EXECUTIVE SUMMARY
Annual action items required by our Charter. The City of Wylie Home Rule Charter states in Article 11,
Section 2"The City Council shall declare an official newspaper of general circulation in the city. All
ordinances,captions of ordinances,notices and other matters required to be published by this charter,by
city ordinances,or by the constitution and laws of the State of Texas,shall be published in this official
newspaper."

2. CONSIDER AND ACT UPON 1H1•.AWARD OF A CONTRACT FOR THE CONSTRUCTION OF THE RUSH CREEK
SEWAGE LIFT STATION TO NORTH TEXAS MUNICIPAL CONSTRUCTION CO., INC./TNG SERVICES, INC.,
IN THE AMOUNT OF$1,019,000.00.
EXECUTIVE SUMMARY
The 1999 Bond program identified the reconstruction of the Rush Creek Lift Station southeast of the
existing location and the construction of a new sewer force main to the Twin Lakes Lift Station. On
December 20, 2001 a total of seven (7) bids were opened for the project. North Texas Municipal
Construction Co.,Inc./TNG Services,Inc,submitted the low bid in the amount of$1,019,000.00. The
1999 Bonds included$1,000,000 for the Rush Creek lift station and force main and the FY 2002 budget
included $130,000 for new pumps for the lift station. Approximately$100,000 has been spent on the
project for engineering,surveying,and geo-technical services.Staff recommends awarding a contract to
North Texas Municipal Construction Co.,Inc./TNG Services,Inc to provide all equipment,labor and
materials for the construction of the Rush Creek Lift Station.

EXECUTIVE SUMMARY
Applicant is requesting initial zoning of the subject property from Agricultural(A)District to Business
Center(BC)District in order to develop a showroom/warehouse and distribution facility. Property totals
approximately 5 acres in size,the majority of which is floodplain.Applicant required to prepare a flood
study & obtain a Conditional Letter of Map Revision from the U.S. Corps of Engineers prior to the
issuance of permits for site grading and initial construction. The floodplain has already been partially
removed from the neighboring property to the south. Applicant proposes to construct a single building of
54,000 square feet, 10,000 sq. ft. of which will be office/showroom with future expansion of 18,000
square feet to the rear of the initial building is planned. At the January 2, 2002 Planning and Zoning
meeting,the Commission voted 5-0 to approve this zoning case. Staff is recommending approval.

EXECUTIVE SUMMARY
On November 13,2001,the City Council adopted major revisions to the nonresidential districts of the
Comprehensive Zoning Ordinance and the Official Zoning Map. Because of its diverse uses and
transitioning development patterns, and at the specific request of several property owners, the City
Council pulled out the area around Cooper Street in the northwest corner of State Highway 78 and F.M.
544 for separate consideration. This area totals approximately 30 acres and is held in approximately 17
separate ownerships.

This area was earlier proposed to be changed from the old Industrial(I)District to the new Community
Retail (CR) District. The Commercial Corridor (CC) District is intended to accommodate a diverse
mixture of commercial and light industrial uses which are all dependent upon direct access to major
regional thoroughfares but which are complimentary to one another as well as to the vehicular corridor.
Several of the existing establishments within the subject area reflect these characteristics,as well as those
of the Community Retail District.At the January 2,2002 Planning and Zoning meeting,the Commission
voted 5-0 to approve this zoning case. Staff is also recommending approval.
6. CONSIDER AND ACT UPON AN ORDINANCE ANNEXING ALL OF A CERTAIN 68.11 ACRE TRACT OF LAND

EXECUTIVE SUMMARY
Voluntary annexation has been submitted by the owner of the property, the Southwest Medical
Foundation, said property is located directly north of the new wastewater treatment plant. Should the
City Council approve the proposed annexation,the property will be temporarily zoned as A(Agricultural)
until permanent zoning is established. Public Hearings have been conducted in accordance with State
Law,proper notice and public hearings were conducted on December 10&December 11,2001. Staff is

Mayor Mondy removed himself from the bench and from any discussion regarding Item No. 1,as he serves as the Chairman of
the Birmingham Land Trust. Mayor Pro Tem Scott presided.
This item was tabled at the November 13,2001 Council Meeting in order to give the applicant time to consider the Council's
concerns for the lot sizes, masonry requirements, size of accessory building and availability of a school site. Councilman
Hogue made a motion to remove Item No. 1 from the Table. Councilman Trout seconded the motion. A vote to remove was
taken and passed unanimously,6-0. Mayor Mondy abstaining.
Mr. Thompson provided a Planning Report and Conditions of Development that reflected the applicants modifications in
response to concerns raised by Council at the November 13, 2001 meeting. Mr. Thompson made reference to Exhibit"B"
Conditions for Planned Development District,Number V. Specific Regulations;No.2, Lot Mix with regard to percentages and
No. 3,Minimum Average Lot Area; No. 19 Accessory Structures Building Area; Number VI. Basic Requirements, No. iii,
Architectural Requirements,No. 1 regarding a change in the wording to reflect"a minimum of 75%exterior facade on all sides
as brick of stone laid masonry units. Cementacious siding can be used on 25% of the exterior facade" and in conclusion,
Section XVII.Regarding the proposed terms of for a future elementary school site in Bozman Farms Estates.
The applicant, Mr. Greg Rich, 5001 LBJ Freeway, Suite 830, Sipiela Development Corporation/Reality Development Trust,
was present to address any concerns of the Council. Mr.Rich stated that he has appreciated the working with the city staff on
the areas of concern and felt that said issues were resolved. Mr. Rich detailed the changes within the Conditions for Planned
Development. There was some discussion regarding the school site and Councilman Hogue expressed his concerns regarding
the donation of land to the school district. Mr.Rich stated that their offer was to make available a suitable site at a fair market
price.
The Mayor Pro Tem them opened the Public Hearing and asked that anyone wishing to speak either in favor or opposition of
the request to please come forward,stating their name and address for the record and limiting their comments to three minutes.
With no response,the Mayor then closed the Public Hearing.
Councilman Trout made a motion to approve the change in zoning from Agriculture (A) to Planned Development (PD) for

Mr. Claude Thompson was present and provided Council with a brief background on the request. He stated that the applicant is
requesting rezoning to the Planned Development District with the expressed intent of establishing the right to reconstruct the
current apartment complex to its existing character and density should it be destroyed. Public Comment Forms were mailed to
thirty-seven(37)property owners within 200 feet of this request. No Comment Form had been returned at the time of posting.
At the November 20,2001 Planning and Zoning meeting,the Commission voted 6-0 to deny this zoning case. A three-fourths
majority vote by the City Council is required for approval of the requested change in zoning because the Planning and Zoning
Commission recommended the request be denied. Staff is recommending denial. Mr. Thompson explained that although the
proposal is consistent with the recommendations of the Comprehensive Plan and characteristics of the tract favor attached
residential uses, the perpetual potential for a density of 34 dwelling units per acre is an inappropriate variance from Wylie's
long-held philosophy of limiting multi-family residential density to 15 dwellings per acre. The facility may continue to operate
as legally nonconforming. Mr.Thompson clarified that if the structure was destroyed,they could rebuild,but it would have to
meet current standards. The applicant was not present.

This item was tabled at the November 13,2001 Council Meeting. Councilman Hogue made a motion to remove Item 4 from
the Table. Councilman Scott seconded the motion. A vote was taken and the motion to remove was approved,7-0.

meeting, the Council took action to approve revisions to the Comprehensive Zoning Ordinance and Official Zoning Map.
The property owner had submitted written opposition to the proposed zoning, requiring the Council to remove the property
from the overall vote and vote on separately. The Council tabled action on the property owned by Birmingham Land Ltd, for
further review, particularly with regard to the existing Multi-Family zoning. Existing zoning includes single family, retail,
multi-family, single-family attached and business zoning. Proposed zoning generally reflects the intent of the
Comprehensive Plan, providing predominately residential zoning on the property with NS (Neighborhood Services) at the
major thoroughfare intersections. The property was reviewed as a part of the overall process of updating the Official Zoning
Map, applying the guidelines for decision-making as identified in previous meetings.

Ms. Mindy Manson,Assistant City Manager,provided Council with a brief background on the annexation request explaining
the required process. She stated that the voluntary annexation by the owner of the above referenced property, the Southwest
Medical Foundation was located directly north of the new wastewater treatment plant and is proposed for single family
residential zoning. If approved, the property will be temporarily zoned as A (Agricultural) until permanent zoning is
established by the City Council.

the area. He is concerned about the development with regard to the sixty acres directly behind his property.

Mr. Proctor stated that he does not oppose the annexation,however,he did express opposition to the proposed development.
He stated that he has been a resident since 1984 and would like to keep the current atmosphere and opposes the development of
smaller homes.

6. Consider and at upon the award of a contract for the Alley and Sanitary Sewer Improvements along Ballard
Avenue to Rycon Incorporated in the amount of$231,127.00.
Mr. Chris Hoisted provided Council with a brief background on this item. He stated that improvements to the alley between
Ballard and Jackson and the alley between Ballard and First were included in the 1999 Bond and include approximately 1,880
square yards of 8-inch thick concrete pavement and approximately 1,344 linear feet of 8-inch sewer replacement. He stated
that six bids were opened on November 2,2001 and Rycon Incorporated submitted the low bid with project completion within
90 calendar days. Staff recommends that Council award a contract to Rycon Incorporated to provide all equipment, labor and
materials for the construction of the Alley and Sanitary Sewer Improvements along Ballard Avenue.
Councilman Young made a motion to approve the award of contract for the Alley and Sanitary Sewer Improvements along
Ballard Avenue to Rycon Incorporated in the amount of$231,127.00. Councilman Hogue seconded the motion. A vote was
taken and the motion was approved,7-0.
7. Consider and act upon approval of an ordinance adopting the 1997 Uniform Fire Code.
City Manager, Anthony Johnson addressed this item explaining the intent of proposed ordinance. He stated that the Fire
Department has maintained the equivalent code in relation to the building code department and that the latest building code is
UBC 1997. The City of Wylie is currently enforcing UFC 1994. The UFC 1997 overall format has not changed and will not
require any changes in relation to amendments sections adopted by the City of Wylie under UFC 1994. In addition,the Fire
Department is currently preparing for an Insurance Services Office Re-evaluation and current fire code will cause a deficit in
possible points.
Councilman Scott made a motion to approve the ordinance adopting the 1997 Uniform Fire Code. Councilman Trout seconded
the motion. A vote was taken and the motion was approved,7-0.
8. Consider and act upon an Ordinance of the City of Wylie, Texas, adopting a comprehensive right-of-way

Clause,a Severability Clause,a Savings Clause, a Penalty Clause,and an Effective Date.
Mr. Mike Sferra,Director of Development Services provided Council with a brief background on the intent of the proposed
ordinance. He stated that the City Council previously adopted regulations governing construction activities occurring within
the City's Rights-of-Way. The current Ordinance contains no provisions for right-of-way management. The intent of the
proposed Ordinance is to accommodate the utilities'need to use the Public Rights-of-Way to provide services to the public and
will allow the City to insure that the public safety is maintained; minimize public inconvenience; protect the City's
infrastructure investment; facilitate work within the Public Rights-of-Way; and to fairly and responsibly protect the public
health,safety,and welfare. Utilities or contractors desiring to perform construction activities in the City's right-of-way will be
required to obtain a permit,at no charge,after City Staff has reviewed plans for the construction activities.

Mr. Chris Holsted, City Engineer, provided Council with a brief background on the intent of the proposed ordinance. He
stated that the Texas Department of Transportation has approved the City's request for a school zone located on FM 1378 at
the intersection with McMillen Road establishing a 35 mile per hour school zone and TxDOT will furnish and install the
necessary signs. TxDOT stated that once the Council approves the proposed ordinance,they will begin proceedings to have the
zoning adopted by the Commission.
Councilman Scott made a motion to approve the ordinance establishing a school zone on FM 1378 at the intersection with
McMillen Road and Park Blvd. Councilman Young seconded the motion. A vote was taken and the motion was approved, 7-
0.
10. Consider and act upon approval of an ordinance extending interim Impact Fees,establishing a collection date,
establishing a date to call a public hearing to amend the Impact Fees,and providing for an expiration date.
Mr. Chris Holsted, City Engineer, addressed this item providing Council a brief background on the item and intent of the
ordinance. Mr. Holsted stated that during the recent Legislative Session, Senate Bill 243 (SB243) was enacted resulting in
several amendments to impact fee regulations and although some of the amendments regarding the procedures which must be
followed to adopt impact fees are beneficial to municipalities, the amendment which affects the collection and calculation of
impact fees will have a negative impact on the City of Wylie. He stated that the ordinance under consideration will extend
Ordinance 2001-42 adopted on September 11, 2001 an additional 90 days to allow further analysis of the credit allowed in
SB243 and further establishes that the City will call a public hearing for the purpose of setting a credit for impact fees in
accordance with the calculation reflected in SB243 factoring in tax and utility revenue, and that this process will be
completed within 90 days.
Councilman Scott made a motion to approve the ordinance extending interim Impact Fees, establishing a collection date,

