Squires be, and he is hereby authorized to submit a legal petition opposing the issuance of a permit to operate a private club on the premises of Outer Limits located on East Highway 78, 1 (one) mile Northeast of FM 544 and Highway 78, in Wylie, Collin County Texas. Section 2: The locatiofi of the establishment itself is not within our corporate city limits, the roadway--State Highway 78--is within our patrol area. As SH 78 is a relatively high traffic area already, issuance of a private club permit would add to the problem. And, as there is no other access to the location other than SH 78, all vehicles must enter into SH 78 to leave the location. Section 3: The business currently attracts younger clientele as it is a "gameroom", and most of the patrons are 18 years of age and younger. Should they continue to feature such forms of entertainment as they do at this time, it could very well create a problem with underage patronage. Duly adopted on this the 25th day of July, A.D. 1983. Squires be, and he is hereby authorized to submit a legal petition opposing the issuance of a permit to operate a private club on the premises of Casa Rosita (Canita Rosita) located at N. Ballard, in Wylie, Collin County Texas. Section 2: The location of the establishment is in the middle of the down- town area and next door to the Funeral Home. The issuance of a private club permit would be immorale. Section 3: The Zoning Ordinance requires one (1) parking space for every three (3) seats under maximum seating arrangement, this establishment does not meet these requirements. AN ORDINANCE REGULATING MOBILE HOME PARKS; REQUIRING A LICENSE AND ESTABLISHING LICENSE FEES; ESTABLISHING PHYSICAL REQUIREMENTS; REGULATING THE LOCATION OF SAID PARKS; ESTABLISHING RULES AND REGULATIONS FOR THE OPERATION OF SAID PARKS; ESTABLISHING REQUIREMENTS FOR WATER, SEWER, AND ELECTRICAL FACILITIES; PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF; PROVIDING FOR THE PUBLICATION OF THE CAPTION OF THIS ORDINANCE AND THE EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS; SECTION 1. DEFINITIONS For the purpose of this ordinance, certain terms, words and phrases shall have the meanings hereinafter described thereto. 1.01 Agent: Any person authorized by the licensee of a mobile home of trailer park to operate or maintain such park under the provisions of this ordinance. The licensee or his designated agent must live on the premises. 1.02 Public Works Director: The legally designated authority of the Public Works Department of the City or his authorized representative. 1.03 Drive-Way: A minor private way used by vehicles and pedestrians or�a mobile home stand or used for common access to a small group of stands or facilities. 1.04 License: A written license issued by the Public Works Director allowing a person to operate and maintain a mobile home park under the provisions of this Ordinance and regulations issued hereunder. 1.05 Licensee: Any person licensed to operate and maintain a mobile home park under the provisions of this Ordinance. 1.06 Mobile Home: A movable or portable dwelling built on a vehicular chassis, connected to utilities and designed for year round living on rigid supports. 1.07 Mobile Homes Park: A unified development of mobile home spaces arranged on 4111 a large tract or sure under single ownership, meeting all requirements of this Ordinance, and designed to accommodate mobile homes on a permanent basis. 1.08 Mobile Home Subdivision: A unified development of mobile homes sited on lots platted for such purpose, which lots may be sold to the owners of mobile homes situated thereon, meeting the area and yard requirements of the Zoning Ordinance, and designed to accommodate mobile homes on a permanent basis. 1.09 Permit: A written permit of certification issued by the Public Works Director permitting the construction, alteration or extension of a mobile home park under the provisions of this Ordinance and regulation issued hereunder. 1. 10 Person: Any natural individual , firm, trust, partnership, association, or corporation. 1. 11 Service Building: A structure housing toilet, lavatory and such other facilities as may be required by this Ordinance. 1. V 1.12 Sewer Connection: The connection consisting of all pipes, fittings and appurtenances from the drain outlet of a mobile home or travel trailer to the inlet of the corresponding sewer riser pipe of the sewage system serving the mobile home park. 1.13 Sewer Riser Pipe: That portion of a sewer lateral which extends vertically to the ground elevation and terminates at a mobile home space. 1. 14 Space: A plot of ground within a mobile home park designed for the accom- modation of one mobile home unit. This term shall also include the terms "lot" , "stand" , and "stall " . 1.15 Water Connections: The connection consisting of all pipes, fittings, and appurtanances from the water riser pipe to the water inlet pipe of the distribution system within a mobile home or travel trailer. 