Consider and act upon, Resolution No. 2013-18 (R) of the City Council of the City of Wylie, Texas, accepting the proposed property tax rate for fiscal year 2013-2014, accepting the calculation of the effective tax rate, establishing dates for public hearings on the proposed property tax rate, and providing for the publication as provided by the Texas Property Tax Code. (L. Bantz, Finance Director) Executive Summary The City is required by law to follow certain meeting and notice (publication) guidelines identified in the "Truth in Taxation" guide. In accordance with the "Truth in Taxation" laws of the State of Texas, the effective and rollback tax rates and other statements and schedules must be published and two public hearings must be held if an entity's proposed tax rate exceeds the lower of either the effective tax rate or the rollback tax rate. This year's effective tax rate is$0.855158 and the rollback tax rate is$0.903962. Hold a Public Hearing and consider, and act upon, amending the zoning from Agricultural District (AG/30) & Planned Development-Single Family District (PD 2012-04) to Planned Development-Single Family District for an expansion-continuation of an existing Planned Development-Single Family District (PD-SF) on approximately 101.525 acres, generally located south of E. Brown Street and west of W.A. Allen Boulevard. ZC 2013-03 (R. 011ie, Planning Director) Executive Summary The applicant is requesting to establish permanent zoning on an approximate 65.85 acre tract immediately adjacent to an existing Planned Development-Single Family Residential subdivision(PD 2012-04). The purpose for the request is to expand and continue single family detached residential development consistent with Kreymer Estates provisions and conforming to existing surrounding residential properties. PUBLIC HEARING 3. Hold a Public Hearing and consider, and act upon amending the zoning from Corridor Commercial (CC) District to Corridor Commercial with a Specific Use Permit (CC-SUP) for a 14,000 sq.ft. major automotive repair shop (Caliber Collision), located on two acres on Westgate Way north of FM544 (just north of Chili's) ZC 2013-04 (R. 011ie, Planning Director) Executive Summary The applicant is requesting to establish SUP zoning for a Major Automotive Repair Use on two acres on the east side of Westgate Way just north of FM544. The applicant is proposing a Caliber Collision branded automotive repair and body center. The property is in the General Urban sector on the Land Use Plan and currently zoned Commercial Corridor on the Zoning Map so the use is generally consistent with the planned and current uses in the area. 4. Consider and act upon, Ordinance No. 2013-31 amending Ordinance No. 2012-27 (2012- 2013 budget) and approving an appropriation of funds in the amount of$45,000.00 for the General Fund Information Technology (Fire Station Fiber and VOIP Construction Project). (J. Butters, Asst City Mgr) Executive Summary Fire Stations #1 and#3 are not currently connected to our Fiber ring. Stations 1, 3 have been using old microwave technology for wireless connectivity. We have a microwave antenna on a North Texas Municipal Water District Tower as part of this system. Recently construction at NTMWD has interfered with this "line of sight" antenna and increased the urgency of connecting Fire Station#1 and#3 to the fiber ring. Recommendation Accept and place on file the Wylie Economic Development Corporation FY 2013 —2014 Budget. Discussion As approved by the WEDC Board of Directors on August 2, 2013, WEDC staff presents a detailed analysis of WEDC revenues and expenditures for FY 2013 — 2014. Many line-item expenditures are presented in a summary format; however key components of the budget are listed by line-item amount and provide a more detailed description of the program. Sales tax revenues are estimated in-line with Finance Department estimates of$1,856,035, or 16% above FY 11-12 actual receipts and 5% above FY 12-13 projected receipts. The WEDC and Finance are in agreement that revenue (sales tax) forecasting should remain conservative so as to not reduce expenditures mid-year should revenue estimates be too aggressive. Including income from seven WEDC lease properties ($123,000), loan receipts from Wylie Ice Cream Holdings ($11,958), allocated interest earnings ($1,000), and an unreserved beginning fund balance ($1,219,418), the WEDC has $3,211,411 available for economic development programs and operating expenses. Utilizing a zero-sum budgeting approach, the WEDC Board identifies all resources available and budgets to expend 100% of those resources should certain opportunities be presented. For example, after identifying all fixed operating expenses including salaries, debt service, proposed land acquisitions, and preexisting incentive commitments, $530,757 in `Future Projects' remains within the Incentives budget to be used for unidentified economic development projects encountered in FY 13-14. Of the available $3,211,411 in WEDC revenue and existing cash reserves, 41% is proposed for Incentives, 32% for Land Acquisition, 8% for Debt Service, 9% for Personnel, 6% for Advertising/Community Development & Special; Services, 3% for Operating, and 1% for Engineering/Architectural Services. If only evaluating expenditures with direct economic development benefits (not including Personnel, Advertising, and Operating), Page 1 of 3 Page 2 of 3 82% of all WEDC revenue sources are utilized for direct economic development programs. There are two budget documents attached for Council's review. The first attachment is in a format similar to what Council reviews for all other City Departments. The second attachment is very similar to what the WEDC Board of Directors utilizes. Line-items/programs which have significant variance from the prior year are identified below. Personnel expenses have increased by 10.2% due to the following: the existing WEDC Senior Assistant will be retiring in FY 13-14 with the WEDC employing an Administrative Assistant for three months prior to the retirement, a prior year expense associated with a Cooper Clinic Executive Health Plan has been reclassified into salary so as to have a more favorable tax impact to the Executive Director, and a 3% merit increase was approved by the WEDC Board of Directors on August 2, 2013. There are no changes to Supplies other than a reduction of$8,000 in Maps & Photography with the production of fold-up aerials in 2013 having a two-year shelf life. Within the Incentives Budget in FY 2013 — 14, the WEDC will fund existing commitments estimated at $420,482 to Direct Development, B&B Theatre, Ascend Custom Extrusions, Clark Street Development, and T.W. Snider & Associates. The Sanden Incentive is budgeted for a current package the WEDC has offered to Sanden for a proposed$24 mm expansion. Sanden has yet to accept the WEDC proposal. As referenced above, the WEDC will have $530,757 at its disposal for unidentified incentive packages. Payments to Direct Development will be reduced from 85% of total sales taxes generated to 65%. The $184,000 budgeted represents a 10% increase over the prior year taxable sales. A sales tax reimbursement payment will be made in September 2014 to B&B Theatre equaling 100% of WEDC receipts for the prior 15 months. Future reimbursements will be based upon 12 month periods. The WEDC will also be funding a $25,000 reimbursement incentive following certification by the Appraisal District of a minimum $10 mm real property valuation. Per the existing Performance Agreement between the WEDC and Ascend Custom Extrusion, a third grant was funded in June 2013 in the amount of$76,518. Current negotiations for the Ascend expansion call for that amount to be increased to $100,000, but only after the completion of the expansion and installation of the third extrusion press. The $23,482 budget for the Ascend Expansion will fulfill the $100,000 commitment. Staff anticipates funding the 4th of 5 payments ($100,000) in February 2015, approximately 12 months after completion of the proposed expansion. The WEDC Board has considered a new program to benefit existing businesses in the maintenance and enhancement to the exterior of their facilities. The program will provide up to $50,000 annually in a single or multiple grants to a company or companies which make long-lasting improvements to the exterior of their facilities. Improvements such as adding a masonry façade to a metal building, exterior painting, sign/monument enhancements, or even xeriscaping landscape improvements will be considered. The Board envisions preferential treatment within the application process being given to those companies funding a percentage of the improvements and bringing a legally non-conforming structure into conformance. Page 3 of 3 Special Services includes monies for leasehold improvements to WEDC owned facilities, web site maintenance, consulting services to assist the WEDC and Council in land-use planning for the City-owned 19 acres on F.M. 544, demographic studies, and traffic counts. Travel & Training earmarks funds for participation in the Texas Economic Development Council, International Council of Shopping Centers, International Economic Development Council, and general prospect recruitment. Prospect Recruitment monies are intended to fund travel and other expenses associated with visiting and recruiting certain business to relocate to Wylie. For example, staff will be traveling to Colorado in August to meet with a prospective retailer which will be adding 9 locations within the metroplex over the next eighteen months. The Board is currently attempting to purchase five properties which are targeted to benefit either industrial or redevelopment programs being pursued by the WEDC. Should all properties be purchased, $1,000,000 is budgeted for the expense. However, it is unlikely that all properties can be acquired at a reasonable purchase price. Unexpended funds within the Land budget will either remain in the Land budget or shifted to incentives should a significant project present itself. Finally, the WEDC has budgeted $60,000 to partner with the City of Wylie for street improvement projects which benefit existing or future commercial development. He noted it may be considered tonight but needed that clarification. City Manager Manson reported that due to a inadvertent error in the Notice regarding Zoning Case 2013-02 (Item E) the City will need to completely restart the process. The item needs to be pulled from consent and no action should be taken. A vote was taken and the motion passed 5-0 with Mayor Hogue and Councilman White absent. REGULAR AGENDA PUBLIC HEARING 1. Hold a Public Hearing and consider, and act upon, amending the zoning from Agricultural District (AG/30) & Planned Development-Single Family District (PD 2012-04) to Planned Development-Single Family District for an expansion-continuation of an existing Planned Development-Single Family District (PD-SF) on approximately 101.525 acres, generally located south of E. Brown Street and west of W.A. Allen Boulevard. (R. 011ie, Planning Director) Staff Comments Planning Director 011ie addressed council stating that this Zoning Case (ZC 2013-04) received a request late today, by the applicant, to table the item to the next regular meeting of the City Council. This is due to his inability to attend the meeting. 011ie explained, the public hearing should be opened to allow anyone wishing to speak on the proposed zoning the opportunity to speak; and then continue the public hearing to the next regular meeting, if the council desires to table the item. Public Hearing Mayor pro tem Scott opened the public hearing at 6:45 p.m. asking anyone present wishing to address council to come forward. Tom Ballow, 221 Rush Creek Dr.; Marc Verduin, 401 Rushcreek Dr.; John Chumbley, 913 Foxwood Ln. (Wylie residents), and Kent Hervey (resident in the ETJ) spoke against the proposed Zoning Case 2013-04 due to the high density housing proposed. Council Discussion Councilwoman Culver asked Planning Director 011ie to explain how each proposed development is established once zoning is approved with regard to the flood plain. Planning Director 011ie explained that once zoning is approved for each project, the developer and city engineer review the land and determine where the flood plain lies. This could require certain planned development in those areas to be removed. Zoning approval does not allow the developer to set housing until all areas have been examined and the city engineer and building inspections department have fully reviewed each plan. Mayor pro tern Scott asked Ms. 011ie to explain the entrances and exits to the development. 011ie explained that the zoning ordinance requires that each development have a minimum of two entrances; egress and ingress. In this particular development there will be a phase to the east and one to the west, and each must have the minimum requirement for access. Council Action A motion was made by Councilman Jones, seconded by Councilwoman Culver to table Item #1, Minutes July 23, 2013 Wylie City Council Page 3 Zoning Case 2013-04 at the request of the applicant. A vote was taken and the motion passed 5- 0 with Mayor Hogue and Councilman White absent. Consider, and act upon, authorizing the City Manager to sign a Development Agreement between the City of Wylie and Robbins Property Company No. 3, LTD, Southwestern Medical Foundation, Groves Farm, LTD., Wylie-FB, LTD., and JBI Partners, Inc. For the development of Dominion of Pleasant Valley. Located west and south of Pleasant Valley Road and south of Sachse Road/South Ballard Ave. (R. 011ie, Planning Director) Staff Comments City Manager Manson reported that Item #2 was directly related to Item E which no action was taken, due to incorrect posting. Zoning Case #2013-02 (Item E) will need to go back to the Planning and Zoning Commission to begin the process again; staff is asking that this development agreement be tabled until such time as the zoning case comes back for consideration. If approved, the development agreement (Item #2)would then be removed from the table for consideration. City Secretary Ehrlich reported there were no ordinances passed to read into the official records. WORK SESSION • 2013-14 Budget Work Session with Council— (L. Bantz, Finance Director) City Manager Manson reviewed some of the fund summaries for the General Fund, the Utility Fund, the 4B Sales Tax Fund, and the Recreation Fund. Also updated was the estimated property tax, which in Collin County was showing an increase from 2012 to 2013 of approximately 5.5%. Manson reported that with the property value increase, estimated sales tax, and reduction in the employee insurance, the proposed budget was balanced with excess new funds estimated at $1,078,590. Manson explained that the direction needed from Council at the July 30th work session includes: - Determination of the tax rate for the FY14 fiscal year Minutes July 23, 2013 Wylie City Council Page 4 - Confirmation on the use of excess Fund Balance to supplement Debt Service - Direction regarding the use of excess General Fund revenues If it is the desire of the Council to be able to consider allocating funding for compensation and/or marketing pending the results of both of those studies. Manson noted it was recommended that the excess funds be placed within the Special Services line item of the Combined Services Department. Once a determination has been made by Council regarding the use of those funds, they can be reallocated to the appropriate departmental line items via a budget amendment approved by Council. She explained that during that meeting the council would also consider extending the deadline to file the proposed budget from August 5, 2013 to August 12, 2013 to allow additional time after the July 30th special meeting to complete the changes. Mayor Hogue convened into work session at 6:08 p.m. WORK SESSION • FY 2013-2014 Budget Discussion and Department Presentations to Council City Manager Manson continued to update some of the fund summaries for the General Fund, the Utility Fund, the 4B Sales Tax Fund, and the Recreation Funds. She stated that today new information had been received on the property valuations for 2013/14 from Collin, Rockwall, and Dallas appraisal districts. In total, the estimated property tax increase went from 5.5% reported at the July 23rd meeting to 6.5% overall. Manson reported that with the property value increase, estimated sales tax, and reduction in the employee insurance, the proposed budget was balanced with excess funds estimated at $1.3 million. Mayor Hogue asked City Manager Manson for an amount of excess funds that would be left if the narcotics officers (2 - one full year and the other mid-year) and the Advocacy Center Officer were considered for approval in the budget. Hogue also requested that excess funds be projected if the above positions were approved and a tax rate reduction of 1 cent, .5 cent, and .25 cents were considered as well. Manson reported, assuming in all three cases the positions were approved, the excess funds remaining if a .25 cent tax reduction was implemented, would be $935,000; if a .5 cent tax reduction was implemented the excess funds remaining would be $875,000, and if a 1 cent tax reduction was implemented the excess funds remaining would be $755,000. Manson asked and received direction from council regarding the following items. Council requested staff to bring back a proposed budget with .5 cent reduction in the tax rate for further consideration. Direction from council regarding the use of all other excess General Fund revenues was for staff to bring back a proposed budget with any un-used excess funds being placed in a Special Services line item awaiting the results of the compensation plan and the marketing plan. Manson reported there would be two public hearings on the final proposed tax rate with the first being on August 27th and the second being held on September 3rd during a special called meeting. Discussion Requests for Proposals were sent to United Healthcare (current provider), AETNA, Cigna, Blue Cross/Blue Shield, Humana and TML. The Wylie Insurance Agency presented several renewal options for medical insurance. Our usage has dramatically decreased in the past 12 months, in part due to the aggressive wellness program that the City of Wylie Human Resources Department has executed. Staff is recommending renewing with United Health Care's TYQ-P plan. This plan is identical to our current plan with three exceptions: 1. There are no office visit co-pays for children up to age 19 (a tremendous value for our families); 2. There are no out-of-network benefits; and 3. The premium is a decrease of our FY2013 rate, saving the City valuable dollars. United Healthcare, represented by Wylie Insurance Agency, presented options for dental insurance. Staff is recommending renewing our current plan with no changes and a 0% rate increase over our FY2011 rate. We have not seen an increase since FY2011. Lincoln Finance Services, represented by Wylie Insurance Agency, is renewing both life and long term disability coverage at the same rate as FY2012. We have not seen an increase since FY2012. When cars park in the southbound lane adjacent to Hartman Elementary it creates visibility issues for pedestrians as well as cars exiting the school property. Approval of the ordinance would restrict parking in this area. Hilltop Lane is a single loaded street with homes fronting the roadway along the east side. Parking for these residents is provided in their driveway and along the northbound (east) side of the street. As a result, if cars park on the southbound (west) side of the street it is difficult for emergency vehicles and school traffic to access Burnett Junior High School. Restricting parking on the west side of Hilltop from Stone Road to Pirate Drive will allow for two way traffic as well as parking along the east side of the roadway. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: FINDINGS INCORPORATED. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Section 110-173 (a) (10) (Stopping, Standing, or Parking Prohibited in Certain Places) of Article VI (Stopping, Standing, and Parking) of Chapter 110 (Traffic and Vehicles) of the Wylie Code of Ordinances. SECTION 3: ENFORCEMENT: In no way shall those areas where stopping, standing, or parking is prohibited be obstructed and no parking shall occur therein. The Police Chief, or his/her authorized representatives, is authorized to issue citations and/or remove or cause to be removed any material or vehicle obstructing the area in which stopping, standing, or parking is prohibited at the expense of the owner of such material or vehicle. The City shall not be responsible or liable for any damage to any vehicle or personal property removed from the area where stopping, standing, or parking is prohibited and shall not be responsible for any damage resulting from the failure to exercise the authority granted under this Ordinance. SECTION 4: SAVINGS/REPEALING CLAUSE. All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect. SECTION 5: SEVERABILITY. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid. SECTION 6: PENALTY PROVISION. Any person violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined a sum of not more than Five Hundred Dollars ($500.00). Each continuing day's violation or separate act under this Ordinance shall constitute a separate offense. The penal provisions imposed under this Ordinance shall not preclude Wylie from filing suit to enjoin the violation. Wylie retains all legal rights and remedies available to it pursuant to local, state and federal law. SECTION 7: AMENDMENTS. For clarity in reading amendments to the Wylie Code of Ordinances, any language intended to be added to the code may be underscored in the amending ordinance, and any language intended to be deleted from the code may be placed in brackets and stricken through. These markings, when used, and the deleted portions shall be removed when amendments are printed in the code. The amended provisions as set forth in this Ordinance have also been renumbered for ease of reading. Discussion During a January 8, 2013, Work Session with city staff and members of the Wylie Downtown Merchants Association, the City Council gave direction to move forward with the Wylie Jubilee Bluegrass on Ballard concept and allocate $5,000 from the Hotel Tax Fund to help support the event, pending involvement by city staff in the execution of the event and participation of the Public Arts Advisory Board through an Arts and Craft fair. Bluegrass on Ballard held July 6, 2013, attracted thousands of people to our Historic Downtown District. Based on informal interviews and feedback from area restaurants and businesses, more than 50% of the attendees were first time visitors to the downtown area. The Best Western Wylie Inn sold out, and restaurants including the Ballard Street Café, Taste of Home, and the 96 West Winery reported record sales, returning sales tax dollars to the city. In addition, the Public Art Advisory Board Arts & Craft event brought in $3,850 to the Public Art Fund. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that it will be beneficial and advantageous to the citizens of the City of Wylie, Texas ("Wylie") to amend Ordinance No. 2012-27 (2012-2013 Budget) for the purpose of allocating funds for the Wylie Downtown Merchants Association Wylie Jubilee Bluegrass on Ballard held on Saturday, July 6, 2013. WHEREAS, the five thousand dollars ($5,000.00) matches the Wylie Downtown Merchants Association's five thousand dollar($5,000.00) funding of the Wylie Jubilee Bluegrass on Ballard to be used to secure musicians and infrastructure for the event; and WHEREAS, the Wylie Jubilee Bluegrass on Ballard attracts visitors from throughout the region and the State of Texas who stay in our hotel, shop our stores and eat in our restaurants. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Ordinance No. 2012-27 (2012-2013 Budget). SECTION 3: Savings/ Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed; but such repeal shall not abate any pending prosecution for violation of the repealed Ordinance, nor shall the repeal prevent prosecution from being commenced for any violation if occurring prior to the repeal of the Ordinance. Any remaining portions of conflicting ordinances shall remain in full force and effect. Discussion The City is required by law to follow certain meeting and notice (publication) guidelines identified in the "Truth in Taxation" guide. In accordance with the "Truth in Taxation" laws of the State of Texas, the effective and rollback tax rates and other statements and schedules must be published and two public hearings must be held if an entity's proposed tax rate exceeds the lower of either the effective tax rate or the rollback tax rate. This year's effective tax rate is $0.855158 and the rollback tax rate is $0.903962. The proposed 2013-14 budget is based on a tax rate of$0.8839 per$100 valuation. Any change in the proposed tax rate will require revision of the proposed budget. Since the proposed tax rate exceeds the effective tax rate the City Council is required to vote on the proposed tax rate and publish the results of the vote at least seven (7) days prior to the first scheduled public hearing on August 27, 2013. A second public hearing is scheduled for September 3, 2013. The Council may not adopt the tax rate at these hearings. At each hearing, it must announce the date, time and place of the meeting at which it will adopt the tax rate. This meeting must take place no less than three (3) days and no more than fourteen (14) days after the second public hearing. The City Council's vote on the tax rate is scheduled for September 10, 2013. The official detailed effective tax rate calculation is available in the office of the Collin County Tax Assessor/Collector (Kenneth L. Maun) in McKinney. ZC 2013-03 Discussion Owner: Nora Kreymer & Retha Tibbals Applicant: Douglas Properties & Bloomfield Homes This item was tabled at the July 23, 2013 City Council meeting and must be removed from the table. The applicant is requesting to establish permanent zoning on an approximate 65.85 acre tract immediately adjacent to an existing Planned Development-Single Family Residential subdivision (PD 2012-04). The purpose for the request is to expand and continue single family detached residential development consistent with Kreymer Estates provisions and conforming to existing surrounding residential properties. Generally located south of E. Brown Street and west of W.A. Allen Boulevard; the area of this request extends west to Oaks Addition, south and southwest to the Rush Creek Estates & Heatherwood Estates residential neighborhoods and encompasses the 100 year flood plain. The proposed addition will connect to existing through streets Oak Street, Rush Creek Drive, Tanglewood Drive and Cedar Creek Drive. Annexation of the referenced Kreymer Family tract was in conjunction with a series of comprehensive citywide annexations in 1986. Multiple tracts would eventually be zoned for single family development and several would retain their Agriculture designation and continue to be used for agricultural and open space uses. Page 1 of 3 Page 2 of 3 The property has native vegetation with various groups of mid-to large trees and has varying degrees of topography, mostly sloping towards Rush Creek. Rush Creek is a natural tributary to Lake Ray Hubbard and a prominent feature of the terrain as well as multiple open space areas. The applicant/owner is requesting a change in zoning to allow for suburban single family residential neighborhood consistent with the City's Comprehensive Plan in preserving natural open spaces and providing pedestrian paths & connections in its design. PD districts allows for innovation in development projects envisioned by the City's Comprehensive Plan. Further, single family residential developments should be sensitive, compatible in scale, character and intensity with surrounding residential neighborhoods. The current Comprehensive Plan designates Medium Density Residential for the area of this request. Medium Density Residential category is for single family detached houses requiring minimum 10,000 square foot lots and may be permitted to have special design standards. Adjacent single family residential properties to the east were developed under the 1999 Comprehensive Land Use Plan requiring minimum 8,500 square foot lots and minimum 1,700 square foot dwelling units. The applicant has provided a zoning exhibit to serve as preliminary plat (Exhibit C) for this proposal as well as a list of proposed planned development provisions (Exhibit B) that will establish additional design guidelines. (See Attached) The applicant has also been collaborating with Park's Department staff and the City's Parks Board in the dedication and construction of public hike & bike trail, open spaces and other recreational amenities (Exhibit P) that will be incorporated throughout the proposed neighborhood as well as open space and other pedestrian linkages. This request proposes to build upon public amenities approved & near completion by adding a pedestrian bridge spanning the creek, 12 adult workstations, picnic benches and appropriate