Present with Chairman Johnston were; Commissioner Ron Smith, Commissioner David Dahl, and Commissioner Ramona Kopchenko. Commissioner F. Darnell Harris, Vice-Chairman Gilbert Tamez, and Commissioner Ruthie Wright were all absent. Staff present was Renae' 011ie, Planning Director, and Charles Lee, Senior Planner, and Mary Bradley, Administrative Assistant. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Dahl gave the invocation and Commissioner Smith led the Pledge of Allegiance. CITIZENS COMMENTS Chairman Johnston opened the Citizens Participation. With no one approaching the Commissioners, Chairman Johnston closed the Citizens Participation. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the December 18, 2012, Regular Meeting. Board Action A motion was made by Commissioner Smith, and seconded by Commissioner Dahl, to approve the Minutes from the December 18, 2012 Regular Meeting as presented. A vote was taken and passed 4—0, with Commissioners Harris, Tamez and Wright being absent. REGULAR AGENDA Public Hearing 1. Hold a Public Hearing and consider a recommendation to the City Council, regarding a request for a Specific Use Permit (SUP) for an Animal Clinic or Hospital use limited to a lease space (Suite 110) of 2,515 Minutes January 15,2013 Wylie Planning and Zoning Board Page 1 of 3 square feet within the existing Zlan Corner Commercial Center, generally located at the northeast corner of Country Club Road and West Brown Street. ZC 2012-11 Staff Comments Mr. Lee presented the Commissioners the report for the request of a Specific Use Permit for an Animal Clinic or Hospital. The applicant is proposing to lease out a 2,515 square foot space, more specifically 456 Country Club, Suite 110 within the existing Zlan Corner Commercial Center. The proposal includes limited overnight boarding of animals to emergency or very ill animals. The applicant did originally request relaxation of the sign ordinance within the provisions of the Conditions for Specific Use Permit. The applicant has met with Building Inspections and has rescinded on this provision, and will comply with the requirements for a wall sign. A stipulation is to be included in the motion that the provision for sign regulation is rescinded. Five notification letters were mailed to the surrounding property owners, as required by law. No written responses were received in favor or in opposition of the request. Commissioners Discussion Commissioner Kopchenko questioned the definition of animal clinic or hospital, and boarding of animals. Ms. 011ie stated within the Zoning Ordinance defines the animal clinic, hospital as animals with a medical condition, and limits boarding overnight. Outside kennels are prohibited. Commissioner Kopchenko questioned about euthanized animals, and what is the process. Michael Lamping, DVM, 703 Glenridge, Wylie, the applicant for the request, stated that the animals that are euthanized, the owner is given options of having the animal cremated, or taken to animal cemetery or unincorporated land to bury the animal. The clinic will have a freezer outside of the main area that the animal is placed inside until arrangements to cremate are made. Public Chairman Johnston opened the Public Hearing. With no citizen approaching the Commissioner, Chairman Johnston closed the Public Hearing. Board Action A motion was made by Commissioner Dahl, and seconded by Commissioner Smith, to recommend approval to the City Council regarding a change in zoning from Neighborhood Services (NS) District to Neighborhood Services—SUP (NS/SUP) District for an Animal Clinic or Hospital use, limited to a lease space of 2,515 square feet and stipulating that all signage adhere to current sign ordinance, within the existing Zlan Corner Commercial Center, generally located at the northeast corner of Country Club Minutes January 15,2013 Wylie Planning and Zoning Board Page 2 of 3 Road and West Brown Street. ZC 2012-11. Motion carried 4 — 0, with Commissioners Tamez, Harris and Wright being absent. Discussion Owner: Clark Street Development Applicant: Dunaway Associates,LP The applicant is proposing to develop a 550 s.f. commercial/retail center on 0.405 acres. The lot is part of an overall planned development established in 2003 with a Final Plat approved in May 2012. Due to the need of the retail establishment, the owner is subdividing lots 6, 7 & 8 to establish a smaller lot for Seattle's Best Coffee shop. The proposed use is allowed by right under current zoning as well as the conditions of the Planned Development. There will be no inside or outside seating. Access to the lot is via an access drive off F.M. 544 to be established by the accompanying Replat and an access drive&Fire Lane off Woodbridge Parkway. Lot 7 does not have 30 feet of frontage along a dedicated, improved street as required by the subdivision regulations. However,the lot incorporates 15' of a dedicated 30' access drive to both FM 544 and Woodbridge Parkway. Article 4 of the Comprehensive Zoning Ordinance states that service and loading areas shall not be visible from a public street; developments unable to meet this requirement are