1. 16 Water Riser Pipe: That portion of the water supply system serving a mobile home park which extends vertically to the ground elevation and terminates at a designated point at a mobile home space. 1. 17 Zoning Ordinance: The Comprehensive Zoning Ordinance or the City of Wylie, Texas. SECTION 2. PERMITS 2.01 Permit Required: It shall be unlawful for any person to construct, alter or extend any mobile home park withing the limits of the City of Wylie un- less he holds a valid permit issued by the Public Works Director in the name of such person for the specific construction, alteration, or extension proposed. All permits require the final approval of the City Council . 2.02 Application Requirements: All applications for permits shall contain the following: a. Name and address of applicant. b. Location and legal description of the mobile home park. c. A site plan, as hereafter described. - 2.03 Permit Fee: All applications shall be accompanied by the deposit of a fee of Three hundred ($300.00) Dollars plus Fifty Dollars ($50.00) for each mobile home space. 2.04 Issuance of Permit: When, upon review of the application, the Public Works Director is satisfied that the proposed plan meets the requirements of this and other applicable ordinances, a permit shall be issued. 2.05 Annual Permit Fee: ($150.00) One Hundred Fifty Dollars per space is payable by the licensee or his agent due the 1st of January each year. SECTION 3. ' LICENSES 3.01 Licenses Required: It shall be unlawful for any person to operate any mobile home park within the limits of the City of Wylie unless he holds a valid license issued annually by the Public Works Director in the name of such person for the specific park. All applications for license shall be made to the Public Works Director who shall issue a license upon compliance by the applicant with provisions of this Ordinance. 2. 3.02 Application for License; Renewal : a. Application for original license shall be in writing, signed by the applicant, accompanied by the affidavit of the applicant as to the truth of the application and by the deposit of the license fee hereinafter provided, and shall contain: the name and address of the applicant; the location and legal description of the park; and a site plan of the park showing all mobile home spaces, structures, roads, walkways, and other service facilities. b. Application for renewal of license shall be made in writing by the licensee and shall contain nay change in the information submitted since the original license was issued or the latest renewal granted. 3.03 Transfer of License: Every person holding a license shall give notice in writing to the Public Works Director within thirty (30) days after having sold, transferred, given away, or otherwise disposed of interest in or control of any park. Such notice shall include the name and address of the person succeeding to the ownership or control of such park. Upon application in writing for transfer of the license, the license shall be transferred if the park is in compliance with all applicable provisions of this Ordinance. 3.04 License Fee: All original license applications and license transfers shall be accompanied by the deposit of a fee of Five hundred ($500.00) Dollars. 3.05 Violations; Notice; Suspension of License: Whenever, upon inspection of any mobile home or travel trailer park, the Public Works Director finds that conditions or practices exist which are in violation of any provision of this Ordinance, he shall give notice in writing in accordance with Section 5.01 to the licensee that unless such conditions or practices are corrected withing a 10 day period of time specified in said notice, the license shall be suspended. At the end of 10 days, the Public Works Director shall reinspect such park and, if such conditions or practices have not been corrected, he shall suspend the license and give notice in writing of such suspension to the licensee. Upon receipt of notice such suspension, licensee shall cease operation of such park, except as provided in Section 5.02 hereof. SECTION 4. INSPECTION 4.01 Inspections Required: The Public Works Director is hereby authorized and directed to make such inspections as are necessary to determine satisfactory compliance with this Ordinance. 4.02 Entry on Premises: The Public Works Diector shall have the power to enter at reasonable times upon any private or public property for the purpose of inspecting and investigating conditions relating to the enforcement of this Ordinance. It shall be the duty of the licensee or his agent to give the Public Works Director free access to all lots at reasonable times for the purpose of inspection. The Public Works Director shall enter and inspect each 6 months and report to the City Council his findings. 4.03 Inspection of Register: The Public Works Director shall have the power to inspect the register containing a record of all residents of the mobile home park. The Public Works Director shall make a quarterly inspection of the register for tax reporting purposes. 4.04 Duty of Occupants: It shall be the duty of every occupant of a mobile home park to give the licensee, his agent or authorized employee, access to any part of such park at reasonable times for the purpose of making such repairs or alterations as are necessary to effect compliance with this Ordinance. 3. SECTION 5. NOTICES, HEARINGS, AND ORDERS 5.01 Notice of Violation; Requirements of Notice: Whenever the Public Works Director determines that there are grounds to believe that there has been a violation of any provision of this Ordinance, the Public Works Director shall give notice of such alleged violation to the licensee or agent, as hereinafter provided. Such notice shall (a) be in writing; (b) include a statement of the reasons for its issuance; (c) allow a reasonable time for the performance of any act it requires; (d) be served upon the owner or his agent as the case may require; provided, that such notice or order shall be deemed to have been properly served upon such licensee or agent when a copy hereof has been sent by registered mail to his last known address, or when he has been served with such notice by any method authorized or required by the laws of this State; (e) contain an outline of remedial action which, if taken, will effect compliance with the provisions of this Ordinance. 5.02 Appeal from Notice: Any person affected by any notice which has been issued in connection with the enforcement of any provision of this Ordinance, may request and shall be granted a hearing on the matter before the Public Works Director; provided that such person shall file in the office of the Public Works Director, a written petition requesting such hearing and setting forth a brief statement of the grounds therefor within ten (10) days after the day the notice was served. The filing of the request for a hearing shall operate as a stay of the notice and of the suspension, except in the case of an order issued under Section 5.05. Upon receipt of such petition, the Public Works Director shall set a time and place for such hearing the petitioner shall be given an opportunity to be heard and show why such notice should be modified or withdrawn. The hearing shall be commenced not later than ten (10) days after the day on which the petition was filed; provided, that upon application of the petitioner the Public Works Director may postpone the date of the hearing for a reasonable time beyond such ten-day period when in his judgement the petitioner has submitted good and sufficient reasons for such postponement. 5.03 Hearing; Order: After such hearing the Public Works Director shall make • findings as to compliance with the provisions of this Ordinance and shall issue an order in writing sustaining, modifying or withdrawing the notice, which order shall be served as provided in Section 5.01 (d) . Upon failure to comply with any order sustaining or modifying the notice, the license of the park affected by the order shall be revoked. 5.04 Hearing Records; Judicial Review: The proceedings at such a hearing including the findings and decision of the Public Works Director, and together with a copy of every notice and order related thereto shall be entered as a matter of public record in the office or the Public Works Director but the transcript of the proceedings need not be transcribed unless judicial review of the decision is sought as provided by this Section. Any person aggrieved by the decision of the Public Works Director may seek relief therefrom in any court of competent jurisdiction, as provided by the laws of this State. 5.05 Order Without Notice: Whenever the Public Works Director finds that an emergency exists which requires immediate action to protect the public health, he may without notice or hearing issue an order reciting the existance of such an emergency and requiring that such action be taken as he may deem necessary to meet the emergency, including the suspension of the permit or license. Not withstanding any other provisions of this Ordinance, such order shall be effective immediately. Any person to whom such an order is directed shall comply therewith immediately, buy upon petition to the Public Works Director shall be afforded a hearing as soon as possible. The provisions of Section 5.03 and 5.04 shall be applicable to such hearing and the order issued thereafter. 5.06 Further Appeal : Items 5.01 through 5.05 are intended to handle what is judged by City Administration as minor infractions. Should these infractions then continue or go unresolved, then the fine and normal various proceedings (Planning and Zoning, Board of Adjustments, City Council ) will be in affect. 