Council Present: Mayor Pro Tem Joel Scott, Councilman Eric Hogue, Councilman Merrill Young, Councilman
J.C. Worley and Councilman Chris Trout. Mayor John Mondy and Councilwoman Reta Allen were absent.
Mayor Pro Tern,Joel Scott presided over the meeting.
Staff Present: Anthony Johnson, City Manager; Mindy Manson, Assistant City Manager; Brady Snellgrove,
Finance Director and Barbara Salinas, City Secretary.
Councilman Eric Hogue was asked to provide the Invocation and Councilman Worley was asked to lead e
Pledge of Allegiance.
•Recognition of WISD Star Students -Character Trait"Responsibility".
The Mayor Pro Tem Scott recognized the following students for their exemplification of the character trait
"Responsibility". Representing Akin Elementary: Zeke Kirk — 4th Grade, son of Ruben and Gwen Kirk;
Birmingham Elementary: Vanessa Morales — 4th Grade, daughter of Osvaldo and Elizabeth Morales; Dodd
Elementary: Sebastian Spaink son of Tom & Marion Spaink; and Wylie Junior High School: Tawnee Field— 8th
Grade, daughter of Greg&Dondi Field. Unable to attend but recognized, were from Hartment Elementary: Lucy
Williams 1st Grade daughter of Marty and Shannon Williams and from Wylie Intermediate School: Patricia
Ridenour—6th Grade,daughter of Dane and Diane Ridenour.
• Mayor Pro Tern Scott Proclaimed the Week of October 16-20, 2000 as "Hosts Week" in Wylie, Texas. Ms.
Susie Fendrick and Monica Gonzales were present to accept the proclamation.
•Mayor Pro Tern Scott Proclaimed the Week of October 9-15, 2000 as"Fire Prevention Week" in Wylie, Texas.
Chief Shan English, "Sparky" the Fire Dog, and representatives of the WFD Fire Safety Clown Program were
present to accept the proclamation.
Mr. Rod Taylor,representing Sanden International was present to voice opposition of Item No. 2 on this evening's
agenda. Mr.Taylor expressed his concerns of maintaining Sanden Blvd industrial area a prime Industrial Park and
the future development of this entryway into Wylie.
A. Approval of the Minutes from the September 26,2000 Regular Meeting.
Councilman Chris Trout made a motion to approve the minutes from the September 26,2000 Regular Meeting.
Councilman Worley seconded the motion. A vote was taken and the motion was approved, 5-0. Mayor Mondy
and Councilwoman Allen were absent.
The Mayor Pro Tern moved to Item No. 5 on the agenda.

5. Consider and act upon approval of the supplemental agreement between East Texas Medical
Center Emergency Medical Services and the City of Wylie for Paramedic Ambulance
Services.
Chief Shan English addressed this item and provided Council with a brief history of the agreement between East
Texas Medical Center Emergency Medical Services (ETMC-EMS) and the City of Wylie. He provided an
explanation of the modifications in the contract that involve the MICU Ambulance that ETMC-EMS has provided
the City of Wylie.
Chief English stated that in 2000, ETMC-EMS requested that Collin County approve a subsidy for ambulance
coverage in Collin County and that the request initiated Collin County to request bids from several ambulance
contractors. He explained that the conclusion of this bid process was a decision by Collin County to use a separate
contractor and the ETMC-EMS' back-up ambulances in Farmersville and Princeton would be removed effective
November 1, 2000. He stated that ETMC-EMS will be providing a second back-up ambulance that will be staffed
and maintained by the Sachse Fire Department.
There was some brief discussion regarding term of contract and the service currently provided by ETMC-EMS.
Chief English explained that the contract references five (5) years, however, we have three (3) years remaining
with an option to extend. He added that they have not had complaints from the service provided by ETMC-EMS
and are happy with the service level provided.
Councilman Hogue made a motion to approve the supplemental agreement between East Texas Medical Center
Emergency Medical Services and the City of Wylie for Paramedic Ambulance Services. Councilman Young
seconded the motion. A vote was taken and the motion was approved, 5-0. Mayor Mondy and Councilwoman
Allen absent.
Mayor Pro Tern then moved to Item No. 1
1. Hold a public hearing to consider and act upon approval of a request from Richard Parker for
approval of a zone change from A (Agriculture) to I (Industrial) on property generally located
at the southwest corner of FM 544 and Sanden Boulevard, and being all of a certain 34.412
acres out of the Duke Strickland Survey, Abstract 841 and the I. Clifton Survey, Abstract No.
193, City of Wylie, Collin County, Texas. ZC No. 2000-08
Mr. Claude Thompson addressed this item and provided Council a brief history of the request. He
advised that the Planning and Zoning Commission has recommended denial without prejudice and that
the applicant has withdrawn his application. He advised that there was no action necessary on Council's
part,however,this was advertised as a public hearing.
The Mayor Pro Tern then opened the public hearing asking that anyone wishing to speak either in favor
or opposition of the request to come forward stating their name and address for the record and limiting
their comments to three minutes. With no response, the Mayor Pro Tem then closed the Public Hearing
and no further action by the Council was required.
2. Hold a public hearing to consider and act upon approval of a request from the Franklin Ovid
Birmingham Memorial Land Trust for approval of a zone change from A (Agriculture) to I
(Industrial) on property generally located at the northeast corner of Hooper Road and
Hensley Lane, and being all of a certain 49.508 acre tract out of the L.K. Pegues Survey,
Abstract No. 703, City of Wylie, Collin County, Texas.
Mr. Claude Thompson addressed this item and provided a brief history of the request. He advised that
the Planning & Zoning Commission moved to table this request at their regular meeting of September
19, 2000 in order to allow the applicant an opportunity to discuss issues related to the hearing.

Mr. Thompson advised Council that staff has met with the neighborhood and the applicant is
considering their comments. He stated that the item was not tabled to a specific date by the Commission
and that there was no action necessary on Council's part, however, this was advertised as a public
hearing.
The Mayor Pro Tern then opened the public hearing asking that anyone wishing to speak either in favor
or opposition of the request to come forward stating their name and address for the record and limiting
their comments to three minutes. The Mayor Pro Tem asked that Mr. Taylor's comments during
Citizens Participation are noted for Item No. 2. With no further response, the Mayor Pro Tem then
closed the Public Hearing and no further action by the Council was required.

Addition, generally located at the southwest corner of Stone Road and Ballard Avenue, and
being all of Lot 31A, Block 1 of the Meadows Addition, of a certain 0.961 acres out of the A.
Atterberry Survey, Abstract No. 23, City of Wylie, Collin County, Texas.
Mr. Claude Thompson addressed this item and provided Council with a brief history of the request. Mr.
Thompson stated that the Planning and Zoning Commission was recommending approval.
The Mayor Pro Tem then opened the public hearing asking that anyone wishing to speak either in favor
or opposition of the request to come forward stating their name and address for the record and limiting
their comments to three minutes. With no response,the Mayor Pro Tem then closed the Public Hearing.

4. Consider and act upon approval for Work Order No. WYL-34A authorizing the Hogan
Corporation to proceed with lift station, force main, and gravity sewer improvements along a
route from the existing Rush Creek Lift Station to its proposed relocation site and from the
proposed relocation site to the existing Twin Lakes Lift Station.
Chris Holsted, City Engineer addressed this item. Mr. Holsted provided Council with a brief
background of the project and the necessity for Work Order No. WYL-34A. Mr. Holsted explained tht
on September 28, 1999, Council approved Work Order No. WYL-34 in the amount of $73,200
authorizing the Hogan Corporation to proceed with the design of a submersible pump style lift station,
approximately 10,000 linear feet of 14 inch diameter force main, manholes, and related appurtenances
for an estimated project construction cost of$850,000. Mr. Holsted explained that the original project
scope included utilization of an existing abandoned mud line which runs parallel to Rush Creek from the
site of the existing Rush Creek Lift Station on Stone Road to the vicinity of the proposed location of the
new Rush Creek Lift Station anticipated to be located near Troy Road and Beaver Creek. However,
engineering analysis concluded that use of the existing abandoned mud line is unfeasible due to its small
size and deteriorated condition. Mr. Holsted explained that the additional costs are associated with the
gravity sewer and the additional four thousand feet of gravity sewer that was not anticipated.

