Council will be awarding the bid for Construction of the Elevated Storage Tank on Tuesday night.
Bids are not scheduled to be opened until Monday. Greg McLean with Hogan Corporation has stated
that the bids will be fairly straightforward as he is familiar with the bidders. He'll be presenting Council
with his recommendation on Tuesday night. We'll provide you with the bid information under separate
cover.

ISSUE
Council will be considering approval of an ordinance reducing the speed limit on McCreary Road
from 45 Miles per hour to 35 Miles per hour.
BACKGROUND
Council and staff have discussed the reduction in the speed limit on McCreary Road as a method
of reducing the number of accidents and complaints related to the poor condition of the Road.
Presently, the road is scheduled as a part of the bond program but high speed, rain, and heavy traffic
only continue the deterioration of the road. The City has begun preparing for the street reconstruction
by clearing the ditches to help the water runoff. Staff believes that a reduction in the speed limit is
needed at least until the street is improved.
STAFF RECOMMENDATION
Staff is recommending approval of the ordinance.

ORDINANCE NO.
AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING THE
MAXIMUM PRIMA FACIE SPEED LIMITS ON McCREARY ROAD; REPEALING
ALL CONFLICTING ORDINANCES; CONTAINING A PENALTY CLAUSE;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, the City has the authority under Section 19.02 of the Wylie City Code and Art.
6701d, Sec. 166 of Vernon's Annotated Civil Statutes, to alter the maximum speed limit on any
street, or alley, or portions thereof, within the City; and,
WHEREAS, the City Council, on the basis of a traffic investigation conducted by the Chief
of Police, has determined that the existing maximum prima facie speed limit of 45 miles per hour
on McCreary Road should be lowered to 35 miles per hour; and,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS, as follows:
SECTION I
That a prima facie maximum speed limit of 35 miles per hour for motor vehicles is hereby
determined and declared to be reasonable and safe, and such maximum speed limit is hereby fixed
as the maximum rate of speed indicated for motor vehicles traveling upon McCreary Road, or any
part thereof, and no motor vehicle shall be operated upon or along said McCreary Road in excess
of such maximum prima facie speed.
SECTION II
The speed limits herein established shall not be effective or enforceable until signs giving
notice of such regulation are posted upon at the entrances to those portions of the effected streets
or highways, as may be the most appropriate in accordance with the State Department of
Highways and Public Transportation of the State of Texas, and the City Manager or his duly
authorized representative is authorized and directed to cause such appropriate signs to be erected.
SECTION III
Any person violating the provisions of this ordinance, or any part hereof, shall be guilty
commits a misdemeanor and, upon conviction shall be fined in an amount not to exceed the sum
of$350.00 for each such offense.

SECTION IV
Should any paragraph, sentence, sub-division, clause, phrase or section of this ordinance be
adjudged or held to be unconstitutional, illegal or invalid the same shall not affect the validity of
this ordinance as a whole or any part or provision thereof, other than the part or parts as declared
to be invalid, illegal, or unconstitutional.
SECTION V
This ordinance shall be in full force and effect from and after its adoption by the City Council
and publication of its caption as the law and the City Charter provide in such cases.
SECTION VI
That all other ordinances and code provisions in conflict herewith are hereby repealed to the
extent of any such conflict or consistency and all other provisions of the Wylie City Code not in
conflict herewith shall remain in full force and effect.
SECTION VII
The repeal of any ordinance, of parts thereof, by the enactment of this Ordinance, shall not
be construed as abandoning any action now pending under or by virtue of such ordinance; nor
shall it have the effect of discontinuing, abating, modifying or altering any penalty accruing or
to accrue, nor as effecting any rights of the municipality under any section or provisions of any
ordinances at the time of passage of this ordinance.

ISSUE
Council is being asked to authorize an all night softball tournament at Community Park on Friday
night, July 15th. Council approved this tournament last year.
BACKGROUND
As Council is aware, our park policy requires approval of special events after park hours. Council
has approved these requests in the past but have had some concerns about noise, lights, and security
of neighboring homes. The police department has patrolled the area during past similar events and an
off-duty officer is being employed by the tournament sponsors for extra security.

You have requested to have an all night Men's/Co-Ed Tournament from
7 : 00 p.m. Saturday July 15 , 1995 until 1 : 00 p.m. Sunday July 16 ,
1995 on Tibbals , Eldridge, Cooper and Rowell fields . Since
Community Park is closed between 12 : 00 midnight and 6 a.m. , this
requested variance will need to be submitted to the Parks and
Recreation Board and the City Council for approval . Although I can
not guarantee approval , past requests such as these have been
approved by both parties.
The next scheduled Parks and Recreation Board meeting is June 26 ,
1995 and the City Council meeting is June 27 , 1995 . Both meetings
are at 7 :00 ,n .m . at City Hall in the Council Chambers . You might
want to attend these meetings in case there are any questions.
If this tournament does take place all fields will be dragged as
feasible but definitely marked due to scheduled games ending
shortly before this tournament begins .
The tournament fee is $100. 00 per field and is due at least seven
( 7) days before the scheduled tournament.

We would like to request the use of the four lighted fields beginning at 7 p.m.
Saturday, July 15;, 1995 through 1 p.m. Sunday, July 16, 1995. We would like
to be able to offer a Alen's and Co-ed Tournament, the one we hosted last
year had a good turn-out and it is better to have an all night tournament in
the heat of the summer. ✓e will employ an off-duly officer to help with any
problems that could occur. He will be available,from 1 a.m. through 5 a.m.
and hopefully will be able to stay longer if the need be. Enclosed is a copy
of the flyer and would appreciate your permission to use the fields.

Last week, Council appointed Mike Collins as interim City Manager. Council has not officially
decided how to proceed in filling the City Manager position on a permanent basis. To date Council has
discussed several options regarding the filling of the position. One option discussed was the use of a
search firm. Tuesday night, David Eisenlohr with the firm of Ralph Anderson and Associates will be
here to explain the search process his firm provides. If Council is interested in using a search firm, Mr.
Eisenlohr can also discuss assisting the City in a search for a Chief of Police. You may listen to Mr.
Eisenlohr's presentation in open meeting if you choose but the agenda is posted in such a way that you
may also discuss the hiring of personnel in Executive Session.
