January 11, 1994
CALL TO ORDER
Mayor John Akin called the meeting to order with the following Councilmembers
present: Jim Swartz, Reta Allen, John Mondy, Steve Wright, Bud Naish, and Ortie
Messenger. No members were absent.
MINUTES OF DECEMBER 14, 1993
Naish made a motion to approve the minutes. Swartz seconded the motion. The
motion was voted on and passed unanimously.
ORDINANCE NO. 93-59 GRANTING A FRANCHISE TO GTE
AN ORDINANCE WHEREBY THE CITY OF WYLIE, TEXAS, AND GTE SOUTHWEST
INCORPORATED AGREE THAT, FOR THE PURPOSE OF OPERATING ITS
TELECOMMUNICATIONS BUSINESS, THE TELEPHONE COMPANY SHALL CONSTRUCT,
ERECT, BUILD, EQUIP, OWN, MAINTAIN AND OPERATE IN, ALONG, UNDER, OVER AND

City Manager Steve Norwood explained that the ordinance had been approved on first
reading and outlined the provisions of the ordinance including the "most favored city"
clause which provides automatic implementation of any increased benefit that another
city may receive. Messenger made amotion to approve the ordinance. Wright seconded
the motion. The motion, upon the reading of the caption, was voted on and passed with
all in favor except Naish who abstained from voting due to a potential conflict of interest.
AWARD OF PROPOSAL TO GSA FOR ADMINISTRATION OF URGENT NEED GRANT
Norwood explained that the City had been approved for a$350,000 grant to assist
storm victims with relocation and rehabilitation. Norwood noted that only one proposal
had been received but the proposal was $5000 less than the approved amount for
administration of the grant. David Lewis with GSA, explained that the application had
allowed for twenty (20) rehabilitations of$10,000 each and four (4) relocations of$25,000
as well as $20,000 for demolition and $30,000 for administration. He explained that GSA
would be working with staff to develop application guidelines and would be expediting
the grant applications as quickly as possible. Swartz made a motion to award the
proposal to GSA. Naish seconded the motion. The motion was voted on and passed
unanimously.
RESOLUTION NO. 94-1 SUPPORTING APPLICATION TO THE CRIMINAL JUSTICE
DIVISION FOR A SCHOOL RESOURCE OFFICER
Norwood explained that the resolution was a result of joint meetings with the Wylie
I.S.D. to create a school resource officer program. He outlined the program and the
funding expected by the grant. Messenger made a motion to approve the resolution.
Naish seconded the motion. The motion was voted on and passed unanimously.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE WYLIE
CITY CODE BY ADOPTING PAVING DESIGN STANDARDS TO BE UTILIZED AND
COMPLIED WITH IN CONSTRUCTION OF PUBLIC IMPROVEMENTS WITHIN THE
CITY AND ITS EXTRA TERRITORIAL JURISDICTION; REPEALING ALL
CONFLICTING ORDINANCES;CONTAINING A PENALTY CLAUSE;CONTAINING
A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the City does not presently have comprehensive and uniform design standards
for paving within the City and its Extraterritorial Jurisdiction (ETJ) (herein collectively referred
to as Jurisdiction); and,
WHEREAS, the City Council has determined that such standards are necessary to facilitate
the orderly, safe, healthy and uniform development within its jurisdiction, as well as being a
necessary complement to the Subdivision Ordinance recently enacted by the City; and,
WHEREAS, the Standards hereinafter detailed and specified have been approved by the City
engineer and appropriate staff personnel;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS, as follows:
SECTION I
That the "Paving Design Standards" as specified, detailed,and enumerated on the attached
Exhibit A, are hereby fully incorporated herein by reference with the same force and effect as
if enumerated within the body of this ordinance, and the same shall be, and they hereby are,
ordained and adopted as the Paving Design Standards for the City of Wylie, Texas.
SECTION II
A. Any person violating the provisions of this ordinance, or any part hereof, commits an
unlawful act and shall be subject to the penalty provisions of the Wylie City Code as set forth
in Section 1-1.06(1) thereof, as the same now exists or is hereafter amended, which presently
provides for a fine of up to $2,000.00 per day.
B. In addition to the above penalties, the City shall also have the right to institute and
maintain appropriate civil actions and proceedings in law or in equity to prevent unlawful
construction, to recover damages, to impose additional penalties, to restrain, correct or abate a
violation of the Standards, whether the same occurs within the corporate boundaries of the City

or within its ETJ.
C. The penalties provided for in paragraph A., shall not apply to violations occurring
wholly within the City's ETJ.
SECTION III
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part or parts as
declared to be invalid, illegal, or unconstitutional.
SECTION IV
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION V
That all other ordinances and code provisions in conflict herewith are hereby repealed to the
extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not
in conflict herewith shall remain in full force and effect.
SECTION VI
The repeal of any ordinance, of parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or
to accrue, nor as effecting any rights of the municipality under any section or provisions of any
ordinances at the time of passage of this ordinance.

SUMMARY OF SUBJECT:
I do not expect to be out of the office for maternity leave prior to May 7th. However,
in case of unforeseen circumstances, we need to appoint a-deputy city secretary to
execute election related documents in my absence. The City Secretary is a City
Manager appointed position so this resolution is really not necessary for day to day
duties. However, the Election Code is vague regarding the deputy Early Voting Clerk
appointments and their authority. As the City Secretary is the Early Voting Clerk and I
the Chief Administrator of Elections, we thought it best that such a substitution be

As we discussed at the last Council meeting, the grant requires that we develop
guidelines for distribution of the funds. We have attempted to develop these
guidelines as liberally as possible in order to accommodate applicants. However, we
are required to make certain safeguards against fraud and abuse. David Lewis with
GSA will be here Tuesday night to help answer questions.

Urgent Need Grant Administration
TO: Steve Norwood, City Manager

Now that we have had several meetings with the representatives of GSA, the firm
assisting us with the administration of the Urgent Need Grant, the following actions still
need to be taken regarding the grant:
(1) We have yet to receive the contract from the State for execution. This will
probably be sent to the Mayor's office. Once we've executed the contract, we will
actually be able to receive the funds.
(2) Meanwhile, we are getting through the paperwork as quickly as possible.
Attached are the draft guidelines for the rehabilitation and relocation distributions
that you and I discussed with David Lewis. Council will, of course, be able to
modify these any way they see fit prior to adoption, but we would like them
adopted as soon as possible.
(3) Tornado victims are calling me daily. As soon as the guidelines are adopted,we'll
begin accepting their applications.
(4) The Finance Department will be required to set-up a separate interest-bearing
account for the grant funds. These funds must be kept separate from any other
funds. The only other requirement of the Finance Department will be to cut
checks once a project is ready to be paid. Each check will need to bear the
signature of both the Finance Director and the City Manager.
(5) We have sent a letter to the auditors who will be notifying the Texas Department
of Housing & Community Affairs that the City has a financial system adequate to
account for the grant funds and that the grant funds will be audited with our
annual audit at the end of our fiscal year.
(6) All grant files will be filed in a separate file cabinet in the City Secretary's office
provided specifically this purpose. The file is accessible to GSA who will be
coming in frequently to review applications, file paperwork from the state, and take
care of miscellaneous accounting paperwork.
(7) Council will need to appoint the Housing Advisory Board as soon as possible to
review the applications. We have scheduled these appointments for Tuesday,
January 25th.
MINUTES
Parks & Recreation Advisory Board
December 13, 1993
The Parks & Recreation Advisory Board met in regular session on Monday, December 13, 1993
in the Council Chambers of the Municipal Complex at 2000 SH 78 N. A quorum was present
and notice had been posted in the time and manner required by law.
The meeting was called to order by Chairman John Burns.
ITEM NO. 1 - DISCUSS AND CONSIDER APPROVAL OF MINUTES FOR MEETING
HELD ON OCTOBER 25. 1993 - Bill Nelson made a correction in Item 3 last paragraph, to
read "Jerry Smith made a motion that three small bleachers at a cost of$2200 be deleted ....".
A motion was made by Aubrey Burroughs that the minutes be approved as corrected. Motion
seconded by Mark Jenneman. Motion carried.
ITEM NO. 2 - DISCUSS AND CONSIDER ATHLETIC FIELD POLICY - Mr. Nelson stated
he had met with Dan Chestnut, Parks & Recreation Advisory Board member and member of
Wylie Sports Association (WSA). Attached to these minutes is a copy of the Athletic Field
Policy as originally presented, together with a copy of the proposed changes as determined
through the meeting between Mr. Nelson and Mr. Chestnut. Discussion items included priority
rights for field usage; athletic field reservation times; athletic field reservation usage fees; athletic
field light usage fees; possibility of opening the baseball fields for use by February 1; policy
exceptions for field usage outside the stated season dates. Aubrey Burroughs made a motion to
recommend the proposed athletic field policy and the changes presented this evening and outlined
on the attached handout, in addition to including a statement to the effect that "league play has
priority over tournament reservations". Seconded by Mark Jenneman. Motion carried.
ITEM NO. 3 - DISCUSS AND CONSIDER ACTION RELATED TO ATHLETIC FIELD
LIGHT FEES: Discussion items included the request that field light usage fees be a flat fee.
Mr. Nelson presented copies of the light bills and explained his opposition to flat fees. Jerry
Smith brought up the 15% increase in electric rates that will impact the park electric bills. No
action taken.
ITEM NO. 4 - COMMUNITY PARK FUND FY 93-94: Discussion items included revisions
in the allocation of funds from the Park Fund. Mr. Nelson spoke with the City Manager
concerning a transfer of funds into the Park Fund in order to take care of the large bleachers for
soccer, ball diamond clay, Rowell fence and the scoreboard. These funds will have to be paid
back from season revenues. Also discussed was the time frame for building the fence for Rowell
field and the installation of the scoreboards.
ITEM NO. 5 - DISCUSS SCOREBOARDS/FENCE SIGNAGE: Mr. Nelson provided copies
of the City's ordinances relevant to signs. Mr. Nelson had spoken with the City Building

Official who interpreted the ordinances to allow advertising signs on the fence. The WSA is
requesting that advertising space be sold for the fences to generate funds for WSA. John Burns
asked if the City would receive any share of the revenue realized from this item. Jerry Smith
asked how long these signs would remain on the fences. Answer from representative from WSA
was that the signs would be removed at the end of the season.
ITEM NO. 6 - WSA PRESENTATION: Dan Chestnut would like an item on the next agenda
to discuss groups that use the park for profit making.

AS ADOPTED BY ORDINANCE 93-9

This policy is to be administered by the City of Wylie Parks and Recreation Department
in regard to the use of outdoor public recreation areas for athletic activities. The purpose
of this policy is to serve as a guide for the comprehensive and effective usage of outdoor
athletic areas owned, leased, scheduled or otherwise controlled by the City of Wylie
Parks and Recreation Department.
It is the intent of this policy to provide a basis for establishing the following objectives:
1) A method of communicating the available inventory of allocatable athletic facilities
to qualified requestors for usage of such facilities.
2) The implementation of a system of facilities allocation producing results most
beneficial to the total City and surrounding communities.

ATHLETIC FIELD ALLOCATION
Organizations or groups requiring facilities for practice and or league games will submit
their request in writing to the City of Wylie Parks and Recreation Department not earlier
than 60 days nor later than 30 days prior to the beginning of the Sports Season. The
request should address the following:
1) Organization/Group Name
2) Starting and ending dates for practice and league play
3) Participation estimates
4) Estimate of number of teams
5) Estimate of the number of practices and games to be played on a weekly
basis by each team in the league
Field allocations will be based upon total game units per week as per available facilities
in order to maximize use of all facilities. The City of Wylie Parks an Recreation
Department will respond to each request with a written approval, denial or a statement
of conditions to be met upon acceptance of approval. Final registration estimates and
current participant registration figures must be submitted by each approved
organization/group two (2) calendar weeks after the start of the specific sport season.
If actual registration numbers are more/less than the estimated registration numbers, the
City of Wylie Parks and Recreation Department may increase/decrease the
organizations/groups field allocations in order to insure an equitable allocation of fields
to all organizations/groups.
ATHLETIC FIELD RESERVATIONS
Athletic fields will be reserved as equitably as possible to accommodate as many
organizations/groups as possible. Citizens of Wylie and surrounding communities and
area will be given priority. Extra consideration will be given to those who abide the Field
Allocation policy as stated above.
The use of athletic fields by the general public during non-reserved/non-City maintenance
times are on a first come, first serve basis. Reserved fields/City maintenance will take
priority over non-scheduled activities. The City of Wylie Parks and Recreation
Department will be the final authority as to athletic field reservation use.
ATHLETIC FIELD RESERVATION TIME SLOTS
Athletic fields will be reserved in one (1) hour increments with the first field usage
beginning at 8:00 A.M. and the last ending at 11:00 P.M., Monday - Thursday; 12:00
midnight, Friday and Saturday. Sunday field usage begins at 12:00 P.M. and ends at
11:00 P.M.

ATHLETIC FIELD RESERVATION USAGE FEE
A fee of $2.00 per person, per sport season for organizations/groups will be charged for
the use of reserved athletic fields. This fee shall be paid to the City of Wylie Parks and
Recreation Department by the responsible organization/group within two (2) weeks after
the start of the specific sport season. The total amount of fees due will be based on the
current participant registration figures at that time. Any increase in participants after
initial payment will result in extra fees being due based on $2.00 per person, per sport
season format. A cash receipt shall be issued by the City of Wylie Parks and Recreation
Department containing the following:
1) Individual's Name
2) Organization's/Group's Name
3) Team Sport/Sport Season
4) Number of Teams and Participants
5) Amount Paid
ATHLETIC FIELD RESERVATION - NON-LIGHTED USE
A receipt shall be issued by the City of Wylie Parks and Recreation Department when a
reservation is confirmed. This receipt shall show the following:
1) Individual's Name
2) Organization's/Group's Name if Applicable
3) Names of the Team That Will Be Utilizing The
Reservation
4) The Day(s), Time(s) and Location(s) of the
Reservation
A new receipt will be issued in the event the date, time or location of a reservation is
changed.
ATHLETIC FIELD LIGHT USAGE FEE
A fee of $3.00 per hour per field will be charged for reservation in which lights are
utilized. Reservation sessions vary through the course of a calendar year to coincide
with sunset. The City of Wylie Parks and Recreation Department shall determine the

ATHLETIC FIELD RESERVATION FOR TOURNAMENT USE
Requests for athletic fields for tournament use shall be made in writing. The City
of Wylie Parks and Recreation Department requests thirty (30) days advance notice. The
price per field reservation fees are as follows:
Friday Night and All of Saturday
$100.00 (Includes Light Usage)
Friday Night and All of Saturday and Sunday
$150.00 (Includes Light Usage)
A security deposit of $100.00 per field reserved shall be paid at least fourteen (14) days
in advance of the scheduled tournament. The deposit(s) shall be credited towards any
monies due for said tournament, with any remaining monies due payable seven (7) days
in advance of the scheduled tournament. All monies paid will not be refundable unless
a field or fields are not playable due to weather conditions, wet field conditions or for
necessary maintenance. If a field or fields are not playable due to said conditions, a
refund or credit will be given. The City of Wylie Park and Recreation Department will be
the final authority as to athletic field use.
A cash receipt shall be issued by the City of Wylie Parks and Recreation Department at
the time the fee is paid and the reservation is confirmed. This receipt shall contain the
following:
1) Individual's Name
2) Organization's/group's Name

A tournament is defined as team competition separate and distinct from league play
involving the payment of an entry fee or additional fees in which to participate. A curfew
of 12:00 Midnight shall be imposed on all tournaments utilizing lights, Monday -
Thursday; 1:00 a.m. on Friday and Saturday. A curfew of 11:00 p.m. shall be imposed
on Sundays.
MISCELLANEOUS
The City of Wylie Parks and Recreation Department will provide homeplate, pitching
rubbers, base distance markers on fences and will drag and mark baseball/softball
infields for fee paid game/toumaments reservations. Soccer and football fields will be
marked for fee paid game reservations. Athletic fields for non-reserved general pubic
use or reserved practices are accepted on an as-is basis.
The City of Wylie Parks and Recreation Department requests 24 hours or more notice
of a reservation. Requests for athletic fields with less than 24 hours notice will be
accommodated if possible. Earlier requests are required for Tournament Use (See
Athletic Field Reservation for Tournament Use).
A person may cancel a reservation and be issued a credit or refund up to 24 hours prior
to the reservation. A credit or refund will be issued with less than 24 hours notice of
cancellation if the City of Wylie Parks and Recreation Department is able to rent the
athletic field(s) to another party or if field maintenance preparation of the reservation has
not started. This paragraph does not apply to Tournament Use. (See Athletic Field
Reservation for Tournament Use).
Any and all athletic field use may be canceled by the City of Wylie Parks and Recreation
Department due to weather conditions, wet field conditions or for necessary
maintenance. If a reservation is canceled, a credit or refund will be issued. It will be the
responsibility of the Wylie Parks and Recreation Department to determine the playing
ability of each field. If fields are not playable due to any or all of the said conditions, this
information will be placed on the City of Wylie's Athletic Hotline no later than 4:00 p.m.,
Monday - Friday. Athletic Field Hotline Number is 442-5354.
In the event of said conditions occurring after 4:00 p.m., Monday -Friday or all of
Saturday and/or Sunday, games can be called off by league directors, commissioners
or the umpires. In the event that play is allowed and significant damage is done to
athletic field(s), the responsible person/party who allowed play will be held responsible
and sanctions may be imposed.

