REGULAR AGENDA Regular Hearing 1. Consider, and act upon, a recommendation to the City Council regarding a Preliminary Plat for Woodbridge Phase 16, consisting of 25.803 acres for 111 single family residential lots and 5 HOA open space lots, generally located north of Sachse Road at Creek Crossing Drive. 2. Consider, and act upon, a recommendation to the City Council regarding a Final Plat for Creekside Estates Phase VI consisting of 15.937 acres for 45 single family residential lots and 1 open space lot dedicated to the City of Wylie, generally located east of McCreary Road, north of Ruby Drive and Phase IV and west of Riverchase Subdivision. 3. Consider, and act upon, a recommendation to the City Council regarding a Final Plat for Creekside Estates Phase VII consisting of 23.014 acres for 10 single family residential lots and 1 open space lot dedicated to the City of Wylie, generally located east of Phase VI, west of Riverchase Subdivision and Rita Smith Elementary. 4. Present with Chairman Johnston were, Vice-Chairman Commissioner Gilbert Tamez, Commissioner Ruthie Wright, Commissioner David Dahl, Commissioner F. Darnell Harris, and Commissioner Ramona Kopchenko. Commissioner Ron Smith was absent. Staff present was Renae' 011ie, Planning Director, Charles Lee, Senior Planner, and Jasen Haskins, Assistant Planner. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Tamez gave the invocation and Commissioner Dahl led the Pledge of Allegiance. CITIZENS COMMENTS Chairman Johnston opened the Citizens Participation. With no one approaching the Commissioners, Chairman Johnston closed the Citizens Participation. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the August 21, 2012, Regular Meeting. Board Action A motion was made by Commissioner Dahl, and seconded by Commissioner Tamez, to approve the Minutes from the August 21, 2012 Meeting as presented. A vote was taken and passed 6—0, with Commissioner Smith being absent. REGULAR AGENDA Public Hearing 1. Hold a Public Hearing and consider a recommendation to the City Council, amending PD 2003-18, Section 5.b.i to re-establish the front and rear yard setbacks for the Townhouse (TH) District, within the Wylie Minutes September 18,2012 Wylie Planning and Zoning Board Page 1 of 4 Lakes Subdivision, generally located east of Forrest Ross Road and south of Skyview Drive. ZC 2012-09. Staff Comments Ms. 011ie addressed the Commissioners stating that the property owner is DR Horton, and the applicant is JBI Partners. The request is to amend PD 2003-18 of the Wylie Lakes Subdivision, Phase 1B, which the Final Plat was approved in August 2005. The PD 2003-18 includes 13.287 acres and created 55 single-family attached townhouse lots and 5.479 acres of dedicated open space. The Planned Development calls for 15 feet front yard setback with a 25 feet rear setback. When the homes were constructed, the homes were placed 20 feet front yard setback to allow for a gentler slope. The lot depth narrowed from west to east by approximately 5 feet, which also increase the potential for encroachment. The applicant is proposing to amend the PD 2003-18, for this particular section to allow for a 20 foot front yard setback and a 20 foot rear yard setback. Sixty-six notifications were mailed to property owners within 200 feet. One response was received in favor and one response in opposition of the request. The one in opposition, Ms. 011ie explained was not verbally contacted, but believes that the opposition may be due to a misunderstanding of the request. The request was not to allow additional townhouses, but rather amend setbacks on existing townhouse district zoning. Ms. 011ie stated that the request is for Phase 1 B, that allows townhouses. The applicant desires to amend all the townhouses within this phase to confirm the setbacks are within the requirements. Commissioner Tamez expressed opposition of the developer asking for amendment after the fact that the townhouses were already constructed. Ms. 011ie stated that the existing townhouses are built with 20 feet front yard setback. The error was not intentional by builder, developer or city inspector, but rather missed during construction and inspection. If lots are not measured individually than the setbacks have the potential to be off. Applicant Discussion Mr. Jeff Miles, 16301 Corwin Drive, Addison, representing DR Horton Homes, addressed the Commissioners stating that homes were constructed within Phase 1B in 2006. Within most subdivisions the back yard setback is 20 feet. The houses constructed on lots 5, 6, 7, etc., needed the additional 5 feet in the front yard to make gentle slope, so the rear yard was made 20 feet instead of the 25 feet. The error was not intentional, but rather a mistake. The 5 feet rear yard encroachment does not have a negative impact on adjacent homeowners. These lots do not and will not have homes backing to them. Chairman Johnston opened the Public Hearing. With no one approaching the Commissioners, Chairman Johnston closed the Public Hearing. Hold a Work Session to discuss potential development of approximately 53 acres generally located south of S.H. 78, east of Wylie East Drive and north of Wylie East High School. Property is within Wylie's Extraterritorial Jurisdiction. Ms. 011ie presented the applicants, Mr. Jim Douglas, Richard Hovas and Mr. J.R. Douglas who are representing property owner Mr. and Mrs. Bill Lewis. The property is within city of Wylie's ETJ, and located off Wylie East Drive and Bennett Road. The property is north of the Wylie East High School. The applicant approached the staff at City of Wylie, as well as joint meeting with Wylie Independent School District. The property would need to go through annexation process to incorporate approximately 50 acres. The applicant desires to present a plan for the property and receive comments from the Commissioners, with direction to staff whether or not to move forward with annexation. The applicant is the same developer as the Kreymer Estates Subdivision. The applicant desires to develop the property very similar to Kreymer Estates. Mr. Jim Douglas, 2309 Avenue K, Suite 100, Plano, Texas, presented a plan for tract of land to be annexed and developed as a single-family residential community with a small parcel to be set aside for neighborhood services zoning. A tract of land will be dedicated to the City of Wylie as open space and parkland, which will be maintained by Homeowner's Association. The proposal will be presented to Parks Board next week. Chairman Johnston questioned the type of screening. Mr. Douglas stated that WISD requested a masonry wall along the southern property line between the school and the subject development; along Wylie East Drive the screening can be masonry wall with wood intertwined or a other materials could be presented. The property owner, Mr. and Mrs. Lewis will continue to live on the 16 acres adjacent to the proposed development. The design of the development was discussed with Mr. and Mrs. Lewis regarding what they wanted to have next to them. Mr. Douglas stated that the northeast corner of the property at Highway 78 and Wylie East Drive could be considered for a small retail building, such as CVS or Walgreens. Commissioner Tamez questioned the development of the dock and security of the dock and stated that the dock is an invitation for kids to jump or to go swimming. Mr. Douglas stated that if there is a concern, the dock can go away. The intent was for the dock to be an addition to the development. Mr. Douglas stated the presentation was minimum and it is not a deal breaker. Minutes September 18,2012 Wylie Planning and Zoning Board Page 3 of 4 Commissioner Wright questioned the runoff to the east down to Bennett Road, and asked whether a study will be done. Mr. Douglas stated that they took the initiative to talk to the lady on Bennett Road, and will be in more contact with the property owner and City Engineer. Commissioner Kopchenko asked for a natural berm along Wylie East Drive. Mr. Douglas stated that natural landscaping and berm takes time to mature. The lake will be open, it will not be screened. Ms. 011ie polled the Commissioners for direction to see if the applicant should move forward on annexation. One of the concern was the development supports the infrastructure, the quality of the home will determine the tax base. Another concern was having the houses spread out and not built on top of one another. It was a general consensus of the Commissioners that they liked the concept and would like to see more detail when officially submitted.