Councilman Trout made a motion to approve Work Order No. WYL-34A authorizing the Hogan
Corporation to proceed with lift station, force main, and gravity sewer improvements along a route from
the existing Rush Creek Lift Station to its proposed relocation site and from the proposed relocation site
to the existing Twin Lakes Lift Station. Councilman Worley seconded the motion. A vote was taken
and the motion was approved, 5-0. Mayor Mondy and Councilwoman Allen were absent.
Presentation by F.Mason and Associates, a library consultant firm, retained by the City in April of this
year to evaluate the long-range needs for library services.
Ms. Mason provided Council with a detailed study of the requirements for a new library. She provided
extensive information with regard to size, site and accommodations requirements to service the growing
community. Ms. Mason stated at the conclusion that the information was conceptual only and that
there are a number of options and strategies to provide future community needs. She stated that this
project is in the planning and research stages and that if it were Council's desire to construct a new
library, it would be a three to four year project.
The Mayor Pro Tern convened into Executive Session at 8.28 p.m. in accordance with Chapter 551, Government
Code, Vernon's Texas Code Annotated (Open Meeting Law), Section 551.072 Real Estate (200 Block of North
Jackson Street)to deliberate the purchase, exchange, lease or value of real property; Section 551.071 Consultation
with Attorney regarding City Attorney relationship with the City Council in which the duty of the attorney to the
governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly
conflicts with this chapter, and Section 551.074 Personnel Matters to deliberate the evaluation of the City
Attorney.

The Mayor Pro Tem then convened into Open Meeting at 9:15 p.m. and announced that there would be no action
taken as a result of the Executive Session

Mr. Satterwhite spoke regarding the Wylie Independent School District's Bond proposal and asked that
the City consider, as the Chamber, making an open statement in support of the Bond.

Ms. Mindy Manson addressed this item providing Council with a brief background on the request and
advised that at the October 3, 2000 Planning and Zoning Commission meeting, the Commission
recommended approval. The applicant, Don Jackson, Jackson & Associates, 2600 West F.M. 544 was
present to address any concerns of Council.
The Mayor then opened the public hearing and asked that anyone who wished to speak either in favor or
in opposition of the Replat, to come forward stating their name and address for the record and limiting
their comments to three minutes. With no response,the Mayor then closed the public hearing.

with the exception of service by an approved means of wastewater collection and treatment. Currently the
applicant's property is 1800' from the nearest sanitary sewer line. The Applicant wishes to provide sewage
treatment to his home with an aerated septic system and has agreed to tie on to the sanitary sewer line currently
proposed by the Centex Development to the North of his property, when accessible. Mr. Don Jackson, Jackson
and Associates was present,representing the owner. There was some concern expressed by Council regarding the
follow up to ensure that when sewer lines are installed, that the applicant does proceed to tie on at that time. Mr.
Johnson explained that as soon as a sanitary sewer line is accessible, the property owner would have to tie on and
that it would not be necessary to include a time frame within the motion.

contract. . He stated that Council approval would allow staff to move forward with the completion of a
1999 Bond Project, identified as P7. He stated that the engineering portion should take approximately
ninety days and that they anticipate going out for bids in January of 2001.
Councilman Trout made a motion to authorize the City Manager to execute and award a contract for
engineering services to Shimek, Jacobs & Finklea, L.L.P., Consulting Engineers, in the amount of
$41,200 for engineering services related to the reconstruction of two alleys with sanitary sewer

Background
On September 12, 2000, TXU Gas Distribution(Lone Star)brought complaint against PG&E Pipeline,
L.P. to the Railroad Commission. The complaint alleges that Lo-Vaca (now PG&E), that has had
contracts to supply gas to Lone Star since 1968, has overcharged Lone Star since January 1, 1994.
In Docket No. 500, the Railroad Commission allowed Lo-Vaca to procure gas to meet its contractual
commitments and allowed the Company to pass on the cost of purchases at a fixed margin. According
to TXU's complaint, since 1994 Valero Transmission (now PG&E) has unlawfully applied the Docket
No. 500 rate to more gas sales than could be justified by gas purchases. TXU alleges that PG&E and
its predecessors sold 15,490,353 Mcf(or over 15 billion cubic feet of gas) than it purchased and
unlawfully charged Lone Star the Commission approved rate for gas purchases on gas that had no cost.
Lone Star apparently purchased 80% of that 15 billion cubic feet resulting in substantial overcharges to
residential and commercial City gate rate customers.
In 1998, the Cities Served by Lone Star settled certain gas cost claims against Lone Star and the
Company agreed to refund $18 million. In GUD No. 8647, the Commission accepted the settlement and
ordered that any refunds obtained by the Company from gas suppliers for the period ending October 31,
1997, would be apportioned between Lone Star and its City residential and commercial customers.
Intervention by the Cities served by Lone Star is encouraged to maximize recovery from PG&E and
appropriate refunds to customers.
Financial Considerations
There is no assessment associated with this effort. This matter involves a Commission approved rate and
charges by PG&E in excess of that rate and is therefore a ratemaking matter. As such, the Cities'
expenses should be reimbursed. Funds are available to the Cities' Steering Committee if the Commission
does not grant reimbursement.

AUTHORIZING INTERVENTION IN RAILROAD COMMISSION
GAS UTILITES DIVISION DOCKET NO. 9173 AND
COORDINATION WITH OTHER CITIES TO ADVOCATE

WHEREAS, the City of Wylie is served by TXU Gas Distribution (a.k.a. Lone Star Gas
Company) which has filed a complaint at the Railroad Commission of Texas against
PG&E Texas Pipeline, L.P., as successor in interest to Lo-Vaca Gathering Company and
Valero Transmission Company; and
WHEREAS, that complaint has been designated as Gas Utilities Division Docket No.
9173; and
WHEREAS, TXU Gas Distribution's complaint alleges that it has overcharged its
customers at least since January 1, 1994, because PG&E charged Lone Star Gas
Company for gas at rates in excess of rates authorized by the Railroad Commission; and
WHEREAS, prior Railroad Commission Orders, agreements between Cities and Lone
Star Gas Company, and reasonable ratemaking principles require that a portion of refunds
received by TXU Gas Distribution from PG&E be passed on to ratepayers; and
WHEREAS, the City of Wylie desires to participate in GUD No. 9173 with other
similarly situated Cities served by TXU Gas Distribution to protect the interests of Cities
and their residents by maximizing refunds to ratepayers;
NOW THEREFORE, BE IS RESOLVED, by the City Council of the City of Wylie,
Texas, that
1. The City shall intervene in GUD Docket No. 9173 and request consolidation
with other Cities served by TXU Gas Distribution.
2. The City shall participate with the Steering Committee of Cities served by Lone
Star Gas Company regarding coordination of litigation strategy, the hiring of
consultants, pursuit of recovery of reasonable ratemaking expenses and
determination of whether to appeal action by the Railroad Commission.

removed and partially vacant, partially platted, and zoned for B-1 (Business) uses.

Issue
Hold a public hearing to consider and act upon approval of a Replat for Railroad Addition, 1st Revision,
proposed by Jackson and Associates Land Surveyors, Inc., for the property generally located at the
southwest corner of Masters Avenue and Fifth Street, and being all of a certain 1.496 acre tract, situated
in the Francisco de la Pina Survey, Abstract No. 688, City of Wylie, Collin County, Texas.
Background
The Replat under consideration is for the Railroad Addition, lst Revision, and specifically a replat of Lots
1-6, Lots 7A-9B, Lot 16, Lot 17 of Block 28, and part of a 20' alley abandoned in block 28 in the
Railroad Addition, and part of a formerly abandoned portion of Fifth Street. The owner proposes to
consolidate all of this property into a single lot in order to expand the existing business. All of the above
mentioned property is currently vacant and undeveloped.
Public Comment Forms were mailed to twenty-two property owners within 200 feet of the request. One
comment form has been returned in favor of the replat.

Notice is hereby given that the following public hearings to consider resubdivision or
replatting of a recorded subdivision as hereinafter described will be held in the City
Council Chambers of the Municipal Complex, 2000 Highway 78 North, Wylie, Texas:

This property is generally at the southwest corner of Masters Avenue and Fifth Street,

The property was previously zoned Single Family (SF-3) for residential uses.
Texas law requires a public hearing when replatting property which is zoned residential -
Section (3), Subsection C):

If the proposed is protested in accordance with this subsection, the
proposed replat must receive, in order to be approved, the affirmative vote
of at least three-fourths of all members of the municipal planning
commission or governing body, or both. For a legal protest, written
instruments signed by the owners of at least 20 percent of the area of the
lots or land immediately adjoining the area covered by the proposed replat
and extending 200 feet from that area, but within the original subdivision,
must be filed with the municipal planning commission or governing body,
or both, prior to the close of the public hearing.
All citizens or interested parties desiring to be heard concerning this replat may speak.
The application and documents are on file for public examination in the Development
Services Department, 2000 Highway 78 North, Wylie, Texas.

PUBLIC NOTICE BEFORE THE PLANNING AND
ZONING COMMISSION OF THE CITY OF WYLIE,
TEXAS AND THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS, TO CONSIDER RESUBDIVISION OR
REPLATTING OF RECORDED SUBDIVISION WITHIN
THE CITY LIMITS OF WYLIE, COLLIN COUNTY, TEXAS.
Notice is hereby given that the following public hearings to consider resubdivision or
replatting of a recorded subdivision as hereinafter described will be held in the City
Council Chambers of the Municipal Complex, 2000 Highway 78 North, Wylie, Texas:
Planning & Zoning Commission: 7:00 PM, October 17, 2000
City Council: 7:00 PM, November 14, 2000
This property is generally at the northeast corner of Stone Road and Stonehedge Drive,
and being all of Lots 1 and 2, Block B of the Stone Grove, Phase I subdivision. The
property is zoned Planned Development (PD) for residential uses.
Texas law requires a public hearing when replatting property which is zoned residential -
Section(3), Subsection (C):
If the proposed is protested in accordance with this subsection, the
proposed replat must receive, in order to be approved, the affirmative vote
of at least three-fourths of all members of the municipal planning
commission or governing body, or both. For a legal protest, written
instruments signed by the owners of at least 20 percent of the area of the
lots or land immediately adjoining the area covered by the proposed replat
and extending 200 feet from that area, but within the original subdivision,
must be filed with the municipal planning commission or governing body,
or both, prior to the close of the public hearing.
All citizens or interested parties desiring to be heard concerning this replat may speak.
The application and documents are on file for public examination in the Development
Services Department, 2000 Highway 78 North, Wylie, Texas.
This facility is wheelchair accessible and handicapped parking spaces are available. Requests for
interpretation services or assistive hearing devices must be made 48 hours prior to the meeting. Contact the

Hold the first of two Public Hearings for the Annexation of 10.9 acres of land and being part of the
Francisco De La Pena Survey, Abstract 688, and being a re-survey of all of a 22.039 acre tract as
conveyed to Gary P. Williford and wife, described by deed dated September 14, 1961, recorded in
Volume 587, Page 253 of the Deed Records of Collin County; save and except a 11.055 acre tract of
land conveyed to David Walden by deed recorded in Volume 1845, Page 813 of the Deed Records of
Collin County; located on the west side of Kreymer Lane and including 1053 S. Kreymer Lane.
Background
In an effort to ensure the goal of protecting the quality of life and the provision of services within the
area, the City of Wylie believes that the property shown on the attached map should be within its city
limits. Should the City Council approve the proposed annexation, the property will be temporarily zoned
as A (Agricultural) until permanent zoning is established by the City Council. The procedure for
establishing the permanent zoning on annexed territory shall conform to the procedures established by
law for the adoption of zoning regulations.
Before a municipality may begin annexation proceedings, the governing body of the municipality must
conduct two (2) public hearing at which persons interested in the annexation are given the opportunity
to be heard. In compliance with state law, staff has prepared the following public hearing schedule:
