April 9, 1987
The City of Wylie has requested renewal of their existing permit for the discharge
of 800,000 gpd of treated domestic wastewater with effluent limitations of 20 mg/1
BODE and 20 mg/1 TSS. This permit renewal is for a limited time and includes
provisions for the installation of new wastewater treatment facilities and
subsequently shutting down the existing treatment facilities permitted for 800,000
gpd.
The new facilities are to be designed for a capacity of at least 2,500,000 gpd and
shall also be designed to meet "advanced treatment" levels delineated in effluent
set 2-N of Chapter 309 of the TAC. These requirements and an implementation
schedule is delineated in paragraph no. 3 of the "Other Requirements" section of
the draft permit. The new facilities are to be in operation By February 1, 1989
and the existing 800,000 gpd facilities are to be shutdown by August 1, 1989.
The new treatment plant is to be located at a landfill site across the road from
the existing site. A closure plan for the landfill site was submitted to the
Texas Department of Health (TDH) on April 1, 1987. This plan reflects that
construction for closure of the site is to be complete by June 29, 1987, which is
about 6 months prior to the initiation of construction for the new wastewater
treatment plant.
The existing facilities discharge treated effluent to an unnamed tributary
adjacent to the plant site; thence to Muddy Creek; thence to Lake Ray Hubbard in
Segment No. 0820 of the Trinity River Basin. The designated uses of this segment
are contact recreation, high quality aquatic habitat and public water supply and
is classified as a water quality limited stream. The latest Waste Load Evaluation
(WLE) was approved on 5/21/74.
The existing treatment facilities consist of an oxidation ditch, a clarifier, a
chlorine contact basin, a sludge digester/holding basin and sludge drying beds.
Final disposal of the sludge is in the Maxwell Creek Sanitary Landfill of the
North Texas Municipal Water District.
No change is recommended in the basic effluent discharge limitations of 20 mg/1
BODE and TSS for this proposed permit renewal . However, a minimum of 3 mg/1
disgolved oxygen (D.O.) has been specified for the effluent to aid in maintaining
the goal of 3 mg/1 D.O. in non-segmented streams per the Texas Surface Water
Quality Standards. The WLE reflects that the City of Wylie's discharge is 5.0
miles from Lake Ray Hubbard (Segment No. 0820) thus requiring a BODEof 10 mg/1.
However, the actual discharge is approximately seven (7) miles, colsequently, a
BOD5 of 20 mg/1 for the permit renewal should be satisfactory.
The effluent limitations of 10 mg/1 BODE, 15 mg/1 TSS, 3 mg/1 NH -N and a minimum
of 4 mg/1 D.O. are required for the hew 2.5 MGD (minimum) plant to meet the
requirements of the Texas Surface Water Quality Standards for Muddy Creek and
Segment 0820.
The treated effluent for the existing facilities and the new plant shall contain a
chlorine residual of at least 1.0 mg/1 after a detention time of at least 20
minutes, based on peak flow.

The proposed effluent limitations for both the existing and new facilities are
consistent with the requirements of Chapter 309 of the TAC.
The existing facilities are located south of State Highway 78 and west of
Birmingham Street, in the southwestern section of Wylie in Collin County, Texas.
The proposed permit renewal stipulates that the permit shall expire at midnight on
December 1 , 1989. This will allow a contingency of four (4) months past the
projected shutdown of the existing facilities by August 1, 1989.
Once the draft permit is completed, it is sent to the notice section of the Texas
Water Commission where a notice is written that is to be published by the
applicant in a newspaper generally circulated in the county where the wastewater
treatment plant will be located. A thirty day period is set aside once the notice
is published for public comment. A notice is also sent out to the landowners
identified in the permit application and any interested parties. At this time, if
any comments requesting a public hearing are filed with the Commission, a public
hearing is held. After the public hearing or after the thirty day waiting period
is up with no request for a public hearing, the proposal for decision or draft
permit is put before the Commissioners for a decision. For additional information

2. The effluent shall contain a chlorine residual of at least 1.0 mg/1 after a detention time of at least

disinfection may be substituted only with prior approval of the Commission.