4. SECTION 6. MOBILE HOME SUBDIVISIONS 6.01 Any development of mobile homes as a mobile home subdivision shall be governed by the provisions of the Zoning and Subdivision Ordinance of the City pertinent thereto. SECTION 7. MOBILE HOME PARKS 7.01 Site Requirements: Any development, redevelopment, alteration, or expansion of a mobile home park in the City shall be done in compliance with the fol- lowing site requirements: a. Location - A mobile home park shall be located only where such use is permissible under the terms and provisions of the Zoning Ordinance. b. Site Plan - A site plan, as required by the Zoning Ordinance, shall be filed with the Public Works Director of the City, showing the following: 1. The area and dimensions of the tract of land; 2. The number, location and size of all mobile home spaces; 3. The location, width, and specifications of roadways and walkways; 4. The location and specification of water and sewer lines and riser pipes; 5. The location and details of lighting and electrical systems; 6. The location and specifications of all buildings constructed or to be constructed withing the park; 7. Such other information as municipal reviewing officials may reason- ably require; 8. Site plan and normal Planning and Zoning proceedings must be adhered to- in advance of any construction. c. Soil and Ground Cover - Exposed ground surface in all parts of every mobile home park shall be paved, or protected with a vegetative growth that is capable of, within 3 months, preventing soil erosion and of eliminating dust. - - d. Drainage - The ground surface in all parts of a park shall be graded and equipped to drain all surface water in a safe, efficient manner. The adequacy of drainage facilities shall be verified by a competent professional engineer. e. Area, Setbacks and Screening Requirements - The minimum areas, setbacks, spacing and screening shall be as prescribed in the Zoning Ordinance and/or by the Planning and Zoning Commission. As required by normal Subdivision Ordinances. Setbacks and Screening etc. will require normal subdivision standards as a minimum. f. Open Space - Open space recreation areas shall be provided in all parks accommodating or designed to accommodate twenty (20) or more mobile homes. The size of such recreation areas shall be based upon a minimum of 200 square feet for each lot. No outdoor recreation area shall contain less than 3,500 square feet. Such areas shall be free from traffic hazards, easily acces- sible to all park residents, and centrally located where topography permits. g. Density Requirements - All mobile homes shall have a maximum density of four (4) mobile home spaces per gross acre. h. Community Television Antenna - All mobile homes shall have buried tele- vision antenna service from one central television antenna, and no individual outside television antennas will be allowed. 5. i . Fencing Requirements - The entire mobile home park site shall be enclosed with a fence as follows: 1. Any area that abutts an external street or highway shall be fenced with brick to a height of eight (8) feet; 2. Any site side line that joins the brick fence shall be fenced for a distance of two-hundred (200) feet with wood fencing to a height of eight (8) feet; - A. j. Minimum Size - Is designated as MH 1200 inside diameter square feet. h. Age - No mobile home may be placed in the park if is is over 2 model years old. 7.02 Access and Traffic Circulation: All mobile home parks shall provide access and means of motor vehicle and pedestrian traffic circulation as follows: a. Access - Motor vehicle entrances and exits shall be designed for safe and convenient traffic movement from adjacent public streets and onto internal streets and shall be limited to one entrance. b. Internal Streets - Internal streets shall be privately owned built and maintained, and shall be designed for safe and convenient access to all spaces and to facilities for common use of park residence. All streets are to be of concrete curb and guttering set to City specifications. 1. On all internal streets, roads or driveways designed or intended to provide access to two or more spaces, there shall be thirty-seven (37) feet of pavement width unobstructed for vehicular access at all times. 2. In the event such streets, roads, or driveways designed are extended to be used also for vehicular parking, a parallel parking space shall be deemed to have a minimum width of 16 feet by 10 feet of street specification concrete, and no such parking space shall occupy or encroach upon the minimum unobstructed access herinabove prescribed. 3. Dead-end streets shall be limited in length to 1,000 feet, and shall be provided at the closed end with a turn-round having a radius of not less than thirty-eight (38) feet. c. Street Specifications Shall comply with subdivision specification in effect. d. Parking Vehicular parking shall be provided in compliance with the Zoning Ordinance of a subdivision. e. Alleys - will be provided according to subdivision specification. f. Outside Entry Roads - Outside roads to the development shall be assessed on a pro-rate basis using spaces as a criteria as dictated by the City Council pertaining to development expense, if there is a usable road that compleys with City specifications. If no road exists it becomes the sole expense of the developer to provide one. 7.03 Mobile Home Spaces: The area of the mobile home space shall be improved to provide adequate support for the placement of the mobile home, thereby securing the superstructure against uplift, sliding, rotation and overturning due to frost action, inadequate drainage, vibration or other forces acting on the structure. Concrete Slab with permanent tie down embedded in the slab for securing. Slab shall conforms to street specification regarding density and structure. 7.04 Water Supply: a. General Requirements: An accessible, adequate, sage and potable supply of water shall be provided in each mobile home park. A public supply of water of satisfactory quantity, quality, and pressure is available from the City of Wylie and a connection shall be made thereto and its supply used exclusively. b. Source of Supply: 1. The water source shall be capable of supplying a minimum of 150 gallons per day per mobile home. 6. 2. Every line of the water supply system shall be located and constr- ucted in such a manner that neither under ground nor surface . contamination will reach the water supply from any source. c. Water Storage Facilities: All water storage reservoirs shall be covered, watertight and constructed of impervious material . Overflows and vents of such reservoirs shall be effectively screened; manholes shall be constructed with overlapping covers, to prevent the entrance of contam- inating material . Reservoir intake pipes shall discharge through an acceptable air gap. d. Water Distribution System: 1. The water supply system of the mobile home park shall be connected by pipes to all mobile homes, buildings, and other facilities requiring water. All mobile home parks shall have water lines of adequate size to supply sufficient water to approve fire sydrants so that no mobile home shall be located more thaan 500 feet from a fire hydrant. 2. All water piping, fixtures and other equipment shall be constructed and maintained in accordance with state and local regulations and requirements and shall be of a type and in locations approved by the Public Works Director. 3. The water piping system shall not be connected with nonpotable or questionable water supplies and shall be protected against the hazards of backfTow of back siphonage. 4. The system shall be so designed and maintained as to provide a pressure of not less than 20 pounds per square inch, under normal operating conditions, at service buildings and other locations requiring potable water supply. e. Individual Water Riser Pipes and Connections: 1. Individual water riser pipes shall be located within the confined area of the mobile home space at a point where the water connection will approximate a vertical position. 2. Water riser pipes shall extend at least four (4) inches above ground elevation. The pipe shall be at least three quarter inch. The water outlet shall be capped when a mobile home does not occupy the space. 3. Adequate provisions shall be made to prevent freezing of service lines, valves and riser pipes and tp protect risers from having and thawing actions of ground during freezing weather. Surface drainage shall be diverted from the location of the riser pipe. 7.05 Sewage Disposal : a. General Requirements - An adequate and safe system shall be provided in all mobile home parks for conveying and disposing of all sewage. Such systems shall be designed, constructed and maintained in accordance with state and local laws. The sewer system shall be connected to the existing public sewer system of the City of Wylie. b. Sewer Lines - All sewer lines shall be located in trenches of sufficient depth to be free from breakage from traffic or other movements and shall be separated from the park water supply systems at a safe distance. Sewers shall be at a grade which will insure a velocity of two feet per second when flowing full . All sewer lines shall be constructed of mat- erials approved by the Public Works Director, shall be adequately vented, and shall have watertight joints, shall adhere to subdivision standards. Expense of new sewer lines and their connection will be borne 100% by the developers. 7. c. Individual Sewer Connections: 1. Each mobile home stand shall be provided with at least a four inch diameter sewer riser pipe. The sewer riser pipe shall be so located on each stand that the sewer connection to the mobile home drain outlet will approximate a vertical position. 2. The sewer connection shall have a nominal inside diameter of at least three inches, and the slope of any portion thereof shall be at least one-fourth inch per foot. The sewer connection shall consist of one pipe line only without any branch fittings. All joints shall be watertight. 