lighting. Hike & bike trails will span for a total of 11,0001.f. In summary, the request to rezone property from Agricultural to PD-SF is consistent with the City's Comprehensive Plan and Land Use Map and does conform to the existing Planned Development 2012-24. In addition, staff recognizes the applicant's desire to preserve open spaces and natural systems along with providing a homeowners association with responsibility of maintenance of those areas accordingly. Notification/Responses: One hundred twenty-three (123) notifications were mailed, with twelve (12) written responses returned opposing the request and no responses in favor of the request at the time of posting. Parks Board Meeting At their May 20, 2013 Parks Board meeting; the Board voted 6-0 to accept the applicant's proposal for parkland dedication as submitted and recommends approval subject to planned development provisions. Planning Commission Discussion At their July 2, 2013 Planning & Zoning Commission meeting one Commissioner suggested the applicant consider an additional tot-lot if possible. Several members from surrounding properties spoke during the public hearing with majority of concern regarding lot density, traffic, storm water runoff and preservation of open space vegetation and wildlife. Discussion Fire Stations #1 and #3 are not currently connected to our Fiber ring. Stations 1, 3 have been using old microwave technology for wireless connectivity. We have a microwave antenna on a North Texas Municipal Water District Tower as part of this system. Recently construction at NTMWD has interfered with this "line of sight" antenna and increased the urgency of connecting Fire Station#1 and#3 to the fiber ring. In the past getting fiber to Stations 1 and 3 have been long runs and were very expensive. Within the last 1.5 years WISD ran fiber down South Ballard so that we can connect without a large cost. As part of The Brown East construction project we had the contractor put in conduit from Fire Station #3 to Kreymer which greatly reduced the cost of connecting Station 3. Reliability and communication will be greatly improved for Fire Stations 1 and 3 if we can connect them by fiber. Once we have Fire Station #1 and #3 connected to our fiber ring it makes a lot of sense for us to convert all three stations to VOIP and put them on our system. The reduction in "hard line" phone bills will pay for the VOIP in approximately one year. We can accomplish all of this with a budget amendment of$45,000. Page 1 of 1 ORDINANCE NO. 2013-31 AN ORDINANCE OF THE CITY OF WYLIE, TEXAS, AMENDING ORDINANCE NO. 2012-27 (2012-2013 BUDGET) AND APPROVING AN APPROPRIATION OF FUNDS IN THE AMOUNT OF $45,000.00 FOR THE GENERAL FUND INFORMATION TECHNOLOGY (FIRE STATION FIBER AND VOIP CONSTRUCTION PROJECT) ; PROVIDING FOR REPEALING, SAVINGS AND SEVERABILITY CLAUSES; AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the City Council of the City of Wylie, Texas ("City Council") has investigated and determined that it will be beneficial and advantageous to the citizens of the City of Wylie, Texas ("Wylie") to amend Ordinance No. 2012-27 (2012-2013 Budget) for the purpose of connecting Wylie Fire Stations #1 and #3 to the City of Wylie/WISD fiber ring and for installing VOIP at Wylie Fire Stations #1,#2, and #3, a construction project funded by the General Fund. WHEREAS, the estimated cost of completing the Fire Station Technology Construction Project is forty-five thousand dollars ($45,000.00); and WHEREAS, the Fire Station technology construction project has become critical to Fire Department communication due to construction at North Texas Municipal Water District which has partially obstructed Fire Stations #1 and#3 from the microwave antenna. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2: Amendment to Ordinance No. 2012-27 (2012-2013 Budget). Ordinance No. 2012-27 (2012-2013 Budget) is hereby amended to allow for the following appropriation: Forty-Five thousand dollars ($45,000.00) shall be appropriated to Expense Account 100-5155-58810 of the General Fund SECTION 3: Savings/ Repealing Clause. All provisions of any ordinance in conflict with this Ordinance are hereby repealed; but such repeal shall not abate any pending prosecution for violation of the repealed Ordinance, nor shall the repeal prevent prosecution from being commenced for any violation if occurring prior to the repeal of the Ordinance. Any remaining portions of conflicting ordinances shall remain in full force and effect. Should any section, subsection, sentence, clause or phrase of this Ordinance be declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Wylie hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause, or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared unconstitutional or invalid. SECTION 5: Effective Date. This Ordinance shall become effective immediately upon its passage.
