Article 10, Section 8 - Damage Suits of the Charter of the
City of Wylie states before the City shall be liable for any
claim for damages for the death or personal injuries of any
person or for damages to property, the complainant or his
authorized representative shall notify the City Secretary.
The notification shall be in writing and shall state
specifically how, when and where the death, injury or damage
occurred; the amount of loss claimed; and the identity of
any witnesses upon whom it is relied to establish the claim.
The notification shall be filed within forty-five (45) days
of the date of injury or damage or, in the case of death,
within forty-five (45) days of the date of death. The
failure to so notify the City within the time and manner
specified shall exonerate, excuse and exempt the City from
any liability whatsoever. No action at law shall be brought
against the City until at least sixty (60) days have elapsed
since the date of notification.

The damages that I observed were substantial, however I feel
that if they act swiftly that they can vaccurn the water out
before there is permanent damage. There was no odor from
the sewer water therefore I feel that the carpet is
salvagable.

As indicated on our visit of 1/16/87, I could not find any negligent
operation on the part of the City of Wylie. Therefore, the claim
was denied that date in person to Mr. Richard Parker. I have at
this time forwarded formal denial to Mr. Parker, and requested that
any inquiries concerning the claim fran his company be directed to
our offices.
I am also attaching photo of the building to go with your photos of
the interior, and I am also attaching a review of the damages suffered
by Mr. Parker.

On 1/16/87, I visited with you and made an inspection of your damages
and an investigation into the cause of the loss captioned above. As
indicated on that date, it is regretful that the damages occurred, but
in the investigation it was felt that the City of Wylie had no respon-
sibility for the damages.
As indicated on that date, the damages to your building at 900 Kirby
should be turned in to your insurance carriers. If, in their investi-
gation, it is felt that there is responsibility, they should be in con-
tact with our office.

schedule will become a part of our renewed permit for the
existing WWTP, which will be issued in the near future .
At our meeting in Austin on March 20 , 1987 , you indicated
that the new WWTP must be on-line by February 1 , 1989 . This
is less than 2 years from now, which presents an extremely
tight schedule with no room for delays . This will also
probably result in higher engineering and construction costs

as our "beginning" date and make every effort possible to

Dear Mr . Santry:
Our meeting last week with the TWC has significantly changed
the "plan of action" that we have been proceeding on with
the City for your wastewater treatment plant (WWTP) facilities.
In essence, the TWC stipulated the following conditions :
1 . The City' s existing discharge permit will be renewed at
a monthly average flow of 0 . 8 mgd. The maximum effluent
BOD and TSS will be set at 150 lb/day. There will be
no requirement established for ammonia removal.
2 . This will be a temporary permit pertaining only to the
• existing plant. The TWC expects the City to spend as
little money as possible on the existing plant and put
a major effort into a new plant.
3 . The renewed permit will be issued with a strict time
schedule by which the new WWTP must be on line . The
TWC has stated that the new plant must be operational
by February 1 , 1989 .
4 . The TWC has stated that the design (peak month average)
capacity of the new plant must be at least 2 . 25 mgd.
The TWC ' s stipulations bring forth two major considerations
for the City. First, we still consider that some improvements
to the existing plant are necessary to help meet the effluent
requirements of the renewed permit. We recommend that the
influent pump station and aeration improvements (to be designed
under our Task Order No. 3) be constructed as planned, with
the exception that the size of these facilities may be some-
what smaller than anticipated earlier . The secondary clari-
fier addition and improvements should be delayed or even
eliminated, with the understanding that the effluent