DEFINITIONS
All definitions contained in Section 26.001 of the Texas Water Code shall apply
to this permit and are incorporated therein by reference. Additional definitions
of words or phrases used in this permit are as follows:
1. Flow Measurements
a. Daily average flow - the arithmetic average of all determinations
of the daily discharge within a period of one calendar month or 30
consecutive days. The daily average flow determination shall
consist of at least four separate determinations. If instantaneous
measurements are used to determine the daily discharge, the
determination shall be the average of all instantaneous
measurements taken during a 24-hour period or during the period of
daily discharge if less than 24 hours.
b. Instantaneous flow - the measured flow during the minimum time
required to operate the flow measuring device.
c. 2-hour peak - the maximum flow sustained for a two hour period
during the period of daily discharge. Multiple measurements of
instantaneous maximum flow within a two-hour period may be compared
to the permitted 2-hour peak flow.
2. Concentration Measurements
a. Daily average concentration - the arithmetic average weighted by
flow value of all samples, of all types, within a period of one
calendar month or 30 consecutive days, consisting of at least four
separate representative measurements. When four samples are not
available in a 30 day period, the arithmetic average (weighted by
flow) of all values in a four consecutive month period consisting
of at least four measurements may be compared to the daily average
limit.
b. 7-day average ' concentration - the arithmetic average of all
samples, of all types, within a period of seven consecutive days,
consisting of at least three separate measurements.
c. Daily maximum concentration - the maximum allowed concentration
measured on a single day (by composite sample, unless otherwise
specified).
3. Sample Type
a. Composite sample - a sample made up of a minimum of three effluent
portions collected in a calendar day or during the period of daily
discharge if less than 24 hours, and combined in volumes
proportional to flow; . or a sample continuously collected,
proportional to flow, in a calendar day or during the period of
daily discharge if less than 24 hours.

b. Grab sample - an individual sample collected in less than 15
minutes.
4. Permitted Facility - Wastewater facilities used in the conveyance,
storage, treatment, recycling, reclamation and/or disposal of municipal
sewage or industrial wastes, including sludge handling or disposal
facilities under the jurisdiction of the Commission.
5. The term "sewage sludge" shall mean the solids and precipitates
separated from wastewater by unit processes.
MONITORING AND REPORTING
1. Self-Reporting
Unless otherwise specified in this permit or otherwise ordered by the
Commission, the permittee shall conduct effluent sampling and reporting
in accordance with 31 TAC §§319.5-319.6. A monthly effluent report must
be submitted each month by the 20th day of the following month for each
discharge which is described by this permit whether or not a discharge
is made for that month. Knowingly making any false statement on any
such report may result in the imposition of criminal and/or civil
penalties as provided by State law.
2. Test Procedures
Test procedures for the analyses of pollutants shall comply with
procedures specified in 31 TAC §§319.10-319.11. Measurements, tests,
and calculations shall be accurately accomplished in a representative
manner.
3. Recording of Results
With respect to each measurement, test or calculation, the following
information shall be accurately recorded, with such records being kept
at the plant site for three years, including the following:
a. The exact place, date and time of sampling or measurement;
b. The dates and times the analyses were performed;
c. The person(s) who performed the analyses, sampling and/or
measurements;
d. The analytical techniques or methods used; and
e. The results of all required analyses.
4. Additional Monitoring by Permittee
If the permittee monitors any pollutant at the location(s) designated
herein more frequently than required by this permit using approved
analytical methods as specified above, the results of such monitoring
shall be included in the calculation and reporting of the value
submitted on the required monthly effluent report. Increased frequency
of sampling shall be indicated on the report.