Any and all parties seeking athletic fields for use accept responsibility for the well being
and cleanliness of facilities during and after their use.
Any and all funds collected by the City of Wylie Parks and Recreation Department will
be used primarily for the maintenance and/or upgrading of athletic facilities and the
paying of electrical utility bills in regard to athletic field fight usage at Community Park.
Secondary use of funds collected will be for maintenance and/or upgrading of other
facilities at Community Park. All funds collected will be allocated tot he Community Park
Fund.

such variance shall be allowed only on the written approval of the
Superintendent of Parks and Recreation, and such written approval shall be
effective if all of the following conditions have been satisfied:
a) The effect or result of the requested variance will not result in allowing
any actions or activities which are in conflict with the spirit and intent
of the general purpose of the policy; and
b) There is not sufficient time to bring the issue before the Parks Board and
City Council for approval; and
c) The variation is approved by the City Manager.

Adult who live outside of the W.I.S.D. will be given last priority.

denied until all monies due are paid in full. Those using fields on a one time basis
shall pay field usage fees before field use. A cash receipt shall be issued by the City
of Wylie Parks and Recreation Department containing the following:

Athletic Field Light Usage Fees shall be billed in arrears. Light fees are due within
thrity (30) days of the statement date. If light fees are not paid within (30) days of
the statement date, an additional charge of ten (10) percent of the original balance
due will also be levied. If the original balance due plus the ten (10) percent additional
charge is not paid within sixty(60) days of the statement date, light use privileges are
subject to being denied until all monies due are paid in full. Those using lights on a
one time basis shall pay light usage fees before light use.

If reserved field lights are not used, the Parks and Recreation Department must be
notified within one (1) week after the scheduled game(s) time(s) in order that a credit
or refund will be given.
A cash receipt shall be issued by the City of Wylie Parks and Recreation Department
at the time the light fee is paid and the reservation is confirmed. This receipt shall
contain the following:
1) Individual's Name
2) Organization's/Group's Name if Applicable Reservation
3) Names of the Teams That Will Be Utilizing the Reservation
4) The Day(s), Time(s) and Location(s) of the Reservation
5) Amount Paid
A new receipt will be issued in the event the date, time or location of a reservation
is changed.
ATHLETIC FIELD RESERVATION FOR TOURNAMENT USE
Requests for athletic fields for tournament use shall be made in writing. The
City of Wylie Parks and Recreation Department requests thirty (30) days advance
notice. The price per field reservation fees are as follows:
Friday Night and All of Saturday
$100.00 (Includes Light Usage)
Friday Night and All of Saturday and Sunday
$150.00 (Includes Light Usage)
A security deposit of $100.00 per field reserved shall be paid at least fourteen (14)
days in advance of the scheduled tournament. The deposit(s) shall be credited
towards any monies due for said tournament, with any remaining monies due payable
seven (7) days in advance of the scheduled tournament. All monies paid will not be
refundable unless a field or fields are not playable due to weather conditions, wet field
conditions or for necessary maintenance. If a field or fields are not playable due to
said conditions, a refund or credit will be given. The City of Wylie Park and
Recreation Department will be the final authority as to athletic field use.
A cash receipt shall be issued by the City of Wylie Parks and Recreation Department
at the time the fee is paid and the reservation is confirmed. This receipt shall contain
the following:
1) Individual's Name

2) Organization's/group's Name
3) Names of the Teams That Will be Utilizing the Reservation
4) The Day(s), Time(s) and Location(s) of the Reservation
5) Amount Paid
A new receipt will be issued in the event the date, time or location of a reservation
changes.
A tournament is defined as team competition separate and distinct from league play
involving the payment of an entry fee or additional fees in which to participate.
League practices and/or games shall take priority over tournaments. A curfew of
12:00 Midnight shall be imposed on all tournaments utilizing lights, Monday -
Thursday; 1 :00 a.m. on Friday and Saturday. A curfew of 11 :00 p.m. shall be
imposed on Sundays.
MISCELLANEOUS
The City of Wylie Parks and Recreation Department will provide homeplate, pitching
rubbers, base distance markers on fences and will drag and mark baseball/softball
infields for fee paid game/tournaments reservations. Soccer and football fields will be
marked for fee paid game reservations. Athletic fields for non-reserved general public
use or reserved practices are accepted on an as-is basis.
A person may cancel a reservation and be issued a credit or refund up to 24 hours
prior to the reservation. A credit or refund will be issued with less than 24 hours
notice of cancellation if the City of Wylie Parks and Recreation Department is able to
rent the athletic field(s) to another party or if field maintenance preparation of the
reservation has not started. This paragraph does not apply to Tournament Use. (See
Athletic Field Reservation for Tournament Use).
Any and all athletic field use may be canceled by the City of Wylie Parks and
Recreation Department due to weather conditions, wet field conditions or for
necessary maintenance. If a reservation is canceled, a credit or refund will be issued.
It will be the responsibility of the Wylie Parks and Recreation Department to determine
the playing ability of each field. If fields are not playable due to any or all of the said
conditions, this information will be placed on the City of Wylie's Athletic Hotline no
later than 4:00 p.m., Monday - Friday. Athletic Field Hotline Number is 442-5354.
In the event of said conditions occurring after 4:00 p.m., Monday -Friday or all of
Saturday and/or Sunday, games can be called off by league directors, commissioners
or the umpires. In the event that play is allowed and significant damage is done to
athletic field(s), the responsible person/party who allowed play will be held responsible
and sanctions may be imposed.

Any and all parties seeking athletic fields for use accept responsibility for the well
being and cleanliness of facilities during and after their use.
Any and all funds collected by the City of Wylie Parks and Recreation Department will
be used primarily for the maintenance and/or upgrading of athletic facilities and the
paying of electrical utility bills in regard to athletic field light usage at Community
Park. Secondary use of funds collected will be for maintenance and/or upgrading of
other facilities at Community Park. All funds collected will be allocated tot he
Community Park Fund.

The subject of the proposed ordinance has been proposed to the Council in the past. At
that time the Council indicated that it was generally favorable, at least in concept, to passage of
an ordinance requiring applicants for City licenses, permits, etc. to free of any debt owed to the
City.
I have drafted the ordinance to speak to all situations where the City is granting licenses,
permits, zoning changes, or other similar privileges to persons. I think that an ordinance which
was selective in its application (by applying to some permits and not others) may not be
enforceable. Thus, I would recommend an all or nothing approach. If the Council is not
comfortable with a comprehensive across the board application then it may want to consider not
passing the ordinance.
Certainly there is no requirement that a City have such an ordinance. It is being brought
forward by the staff as a solution to the problem of persons owing the City monies and
continuing to conduct activities which are sanctioned by the City via license and permit. It
would be an effective means of applying leverage to those persons who are in arrears to the City
and who might not otherwise pay. Furthermore, as noted in the ordinance, it is somewhat unfair
to allow these persons to continue to receive what amounts to benefits from the City, at the
expense of the other taxpayers.
I have included for your comparison and review copies of similar ordinances from
Rockwall and Lancaster. The Rockwall ordinance is very simple and comprehensive. The
Lancaster one is more complex but is limited to zoning matters only.
I note that Section IV concerning debts discharged by bankruptcy is probably not
something that the Council would voluntarily put into the ordinance. However I believe it is
necessary as the City should not be taking actions which are tantamount to involuntary collection
of what have become legally unenforceable debts. Not to mention the fact that the City would
be ignoring the order of a Federal District Court.
If the Council has further concerns, suggestions, or input on the matter please advise.

AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE WYLIE
CITY CODE BY ADDITION OF A NEW SECTION PROVIDING THAT BEFORE ANY
PERMIT OR LICENSE IS ISSUED TO AN APPLICANT, SAID APPLICANT MUST
NOT BE IN ARREARS ON ANY AMOUNT OWED TO THE CITY; FURTHER
PROVIDING THAT AN APPLICANT FOR CHANGE OF ZONING MUST NOT BE IN
ARREARS ON ANY AMOUNTS OWED TO THE CITY; REPEALING ALL
CONFLICTING ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE
WHEREAS,the City has experienced, and continues to experience, significant problems with
persons and entities who are delinquent in obligations to the City, continuing to transact business
with the City by way of receiving permits, licenses, changes in zoning, and other benefits from
the City without having to bring such delinquent obligations up to date; and,
WHEREAS, allowing such persons who are delinquent in their obligations to the City to
continue to receive licenses, permits and other privileges is unfair to the other citizens who have
paid all of their obligations to the City; and,
WHEREAS, persons, entities and firms frequently change names and/or form of entity in
which they conduct their business and thereafter seek to receive privileges of receiving permits
licenses and the like from the City thereby making it necessary to apply the effect of this
ordinance to all related or predecessor parties, as hereinafter defined;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WYLIE, TEXAS, as follows:
SECTION I
(a) No permit, license or similar such privilege shall be issued by the City when the
appllicant or the owner of the premises for which the application is made, is in arrears to the
City for taxes, water, sewer, garbage, or any other fees or expenses due to the City.
(b) No applications for any zoning actions, including original applications for zoning,
change of zoning classification, application for special use permits, appeals, shall be accepted
or considered if the person submitting the application or a person owning a substantial interest
in the property effected thereby, is arrears to the City as provided in the preceding paragraph.

SECTION II
The provisions of this ordinance shall apply not only to the person or entity applying for
the permit, license, or zoning action or owner of the effected property, but also and equally
apply and be effective against persons who have or had a substantial interest a concern or entity
who is so indebted to the City notwithstanding the fact that the application or request is being
made in under a different name.
SECTION III
As used herein the following terms shall be defined and taken to mean as follows:
(a) Person: An individual, partnership, corporation, association or other business entity.
(b) Substantial Interest: Having an ownership interest of 25% or more and/or having
general managerial and administrative control over a business or entity.
SECTION IV
Nothing herein shall prevent the issuance of a permit, license, or zoning application in
those situations where the indebtedness to the City has been legally discharged in bankruptcy
proceedings in the United States District Court.
SECTION V
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity
of this ordinance as a whole or any part or provision thereof, other than the part or parts as
declared to be invalid, illegal, or unconstitutional.
SECTION VI
This ordinance shall be in full force and effect from and after its adoption by the City
Council and publication of its caption as the law and the City Charter provide in such cases.
SECTION VII
That all other ordinances and code provisions in conflict herewith are hereby repealed to the
extent of any such conflict or inconsistency and all other provisions of the Wylie City Code not

in conflict herewith shall remain in full force and effect.
SECTION VII
The repeal of any ordinance, of parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or
to accrue, nor as effecting any rights of the municipality under any section or provisions of any
ordinances at the time of passage of this ordinance.

the premises for which the license or permit is being applied, must
not be in arrears to the City for taxes, water, sewer or garbage
fees, or any other fees due the City."
Section 2. If any section, article, paragraph, sentence, clause, phrase or
word in this ordinance, or application thereof to any person or circumstance, is
held invalid or unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions of the ordinance,
and the City Council hereby declares it would have passed such remaining
portions of the ordinance despite such invalidity, which remaining portions shall
remain in full force and effect.
Section 3. Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate
offense shall be deemed committed upon each day during or on which a violation
occurs or continues.
Section 4. This ordinance shall become effective after its adoption by
the City Council.

PROPERTY BEFORE ACCEPTANCE OF AN APPLICATION FOR A CHANGE OF ZONING;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission of the City of Lancaster and the
City Council of the City of Lancaster, in compliance with the laws of the State of Texas
with reference to the granting of zoning classifications and changes, have given the
requisite notices by publication and otherwise, and have held due hearings and afforded
a full and fair hearing to all property owners generally, and the City Council of the City of
Lancaster is of the opinion and finds that the Comprehensive Zoning Ordinance should
be amended; NOW,. THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LANCASTER,
TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance of the City of
Lancaster, Texas, be, and the same is hereby, amended by amending Section 44.5(1) to
read as follows:
"44.5 Procedure on Zoning Hearings:
(1) Applications; Payment of Taxes, etc.; Waiver.
(a) All applications for changes in zoning and all applications for
permanent zoning to be given to properties newly annexed
shall be made in writing, to the City Manager or his designate,
and shall be accompanied by the appropriate fee established
by ordinance or resolution of the City Council. The public
schools of the City of Lancaster shall be exempt from the
payment of such fees, but not from the other procedures
required for zoning under this section.
(b) When submitting an application for a change of zoning, the
applicant must submit proof, such as a tax certificate, that
property taxes, and any city fees, fines or penalties are not
delinquent on the subject property. Unless such proof is
submitted, the application will be considered incomplete and

returned to the applicant. A waiver of this requirement may
be granted by two-thirds vote of the City Council if:
(1) a waiver will facilitate urban redevelopment, historic
conservation, or an important planning objective;
(2) a pending sale of the property is contingent on the
zoning application, and the applicant can supply
evidence, such as a contract of sale, that the taxes and
any city fees, fines or penalties will be paid at closing;
(3) the applicant can demonstrate financial hardship that
makes payment of taxes impossible, and approval of a
waiver will improve the applicant's ability to pay the
taxes and any city fees, fines or penalties; or
(4) the property is an asset in a bankruptcy case, and the
zoning application is submitted in connection with the
liquidation or reorganization of the debtor.
(c) A waiver application form may be obtained from the
department of planning and development. The waiver
application form and waiver application fee must be filed with
the city secretary.
(d) Consideration of a waiver application under this procedure is
not a consideration of the merits of the zoning application,
and does not imply that the zoning application will be
approved or disapproved when considered on its merits.
(e) The application shall contain all necessary information as
required by the application form and shall be signed by each
owner of property within the area of request.'
SECTION 2. Any ordinance of the City of Lancaster in conflict with the
provisions hereof is hereby repealed, and any ordinance not in conflict herewith shall
remain in full force and effect.
SECTION 3. That should any sentence, paragraph, subdivision, clause,
phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or

invalid, the same shall not affect the validity of this ordinance as a whole, or any part or
provision thereof other than the part so decided to be unconstitutional, illegal or invalid.
SECTION 4. This ordinance shall take effect immediately from and after its
passage as the law and charter in such cases provide.

SUBJECT : Consideration of Approval of Construction Plans for
sanitary sewer improvements
During the early fall of 1993, I indicated to council that with the increased
amount of working capital in the utility fund, we would be in a position to
finance at least two critical utility projects on a pay-as-you-go-basis.
The recommended projects are the Holland Hitch sewer line and the Home
Town Furniture sewer line. Currently, Holland Hitch is serviced off of a line
that runs underneath Wylie Butane and a mobile home park. The city, as part
of this agreement, is required to maintain all water and sewer lines within the
park. This was a "dead'that was originated in the 70's when Holland Hitch was
locating to Wylie. Nevertheless, it is a deal that must be terminated. Not only
is the mobile home park currently receiving benefits that other parks do not,
but it places extensive labor burdens on our Public Works Department. The
proposed sewer line will eliminate this problem. The current owners of the
mobile home park were not the originators of this agreement.
The proposed sewer line for Home Town Furniture will provide service to
approximately five land owners located south of Eubanks Lane. This area
includes Home Town Furniture, Family Hair Care, among others. When the
city annexed the businesses, approximately seven years ago, the city agreed
to plan sewer services within three years. Obviously, the city has not fulfilled
this agreement. The owners have concurred to fund 50% of these sewer
improvements in order to expedite the project. I recommend that we proceed
ahead and allow the businesses to reimburse their portion to the city over a
period of the next three years.

Once council approves the construction plans for the sanitary sewer
improvement plans, we can then advance very quickly with bidding and
construction. I recommend council approve the construction plans for the
sanitary sewer improvements on both projects.

SUMMARY OF SUBJECT:
During the budget process of 1993/1994, city council approved the purchase of a mini-pumper/grass
rig. The estimated cost was $70,000.
I have purposely held up the purchase, in waiting for our new Fire Chief so that it would enable him to
review the specifications, needs, etc. Our new Fire Chief is strongly recommending that we reject all
bids. He is definitely convinced that we need a tank truck(for the purpose of grass fires) and that we
do not need one with as many "bells and whistles".
We will be coming back to council shortly with another course of action within these dollar amounts.
ALTERNATIVES:
1 .) Approve the lowest bidder.

2. Award bid to Neel Associates and authorize staff to negotiate a price for the
addition of a 10 ton winch with the provision that the total purchase price
will not exceed the budgeted amount of $70,000.00. (The cost of the winch is
estimated to be less than $1,500.00.)

SUMMARY OF SUBJECT:
I do not expect to be out of the office for maternity leave prior to May 7th. However,
in case of unforeseen circumstances, we need to appoint a•deputy city secretary to
execute election related documents in my absence. The City Secretary is a City
Manager appointed position so this resolution is really not necessary for day to day
duties. However, the Election Code is vague regarding the deputy Early Voting Clerk
appointments and their authority. As the City Secretary is the Early Voting Clerk and
the Chief Administrator of Elections, we thought it best that such a substitution be

This ordinance complies with requirements of the State Comptroller's Office regarding

canvassed the election but the ordinance is a specific requirement for the sales tax

As we discussed at the last Council meeting, the grant requires that we develop
guidelines for distribution of the funds. We have attempted to develop these
guidelines as liberally as possible in order to accommodate applicants. However, we
are required to make certain safeguards against fraud and abuse. David Lewis with
GSA will be here Tuesday night to help answer questions.

EXHIBIT "A"
This policy is to be administered by the City of Wylie Parks and Recreation Department
in regard to the use of outdoor public recreation areas for athletic activities. The purpose
of this policy is to serve as a guide for the comprehensive and effective usage of outdoor
athletic areas owned, leased, scheduled or otherwise controlled by the City of Wylie
Parks and Recreation Department.
It is the intent of this policy to provide a basis for establishing the following objectives:
1) A method of communicating the available inventory of allocatable athletic facilities
to qualified requestors for usage of such facilities.
2) The implementation of a system of facilities allocation producing results most
beneficial to the total City and surrounding communities.

ATHLETIC FIELD ALLOCATION
Organizations or groups requiring facilities for practice and or league games will submit
their request in writing to the City of Wylie Parks and Recreation Department not earlier
than 60 days nor later than 30 days prior to the beginning of the Sports Season. The
request should address the following:
1) Organization/Group Name
2) Starting and ending dates for practice and league play
3) Participation estimates
4) Estimate of number of teams
5) Estimate of the number of practices and games to be played on a weekly
basis by each team in the league
Field allocations will be based upon total game units per week as per available facilities
in order to maximize use of all facilities. The City of Wylie Parks an Recreation
Department will respond to each request with a written approval, denial or a statement
of conditions to be met upon acceptance of approval. Final registration estimates and
current participant registration figures must be submitted by each approved
organization/group two (2) calendar weeks after the start of the specific sport season.
If actual registration numbers are more/less than the estimated registration numbers, the
City of Wylie Parks and Recreation Department may increase/decrease the
organizations/groups field allocations in order to insure an equitable allocation of fields
to all organizations/groups.
ATHLETIC FIELD RESERVATIONS
Athletic fields will be reserved as equitably as possible to accommodate as many
y' organizations/groups as possible. Citizens of Wylie and surrounding communities and
area will be given priority. Extra consideration will be given to those who abide the Field
Allocation policy as stated above.
The use of athletic fields by the general public during non-reserved/non-City maintenance
times are on a first come, first serve basis. Reserved fields/City maintenance will take
priority over non-scheduled activities. The City of Wylie Parks and Recreation
Department will be the final authority as to athletic field reservation use.
ATHLETIC FIELD RESERVATION TIME SLOTS
Athletic fields will be reserved in one (1) hour increments with the first field usage
beginning at 8:00 A.M. and the last ending at 11:00 P.M., Monday - Thursday; 12:00
midnight, Friday and Saturday. Sunday field usage begins at 12:00 P.M. and ends at
11:00 P.M.

ATHLETIC FIELD RESERVATION USAGE FEE
A fee of$2.00 per person, per sport season for organizations/groups will be charged for
the use of reserved athletic fields. This fee shall be paid to the City of Wylie Parks and
Recreation Department by the responsible organization/group within two (2) weeks after
the start of the specific sport season. The total amount of fees due will be based on the
current participant registration figures at that time. Any increase in participants after
initial payment will result in extra fees being due based on $2.00 per person, per sport
season format. A cash receipt shall be issued by the City of Wylie Parks and Recreation
Department containing the following:
1) Individual's Name
2) Organization's/Group's Name
3) Team Sport/Sport Season
4) Number of Teams and Participants
5) Amount Paid
ATHLETIC FIELD RESERVATION - NON-LIGHTED USE
A receipt shall be issued by the City of Wylie Parks and Recreation Department when a
reservation is confirmed. This receipt shall show the following:
1) Individual's Name
2) Organization's/Group's Name if Applicable
3) Names of the Team That Will Be Utilizing The
Reservation
4) The Day(s), Time(s) and Location(s) of the

ATHLETIC FIELD LIGHT USAGE FEE
A fee of $3.00 per hour per field will be charged for reservation in which fights are
utilized. Reservation sessions vary through the course of a calendar year to coincide
with sunset. The City of Wylie Parks and Recreation Department shall determine the

ATHLETIC FIELD RESERVATION FOR TOURNAMENT USE
Requests for athletic fields for tournament use shall be made in writing. The City
of Wylie Parks and Recreation Department requests thirty (30) days advance notice. The
price per field reservation fees are as follows:
Friday Night and All of Saturday
$100.00 (Includes Light Usage)
Friday Night and All of Saturday and Sunday
$150.00 (Includes Light Usage)
A security deposit of $100.00 per field reserved shall be paid at least fourteen (14) days
in advance of the scheduled tournament. The deposit(s) shall be credited towards any
monies due for said tournament, with any remaining monies due payable seven (7) days
in advance of the scheduled tournament. All monies paid will not be refundable unless
a field or fields are not playable due to weather conditions, wet field conditions or for
necessary maintenance. If a field or fields are not playable due to said conditions, a
refund or credit will be given. The City of Wylie Park and Recreation Department will be
the final authority as to athletic field use.
A cash receipt shall be issued by the City of Wylie Parks and Recreation Department at
the time the fee is paid and the reservation is confirmed. This receipt shall contain the
following:
1) Individual's Name
2) Organization's/group's Name
3) Names of the Teams That Will be Utilizing the Reservation
4) The Day(s), Time(s) and Location(s) of the Reservation
5) Amount Paid

A new receipt will be issued in the event the date, time or location of a reservation
changes.
A tournament is defined as team competition separate and distinct from league play
involving the payment of an entry fee or additional fees in which to participate. A curfew
of 12:00 Midnight shall be imposed on all tournaments utilizing lights, Monday -
Thursday; 1:00 a.m. on Friday and Saturday. A curfew of 11:00 p.m. shall be imposed
on Sundays.
MISCELLANEOUS
The City of Wylie Parks and Recreation Department will provide homeplate, pitching
rubbers, base distance markers on fences and will drag and mark baseball/softball
infields for fee paid game/tournaments reservations. Soccer and football fields will be
marked for fee paid game reservations. Athletic fields for non-reserved general public
use or reserved practices are accepted on an as-is basis.
The City of Wylie Parks and Recreation Department requests 24 hours or more notice
of a reservation. Requests for athletic fields with less than 24 hours notice will be
accommodated if possible. Earlier requests are required for Tournament Use (See
Athletic Field Reservation for Tournament Use).

A person may cancel a reservation and be issued a credit or refund up to 24 hours prior
to the reservation. A credit or refund will be issued with less than 24 hours notice of
cancellation if the City of Wylie Parks and Recreation Department is able to rent the
athletic field(s) to another party or if field maintenance preparation of the reservation has
not started. This paragraph does not apply to Tournament Use. (See Athletic Field
Reservation for Tournament Use).
Any and all athletic field use may be canceled by the City of Wylie Parks and Recreation
Department due to weather conditions, wet field conditions or for necessary
maintenance. If a reservation is canceled, a credit or refund will be issued. It will be the
responsibility of the Wylie Parks and Recreation Department to determine the playing
ability of each field. if fields are not playable due to any or all of the said conditions, this
information will be placed on the City of Wylie's Athletic Hotline no later than 4:00 p.m.,
Monday - Friday. Athletic Field Hotline Number is 442-5354.
In the event of said conditions occurring after 4:00 p.m., Monday -Friday or all of
Saturday and/or Sunday, games can be called off by league directors, commissioners
or the umpires. In the event that play is allowed and significant damage is done b
athletic field(s), the responsible person/party who allowed play Will be held responsible
and sanctions may be imposed.

Any and all parties seeking athletic fields for use accept responsibility for the well being
and cleanliness of facilities during and after their use.
Any and all funds collected by the City of Wylie Parks and Recreation Department win
be used primarily for the maintenance and/or upgrading of athletic facilities and the
paying of electrical utility bills in regard to athletic field light usage at Community Park
Secondary use of funds collected will be for maintenance and/or upgrading of other
facilities at Community Park All funds collected will be allocated tot he Community Park
Fund.

HOMEOWNER REHABILITATION PROGRAM GUIDELINES
Sec. 1: PURPOSE OF PROGRAM
A. The City of Wylie,Texas, may provide financial assistance to homeowners in Wylie who were
victims of the May 9, 1993 tornado and who meet the eligibility criteria specified herein.
L. The Sole purpose of the financial assistance is to provide decent, safe, and sanitary bonging for
tornado victims by the rehabilitation of existing structures to a condition which brings the
structures into pre-tornado condition and in compliance with HUD's Section 8 Housing Quality
Standards and local building codes.
C. This program shall be operated in accordance with all applicable rules and regulations of the
City of Wylie and the Texas Department of Housing and Community Affairs.
Sec, 2: DESIGNATED AUTHORITY TO ADMINISTER PROGRAM
The City Manager shall be responsible for the overall administration of the homeowner
rehabilitation program. The City Manager shall have the authority to delegate any duties in
carrying out the components of the rehabilitation program (e.g., taking applications, verifying
eligibility, preparing work write-ups and bidding documents, and conducting rehabilitation
inspections),
See. 3: RECIPIENT ELIGIBILITY & PROPERTY REQUIREMENTS
A. The applicant must be an individual or family who owns and occupies or intends to re-occupy a
single family dwelling within the City of Wylie that was damaged by the tornado of May 9, 1993.
The applicant will be considered the owner if he or she:
1. Is the "owner of record" on the books at the County Court House;
2, Possesses a valid contract for deed which has been or may be filed for record with the
County Clerk's office and which includes reasonable rights of redemption and quiet and
peaceable possession of the property; or
3. Possesses a life estate which has been, or may be, filed for record at. the County Clerk's
office.
B. The owner-occupied structure must not be in a flood hazard area.,
C. Since Community Development funds are intended to serve low and moderate income residents
or hardship cases who have no other means of financing repair or improvements, such funds shall
not be made available to any applicants who have substantial financial resources available.
D. The owner must furnish evidence that the residence is insured with fire and casualty insurance
in an amount sufficient to cover the fair market value of the dwelling.
E. The applicant must be a U.S, citizen and had been a resident of Wylie on May 9, 1993.

:F. All property taxes shall be paid on the property prior to the award of the grant, or the property
owner must have qualified for and received the tax deferral as allowed under Section 33.06 of the
Texas Property Tax Code.
G. No member of the governing body of the City and no other official, employee or agent of the
City who exercises policy or decision-making functions or responsibilities in connection with the
planning and implementation of this program shall be eligible for rehabilitation assistance-
Sec. 4: ELIGIBLE IMPROVEMENTS & EXPENSES
A. Rehabilitation funds shall be used for those repairs and/or replacements which are
necessary to correct actual or incipient violations of the building codes of the City of
Wylie, to bring the property into compliance with HUD's Section 8 Existing Housing Quality
Standards, and to bring the affected property to pre-tornado condition,
B. All improvements must be physically attached to the property and be permanent in nature, No
personal property shall be acquired with grant funds. Landscaping improvements are not eligible
improvements except where landscaping of the grounds is necessary for adequate drainage.
C. Refrigerators, microwaves, and other appliances such as washing machines and dryers
(excluding air conditioning/heating systems, hot water heaters, built-in kitchen stoves/ovens) are
not eligible items under this program. Also, grant funds may not be used for garage door openers,
security systems, swimming pools, fences, detached storage buildings, and television satellite
dishes,
D. The use of lead based paints is strictly prohibited..
E. All City building permits shall be obtained by the contractor at his/her expense and may be
included as part of the bid.
Sec. 5: MAXIMUM GRANT ASSISTANCE
A, When all qualifications have been met by the applicant, he/she shall be entitled to receive
rehabilitation assistance in the amount necessary to bring the property up to meet HUD's Section 8
Existing Quality Standards, local building code standards or pre-tornado condition as established
by the low bid process; provided the bid does not exceed $10,000,00 in grant funds. No applicant
may receive more than one rehabilitation grant.
B. In the event $10,000.00 is not sufficient to bring the property up to meet local building codes
or HUD's Existing Housing Quality Standards, rehabilitation assistance will not be approved
unless:
1. The applicant places the necessary funds in escrow with the City when the grant agreement
is executed,
2, Used in conjunction with an approved home improvement loan from a local or area financial
institution. A letter of commitment from the financial institution must be in hand when the
grant agreement is signed.
Applicants shall have ninety (90)days to secure additional financing or will be rejected.
C, The financial assistance will be in the form of a grant and will not be required to repaid.

Sec. 6: CONTINGENCY FUNDS OR CHANGE ORDERS
At the discretion of the Chief Building Official, additional funding, not to exceed one thousand
dollars ($1,000.00) may be utilized as contingency funds to pay the cost of repair and/or
replacement of actual or incipient code violations which were not observed or included in the
original contract and commonly handled through change orders. No change order or cumulative
change orders shall be issued above $1,000.00 without approval of the City Council approval.
Examples of change order items are as follows:
Termite infestation and damage not discovered until repairs were begun.
Collapsed sewer lines not discovered until roto-rooting was attempted.
Sec. 7: SELECTION OF APPLICANTS, WORK WRITE-UPS, & BIDDING
A. Applications will only be accepted during an advertised application period, Such application
period shall be advertised by public notice in the local newspaper and by posting notices in the city
hall and in other prominent public places. Said application period shall not be less than thirty (30)
days. The City Secretary's office will be responsible for advertising the availability of the program
and for accepting applications.
B, Upon receipt of the applications, applications shall be screened for completeness and all
information related to employment, income, assets and insurance settlements shall be verified in
order to determine the applicant's eligibility. The City Secretary's office will be responsible for
screening and determining the eligibility of each applicant.
C. Upon determination of the applicant's eligibility, each completed and eligible application will
then be rated by a Housing Advisory Committee according to a priority scoring system as
hereinafter established. The Housing Advisory Committee will be responsible for scoring the
applications. The Housing Advisory Committee shall be appointed by the City Council from a list
of names submitted by the Mayor. The Housing Advisory Committee shall consist of five (5)
members appointed by the City Council, The Housing Advisory Committee shall be an ad hoc
committee and will serve until the program is completed. It shall be the duty of the committee to
rank each application and to make funding recommendations to the City Council. Upon receipt of
the funding recommendations from the Housing Advisory Committee, the City Council shall
approve,disapprove or modify such recommendations. The funding decisions of the City Council
shall be final,
D. After the applicants have been approved for funding assistance by the City Council, the Chief
Building Official shall conduct a property inspection of the highest rated applicants to determine
the specific items to be required or replaced in order to bring the structure up to HUD's Section 8
Existing Housing Quality Standards, the City building codes, and/or to bring the structure to pre-
tornado condition. This list of work items will constitute the work write-up for that structure.
"Before" pictures shall be taken by the Chief Building Official to provide a photographic record of
the structure and improvements needed.
Work write-ups will only be required for the appropriate number of applicants to deplete the
available funds. After completing the work write-ups for each of the highest rated applicants, the
Chief Building Official shall then estimate the cost of the proposed work, including labor and
material costs, for each structure. If the estimated cost is not expected to exceed $10,000.00, bids
for such rehabilitation will be let. However, if the estimated cost exceeds the $10,000.00
maximum, bids will not be let unless the applicant agrees to pay for all costs above the
$10,000,00. Regardless, grants for rehabilitation assistance will only be provided to the applicant
for a maximum of$10,000.00 at the time of bid award.

Applicants will be given the opportunity to accompany the Chief Building Official on the work
write-up inspection in order to discuss the proposed work items. When the work write-up has
been completed and a cost estimate prepared, the Chief Building Official shall discuss the scope of
work and the effect of the cost estimate with the applicant. If the applicant agrees with the scope of
work and to iris or her responsibility regarding any additional funding, the applicant shall then
sign off on the final work write-up which shall be utilized in the bidding process. The Chief
Building Official shall agree not to omit any work items that are necessary to bring the structure up
to the minimum program standards as previously established herein. If the applicant does not
agree to pay for the additional cost over the maximum grant amount of $10,000.00, then such
application shall be deemed ineligible for grant assistance and shall be classified as not feasible to
rehabilitate.
E. Upon completion of the work write-up(s), the Chief Building Official shall, on behalf of the
applicants, solicit competitive bids from general contractors for the proposed rehabilitation work.
The contractor submitting the lowest and most responsible bid for each project may be awarded the
work through City Council action; provided,the contractor can meet the contractor requirements as
hereinafter established. However, should the applicant desire to have a contractor different from
the low bidder perform the work,the applicant shall be required to pay for the difference in the low
bid and the bid of the contractor preferred by the applicant.
F. Prior to bidding, notification will be given to the Texas Historical Commission requesting the
Commission to review the approved dwelling for any historical significance. Such notice shall be
in writing and given by certified mail, 5-day return receipt requested. Pictures and the address of
each dwelling shall be given to the Texas Historical Commission with the notification. No
rehabilitation work will be started prior to clearance from the Texas Historical Commission or prior
to the expiration of thirty (30) days from the receipt of such notice by the Texas Historical
Commission,
Sec. 8: PRIORITY RATING SYSTEM
All eligible applicants will be rated on a scoring system in order to establish the priority of funds.
This rating process has been designed to incorporate both the family and dwelling characteristics of
an applicant in order to establish a system which gives the most needing persons higher priority
over others. Scoring shall be based on the following factors:
1, Income (maximum 15 points);
If family income is below the median income limit for Wylie 1.5 pts.
If family income is between 100% and 120% of median income limits ...,, 10 pts.
If family income is above 120% of median income limits 5 pts.
2. Head of Household (maximum 15 points):
If head of household is 62 years of age or older 15 pts.
If head of household is female 15 pts.
If the head of household is currently unemployed.. 15 pts.

Sec. 9: CONTRACTOR QUALIFICATIONS
In order to be eligible to participate in the construction work financed under this rehabilitation
program, contractors must meet the following minimum requirements:
A. The contractor must not be a debarred, suspended, or ineligible contractor according to HUD's
"Consolidated List of Debarred, Suspended, and Ineligible Contractors" and the U,S, General
Services Administration's "Consolidated List of Debarred and Suspended Contractors".
Verification of contractor eligibility shall be obtained from the Texas Department of Housing and
Community Affairs prior to awarding any contract to the contractor.
B. The contractor must certify that he or she will not discriminate against any protected group of
persons under State and Federal law.
C. Each contractor shall carry worker's compensation insurance, automobile liability insurance,
and unemployment insurance as required by the State of Texas. Additionally, the contractor must
carry general liability and property damage insurance for rehabilitation work done within the city in
the amount of $300,000 and $100,000 respectively. This insurance must be applicable to
construction work done in the City and must be in effect during the contracted period. Evidence of
such insurance must be presented prior to the execution of the contract.
D. The contractor must have submitted all contractor certifications prior to execution of any
contracts,
E. The contractor may be judged to be a non-responsible bidder if his or her past performance on
other rehabilitation projects was marginal or not.acceptable.
F. The contractor shall be of good reputation, financially sound, and have adequate financial
resources to carry Out his or her work.
G. The contractor shall have prior trade experience in home repairs, rehabilitation, or building.
Such prior work experience must be verifiable by the Chief Building Official.

Sec. 10: GRANT AWARD & CONTRACTING REHABILITATION WORK
A. The Chief Building Official shall submit each eligible application, in its numerical order of
ranking, along with the construction bids received for each structure to the City Council for their
consideration The City Council shall either award, modify, or reject the bid received from the
lowest and most responsible bidder.
B. If the City Council awards the bid, the Chief Building Official. shall cause to have a grant
agreement executed between the City and the applicant and a construction contract executed
between the applicant homeowner(s) and the contractor awarded the bid. However, should the
applicant desire to have a contractor different from the low bidder perform the work, the applicant
shall be required to pay the difference in the low bid and the bid of the contractor preferred by the
applicant. The applicant may not select a contractor that does not submit a bid on the work. Such
grant agreements and construction contracts shall be executed on forms approved by the City
Attorney,
C. Each agreement executed with a contractor shall contain a completion date and provide for
liquidated damages if the contractor falls to meet such completion date.
D. In the event a change order is necessary as determined by the Chief Building Official, the
Chief Building Official shall cause to have a change order executed between the City,homeowner,
and the contractor. However, in no event shall a change order, or cumulative change orders, be
executed in an amount more than $1,000.00. Additionally, no change order shall cause the total
grant amount to exceed $1.0,000.00 without City Council approval.
Sec. 11: WORK INSPECTIONS & PAYMENTS FOR WORK
A. The Chief Building Official will assist the homeowner in ensuring that all contracted work is
completed prior to payment and that such work was performed in an acceptable manner. To
accomplish this, the Chief Building Official will conduct interim inspections as necessary, a final
inspection upon completion of all of the work, and a post-inspection within sixty (60) to ninety
(90)days after completion.
B. All electrical work will be inspected by the City's electrical inspector in accordance with the
City's normal electrical inspection requirements. Electrical permits are required for all electrical
work, All electrical work must be performed by an electrician approved and licensed in the City of
Wylie.
C. All plumbing work will be inspected by the Ci.ty's plumbing inspector in accordance with the
City's normal plumbing inspection requirements. Plumbing permits axe required for all plumbing
work. All plumbing work must be performed by a master plumber approved to do work in the
City.
D. All building work will be inspected by the City's building inspector in accordance with the
City's normal building inspection requirements. Building permits are required for all applicable
construction work.
E. In addition to the inspections outlined above, the Chief Building Official shall conduct a final
inspection of the structure upon completion of the rehabilitation work when notified to do so by the
general contractor. The Chief Building Official shall also conduct any necessary interim
inspections which may be required. After all work has been completed to the satisfaction of the
City's Inspection Department and the homeowner has signed a release, the Chief Building Official
shall issue a Certificate of Completion, provided he is also satisfied with the work and all the
contracted work has been completed.

F. When final inspection determines that the rehabilitation work is satisfactorily completed in
accordance with the contract, the Chief Building Official shall obtain from the contractor an "All
Bills Paid Affidavit" and a release of liens from all. subcontractors and suppliers, copies of each
warranty due the applicant for the work, and the 1 shall cause�a request foractor's st for paymen fuidsta be otrderfed, and receipt

receipt of the funds, cause disbursement of the funds to the contractor.
G. Sixty (60) to ninety (90) days after the final inspection has been made, the Chief Building
Official shall conduct a post-inspection of the rehabilitated structure to ensure that all work is
holding up and still satisfactory. If any problems are identified in this post inspection, the Chief
Building Official shall then notify the contractor to come back and correct the same within a
reasonable amount of time, such as two (2) weeks. Should the contractor fail to do so, the
homeowner :may take any necessary legal recourse and the contractor shall be barred from
performing any more rehabilitation work in the City. Also, should the contractor be doing other
rehabilitation work under this program and fails to correct any warranty problems, no other
payments shall be made to him or her until such problems have been corrected.
Sec. 12: CONTRACTOR'S WARRANTY OF WORK
All work performed by the contractor shall be guaranteed for a period of six (6) months from poor
or faulty workmanship or materials. Such warranty shall be stipulated in the construction contract

Sec, 13: FILES & REPORTS
The City Secretary shall maintain accurate files and records on each applicant and shall retain all
pertinent documentation. Such files shall be open for public inspection in accordance with the
Texas Open Records Act.
Sec. 14: APPEALS & GRIEVANCES
Each applicant or participant shall have the right to appeal any decision of or grievance against the
Chief Building Official or other program staff personnel to the City Manager; provided such appeal
is made within fifteen (15) days from when the decision has been rendered or the grievance
occurred and/or became known to the applicant. If the applicant/participant is not satisfied with the
decision of the City Manager., he or she may then appeal his or her grievance to the City Council
provided such appeal is made within ten (10) days from the date of the decision of the City
Manager. The decision of the City Council shall be final.,
Sec. 15: CITY NOT TO BE HELD LIABLE
No member of the governing body nor any representative, official or employee of the City of
Wylie who exercises any functions or responsibilities in connection with the administration and
implementation of this program shall be held liable for the exercise thereof, This provision shall.
not exclude liability for any illegal acts.
Sec. 16: CHANGES, WAIVERS, AND/OR CONFLICTS
A. The City Council shall have the right to change, modify, waive or revoke all or any part of
these guidelines by a majority vote of the Council.

B, The City shall have the right to waive the Section 8 Existing Housing Quality Standard
requirements or code violations providing such waiver will not diminish marketability of the
property, when long-standing local acceptance is evident of topography or when the architecture of
the structure makes compliance unfeasible.

CITY OF WYLIE, TEXAS
VOLUNTARY RELOCATION PROGRAM GUIDELINES
Sec. 1: PURPOSE OF PROGRAM
A. The purpose of this program is to provide financial assistance to assist victims of the May 9,
1993 tornado in the provision of safe,decent, and affordable housing for tornado victims.
B. This program shall be operated in accordance with all applicable rules and regulations of the
City of Wylie and the Texas Department of Housing and Community Affairs.
Sec, 2: DESIGNATED AUTHORITY TO ADMINISTER PROGRAM
The City Manager shall be responsible for the overall program administration of the relocation
program. The City Manager shall have the authority to delegate any duties in carrying out the
components of the relocation program (e.g,, taking applications, verifying eligibility, counseling,
etc.).
Sec. 3: RECIPIENT ELIGIBILITY & PROPERTY REQUIREMENTS
A. The applicant must be an individual or family who owned a single family home that was
damaged by the tornado of May 9, 1993 and that has not been able to obtain affordable housing
since the tornado, The applicant will be considered the owner if he or she:
1. Is the "owner of record" on the books at the county courthouse;
2, Possesses a valid contract for deed which has been or may be filed for record with the
County Clerk's office and which includes reasonable rights of redemption and quiet and
peaceable possession of the property; or
3. Possesses a life estate which has been, or may be, filed for record at the County Clerk's
office.
-OR-
The applicant must have applied for rehabilitation assistance under the City's Homeowner
Rehabilitation Program and his or her home was determined not feasible to rehabilitate under the
program because the structure is too deteriorated and/or dilapidated.
C. The applicant must currently occupy or intend to re-occupy a single family dwelling unit
within the City of Wylie.
D. Since Community Development grant funds are intended to serve low and moderate income
residents or hardship cases, such funds shall not be made available to any applicants who have
substantial financial resources available,
E. The applicant must provide a release authorizing the City to demolish his or her current
occupied dwelling if the dwelling has been condemned and declared unfit for habitation, and
further release the City from all claims arising therefrom;

F. All property taxes on property owned by the applicant shall be paid prior to award of any
relocation payment, or the property owner must have qualified for and received the tax deferral as
allowed under Section 33.06 of the Texas Property Tax Code.
G, The applicant must be a U. S. citizen and had been a resident of Wylie on May 9, 1993.
H. No member of the governing body of the City and no other official, employee, or agent of the
City and no other official, employee or agent of the City who exercises policy or decision-making
functions or responsibilities in connection with the planning and implementation of this grant
program shall be eligible for relocation assistance.
I. The applicant must agree to insure the replacement dwelling in an amount not less than fair
market value for at least one year from the date of the relocation payment. If the property is located
within a flood plain, the applicant must also maintain flood insurance for at least one year from the
date of the relocation payment.
J. The replacement dwelling must meet all local building codes and ordinances.
Sec. 4; MAXIMUM GRANT ASSISTANCE & ELIGIBLE EXPENSES
A. Relocation payments and assistance, not to exceed $2.5,000.00, may be provided to eligible
applicants subject to the availability of funds in the program, However, in the event the cost of
acquiring a comparable and affordable replacement dwelling is less than the maximum grant
allowed, then the relocation payment shall be the lesser amount.
B. The City may pay, as part of the relocation payment, actual and reasonable moving expenses,
plus related expenses necessary to effect the moving of the displacee's personal belongings from
'.he original vacated dwelling to the replacement dwelling, provided such expenses are approved by
the City.
C. The City may pay, as part of the relocation payment, the cost of utility transfers and hook-ups
as determined by the City to be necessary to make the replacement dwelling ready for occupancy
and in compliance with city codes and ordinances.
1D. Additionally, the City may pay as part of the relocation payment, closing and settlement costs
related to the purchase of a replacement dwelling; provided such expenses are approved by the City
prior to incurring them.
E. In addition, as a part of the relocation payment assistance, the City may pay the cost of, and
bring about, the demolition and removal of the applicant's tornado-damaged dwelling and clearance
of the property if needed.
See. 5: GENERAL APPLICATION PROCEDURES
A. Applications will only be accepted during an advertised application period. Such application
period shall be advertised by public notice in the local newspaper and by posting notices in the city
hall and in other prominent public places. Said application period shall not be less than thirty (30)
days, The City Secretary's office will be responsible for advertising the availability of the program
and for accepting applications.
:B. Upon receipt of the applications for relocation assistance, applications shall be screened for
completeness and all information related to employment, income, assets and insurance settlements
shall be verified in order to determine the applicant's eligibility. The City Secretary's office will be
responsible for screening and determining the eligibility of each applicant.

C All applications of eligible applicants will then be forwarded to the Housing Advisory
Committee for evaluation and ranking by the committee.
D. Upon determination of the applicant's eligibility, each completed and eligible application will
then be rated by a Housing Advisory Committee according to a priority scoring system as
hereinafter established, The Housing Advisory Committee will be responsible for scoring the
applications and recommending the amount of funding for each applicant. The Housing Advisory
Committee shall be appointed by the City Council from a list of names submitted by the Mayor,
The Housing Advisory Committee shall consist of five (5) members appointed by the City
Council, The Housing Advisory Committee shall be an ad hoc committee and will serve until the
program is completed, It shall be the duty of the committee to rank each application and to make
funding recommendations to the City Council.
E, The recommendations of the committee will then be forwarded to the City Council for
consideration, Upon receipt of the funding recommendations from the Housing Advisory
Committee, the City Council shall approve, disapprove or modify such recommendations, The
funding decisions of the City Council shall be final.
F. All applicants selected for assistance shall then be counseled by the City Secretary, or her
designated representative, regarding his or her housing needs and available options in helping to
find suitable and affordable replacement housing. The City Secretary shall cause a relocation
agreement, and demolition agreement if needed., to be executed with the applicant which outlines
the responsibilities of the applicant and the City.
G. If needed, the City will contract for the clearance and demolition of the applicant's condemned
dwelling and lot;
H, Upon selection of the replacement dwelling, the applicant must obtain written approval of the
City before entering into any formal contractual arrangement to acquire the replacement dwelling.
The Chief Building Official will also inspect the replacement dwelling and issue a certificate of
occupancy upon his acceptance,
):. Upon acceptance by the City, the City Secretary, with the approval of the City Manager, will
cause the disbursement of funds to be made to the applicant.
Sec. 6: PRIORITY RATING SYSTEM
All eligible applicants for relocation assistance will be rated on a scoring system in order to
establish the priority of funding, This rating process has been designed to incorporate both the
family and dwelling characteristics of an applicant in order to establish a system which gives the
most needing persons higher priority over others, Scoring shall be based on the following factors:

Sec. 7: FILES & REPORTS
The City Secretary shall maintain accurate files and records on each applicant and shall retain all
pertinent documentation, Such files shall be open for public inspection in accordance with the
Texas Open Records Act.
Sec, 8: APPEALS & GRIEVANCES
Each applicant or participant shall have the right to appeal any decision of or grievance against the
City Secretary or other program staff personnel to the City Manager; provided such appeal is made
within fifteen (15)days from when the decision has been rendered or the grievance occurred and/or
became known to the applicant. If the applicant/participant is not satisfied with the decision of the
City Manager, he or she may then appeal his or her grievance to the City Council provided such
appeal is made within ten (10)days from the date of the decision of the City Manager. The decision
of the City Council shall be final.
Sec. 9: CITY NOT TO BE HELD LIABLE
No member of the governing body nor any representative, official or employee of the City of
Wylie who exercises any functions or responsibilities in connection with the administration and
implementation of this program shall be held liable for the exercise thereof. This provision shall
not exclude liability for any illegal acts.
Sec. 10: CHANGES, WAIVERS, AND/OR CONFLICTS
A. The City Council shall have the right to change, modify, waive or revoke all or any part of
these guidelines by a majority vote of the Council.