requirements stipulated by the TWC will be very difficult to
achieve even with polymer addition.
The second major consideration for the City is schedule . As
you are aware, the schedule proposed by the TWC is extremely
tight. Assuming a construction period of 15 months (which
is the minimum we would recommend for a new facility in the
2 . 5 to 4 mgd size range) and an advertisement, bid, and award
period of 1 } months , only about 6 months remain for the new
plant predesign and design effort. As a result, it is impera-
tive that design of the new WWTP begin as quickly as possible.
Based on these considerations, we recommend the following:
1 . The scope defined in Task Order No. 3 should be modified
to include design of the existing WWTP short-term improve-
ments (influent pumping and aeration only) and a fast-
track predesign of the new WWTP. We believe that the
budget of $62 , 900 established in Task Order No. 3 should
be adequate to perform these services . The advantage
of modifying the task order already authorized by the
City is that the proposed work is within the Council ' s
intent regarding timely resolution of the WWTP problems
and work on the predesign activity could begin immedi-
ately. We strongly feel that this will be necessary if
the schedule stipulated by the TWC is to be met.
2 . In early April , a scope and fee for Task Order No. 4
pertaining to the final detailed design services for
the new WWTP should be drafted, negotiated and approved
by the Council. We anticipate an advertisement date of
September 15 , 1987 which allows only about 6 months for
this design and review period.
The basic scope of services that we propose to furnish for
the modified Task Order No. 3 are summarized in the attached
"Amendment to Task Order No. 3 Scope of Services . " As compen-
sation for providing these services, we propose that the
estimated budget for Task Order No. 3 remain at $62, 900 .
This compensation will still be paid on a monthly billing
basis at a rate of the personnel ' s salary cost times a multi-
plier of 2 . 25 , with reimbursement of all direct expenses at
actual cost times 1 . 10 . The work will be done on a time and
materials basis so that the City will only pay for actual
hours expended and costs incurred on the project. The total

AMENDMENT TO TASK ORDER NO. 3 SCOPE OF SERVICES
The basic scope of services will include the following tasks
to be performed by the ENGINEER:
A. EXISTING PLANT, SHORT-TERM IMPROVEMENTS DESIGN SERVICES
1 . Final Design Project Management, Project Coordina •
-
tion, and Project Review and Quality Control
a. The ENGINEER will conduct meetings to provide
guidance and coordination with the ENGINEER' s
assigned Project Staff.
b. The ENGINEER will manage the Project' s budget
and monitor its percent complete status by
preparing monthly Project status analyses and
formally submitting invoices to the OWNER on
a monthly basis .
c . The Project' s quality will be monitored
through the use of OWNER and ENGINEER reviews
as described below:
o OWNER' s informal review will be conducted
through the use of one meeting between
the ENGINEER and designated representa-
tives of the OWNER at approximately the
50-percent complete stage.
o The ENGINEER will provide in-house re-
view of the final design status and Con-
tract Documents at the 80-percent comple-
tion level by technically competent senior
Project personnel.
o Concurrent with the ENGINEER' s 80-percent,
in-house review of the Contract Documents ,
the ENGINEER will conduct an 80-percent
review meeting with the OWNER.
o Additional meetings with the OWNER will
be conducted if requested by the OWNER
under the provisions of an increased
scope amendment to this Task Order
Amendment.
2 . Final Design Process Components
The following specific facilities identified in
the Preliminary Engineering Study are to be designed

by the ENGINEER for installation in one contract
at the existing wastewater treatment plant site:
a. The replacement of two influent pumps and
associated suction and discharge piping with
new pumps and piping at the influent pump
station. Associated electrical equipment and
wiring modifications will also be included.
b. The addition of four new floating aspirator
aerators at the oxidation ditch with associated
electrical equipment and wiring.
Final detailed design work will include structural,
mechanical , and electrical drawings . Specifications
will be prepared for the installation of the facili-
ties listed above, including sections for bidding
requirements , contract forms, conditions of the
contract, general requirements, site work, concrete,
metals, equipment, special construction, mechanical,
and electrical.
3 . Preliminary Document Printing, Construction Cost
Opinion, and Miscellaneous Tasks
a. The ENGINEER will provide two sets of pre-
liminary Contract Documents at the 80-percent
design completion stage to the OWNER.
b. Upon receipt of the OWNER and ENGINEER review
comments , the ENGINEER will modify the Con-
tract Documents as required and submit five
sets of Contract Documents to the OWNER for
distribution to governmental agencies having
jurisdiction for their review.
c. The ENGINEER will prepare an opinion of the
construction cost of the Project. The ENGI-
NEER' s opinion of cost will be prepared after
completion of the final plans and specifica-
tions and prior to the Project' s advertisement
for bids . Should the results of the ENGINEER' s
cost opinion affect the OWNER' s apparent ability
to finance the project, the ENGINEER will
modify the Contract Documents which were the
basis of the construction cost opinion if
specifically asked to do so, but only under
the provisions of an increased scope amendment
to this Task Order Amendment.
d. Upon receipt of approval of OWNER and appro-
priate reviewing agencies of the draft plans

and specifications (within 60 days from date
such draft plans and specifications were sub-
mitted) , the ENGINEER will provide 5 copies
of the Contract Documents to the OWNER. In

struction. These documents will consist of
bound reproductions of computer-printed spec-

B. NEW PLANT, PRELIMINARY ENGINEERING DESIGN SERVICES
1 . Selection of Basic Treatment Processes
Using the ultimate influent wastewater flows and
loads developed in the Preliminary Engineering
Study, the ENGINEER will develop a proposed plan
for the basic wastewater treatment processes listed
below for use in the new wastewater treatment plant
• located at the landfill site.

Feasible alternatives for the processes listed
above will be screened through a consideration of
relative advantages and disadvantages in terms of
process reliability, ease of operation, and energy
and resource requirements. Where necessary to
decide between alternatives , cost curve level capital
and annual operation and maintenance costs will be
compared.
On the basis of this process evaluation, a summary
of the size requirements for the selected ultimate
plant unit processes will be developed. A draft
technical memorandum containing the results of the
treatment process selection and sizing evaluation
will be prepared and five copies submitted to the
OWNER for review.
2 . Staging Analysis
a. A staging analysis will be performed to deter-
mine the design capacity of the first stage
of the treatment plant. The stagirrg analysis
will be based on low and high population esti-
mates summarized in the Preliminary Engineering
Study and input from the OWNER' s staff.
b. Influent wastewater design criteria for the
first stage plant will be summarized.
c . A draft technical memorandum containing the
results of the staging analysis will be pre-
pared and five copies submitted to the OWNER
for review.
3 . Preliminary Design of First Stage Plant
A preliminary design of the first stage plant will
be developed. The preliminary design will consist
of the following components :
a. An analysis will be performed to investigate
methods to delay construction of specific
unit processes or structures until subsequent
stages of the plant are necessary. Sand drying
beds will be included in the evaluation as an
initial dewatering method as a means to delay
construction of the dewatering system (s)
selected for the ultimate plant.

b. Process sizing and design criteria for the
selected first stage processes will be final-
ized and summarized. A more complete des-
cription of the first stage plant will be
made.
c. A preliminary site plan showing the general
location and arrangement of the first stage
and ultimate facilities will be prepared.
Space will be provided for the following future
advanced treatment processes that might be
required: denitrification for nitrogen removal,
phosphorus removal, and dechlorination.
d. A preliminary hydraulic profile of the plant
will be established to set tentative structure
elevations.
e. General materials of construction will be
defined in consideration of corrosion poten-
tial, ease and time of construction, archi-
tectural style, length of useful service, and
costs. An evaluation will be made comparing
• the use of glass fused steel tanks with con-
crete tanks and metal buildings with concrete
block buildings .
f. An estimate of the capital cost of the first
stage facilities will be prepared. The opinion
of cost will be of budget level accuracy devel-
oped with the use of cost curves, manufacturer' s
estimates, and similar construction of other
wastewater facilities.
g. The results of the first stage facilities
preliminary design will be summarized in a
draft technical memorandum and five copies
will be submitted to the OWNER for review.
4 . Preparation of Preliminary Design Report
a. A preliminary design report summarizing the
results of the investigation itemized in
Sections B-1 , B-2, and B-3 of this Task Order
Amendment will be prepared and submitted to
the OWNER. Thirty (30) copies of the report
will be provided.
C. SERVICES SPECIFICALLY NOT INCLUDED
This item and Task Order Amendment specifically excludes
the following from this Scope of Services:

1 . Engineering services during construction of the
short-term improvements to the existing wastewater
treatment plant listed under Section A of this
Task Order Amendment.
2 . Engineering services related to the final detailed
design and geotechnical investigation for the
first stage facilities of the new plant.
3 . Engineering services related to the method of
financing and the work required to secure finances
for the existing plant and new plant construction.
4 . Engineering services related to the boundary survey
and topographic elevation survey of the existing
wastewater treatment plant site and the 40-acre
landfill site identified as the new wastewater
treatment plant site in the Preliminary Engineering
Study. Base maps necessary to prepare satisfactory
plans and specifications will be provided' by others
for these sites.
5 . Surveying services necessary to locate geotechnical
investigation borings at the 40-acre landfill site.