3. All materials used for sewer connections shall be semirigid, corrosion resistant, nonabsorbant and durable. The inner surface shall be smooth. 4. The sewer riser pipe shall be plugged when a mobile home does not occupy the lot. Surface drainage shall be diverted away from the riser. The rim of the riser pipe shall extend at least four inches above ground elevation. d. Sewage Treatment and/or Discharge: The Sewer lines of the mobile home park connected to the public sewer of Wylie. 7.06 Electrical Distribution System: a. General Requirements Every park shall contain an electrical wiring system consisting of wiring, fixtures, equipment and appurtenances which shall be installed and maintained in accordance with applicable codes and regulations governing such system. b. Power Distribution Lines: 1. All electric power lines located in the mobile home park shall be buried below ground. 2. All direct burial conductors of cable shall be buried at least eighteen (18) inches below the ground surface and shall be located not less than one (1) foot radial distance from water, sewer, gas or communication lines. c. Individual Electrical Connections: 1. Each mobile home lot shall be provided with an approved dis- connecting device and over-current protective equipment. The minimum service per outlet shall be 120/240 volts AC, 60 amperes. 2. Outlets (Recepticles or pressure connectors) shall be housed in a weatherproof outlet box, and shall be located not more than 25 feet from the overcurrent protective device in the mobile home. A three-pole, four-wire grounding type shall be used. 3. Receptacles, if provided, shall be in accordance with American Standard Outlet Receptacle C-73. 1. 4. Connectors, if not substituted by more than one receptacle, shall be provided where the calculated load of the mobile home is more than 50 ampheres. 5. The mobile home shall be connected to the outlet box by an approved type of flexivle supply cord with a male attachment plug or with pressure connectors. 8. d. Required Gounding - All exposed non-current carrying metal parts of mobile homes and all other equipment shall be gounded by means of an approved grounding conductor with branch circuit conductors or other approved method of grounded metallic wiring. The neutral conductor shall not be used as an equipment ground for mobile homes or other equipment. 7.07 Service Building and Other Community Service Facilities: a. General - The requirements of this Section shall apply to service buildings, recreation buildings and other community service facilities, such as management offices, maintenance and storage areas, and san- itary or laundry facilities. b. Required Community Sanitary Facilities - Every park shall be provided with emergency sanitary facilities consisting of not less than one (1) flush toilet and one (1) lavatory per sex for each 50 mobile home lots, or fractional part therof, which shall be accessible to all mobile homes. c. Structural Requirements for Buildings: 1. Service building shall be protected from damage by ordinary uses and by decay, corrosion, termites and other destructive elements. Exterior portions shall be of moisture and weather-proof materials and construction. Construction must comply with existing of 75% brick masonary etc. 2. All rooms containing sanitary or laundry facilities shall : (a) Have sound resistant walls extending to the ceiling between male and female sanitary facilities. Walls and partitions around showers, bathtubs, lavatories and other plumbing fixtures shall be constructed of dense, nonabsorbant water-proof material or covered with moisture-resistant material . (b) Have at least one window or skylight facing directly to the outdoors. The minimum aggregate gross area of windows for each required room shall be not less than 10 per cent of the floor area served by them. (c) Have at least one window which can be easily opened or an adequate mechanical ventilation device. 3. Toilets shall be located in separate compartments equipped with self-closing doors. Shower stalls shall be of the individual type. The rooms shall be screened to prevent direct view of the interior when the exterior doors are open. 4. Illumination levels shall be maintained as follows: (a) General seeing tasks - Five (5) foot-candles; (b) Laundry room work area - Forty (40) Foot-candles; (c) Toilet room, in front of mirrors - Forty (40) foot-candles. 5. Hot and cold water shall be furnished to every lavatory, sink, and bathtub, shower and laundry fixture, and cold water shall be furnished to every toilet and urinal . d. Barbecue Pits, Fireplaces, Stoves - Cooking Shelters, barbecue pits and fireplaces shall be so located, constructed maintained and used so as to minimize fire hazards and smoke nuisance. No open fire shall be left unattended. No fuel shall be used and no material burned which emits dense smoke or objectionable odors. No open fire shall be permitted except in approved facilities. 7.08 Refuse Handling: a. The storage, collectioj and disposal of refuse in the mobile home park 9. shall be so conducted to create health hazards, rodent harborage, insect breeding areas, accident or fire hazards or air pollution. b. All refuse shall be stored in flytight, watertight, rodent proof containers, which shall be located at each mobile home space. Con- tainers shall be provided in sufficient number and capacity to properly store all •refuse and shall not exceed thirty (30) gallons capacity or be excessive in weight. c. Refuse collection stands shall be provided for all refuse containers. Such container stands shall be so designed as to prevent containers from being tipped, to minimize spillings and container deterioration and to facilitate cleaning around them. d. All refuse containing garbage shall be collected at least once weekly. All refuse shall be collected and transported by the City of Wylie Sanitation Dept. or their contractor. 7.09 Insect and Rodent Control : a. Grounds, building and structures shall be maintained free of insect and rodent harborage and infestation. Extermination methods and other measures to control insects and rodents shall conform with the require- ments of the City Health Department. b. Parks shall be maintained free of accumulations of debris which may provide rodent harborage or breeding places for flies, mesquitoes and other pests. c. The growth of brush, weeds and grass shall be controlled to prevent the harborage of noxious insects or other pests. Parks shall be so maintained as to prevent the growth of noxious weeds considered detri- mental to health. Open areas shall be maintained free of heavy under- growth of any description. 7. 10 Fuel Supply and Storage: a. Natural Gas System 1. Each space provided with piped gas will have an approved manual shutoff valve _installed ups.tream,:of the gas'.eutlet: Tb@..eutiet. -. shall be equipped with an approved cap to prevent accidental dis- charge of gas when the outlet is not in use. 2. Natural gas piping systems shall be installed and maintained in accordance with applicable codes and regulations governing such systems. b. Liquified Petroleum Gas Systems 1. Liquified petroleum gas systems shall be installed and maintained in accordance with applicable codes of the City governing such systems and regulations of the Texas Railroad Commission pertaining thereto. 2. Systems shall be provided with safety devices to relieve excessive pressures and shall be arranged so that the dischard terminates at a safe location. 3. Systems shall have at least one accessible means for shutting off gas. Such means shall be located outside the mobile home and shall be maintained in effective operating condition. 10. 4. All LPG piping outside the mobile homes shall be well supported and protected against mechanical injury. Undiluted liquified petroleum gas in liquid form shall not be conveyed through piping equipment and systems in mobile homes, and placed in a concrete slab with a minimum of 3 feet of concrete surrounding on all sides. 5. Liquified petroleum gas containers installed on a space shall be securely but not permanently fastened to prevent accidental over- turning. Such containers shall not be less than 12 not more than 60 U. S. gallons gross capacity. 6. No liquified petroleum gas vessel shall be stored or located inside or beneath any storage cabinet, carport, mobile home, or in any other structure, unless such installations are approved by the Public Works Director. 7. 11 Fire Protection: a. Mobile home parks shall be kept free of litter, rubbish and other flam- mable materials. b. Portable fire extinguishers rated for classes B and C fires shall be kept in service buildings and shall not be less than 5 pounds. c. Fire hydrants shall be installed in accordance with the following requirements: 1. The water supply system shall permit the operation of a minimum of twp one and one-half inch hose streams and shall be at least 6 inches in diameter. 2. Each of two nozzles, held four feet above the ground, shall deliver at least 75 gallons of water per minute at a flowing pressure of at least 30 pounds per square inch at the highest elevation point of the park. d. Fire hydrants shall be located within 500 feet of nay mobile home, service building or other structure in the park, such distance to be measured along the street. 7. 12 Non-Conforming Mobile Home Parks a. Any mobile home park in existance at the time of passage of this Ordinance which does not meet the regulations as set forth herein, shall not enlarge, extend or improve this non-conforming mobile home park unless the enlargement, extention or improvement meets with the terms of this Ordinance. In the event of a change of ownership, the new owner developer must comply to the Ordinance. 7. 13 Miscellaneous Requirements: a. Responsibilities of the Park Management 1. The licensee or his agent shall operate the park in compliance with this and other applicable ordinances and shall provide adequate supervision to maintain the park, its facilities and equipment in good repair and in clean and sanitary condition. 2. The licensee or agent shall notify park occupants of all applicable provisions of this Ordinance and inform then of their duties and responsibilities under this Ordinance. 3. The licensee or agent shall supervise the placement of each mobile home on its mobile home stand and the installing of all utility connections. 4. The licensee or agent shall maintain a register of park occupancy which shall contain the following information. (a) Name and address of park residents 11. (b) Mobile home registration date, including make, length, width, year of manufacture and indentification number (c) Location of each mobile home within the park by space or lot number (d) Dates of arrival and departure (e) A new register shall be initiated on January 1st of each year, and the old register may thereafter be retired buy shall be retained on the premises for at least three (3) years following its retirement. Registers shall be available for inspection at all reasonable times by any official of the City of Wylie whose duties may necessitate access to the information contained therein. 5. The licensee or agent shall furnish to the Accessor and Collector of taxes for the City of Wylie within ten (10) days after the first day of January of each year, and update quarterly, a list of all mobile home residents in the park on the first day of January, showing the owner's name and address, the make, length, width, year of manufacture and identification number of the mobile home, and the address of location description of said mobile home within the park. Said lists shall be prepared using forms provided by the Assessor and Collector of Taxes of the City, the licensee is responsible for returning to the Tax Assessor of the City of Wylie by April 15, July 15, and October 15 as well as January. b. Responsibilities of Park Occupants 1. The park occupant shall comply with all requirements of this Ordinance and shall maintain his mobile home space, its facilities and equipment in good repair and in a clean and sanitary condition. 2. The park occupant shall be responsible for proper placement of his mobile home on its mobile home stand and proper installation of all utilities connections in accordance with the instructions of the park management. All mobile homes shall be underpinned or skirted with a solid sheet material . All four sides of the trailer shall be enclosed from the bottom of the mobile home to the ground. 3. Skirting, porches, awnings and other additions, when installed, shall be maintained in good repair. Skirting material will be consistant with the home and provided by the mobile home manufacturer or it's equilevent and be judged aesthetically pleasing. (a) The storage area shall have a base of impervious material . (b) Stored items shall not interfere with the underneath inspection of the mobile home. (c) The storage area shall be enclosed by skirting. (d) Hitch and towing apparatus cover shall be of similar material as skirting and is required. (e) The running gear must be removed completely (axle and wheels) the mobile home should be affixed to a -permanent foundatiotl laid according to street specifications. 7.14 Cost of Securing Water or Sewer Service - The expense of securing water and sewer service to the site on any mobile home park shall be the sole expense of the mobile home park developer. . . tr is 12. SECTION 8. If any section, subsection, paragraph, sentence, phrase, or clause of this Ordinance shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this Ordinance which shall remain in full force and effect; and to this end the provisions of this Ordinance are hereby declared to be severable. Section 9. All provisions of any Ordinance in conflict herewith are hereby repealed so far only as it affects only that portion described herein. Section 10. Any person who violates any provision of this Ordinance shall be deemed guilty of a misdeameanor, and upon conviction therefor shall be fined any sum not ex- ceeding Four-Hundred ($400.00) Dollars. Each day the violation continues shall be considered a separate offense. Section 11. The caption of this ordinance shall be published one (1) time in a newspaper having general circulation in the City of Wylie and shall be effective immedi- ately upon its passage and publication. Section 12. In the case of construction standards when any doubt exists as to specifications the current subdivision standards and Ordinances will apply or the City Council or Planning and Zoning can make the final determination as to the intent of the Ordinances.
