AN ORDINANCE TO EMPLOY A CHIEF OF POLICE FOR
THE CITY OF WYLIE, TEXAS AFFIXING HIS COMPENSA-
TION, TENURE OF OFFICE, AND SETTING THE AMOUNT
OF HIS OFFICIAL BOND.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WYLIE, TEXAS:
The City Council of the City of Wylie, Texas by this
ordinance does appoint H. M. Bentley, Chief of Police for
the City of Wylie and authorizes him to act in said capaci ty
until further ordinance of this council is passed and ap-
proved.
Said Council does hereby set the remuneration
for such officer at a salary of $245.00 per month
and in addition thereto, any and all legal fees of said
officer. Said Council does hereby set the official bond
of said H. M. Bentley as Chief of Police of the City of
Wylie at the sum of ~~
and directs that he
shall give said bond for the faithful performance of his
duties. It is further ORDAINED that said H. M. Bentley
shall have like powers, rights and authorities as are by
law vested in City Marshals.
All Ordinances in conflict herewith are hereby can-
celed.

DUTIES OF CHIEF OF POLICE
SECTION 1. Chief - Function; supervision; Executing Search Warrants.
Search Warrants
The Chief of Police shall be the Chief Police Officer of the
City, shall have Supervision, Subordinate to that of the City Manager,
over the other members of the Police Department and shall have the
power with the Sheriff of the County to execute writs of Search War-
rants. He shall devote all his working time and attention to the
affairs of the Police Department and be responsible to the City
Manager for the efficient Administration of its affairs.
SECTION 2. Attending Court
The Chief of Police shall attend upon every session of the
Municipal Court and shall promptly and faithfully execute all writs
and process issued for the Court.
SECTION 3. Taking Bail
The Chief of Police shall have the authority to take suitable
and sufficient bail as recommended by the Municipal Judge for the
appearance before the Municipal Court of any person charged with
an offense within the jurisdiction of such court.
SECTION 4. Powers and Authority
The Chief of Police shall have the powers in the prevention
and suppression of crime and the arrest of offenders within the
City. He shall have like power, authority, and jurisdiction as
the Sheriff of the County under the laws of the State, and Ordinan-
ces of the City. He shall be responsible for maintaining peace,
arrest all persons who shall obstruct or interfer with the execu-
tion of the duties of the office. He may without warrant, arrest
any offender or alleged offender in any of the following cases:
(1) When any felony, disturbance, affray or breach of the
peace, or violation of any city ordinance is committed
within the view or presence of the member of the police
department making the arrest.
(2) When a felony or breach of the peace has been committed
within the presence or view of a magistrate and such
magistrate shall verbally order the arrest of the offender.
(3) When it is represented to some member of the police de-
partment by some creditable person that a felony, dis-
turbance, affray or breach of the peace, or violation of
some city ordinance, has been committed, and that the
offenders will probably escape if the arrest is delayed
to procure a warrant.
(4) When persons are found in SUSpICIOUS places, or under
circumstances which reasonably show that such persons
have been guilty of some felony, or threaten, or are
about to commit some offense against the laws of the
state or ordinances of the city.
(b) For greater certainty it is specifically provided that
such officers or members of the police department may so arrest
without warrant any person found or apprehended under the follow-
ing circumstances:
(1) Where a person is found lurking or hiding in alleys or
on premises not his own, and such person is unable to
satisfactorily explain his actions.
(2) Where a person is fleeing under circumstances which in-
dicate that he is attempting to escape from the scene
of some crime on his part.
(3) Where a person is caught or found in the nightime in a
house or residence, or outhouse, barn or garage appurten~
ant thereto, and is unable to show or state any right or
authority for being in such place or is found or caught
in any business or public place in the nighttime and is
unable to show or state any right or authority for being
in such place.
(4) Where a person is caught or found emerging from any
house or building at an unusual hour, or by an unusual
or suspicious means of exit.
(5) Where any person is discovered with any tools, appliances
or materials on his person or in his charge which are of
such nature as to indicate that they are intended or de-
signed for use in the perpetration of some crome.
SECTION 5. Vacancies Within the Department.
The Chief of Police shall solicit applications In the case of
a vacancy for any cause in the Police Department. He shall investi-
gate the educational, training, and work experiences of the app-
licant's for such vacancies. Upon completion of the screening he
shall make the recommendations to the City Manager. He shall keep
complete records of all personel under his supervision.
SECTION 6. Budget.
The Chief of Police shall prepare on approved forms the recom-
mendations for the purpose of assisting the City Manager in prepar-
ing the Annual Budget for the Police Department and any Sub-Depart-
ments under his jurisdictation.
SECTION 7. City Council Meetings.
The Chief of Police shall attend the regular City Council Meet-
ing each month and all additional meetings as requested. He shall
have prepared Monthly departmental activity reports as required by
the City Manager, to be presented and discussed at said meetings.
SECTION 8. Police Department Personnel Policies and Procedures.
The Chief of Police shall establish policies and procedures
for implementation after approval by the City Manager. Such policies
and procedures shall be in compliance with any policies already es-
tablish by the City Councilor which may be established governing
the employees of the City.