Trout seconded the motion. A vote was taken and the motion was approved, 7-0.
11. Consider and act upon an ordinance addressing the taxation of on leased motor vehicles.
Ms. Mindy Manson, Assistant City Manager addressed this item, providing Council a brief background on the intent of the
ordinance. She stated that SB 248,passed this session, implements the 1999 amendment and that the bill provides that motor
vehicles leased and used primarily for non-income-producing purposes are January 2, 2002, are exempt from property taxes
and gives cities an opt-out from the exemption. She stated that the City may continue to tax such leased motor vehicles if it
adopts an ordinance to that effect before January 1, 2002. If the ordinance is not adopted, the City would continue to tax
only those vehicles not covered by SB 248 such as vehicles used for business purposes.
It was clarified that adoption of the ordinance will simply keep the option to tax open and that if the ordinance is not
adopted, we would loose our option to tax in the future. This action will not effect our budget today, however, it could in
the future. Mr. Johnson stated that the possibility of future taxation will need to be researched and that the adoption of the
ordinance will only serve to keep the option open.
Councilman Scott made a motion to approve the ordinance addressing the taxation on leased motor vehicles. Councilman
Hogue seconded the motion. A vote was taken and the motion was approved, 5-2. Councilman Worley and Councilman
Trout voting in opposition.
Ordinance Numbers 2001-51 through 57 were then read into the record as required by the Wylie City Charter.

Issue
Consider and act upon a Final Plat for the Country Ridge Phase A Addition, being all of a certain
59.448 acre tract of land, situated in the William Patterson Survey, Abstract No. 716, City of Wylie,
Collin County, Texas, and being a portion of the 99.7418 acre tract described in the deed to Fredrick
Veninga, Trustee, according to the deed recorded in Volume 883, Page 628 of the Deed Records of
Collin County, Texas.
Background
The Final Plat for the Country Ridge Addition Phase A is the initial phase of the Country Ridge
Addition, and includes 59.448 acres and will create 180 single-family residential lots. The Plat also
dedicates additional right-of-way for the widening of Country Club Road (F.M. 1378), and creates
common spaces for landscape and screen wall easements as well as an amenity center.
The property is zoned Planned Development District (PD 2001-24) for Single-Family Residential
Uses, approved by the City Council on May 22, 2001. The PD limits the overall development to a
total 312 lots, requiring a minimum lot size of 8,500 square feet and a minimum house size of 2,000
square feet. A Preliminary Plat/Development Plan for the overall development was approved by the
City Council on July 24, 2001.
Section 212.005 of the Texas Local Government Code states that "the municipal authority
responsible for approving plats must approve a plat that satisfies all applicable regulations". Section
212.009(a) states that "the municipal authority responsible for approving plats shall act upon a plat
within 30 days after the date the plat is filed. A plat is considered approved by the municipality unless
it is disapproved within that time period".
Financial Considerations

The applicant is aware that development impact fees must be paid prior to the issuance of a building
permit on each lot.
Other Considerations
1. The Final Plat substantially conforms to the Concept Plan of the approved Planned Development
District as well as to the approved Preliminary Plat/Development Plan. The Plat also complies
with all applicable technical requirements of the City of Wylie.
2. The Plat dedicates right-of-way for the widening of Country Club Road (F.M. 1378).
3. The Plat provides open space for an amenity center as well as for a landscaped perimeter screen
wall, to be maintained by a Homeowners Association.
Board/Commission Recommendation
At the December 18, 2001, Planning and Zoning Commission meeting, the Commission voted 4-0

There are two requirements that must be met for a newspaper to meet the statutory requirements as a
newspaper of general circulation. First, the publication must be a "newspaper" as defined by Section
2051.044, Texas Government Code. The section defines the term"newspaper" as:

Consider and at upon the award of a contract for the construction of the Rush Creek Sewage Lift Station
to North Texas Municipal Construction Co., Inc./TNG Services, Inc., in the amount of$1,019,000.00.
Background
The 1999 Bond program identified the reconstruction of the Rush Creek Lift Station southeast of the
existing location and the construction of a new sewer force main to the Twin Lakes Lift Station.
Construction of the Cimarron Estates subdivision has increased the need for the new lift station. The
lift station is a submersible pump style station including three pumps, valve vault, emergency generator,
SCADA system upgrades at the public works service center, and related site improvements. The
contract requires substantial completion within 180 days of the notice to proceed.
Easements for the force main extending from the new Rush Creek lift station to the existing Twin Lakes
lift station are being acquired. The force main project will be advertised upon acquisition of the
easements and construction completion of the lift station and force main should coincide.
On December 20, 2001 a total of seven (7) bids were opened for the project. North Texas Municipal
Construction Co., Inc./TNG Services, Inc, submitted the low bid in the amount of$1,019,000.00. The
references for the contractor were contacted and a pre-award conference was held to discuss the project.
Financial Considerations
The 1999 Bonds included $1,000,000 for the Rush Creek lift station and force main and the FY 2002
budget included $130,000 for new pumps for the lift station. To date approximately $100,000 has been
spent on the project for engineering, surveying, and geo-technical services. The lift station and force
main were both included in the most recent impact fee update, and sewer impact fees will be used to
construct the force main project.
Other Considerations
The solicitation of competitive sealed bids was conducted in accordance with Chapter 252.021 of the
Texas Local Government Code.
Staff Recommendations
Staff recommends that Council award a contract to North Texas Municipal Construction Co., Inc./TNG
Services, Inc to provide all equipment, labor and materials for the construction of the Rush Creek Lift
Station.

On December 20,2001, a total of seven(7)bids for the referenced project were received
in your offices and opened. North Texas Municipal Construction Company, Inc./TNG
Services,Inc.—Joint Venture(NTMCCl/TNG)submitted the apparent low base bid in
the amount of$1,019,000_ All bid submittals have been subsequently reviewed and
tabulated. No mathematical errors or significant discrepancies in any submittals were
noted. A copy of the bid tabulation is attached.
We solicited and reviewed qualification information provided by NTMCCl/TNG. The
information indicates both companies were formed and began operating independently in
1993,and have been working together as a joint venture for approximately the last 1-1/2
years. We contacted a several of the references provided by the bidder_ While two of the
NTMCCI project references indicated some concerns related to slow progress and
management issues,the concerns appeared to be limited in scope and time; i.e.,there was
no contract default,and the concerns were not repeated by other references contacted.
Based on our review of the qualification information submitted,we see no reason to
believe that NTMCCl/TNG would be incapable of performing this work.
The bidding documents included a deductive alternate bid item that would allow the City
to purchase the pumps and related equipment directly from the manufacturer, rather than
this equipment being furnished through the contractors contract. A review of the bid
tabulation indicates that the deduct amount bid by the low bidder is consistent with nearly
all of the other bids,and the acceptance of the deduct would not change the ranking of the
bidders.

Issue
Hold a Public Hearing to consider and act upon a change in zoning from Agriculture (A) District to
Business Center (BC) District with a Specific Use Permit (SUP) for Warehouse and Distribution
Uses, being a 5.0 acre tract of land located west of Sanden Boulevard and south of F.M. 544, north
of Hensley Lane, being part of a 16.6174 acre tract of land recorded in Volume 3367, Page 230, of
the Collin County Land Records, situated in the Duke Strickland Survey, Abstract No. 841, City of
Wylie, Collin County, Texas. (Zoning Case No. 2001-18)
Background
The applicant is requesting initial zoning of the subject property from Agricultural (A) District to
Business Center (BC)District in order to develop a showroom/warehouse and distribution facility.
The subject property totals approximately 5 acres in size, the majority of which is floodplain. The
applicant will be required to prepare a flood study and obtain a Conditional Letter of Map Revision
(CLOMR) from the U.S. Corps of Engineers prior to the issuance of permits for site grading and
initial construction. The floodplain has already been partially removed from the neighboring property
to the south.
The applicant proposes to initially construct a single building of 54,000 square feet, 10,000 sq. ft. of
which will be office/showroom. A future expansion of 18,000 square feet to the rear of the initial
building is planned.
Public Comment Forms were mailed to five (5) property owners within 200 feet of this request. No
Comment Form had been returned at the time of posting.

Other Considerations
1. The Comprehensive Plan recommends that the subject property be developed as Business Center
land uses. The Plan defines the Business Center category as including offices and clean
manufacturing/assembly, allowing limited retail uses subordinate to the office and manufacturing
functions. The proposed use is consistent with this recommendation of the Comprehensive Plan.
2. The nonresidential portion of the Zoning Ordinance, adopted November 13, 2001, permits
Warehouse and Distribution uses within the Business Center District with a Specific Use Permit
(SUP). The SUP provides additional review and the opportunity to impose special development
conditions on certain uses when desired to better insure their compatibility with adjacent
development. The SUP runs with the land and is transferable, just as is the base zoning. The
proposed development satisfies the Base Standards as well as sufficient Desirable Requirements
to achieve the required points, and it is believed that no additional conditions need be imposed.
3. The accompanying Site Plan provides a summary of the proposed development requirements, and
this Plan shall be considered part of the development requirements for the subject property. It
is the staffs opinion that the subject facility, as proposed to be developed, will provide sufficient
compatibility to neighboring developments regardless of varied uses which may occupy the facility
in the future.

At the January 2, 2002 Planning and Zoning meeting, the Commission voted 5-0 to approve this
zoning case.
Staff Recommendation
Approval. The Departments of Development Services, Public Works and Fire concur with this
recommendation.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS,
AMENDING THE COMPREHENSIVE ZONING ORDINANCE
OF THE CITY OF WYLIE, AS HERETOFORE AMENDED,
SO AS TO CHANGE THE ZONING ON THE HEREINAFTER
DESCRIBED PROPERTY, ZONING CASE #2001-18 TO,
BUSINESS CENTER (BC) DISTRICT CLASSIFICATION
WITH A SPECIFIC USE PERMIT (SUP); PROVIDING FOR
THE REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission and the governing body of the City of
Wylie, Texas, in compliance with the laws of the State of Texas with reference to the amendment of
the Comprehensive Zoning Ordinance, have given the requisite notices by publication and otherwise,
and after holding due hearings and affording a full and fair hearing to all property owners generally
and to owners of the affected property, the governing body of the City is of the opinion and finds that
the Comprehensive Zoning Ordinance and Map should be amended;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
SECTION 1.
That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be, and the same is
hereby, amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described
property a new zoning classification of, Business Center(BC)District Classification with a Specific
Use Permit (SUP), said property being described in Exhibit "A" attached hereto and made a part
hereof for all purposes.
SECTION 2.
That all ordinances of the City in conflict with the provisions of this ordinance be, and the
same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of
this ordinance shall remain in full force and effect.
SECTION 3.
That the above described property shall be used only in the manner and for the purposes
provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting
of this zoning classification.
SECTION 4.
Any person, firm or corporation violating any of the provisions of this ordinance or the
Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act and shall be subject
to the general penalty provisions of Section 38 of the Zoning Ordinance, as the same now exists or
is hereafter amended.
SECTION 5.
Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this
ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid,
illegal or unconstitutional, and shall not affect the validity of the Comprehensive Zoning Ordinance
as a whole.
SECTION 6.
This ordinance shall be in full force and effect from and after its adoption by the City Council
and publication of its caption as the law and the City Charter provide in such cases.
SECTION 7.
The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall
it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to accrue,
nor as effecting any rights of the municipality under any section or provisions of any ordinances at
the time of passage of this ordinance.

particularly described as follows:
BEGINNING at a Roome 1/2-inch capped iron rod found marking the northeast corner of a 5.00

Planned Development District (PD 2001-46), generally located north of F.M. 544 and east of
McCreary Road, being north of the Lakeside Estates Addition and east of the Sage Creek Addition,
situated in the Moses Sparks Survey, Abstract No. 849, City of Wylie, Collin County, Texas, being
part of a 28.5675 acre tract and all of a 27.4522 acre tract conveyed to Thomas Mannewitz by deed
recorded under County Clerk's File No. 92-0064130, Deed Records, Collin County, Texas. (Zoning
Case No. 2001-19)
Background
The Planned Development District which established the initial zoning on the subject property (PD
2001-46), including Conditions of Development and a Conceptual Plan, was adopted by the City
Council on September 25, 2001. The Preliminary Plat, the first step in the development process, was
approved by the Council on December 15, 2001.
The Plat for the 41.7 acre tract will create 151 single-family residential lots. The Conditions of the
Planned Development District provides for an average lot size of 8,500 square feet, with no lots being
smaller than 7,200 square feet and no fewer than 97 lots having a minimum size of 8,500 square feet.
The PD provided for reduced side yards.
The adopted Planned Development also provided that the"architectural point standards for the SF
8.5 District Zoning will be met." The applicant is now requesting an amendment to the Conditions
of the Planned Development District in order to achieve certain variances to the standard
requirements of the Zoning Ordinance. These include the following:

Other Considerations
1. The Residential requirements of the Zoning Ordinance, adopted in July of 2000, require that seven
(7) lots be skipped on the same side of the street and four (4) on the opposite side before
repeating a dwelling unit with substantially the same floor plan and street elevation. The applicant
is requesting a skipping of four on the same side and two on opposite sides, which more closely
follows accepted development practices. Of ten neighboring municipalities surveyed, only
Rockwall had any requirement to skip elevations and they required a skipping of five (5) lots.
2. The Residential requirements of the Zoning Ordinance, adopted in July of 2000, require that all
dwellings within the SF 8.5/17 District be provided with a covered entry of not less than 40
square feet and 4 feet depth. The required Base Standard for all other dwelling sizes is 20 square
feet and 21/2 feet depth, with the 40 sq. ft. being a Desired Option for which additional points are
provided. The applicant is requesting a covered front porch of eighteen (18) square feet and five
(5) feet width. Of ten neighboring municipalities surveyed, none had any requirement for a porch
or covered entry.
3. The PD Conditions as amended require compliance with all other Base Standards of the
Architectural Requirements.

AMENDING THE COMPREHENSIVE ZONING ORDINANCE
OF THE CITY OF WYLIE, AS HERETOFORE AMENDED,
SO AS TO CHANGE THE ZONING ON THE HEREINAFTER
DESCRIBED PROPERTY,ZONING CASE NUMBER 2001-19,
TO PLANNED DEVELOPMENT (PD) DISTRICT
CLASSIFICATION; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission and the governing body of the City of
Wylie, Texas, in compliance with the laws of the State of Texas with reference to the amendment of
the Comprehensive Zoning Ordinance, have given the requisite notices by publication and otherwise,
and after holding due hearings and affording a full and fair hearing to all property owners generally
and to owners of the affected property, the governing body of the City is of the opinion and finds that
the Comprehensive Zoning Ordinance and Map should be amended;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
SECTION 1.
That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be, and the same is
hereby, amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described
property a new zoning classification of Planned Development (PD) District Classification, said
property being described in Exhibit"A" and Exhibit"B" attached hereto and made a part hereof for
all purposes.
SECTION 2.
That all ordinances of the City in conflict with the provisions of this ordinance be, and the
same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of
this ordinance shall remain in full force and effect.
SECTION 3.
That the above described property shall be used only in the manner and for the purposes
provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting
of this zoning classification.
SECTION 4.
Any person, firm or corporation violating any of the provisions of this ordinance or the
Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act and shall be subject
to the general penalty provisions of Section 38 of the Zoning Ordinance, as the same now exists or
is hereafter amended.
SECTION 5.
Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this
ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid,
illegal or unconstitutional, and shall not affect the validity of the Comprehensive Zoning Ordinance
as a whole.
SECTION 6.
This ordinance shall be in full force and effect from and after its adoption by the City Council
and publication of its caption as the law and the City Charter provide in such cases.
SECTION 7.
The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall
it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to accrue,
nor as effecting any rights of the municipality under any section or provisions of any ordinances at
the time of passage of this ordinance.

CONDITIONS FOR PLANNED DEVELOPMENT DISTRICT
ZONING CASE NO. 2001-19
MANNEWITZ TRACT
Wylie, Texas
General Conditions:
1. This Planned Development District shall not affect any regulation within the Code of
Ordinances, except as specifically provided herein.
2. All regulations of SF-8.5 District set forth in Article 2, Section 3.3 A.3 of the Comprehensive
Zoning Ordinance are included by reference and shall apply except as provided herein.
Special Conditions:
1. The side yard setback shall be not less than six (6)feet or ten percent (10%) of the lot width
at the building line, whichever is greater, not to exceed ten (10) feet, on each side.
2. A side yard adjacent to a street shall be not less than fifteen (15) feet. A side yard on key lots
adjacent to a street shall be not less than twenty-five (25) feet.
3. Mandatory Homeowners Association
4. All open space and landscape to be maintained by the Homeowners Association. Landscaped
entry feature with landscaped median.
5. The Village Residential District point standards for SF-8.5 District Zoning will be met for
Village Land Design Requirements and Street and Sidewalk Requirements. The Architectural
points requirement will be met, except that the Base Standard for units with same floor plan
and same street elevation shall require four (4) lots to be skipped on both sides of the street
before repeating an identical floor plan with an identical elevation, and the Base Standard shall
require a covered front porch to have a minimum of eighteen (18) square feet with a 5'
minimum width.
6. Minimum lot width of 60' at the building line.
7. Minimum lot depth of 100' for lots.
8. Average lot size for the overall tract will be approximately 8,500 square feet.
9. There will be no more than forty-seven (47) lots with a lot size less than 8,500 square feet.
There will be no fewer than ninety-seven (97) lots with a minimum lot size greater than 8,500
square feet. No lot will be less than 7,200 square feet.
10. An Amenity Center with pool and playground shall be required, and shall provide trail access
to the flood plain. All required parking for the Amenity Center shall be on-site.

Background
On November 13, 2001, the City Council adopted major revisions to the nonresidential districts of
the Comprehensive Zoning Ordinance and the Official Zoning Map. These revisions were
necessitated by the adoption in 1999 of a revised Comprehensive Plan, which recommended certain
changes in the nomenclature and distribution of land uses. The newly-adopted zoning requirements
and map are intended to implement the goals expressed by the Comprehensive Plan.
Because of its diverse uses and transitioning development patterns, and at the specific request of
several property owners, the City Council pulled out the area around Cooper Street in the northwest
corner of State Highway 78 and F.M. 544 for separate consideration. This area totals approximately
30 acres and is held in approximately 17 separate ownerships.
This area was earlier proposed to be changed from the old Industrial (I) District to the new
Community Retail (CR)District. The Community Retail District is intended to become Wylie's major
commercial center, accommodate a broad variety of diverse and intensive commercial uses including
shoppers and comparison goods as well as convenience goods. Several of the recently-initiated retail
developments in the subject area reflect this goal and definition.
The Commercial Corridor(CC)District is intended to accommodate a diverse mixture of commercial
and light industrial uses which are all dependent upon direct access to major regional thoroughfares
but which are complimentary to one another as well as to the vehicular corridor. Several of the
existing establishments within the subject area reflect these characteristics, as well as those of the
Community Retail District.
Public Comment Forms were mailed to Fifty-five (55) property owners within 200 feet of this
request. One Comment Form had been returned at the time of posting, FAVORING the rezoning.

Other Considerations
1. The Comprehensive Plan recommends that the subject property be developed as Community
Retail and Office land uses, as Wylie's new commercial center(the architectural and use character
of the Downtown Historic District is to be preserved, thereby limiting its appropriateness for
modern, vehicular-dependant uses). Either the Community Retail or Commercial Corridor zoning
districts are consistent with this recommendation of the Comprehensive Plan.
2. The recently-adopted revisions to the Zoning Map assigned the Commercial Corridor (CC)
District to all of the lands fronting the north side of the S.H. 78 and F.M. 544 intersection, except
for the subject area. The Commercial Corridor District provides for a variety of land uses to
accommodate both a majority of the viable existing uses and the commercial uses envisioned by
the Comprehensive Plan. The adopted Design Regulations of the Commercial Corridor District
are sufficient to require the quality of development desired at this highly-visible intersection, and
support the desired image of Wylie's central place and identifying physical image.
3. The size and configuration of many of the existing lots within the subject area favor development
as Commercial Corridor uses rather than as Community Retail.
Board/Commission Recommendation
At the January 2, 2002 Planning and Zoning meeting, the Commission voted 5-0 to approve this
zoning case.
Staff Recommendation
Approval. The Departments of Development Services, Public Works and Fire concur with this
recommendation.

OF THE CITY OF WYLIE, AS HERETOFORE AMENDED,

DESCRIBED PROPERTY,ZONING CASE NUMBER 2001-20,

CLASSIFICATION; PROVIDING FOR 1'Hl;REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission and the governing body of the City of
Wylie, Texas, in compliance with the laws of the State of Texas with reference to the amendment of
the Comprehensive Zoning Ordinance, have given the requisite notices by publication and otherwise,
and after holding due hearings and affording a full and fair hearing to all property owners generally
and to owners of the affected property, the governing body of the City is of the opinion and finds that
the Comprehensive Zoning Ordinance and Map should be amended;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
SECTION 1.
That the Comprehensive Zoning Ordinance of the City of Wylie, Texas, be, and the same is
hereby, amended by amending the Zoning Map of the City of Wylie, to give the hereinafter described
property a new zoning classification of Commercial Corridor (CC) District Classification, said
property being described in Exhibit "A" attached hereto and made a part hereof for all purposes.
SECTION 2.
That all ordinances of the City in conflict with the provisions of this ordinance be, and the
same are hereby, repealed and all other ordinances of the City not in conflict with the provisions of
this ordinance shall remain in full force and effect.
SECTION 3.
That the above described property shall be used only in the manner and for the purposes
provided for in the Comprehensive Zoning Ordinance of the City, as amended herein by the granting
of this zoning classification.
SECTION 4.
Any person, firm or corporation violating any of the provisions of this ordinance or the
Comprehensive Zoning Ordinance, as amended hereby, commits an unlawful act and shall be subject
to the general penalty provisions of Section 38 of the Zoning Ordinance, as the same now exists or
is hereafter amended.
SECTION 5.
Should any paragraph, sentence, subdivision, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this
ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid,
illegal or unconstitutional, and shall not affect the validity of the Comprehensive Zoning Ordinance
as a whole.
SECTION 6.
This ordinance shall be in full force and effect from and after its adoption by the City Council
and publication of its caption as the law and the City Charter provide in such cases.
SECTION 7.
The repeal of any ordinance, or parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor shall
it have the effect of discontinuing, abating, modifying or altering any penalty accruing or to accrue,
nor as effecting any rights of the municipality under any section or provisions of any ordinances at
the time of passage of this ordinance.

Issue
Consider and Act Upon an Ordinance annexing all of a certain 68.11 acre tract of land
out of the Guadalupe De Los Santos Survey, Abstract No. 1384, Dallas County, Texas;
and generally located on Pleasant Valley Road.
Background
A request for voluntary annexation has been submitted by the owner of the property, the
Southwest Medical Foundation. The property is located directly north of the new
wastewater treatment plant. Should the City Council approve the proposed annexation,
the property will be temporarily zoned as A (Agricultural) until permanent zoning is
established. The procedure for establishing the permanent zoning on annexed territory
shall conform to the procedures established by law for the adoption of zoning regulations.
In accordance with State Law, proper notice and public hearings were conducted
according to the following schedule:

Financial Consideration
The current property tax rate for the City of Wylie is .725 per $100 of valuation.
Other Considerations
Article 1, Section 3 of the Wylie City Charter authorizes the City Council to adjust
boundaries. The City will also be required when the annexation is considered to comply
with the Local Government Code for the provision of services, (please see attached
Service Plan). This annexation is being conducted in compliance with Sections 43.063 of
the Local Government Code.

SHALL BE ENTITLED TO THE RIGHTS AND PRIVILEGES OF
OTHER CITIZENS OF WYLIE AND BE BOUND BY THE ACTS
AND ORDINANCES NOW IN EFFECT AND HEREAFTER
ADOPTED; PROVIDING FOR A PENALTY FOR A VIOLATION
OF THIS ORDINANCE AND COMPREHENSIVE ZONING
ORDINANCE NO. 2001-48; PROVIDING FOR REPEALING,

WHEREAS, the City Council of the City of Wylie, Texas ("City Council") under
the authority of Section 43.021. Local Government Code and the City of Wylie, Texas'
(Wylie) Home Rule Charter, investigated and determined that it would be advantageous
and beneficial to Wylie and its inhabitants to annex the below-described property (the
"Property") to Wylie; and
WHEREAS, prior to conducting the public hearings required under Section
43.063, Local Government Code, the City Council also investigated and determined that
the Property is within the extraterritorial jurisdiction of Wylie and is adjacent and
contiguous to the existing city limits of Wylie; and
WHEREAS, before the publication of the notice of the first public hearing
regarding the annexation of the Property, the City Council directed the appropriate
persons to prepare a service plan that provides for the extension of full municipal services
to the Property to be annexed; and
WHEREAS, the City Council finds that the service plan has been prepared in full
compliance with Section 43.056, Local Government Code, and has been made available
for public inspection and was available for explanation to the inhabitants of the Property
at the public hearings; and
WHEREAS, the City Council finds that the field notes close the boundaries of the
Property being annexed; and
WHEREAS, the City Council has conducted at least two (2) public hearings at
which persons interested in the annexation were given an opportunity to be heard
regarding the proposed annexation and the proposed service plan; and
WHEREAS, the City Council finds that the public hearings were conducted on or
after the fortieth (40th) day but before the twentieth (20th) day before the date of
institution of the annexation proceedings; and
WHEREAS, the City Council finds it has completed the annexation process
within ninety (90) days after the City instituted the annexation proceedings; and
WHEREAS, the City Council finds that all legal notices, hearings, procedures and
publishing requirements for annexation have been performed and completed in the
manner and form set forth by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WYLIE, TEXAS:
SECTION l: The Property described in "Exhibit A" and all public streets,
roadways and alleyways located within or contiguous to the same is hereby annexed to
Wylie.
SECTION 2: The Service Plan for the Property is attached hereto as "Exhibit B"
and made a part hereof for all purposes.
SECTION 3: That from and after the passage of this Ordinance, the Property shall
be a part of Wylie, and the inhabitants thereof shall be entitled to all the rights and
privileges of all of the citizens of Wylie and shall be bound by all of the ordinances and
regulations enacted pursuant to and in conformity with the City Charter and the laws of
the State of Texas.
SECTION 4: That the official map and boundaries of Wylie are hereby amended
to include the property as part of the City of Wylie, Texas, and that a certified copy of
this Ordinance shall be filed in the County Clerk's office of Collin County, Texas.
SECTION 5: It shall be unlawful for any person, firm or corporation to make use
of the Property in some manner other than as authorized by this Ordinance and
Comprehensive Zoning Ordinance No. 2001-48, and any amendments thereto; and it
shall be unlawful for any person, firm or corporation to construct on the Property any
building that is not in conformity with the permissible use under this Ordinance and
Comprehensive Zoning Ordinance No. 2001-48, and any amendments thereto.
SECTION 6: Any person, firm or corporation who violates any provision of this
Ordinance and Comprehensive Zoning Ordinance No. 2001-48, and any amendment
thereto, shall be deemed guilty of a misdemeanor and upon conviction shall be fined a
sum not exceeding Two Thousand and 00/100 Dollars ($2000.00), and each and every
day such violation continues shall be considered a separate offense; provided, however,
such penal provision shall not preclude a suit to enjoin such violation.
SECTION 7: Should any part or portion of this Ordinance, or the use created
herein or under Comprehensive Zoning Ordinance No. 2001-48, and any amendments
thereto, be declared unconstitutional or invalid by any court of competent jurisdiction, it
is expressly provided that any and all remaining portions shall remain in full force and
effect.
SECTION 8: All ordinances in conflict with this Ordinance are repealed to the
extent they are in conflict, and any remaining portions of the conflicting ordinance shall
remain in full force and effect.
SECTION 9: The caption of this Ordinance shall be published in accordance with
the law and the City Charter and shall be effective immediately upon its passage or as
required by law.

Being a tract of land located on Pleasant Valley Road in Dallas County, Texas out of the
Guadalupe De Los Santos Survey, Abstract No. 1384, and being parts of Lots No. 1 and 2
of the partition of the Estate of Josiah Stone among his children and being part of a
154.31 acre tract and a 1.01 acre tract conveyed to B.B. Owen and H.A. Walker by deed
dated July 30, 1960 and filed for record August 5, 1960 in the Deed Records of Dallas
County, Texas and being more particularly described as follows:
BEGINNING at an iron stake on the Northwest R.O.W. of Pleasant Valley Road at the
intersection of said Northwest R.O. W. of said road with the Northeast line of said 154.31
Owen-Walker tract, said point being the North corner of a 3.83 acre tract conveyed to the
County of Dallas for road R.O.W. by deed dated February 7, 1969;
THENCE Southwesterly with the new R.O.W. of Pleasant Valley Road as
follows:
South 45 deg. 50' West 781.11 feet;
South 43 deg. 33' West 1,100.58 feet;
South 45 deg. 39' West 62.30 feet to an iron stake set in said R.O.W. for
corner;
THENCE North 45 deg. 49' 34" West across said 154.31 acre Owen-Walker
tract, 1,540.58 feet to an iron stake set in an old fence line for corner;
THENCE North 44 deg. 53' East with said old fence line and the Northwest line
of said Owen-Walker 154.31 acre tract 1,944 feet to an iron stake for corner set at the
base of a corner post for corner, said point being the North corner of said Owen-Walker
tract;
THENCE South 45 deg. 49' East with said old fence line and Northeast line of
said Owen-Walker tract, 1,528.76 feet to the Place of Beginning and containing 68.11
acres of land.

Municipal Services to the acreage described above shall be furnished by or on behalf of
the City of Wylie, Texas (the "City"), at the following levels and in accordance with the
following schedule:
A. POLICE SERVICE
1. Patrolling, responses to calls and other routine police services, within the
limits of existing personnel and equipment and in a manner consistent
with any of the methods of the City, extends police service to any other
area of the municipality, will be provided within sixty (60) days of the
effective date of the annexation ordinance.
2. As development and construction commence in this area, sufficient police
personnel and equipment will be provided to furnish this area the
maximum level of police services consistent with the characteristics of
topography, land utilization and population density within the area as
determined by the City Council within four and one-half (4-1/2) years
from the effective date of the annexation ordinance, or upon
commencement of development within the area, whichever occurs later.
3. Upon ultimate development of the area, the same level of police services
will be provided to this area as are furnished throughout the City.
B. FIRE SERVICES
1. Fire protection by the present personnel and the present equipment of the Fire
Department, within the limitations of available water and distances from
existing fire stations, and in a manner consistent with any of the methods of
the City, extends fire service to any other area of the municipality, will be
provided to this area within sixty (60) days of the effective date of the
annexation ordinance.
2. As development and construction commence in this area, sufficient fire and
emergency ambulance equipment will be provided to furnish this area the
maximum level of fire services consistent with the characteristics of
topography, land utilization and population density within the area as
determined by the City Council within four and one-half (4-1/2) years from
the effective date of the annexation ordinance, or upon commencement of
development within the area, whichever occurs later.
3. Upon ultimate development of the area, the same level of fire and emergency
ambulance services will be provided to this area as are furnished throughout
the City.
C. ENVIRONMENTAL HEALTH AND CODE ENFORCEMENT SERVICES
1. Enforcement of the City's environmental health ordinances and
regulations, including but not limited to, weed and brush ordinances,
junked and abandoned vehicle ordinances and animal control ordinances,
shall be provided within this area sixty (60) days of the effective date of
the annexation ordinance. These ordinances and regulations will be
enforced through the use of existing personnel.
2. Complaints of ordinance or regulation violations within this area will be
answered and investigated within sixty (60) days of the effective date of
the annexation ordinance.
3. Inspection services, including the review of building plans, the issuance of
permits and the inspection of all buildings, plumbing, mechanical and
electrical work to ensure compliance with City codes and ordinances will
be provided within sixty (60) days of the effective date of the annexation
ordinance. Existing personnel will be used to provide these services.
4. The City's zoning, subdivision, sign and other ordinances shall be
enforced in this area beginning within sixty (60) days of the effective date
of the annexation ordinance.
5. All inspection services furnished by the City, but not mentioned above,
will be provided to this area beginning within sixty (60) days of the
effective date of the annexed ordinance.
6. As development and construction commence in this area, sufficient
personnel will be provided to furnish this area the same level of
Environmental Health and Code Enforcement Services as are furnished
throughout the City.
D. PLANNING AND ZONING SERVICES
The planning and zoning jurisdiction of the City will extend to this area within
sixty (60) days of the effective date of the annexation ordinance. City planning
will thereafter encompass this property, and it shall be entitled to consideration
for zoning in accordance with the City's Comprehensive Zoning Ordinance and
Comprehensive Plan.
E. PARK AND RECREATION SERVICES
1. Residents of this property may utilize all existing park and recreational
services, facilities and sites throughout the City, beginning within sixty (60)
days of the effective date of the annexation ordinance.
2. Additional facilities and sites to serve this property and its residents will be
acquired, developed and maintained at locations and times provided by
applicable plans for providing parks and recreation services to the City.
3. Existing parks, playgrounds, swimming pools and other recreational facilities
within this property shall, upon dedication to and acceptance by the City, be
maintained and operated by the City of Wylie, but not otherwise.
F. SOLID WASTE COLLECTION
1. Solid waste collection shall be provided to the property in accordance with
existing City policies, beginning within sixty (60) days of the effective
date of the annexation ordinance. Residents of this property utilizing
private collection services at the time of annexation shall continue to do so
until it becomes feasible because of increased density of population to
serve the property municipally. Commercial refuse collection services
will be provided to any business located in the annexed area at the same
price as presently provided for any business customer within the City,
upon request.
2. As development and construction commence in this property and
population density increases to the property level, solid waste collection
shall be provided to this property in accordance with the current policies
of the City as to frequency, changes and so forth.
3. Solid waste collection shall begin within sixty (60) days of the effective
date of the annexation ordinance.
G. STREETS
1. The City's existing policies with regard to street maintenance, applicable
throughout the entire City, shall apply to this property beginning within sixty
(60) days of the effective date of the annexation ordinance. Unless a street
within this property has been constructed or is improved to the City's
standards and specifications, that street will not be maintained by the City.
2. As development, improvement or construction of streets to City standards
commences within this property, the policies of the City with regard to
participation in the costs thereof, acceptance upon completion and
maintenance after completion, shall apply.
3. The same level of maintenance shall be provided to streets within this
property which have been accepted by the City as is provided to City streets
throughout the City.
4. Street lighting installed on streets improved to City standards shall be
maintained in accordance with current City policies.
H. WATER SERVICES
1. Connection to existing City water mains for water service for domestic,
commercial and industrial use within this property will be provided in
accordance with existing City policies. Upon connection to existing mains,
water will be provided at rates established by City ordinances for such service
throughout the City.
2. As development and construction commence in this property, water mains of
the City will be extended in accordance with provisions of the Subdivision
Regulations and other applicable ordinances and regulations. City
participation in the costs of these extensions shall be in accordance with the
applicable City ordinances and regulations. Such extensions will be
commenced within two (2) years from the effective date of the annexation
ordinance and substantially completed with four and one-half (4 1/2) years
after that date.
3. Water mains installed or improved to City standards which are within the
annexed area and are within dedicated easements shall be maintained by the
City of Wylie beginning within sixty (60) days of the effective date of the
annexation ordinance.
4. Private water lines within this property shall be maintained by their owners in
accordance with existing policies applicable throughout the City.
SANITARY SEWER SERVICES
1. Connections to existing City sanitary sewer mains for sanitary sewage service
in this area will be provided in accordance with existing City policies. Upon
connection, sanitary sewage service will be provided at rates established by
City ordinances for such service throughout the City.
2. Sanitary sewage mains and/or lift stations installed or improved to City
standards, located in dedicated easements, and which are within the annexed
area and are connected to City mains will be maintained by the City of Wylie
beginning within sixty (60) days of the effective date of the annexation
ordinance.
3. As development and construction commence in this area, sanitary sewer
mains of the City will be extended in accordance with provisions of the
Subdivision Regulations and other applicable City ordinances and regulations.
Such extensions will be commenced within two (2) years from the effective
date of the annexation ordinance and substantially completed within four and
one-half(4 1/2) years after that date.
J. MISCELLANEOUS
1. Any facility or building located within the annexed area and utilized by
the City in providing services to the area will be maintained by the City
commencing upon the date of use or within sixty (60) days of the effective
date of the annexation ordinance, whichever occurs later.
2. General municipal administrative services of the City shall be available to
the annexed area beginning within sixty (60) days of the effective date of
the annexation ordinance.
3. Notwithstanding, anything set forth above, this Service Plan does not
require all municipal services be provided as set forth above if different
characteristics of topography, land use and population density are
considered a sufficient basis for providing different levels of service.
4. The Service Plan is valid for ten (10) years from the effective date of this
Ordinance.
