Consider and act upon a recommendation to City Council regarding a Replat of St. Anthony Catholic Church Addition No. 2, Lot 1, Block A, generally located north of East Brown Street and east of North Ballard Avenue. Staff Comments Ms. 011ie addressed the Commissioners stating that the applicant desires to combine three tracts and three separate lots into one single lot and block for future development and expansion of existing structures. This combination of land includes the 2.208 acres of land annexed into the city on August 14, 2012; the overall total is 20.011 acres. The Replat complies with all applicable technical requirements of the City of Wylie. Applicant Discussion Mr. Joe Helmberger, Helmberger and Associates, 315 Houston, Farmersville, Texas, representative for the applicant, addressed the Commissioners stating that the Catholic Church plans on expanding the main sanctuary, and constructing a youth educational center. The initial master plan is to move the old chapel to sit further back on the lot, and increase the number of parking spaces. The Catholic Church is in the preliminary design stages and nothing is ready to submit to the City of Wylie at this time. Board Action A motion was made by Commissioner Harris, seconded by Commissioner Smith to recommend approval to the City Council regarding a Replat of St Anthony Catholic Church Addition No 2, Lot 1, Block A, subject to additions and/or alterations by the Engineering Department. The property is generally located north of East Brown Street and east of North Ballard Avenue. A vote was taken and passed 6 — 0, with Commissioner Wright being absent. The Final Plat for Phase 1B was approved by Council in August of 2005 and included 13.287 acres and created 55 single-family attached townhouse lots and 5.479 acres of dedicated open space. The development standards of the PD referred to the zoning ordinance in place at the time, which allowed for front yard setbacks of 15 feet with a rear setback of 25 feet. However, at the time of construction, the developer set the front yard at 20 feet in order to allow for a gentler slope. This accommodation pushed the entire footprint of the house back 5' into the rear setback. The lot depth narrowed from west to east by approximately 5 feet, which also increased the potential for encroachment. The subject homes back up to the St. Louis Southwestern Railroad Company, therefore no negative impact on any adjacent homeowners. Exhibit C is the 2003 approved Planned Development Conditions and is included for reference. Sixty-six (66) notifications were mailed to property owners within 200 feet in accordance with State Law. As of September 12, 2012 one (1) response favoring the request was received, and one (1) response opposing. WYLIE LAKES REZONING REQUEST Wylie Lakes was zoned to a planned development in August 2003 (Ord.No. 2003-18). A portion of Tract 2 was zoned to the(III)Townhouse zoning district. The Townhouse zoning district at the time of the rezoning allowed for a 15' front yard. Phase 1 B of the Wylie Lakes Addition was final platted for 55 townhome lots in September 2006. (Lots 5-59, Block E) All of these lots are located on the south side of Colby Lane. The 15' front building line was established on this final plat. When DR Horton started to build homes on these lots,a 20' front building line was used so that the front yard would have a gentler slope. This accommodation slid the entire house back 5' into the lot. No one checked to see if this created any problem at the rear of the lots since there was still a 20' rear setback from the face of the garage to the alley. Unfortunately,the Townhouse zoning district requires a minimum rear setback of 25'. As such,the majority of the 36 newly constructed homes encroached into that 25' rear yard. The error has come to light through the review process of a recently submitted building permit. There are 10 homes currently under construction. All of these homes have a 20' front setback, which means they have all been pushed 5' deeper in the lot as the previously built homes were. None of the homes currently under construction or previously built have been over-built on the lot. Instead of a 15' front setback and 25' rear setback(40 total feet of setback.)the homes have a 20' front setback and 20' rear setback(40 total feet of setback). Since these lots do not and will not have homes backing to them. The 5' rear yard encroachment does not have a negative impact on adjacent homeowners.