required to have masonry screening walls with gates. Although placed approximately 80'south of FM 544, the dumpster would be visible from a public street. The applicant is proposing a 6'-8"high masonry screening wall with gates and added landscaping. All roof mounted mechanical units shall be screened from view in accordance with Section 7.2 of the Zoning Ordinance. Recommendation Direction to Planning Staff on drafting an ordinance amendment to Comprehensive Zoning Ordinance. Discussion In evaluating the City of Wylie's parking requirement regulations Staff is seeking input and direction from the P&Z Commission in an effort to update and improve upon standard requirements for residential and non-residential developments. There are several objectives of this proposed amendment to parking requirements: 1. Simplify and unify required parking calculations 2. Reduce, if possible,the amount of required parking 3. Increase,if possible,the amount of developable land within the city 4. Discover and implement sound alternative parking standards Staff's first objective was to simplify the calculations required to determine minimum parking for a given use. Currently there are eight different ways that are used to calculate required parking depending on the use. 1. Square footage of the building(s) 2. Square footage of the entire site 3. Number of Employees 4. Number of seats 5. Fixed number based on Specific Use 6. Variable number based on Specific Use 7. Site Plan review 8. Various combinations of the above The proposed amendments reduces these eight to two: 1. Square footage of the building(s) 2. Site Plan review Each of the former eight can easily be redefined and reduced into one of the two latter categories. In most,but not all cases,number of employees and number of seats are a direct function of square footage and necessary parking can be accurately determined using that metric. Parking for all other uses could best be established by review on a case by case basis. Page 1 of 2 Page 2 of 2 In working to achieve the second of our stated objectives,reducing the number of parking spaces in the City,planning staff conducted two types of research. The first type examined other cities'parking requirements. The second examined how the current required parking spaces are being used in real world scenarios. First, staff compared Wylie's parking requirements to several neighboring cities. Examining neighboring cities parking requirements resulted in a confirmation that our current parking requirements were overstating the number of spaces needed for a majority of the various uses. While some cities had similar parking requirements for a similar use as Wylie has, in almost all cases one or more cities required less parking for that use and/or had a simpler formula for determining that use. Second, staff conducted a parking survey of several different local businesses at various days and times to determine parking capacity versus usage. It was determined that existing parking is never fully utilized, even at retail locations on peak shopping days. Based on the research staff recommends that the required parking for most uses listed in the Zoning Ordinance be reduced. As for our third objective, staff believes that reducing the required parking could increase the value of the developable land within the city and that densities can increase,where appropriate.Undeveloped commercial or industrial land can develop at higher densities because less room will be required for parking. In addition, certain existing developments within the city could redevelop land currently used as parking. The greatest immediate advantage to the city is an increase in the tax base. Buildings and the uses they undertake are worth more financially then empty parking spaces. Other benefits could include aesthetic improvements, storm water runoff improvements, and improvements to the `heat-island' effect. Lastly, staff looked at various alternatives to the traditional minimum parking requirements. During the examination, staff looked to not only our neighboring cities,but cities such as Portland, OR and Austin, TX as they are widely regarded as the most progressive cities in terms of planning in the nation and in our state,respectively. Taking into consideration the obvious differences (population, densities, and access to public transportation, for example)between those cities and Wylie, staff recommends the following additions to the Zoning Ordinance: 1. Allowing up to 10%of parking spaces to be smaller alternative sizes to the 10'x20' standard.Marked motorcycle or subcompact parking is an example. 2. Implement a maximum parking ratio of 25%greater than the minimum. 3. Require parking over the maximum,to be on alternative surfaces. In summary,the City's existing Ordinance adequately addresses parking regulations,however; staff continually examines and reevaluates the adopted Zoning Ordinance for ways to improve. Staff believes that the recommended amendments are beneficial for both the city and developers by increasing commercial densities and allowing for flexibility and clarity in the parking requirements.
