Board Members present were; Board Member Karyn McGinnis, Board Member Kelly Price, Board Member Linda Jourdan, and Board Member Darnell Harris. Staff members present were: Renae' 011ie, Planning Director, Jasen Haskins, Assistant Planner, and Mary Bradley, Administrative Assistant. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the April 16, 2012 Meeting. A motion was made by Board Member Harris, and seconded by Board Member Jourdan, to approve the Minutes from the April 16, 2012 Meeting as submitted. Motion carried 5 — 0. PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Wylie ISD for a Variance to Section 3.1 A (3) Development Standards of the Zoning Ordinance for A/30 zoned properties requiring a minimum 50 feet front yard setback, property located at 3000 Wylie East Drive, being Lot 1, Block A of the Wylie East high school Addition. ZBA 2012-06. Staff Comments Mr. Haskins stated that the property is located at 3000 Wylie East Drive. The applicant is Wylie Independent School District, Wylie East High School. The Minutes May 21, 2012 Wylie Zoning Board of Adjustment Page 1 of 5 applicant is requesting a variance to setbacks for property zoned AG/30, which requires a fifty foot front yard setback. The request is for thirty foot setback. The proposal is for an expansion that is thirty-five feet and six inches from the west property line. This part of Phase II expansion that was noted on the original Site Plan approved in 2007. A consideration for hardship is that all public schools are allowed within any zoned property in the City and are not usually required to rezone prior to building. Wylie East was built on property zoned AG/30 and was not rezoned. If the property had been zoned CC or SF10 when the school was built, the setback would be 25' and a variance would not be required. Twenty-two (22) public comment forms were mailed to property owners within 200 feet, as required. One response was received against the request, and staff responded by a return letter with additional explanation of the proposed variance. Chairman Baumbach opened the Public Hearing. Mr. Robert D.K. Dean, 14001 N Dallas Parkway, Dallas, representative for the applicant, stated that the proposed expansion was shown on the initial Site Plan, shown as a dashed area of Phase II. Board Discussion Board Member Jourdan questioned if the expansion was to the band hall. Mr. Dean stated that the overall plan was to remodel the existing band hall into a black box theater and construct a new band hall. Board Member Darnell expressed desire for clarification of how close the expansion would be to the proposed student parking lot. Mr. Dean stated that the expansion is close to the front of the proposed student parking lot. Chairman Baumbach closed the Public Hearing. Board Action A motion was made by Board Member Jourdan, and seconded by Board Member Harris to Grant the request for a variance for a thirty (30) foot front yard setback in lieu of the required fifty (50 foot setback from Section 3.1.A (3) Development Standards of the Zoning Ordinance. This variance is tied to the property located at 3000 Wylie East Drive, being Lot 1, Block A of the Wylie East High School Addition. Motion carried 5 — 0. ZBA 2012-07 Discussion The subject property is located at 1100 West Brown Street. The property is owned and occupied by New Hope Christian Church and zoned as SF 10/24. In 2010 the applicant attended a Development Issues Review Team (DIRT) meeting in which they proposed a site plan and elevations for a new and separate addition to the New Hope Christian Church. However, the church, with a variance from ZBoA, placed a temporary building on site until the construction of a permanent structure is financially possible. That variance needs to be renewed. In addition, the church is asking for a variance to place a second similar building next to the first. The Zoning Ordinance allows for a temporary structure to be placed on site for up to 90 days during a given 12 month period. The applicant foresees a longer than 90 day time period being needed for the temporary building. Therefore the applicant is requesting a variance to that Section of the Ordinance 5.5.A. The requested variance is to last for one year or until the completion and occupancy of a new building,whichever comes first. The applicant has stated that construction of the permanent facilities should begin in January of 2013. The Board can approve the Variance as requested or for any time period it sees fit. The Board has approved similar requests in the past 12 months. Public comment forms were mailed to 38 property owners within 200 feet of this request, as required by State Law.No responses were received at the time of this posting. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements Page 1 of 2 Page 2 of 2 ZBOA 2012-07 of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions,the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