5. Calibration of Instruments
All automatic flow measuring and/or recording devices and/or totalizing
meters shall be accurately calibrated by a qualified person at plant
startup and as often thereafter as necessary to ensure accuracy, but not
less than annually. Such person shall certify in writing that the
device is operating properly and giving accurate results. Copies of the
certification shall be kept at the plant site for at least three years,
in accordance with the following paragraph.
6. Records Retention
All records and information resulting from the monitoring activities
required by this permit, including all records of analyses performed, as
well as all calibration and maintenance of instrumentation and
recordings from continuous monitoring instrumentation, shall be retained
at the plant site for a minimum of three years (or longer if requested
by the Regional Administrator of the Environmental Protection Agency or
the Executive Director of the TWC). The period during which records are
required to be kept shall be automatically extended to and through the
final disposition of any administrative or judicial enforcement action
that may be instituted.
7. Noncompliance Notification
If, for any reason, the permittee does not comply with or will be unable
to comply with any permitted effluent limitation, the permittee shall
provide the Executive Director of the Commission with the following
information, in writing, within five days of becoming aware of such
condition:
a. A description of the discharge and cause of noncompliance; and
b. The period of noncompliance, including exact dates and times; or,
if not corrected, the anticipated time the noncompliance is
expected to continue, and steps being taken to reduce, eliminate
and prevent recurrence of the noncomplying discharge.
PERMIT CONDITIONS
A. General Requirements
1. The permittee must comply with all terms and conditions of this permit,
applicable state laws, and rules and orders of the Commission.
Noncompliance by the permittee may result in the imposition of civil
and/or criminal penalties as provided by the Texas Water Code.
Violation of the permit includes, but is not limited to, the discharge
of any pollutant more frequently than, or at a level in excess of, that
identified and authorized by this permit.

2. This permit was granted on the basis of the information supplied and
representations made by the permittee in the course of the application
process and in reliance upon the accuracy and completeness of that
information and those representations. After notice and opportunity for
a hearing, this permit may be modified, suspended, or revoked in whole
or in part during its term for cause including, but not limited to, the
following:
a. Violation of any terms or conditions of this permit:
b. Obtaining this permit by misrepresentation or failure to disclose
fully all relevant facts; or
c. A change in any condition that requires either a temporary or
permanent reduction or elimination of the authorized discharge.
3. All notifications to the Commission required of the permittee by this
permit shall be made in writing. The permittee shall keep and make
available (1) proof of delivery and (2) a copy of each such
notification, upon the same basis as self-monitoring data are required
to be kept and made available.
4. Any act required by this permit to be accomplished by the permittee on
or by a described or specified date shall be done on or before that
date. If the act is not done on or before that date, a new obligation
to do the act shall arise on each succeeding calendar day until the act
is done.
5. As a condition to issuance of this permit, the permittee expressly
consents to announced and unannounced inspections of the permitted
facility. The permittee is also hereby notified that the State and/or
local governments specifically reserve all rights of entry and
inspection granted them by law, including, but not limited to, the
rights:
a. To enter upon the permittee's premises or other premises under the
control of the permittee, where an effluent source is located or in
which any records are required to be kept under the terms and
conditions of this permit;
b. To have access to and copy any records required to be kept under
the terms and conditions of this permit;
c. To inspect any monitoring equipment or monitoring method required
in this permit;
d. To sample any discharge; and
e. To perform an enforcement and/or operation and maintenance
inspection of the permittee facility.

