1959 Ordinance-Annexing & Extending Boundary Limits (3) ANNEXING ORDINANCE AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED TERRITORY TO THE CITY OF WYLIE , COLLIN COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE CITY LIMITS, AND GRANTING TO SAID TERRITORY AND TO ALL FUTURE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID FUTURE INHABITANTS BY ALL OF THE ACTS AND ORDINANCES OF SAID CITY. WHEREAS, a petition for annexation has been duly signed and acknow- ledged by each and every person or corporation having an interest in the following described territory, to-wit: All that certain lot, tract or parcel of land, situated in Collin County, State of Texas, and described as follows: BEING 111.10 acres of land, more or less, and being a re- survey and consolidation of two (2) tracts of land, the first tract being 46.00 acres and the second tract being 55.00 acres of land described in a Decree of the District Court of Collin County, Texas, wherein said land was decreed to the Dallas Joint Stock Land Bank of Dallas, Texas, shown of record in Volume Dl, Pages 343-346, of the District Court Minutes, Collin County, Texas, and a part of the E. C. Davidson survey, Abstract No. 267; " BEGINNING at a stake in the center of road at the north eBst corner of said 46.00 acre tract, which is also the northwest corner of 41.04 acres_ of land decreed to Clayton A. Stone and ,,r:Lfe; THENCE SOUTH 22.43 chains to a stake at the southwest corner of said 41.04 acres, which is also the northeast corner of 10-1/8 acres conveyed by Clayton A. Stone and wife to Loyd Neilon by deed dated January 20, 1920, and recorded in Volume 226, Page 433, Collin County Deed Records; THENCE NORTH 87-3/4 degrees West 15.77 chains to a stake 1mder fence at the northwest corner of said 10-1/8 acres; c1,,', THENCE SOUTH 5-1/2 degrees West 6.28 chains following estab- lished fence line, to stm<e at fence corner, the southwest corner of said 10-1/8 acres; .' Railroad; ~ THENCE NORTH 4-1/2 degrees East at 2.06 chAins a stake at fence COTI1er in the northwest line of said railroad right of way; continuing north 4-1/2 degrees East in all 11.26 chains to a stake in center of dirt road; THENCE SOUTH 87-1/4 degrees East with center of said road at 10.65 chains a stake in the northwest line of said railroad right of way; continuing south 87-1/4 degrees East at 12.97 chains a stake in the southeast line of said railroad ri:::;ht of way, conti..lming south 87-1/4 degrees East with center said dirt road in all 19.13 chains to the place of beginning, containing 113.50 acres of land, LESS 2.40 acres of land in the right of way of the G.C. &. S.F. Railroad, LEAVING net amount 111.10 acres of land as per survey made by Add G. Wilson, Licensed State Land Surveyor of McKinney, Texas, on Nov. 26th, 1941. Being the same land conveyed by Dallas Joint Stock Land Bank to Robert F. Axe by deed dated April 6th, 1942, and recorded in Volume 336, Page 3, Collin County Deed Records. There is, however, excepted and reserved to Grantor, (The Dallas Joint Stock Land Bank of Dallas, Texas), its successors and assigns forever, an undivided one-fourth (1/4) interest in and to all of the oil, gas, and other minerals in place in, on and under said land or that may be produced from said land. This reservation is on a par- ticipating basis as to lease bonuses and lease rentals. And being the same property described in a deed from Robert F. Axe and wife to Aurelio C. Martinez dated Oct. 17, 1942, and recorded in Vol. 336, Page 275, Collin County Deed Records, LESS 3.53 acres, more or less, conveyed to the City of Wylie by warranty deed dated July 20, 1956, and recorded in Vol. 519, Page 197, Collin County Deed Records. WHEREAS, said tract of land is contiguous and adjacent to the City of Wylie, Texas, and is not more than one-half (1/2) mile in width, and WHEREAS, said petition was presented to the City Council on the 22 day of August , 1959, such date being not less then 5 and not more than 30 days from the date hereof, and WHEREAS, after hearing such petition and the arguments for and against the same the City Council has voted to grant such petition and to annex said territory to the City of Wylie, Texas; NOW, THEREFORE, be it ordained by the City Council of the City of Wylie, Texas: That the following described property, to-wit: All that certain lot, tract or parcel of land, situated in Collin County, State of Texas, and described as follows: BEING 111.10 acres of land, more or less, and being a resurvey and consolidation of two (2) tracts of land, the first tract being 46.00 acres and the second tract being 55.00 acres of land described in a Decree of the District Court of Collin County, Texas, wherein said land was decreed to the Dallas Joint Stock Land Bank of Dallas, Texas, shown of record in Volume Dl, Pages 343-346, of the District Court Minutes, Collin County, Texas, and a part of the E. The City Clerk is hereby directed to file with the Couty Clerk of Collin County, Texas, a certified copy of this ordinance.
