule the next required public hearing on the tax rate for
September 11, 2001, after the close of the public hearing.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
City of Wylie, TEXAS, as follows,
SECTION 1
The Section 1.02 of Appendix C to the Code of Ordinance of the City of
Wylie, Texas, is hereby amended by deleting the existing section, in its entirety
and substituting the following therefore:
(a) the following monthly water rates, shall apply to all RESIDENTIAL
customers within the corporate limits of the City of Wylie, Texas:
(1) Monthly minimum Charge for first 1,000 gallons of
metered water consumption... ... ... ... ... ... ... ... ... ... ...... ... .... $8.90
(2) Volume charge for all consumption exceeding 1,000
gallons (per 1,000 gallons)
-1,001 to 2,000 gallons (per 1,000)... ... ... ... ......... ..... $2.00
-Over 2,000 gallons (per 1,000 gallons)... ... ... ... ... ..... $2.73

(b) The following monthly water rates shall apply to all COMMERCIAL
customers, (other than apartments, mobile home parks and other multi-unit
dwellings not individually metered) within the corporate limits of the City of Wylie,
Texas:
(1) Monthly minimum charge for first 1,000 gallons of
metered water consumption... ... ... ... ... ... ... ... ... ... ... ... ... .... $12.15
(2) Volume charge for all consumption exceeding 1,000
gallons (per 1,000 gallons)
-1,001 to 2,000 gallons (per 1,000) $2.10
-Over 2,000 gallons (per 1,000) $2.73
(c)The following water rates shall apply to all APARTMENTS, MOBILE
HOMES PARKS, and OTHER MULTI-UNIT DWELLINGS, not individually
metered, within the corporate limits for the City of Wylie, Texas:
(1) Monthly minimum charge for first 1,000 gallons of
metered water consumption... ... ... ... ... ... ... ... ... ... ... ... ... .... $12.15
(2) Volume charge for all consumption exceeding 1,000
gallons (per 1,000 gallons)
-1,001 to 2,000 gallons (per 1,000) $2.10
-Over 2,000 gallons (per 1,000) $2.73
(3) An additional charge of $4.00 per occupied unit, with occupancy being
determined as of the fifth day of the month preceding the billing.
(d)the monthly water charge for any customers (residential, commercial,
apartment , mobile home park, or other multi-unit dwelling not individually
metered) located outside the corporate limits of the City of Wylie, Texas shall be
at the rate of one hundred fifteen percent (115%) of the rate charged customers
inside the corporate limits of the City.
(e)Any bulk water customer who desires to withdraw water from a hydrant
or other source not metered and charged directly to them shall fill our a water
application form and sign the form in the same manner as a regular metered
customer. Bulk water rate charges are to be charged in 25 gallon increments at
the same rates as the commercial customers.
SECTION II
The rates herein imposed shall be effective for all water usage occurring after
September 30, 2001.

SECTION III
Should any paragraph, sentence, subdivision, clause, phrase or section of
the ordinance be adjusted or held to be unconstitutional, illegal or invalid the
same shall not affect the validity of this ordinance as a whole or any part or
provision thereof, other than the part or parts as declared to invalid, illegal, or
unconstitutional.
SECTION IV
This ordinance shall be in full force and effect from and after its adoption
by the City Council and publication of its caption as the law and the City Charter
provide in such cases.
SECTION V
That all ordinances and code provisions in conflict or consistency are hereby
repealed and all other provisions of the Wylie City Code not in conflict herewith
shall remain in full force and effect.