6. Nothing in this permit shall be construed to preclude the institution of
any legal action nor relieve the permittee from any responsibilities,
liabilities or penalties established pursuant to any applicable State or
Federal law or regulation.
7. This permit does not authorize any activity of hazardous solid waste
storage, processing, or disposal which requires a permit pursuant to the
Texas Solid Waste Disposal Act, Article 4477-7, Vernon's Annotated Texas
Statutes.
R. The conditions of this permit are severable, and if any provision of
this permit, or the application of any provision of this permit to any
circumstance, is held invalid, the application of such provision to
other circumstances, and the remainder of this permit, shall not be
affected thereby.
B. Amendment Notice
1. Prior to any facility modifications, additions and/or expansions of a
permitted facility that will increase the plant capacity beyond the
permitted flow, the permittee must apply for a permit amendment and
receive written approval of the permit amendment from the Commission
before commencing construction.
2. Prior to accepting wastes which are not described by this permit or
which would result in a significant change in the quantity or quality of
the existing discharge, the permittee must report the proposed changes
to the Commission and apply for a permit amendment reflecting any
necessary changes in permit conditions, incluaing effluent limitations
for pollutants not identified and limited by this permit. In no case
are any new connections, increased flow or significant changes in
influent quality authorized that will cause violation of the effluent
limitations specified by this permit.
3. Prior Lu any transfer of this permit or change in control ur ownership
of facilities authorized by this permit, a Commission order must be
obtained authorizing such transfer or change.
4. By accepting this permit, permittee accepts the Commission's authority
to amend the permit to require the system covered by this permit to be
integrated into an areawide system, should such be developed. Such
amendments may he made when changes required are advisable for water
quality control purposes and are feasible on the basis of waste
treatment technology, engineering, financial , and related considerations
existing at the time the changes are required, exclusive of the loss of
investment in or revenues from any of the existing or proposed waste
collection, treatment or disposal systems.

C. Operational Requirements
1. The permittee shall at all times operate and maintain the permitted
facility to achieve compliance with the terms and conditions of this
permit. Proper operation and maintenance of the permitted facility is
required at all times, and includes effective performance, adequate
maintenance of equipment, adequate funding, adequate operator staffing
and training, and adequate laboratory and process controls, including
appropriate quality assurance procedures.
2. Unless otherwise specified in this permit or otherwise ordered by the
Commission, the permittee shall comply with all provisions of 31 TAC
§§319.21 - 319.29 concerning the discharge of certain hazardous metals.
3. The permittee shall notify the Executive Director of the Commission at
least 90 days prior to conducting any activity of closure of any pit,
pond, lagoon, or surface impoundment regulated by this permit.
4. The permittee is responsible for installing prior to plant startup, and
subsequently maintaining, adequate safeguards to prevent the discharge
of untreated or inadequately treated wastes during electrical power
failures by means of alternate power sources, standby generators, and/or
retention of inadequately treated wastewater.
5. Whenever flow measurements for any domestic sewage treatment facility
reach 75 percent of the permitted average daily flow for three
consecutive months, the permittee must initiate engineering and
financial planning for expansion and/or upgrading of the domestic
wastewater treatment and/or collection facilities. Whenever, the
average daily flow reaches 90 percent of the permitted average daily
flow for three consecutive months, the permittee shall obtain necessary
authorization from the Commission to commence construction of the
necessary additional treatment facilities. In the case of a domestic
wastewater treatment facility which reaches 75 percent of the permitted
daily average flow for three consecutive months, and the planned
population to be served is not expected to exceed the design limitations
of the treatment facility, the permittee will submit an engineering
report supporting this claim to the Executive Director of the
Commission. If in the judgment of the Executive Director the population
to be served will not cause permit noncompliance, then the requirement
of this section may be waived. To be effective, any waiver must be in
writing and signed by the Executive Director or his or her designee, and
such waiver of these requirements will be reviewed upon expiration of
the existing permit. However, any such waiver shall not be interpreted
as condoning or excusing any violation of any permit parameter.
6. Sewage treatment plants shall be operated and maintained by a sewage
plant operator holding a valid certificate of competency.

7. The plans and specifications for sewage collection and treatment works
associated with the discharge authorized by this permit must be approved
pursuant to State law, and failure to secure approval before commencing
construction of such works or making a discharge therefrom is a violation
of this permit and each day of discharge is an additional violation until
approval has been secured.

D. Other Requirements
1. The permittee shall immediately notify the Austin Office and the District
4 Office of the Texas Water Commission in writing upon completion of the
new facilities.

permittee shall ensure that the disposal of sludge does not cause any

Chapter 317 of the TAC, entitled "Design Criteria for Sewerage Systems."
The effluent limitations of the new facilities shall meet the "advanced
treatment" levels delineated in Set 2-N of Chapter 309 of the TAC,
entitled, "Effluent Standards". The basic parameters for set 2-N are:
