In attendance were: Chairman Larson, Commissioner Ames, Commissioner Finnell, Commissioner Onufreiczuk, and Commissioner Goss. Commissioner Bennett was absent Staff members present were Renae 011ie, Charles Lee, and Mary Bradley. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner Onufreiczuk gave the invocation and Commissioner Ames led the pledge of allegiance. CITIZENS COMMENTS No one approached the Commissioners. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the February 20, 2007 Regular Meeting. A motion was made by Commissioner Onufreiczuk, and seconded by Commissioner Finnell, to approve the minutes from February 20, 2007, regular meeting as submitted with no changes or corrections noted. Motion carried 5 — 0. Minutes April 3, 2007 Wylie Planning and Zoning Board Page 1 of 2 ACTION AGENDA ITEMS 1. Consider a recommendation to the City Council regarding a Final Plat for Kirby-Stone Addition, Lots 1-5. The plat dedicates rights-of- way for Kirby-Stone Connector and five (5) out-parcel lots on 3.09 acres, generally located east of Birmingham Street extending west to Ballard Street. Mr. Lee stated that the Plat is a final step associated with an item on the City of Wylie's 1999 Bond Program. The Plat dedicates 1.65 acres for right-of-way, approximately 820 linear feet of roadway, with widths ranging from forty (40') to one-hundred (100') feet. Mr. Chris Hoisted, City Engineer, stated that in acquiring property for this project several out parcels were created. None of these parcels are singularly available to develop; however, several of the adjacent property owners have expressed interest in purchasing them. A motion was made by Commissioner Ames, and seconded by Commissioner Goss, to recommend approval to the City Council for a Final Plat for Kirby-Stone Addition, Lots 1-5, located between Birmingham Street and South Ballard Avenue. Motion carried 5 — 0. 2. Consider a recommendation to the City Council regarding a Final Plat for BVSDB Addition. The plat creates one (1) commercial lot located within the City's ETJ, generally located north of SH 78 and approximately 1,150 feet east of Skyview Court. Mr. Lee stated that the property totals 4.863 acres and will create one commercial lot. The property is located within the city's extraterritorial jurisdiction, therefore, a site plan and building permits are not required for the development. Mr. Bill Watson, 12854 CR 483, Lavon, Texas, 75166, represented property owner of the subject property, and stated that the property is located across the street from Leroy's Bait and Tackle Shop off State Highway 78. The property will be used for RV Storage. A motion was made by Commissioner Finnell, and seconded by Commissioner Goss, to recommend approval to City Council for a Final Plat for BVSDB Addition, located north on SH 78 and approximately 1,150 feet east of Skyview Court. He stated that several residents raised the question to him with the recent tornado hitting a portion of Riverchase and Country Ridge Subdivisions. Ms. 011ie stated that no layout or site plan is reviewed by the Planning and Zoning Commission, but is processed through Public Safety, fire and police department. Discussion The applicant is proposing to develop a medical office facility on one lot. The lot is 1.647 acres in size. The property is zoned Community Retail district (CR). The site will consist of a 16,980 square foot single-story building to be used for medical and professional office purposes. Medical and professional office uses are allowed by right in CR zoning districts. The property is located to the rear (northeast) of an existing shopping center & office complex (Brookshire's, Wylie Shopping Village & Bariatric Care Center). A 120-bed assisted living facility is currently under construction adjacent to the south of subject property. Single family residential zoned property is to the east and has been developed for single family residential uses. A 10-foot section of unpaved alleyway separates the subject property from the single family uses to the east. This property does not have frontage along a public street. As reflected on the site plan, two points of access is being provided, one is an existing 36-foot access easement from SH 78 serving both the shopping center and office development. The second access point will be provided via access easement along southern boundary adjacent to the assisted living facility's development currently under construction. The City Engineer requires two access points be provided and shared access easements be dedicated to accommodate abutting properties with no direct access to public streets. The proposed plan meets the base design standards for site, architectural and landscape design requirements. A final plat was approved for this property in November 2005 and has yet to be filed & recorded. At that time, the final plat was approved to establish property boundaries and dedicate the necessary access easements to accommodate the assisted living facility and future development of Lot 2. The residential campus-like center has internal and external amenities consisting of perimeter walking paths leading to two gazebos, water features and manicured landscaped areas. The vacant unplatted property was zoned in October 1999 (PD99-32) as part of an overall planned development (PD) for Creekside Estates. Along with PD99-32 stipulations, this development shall conform to the City of Wylie's 1985 Zoning & Development Regulations. As reflected on the approved concept plan for Creekside Estates, the area of this request is a 12 acre tract designated Business-1 (B-i) zoning. The 1985 ordinance permits the applicant's proposed use by right in a B-1 zoning district. The proposed building will be constructed primarily of face brick with stone accents. Discussion The applicant(Metro Fleet Collision Repair) is proposing a 4,800 square foot building addition to accommodate new equipment and business upgrades to the existing 10,000 square foot facility. The property is located at the northeast corner of Regency Drive and Steel Road within Regency Business Park. The two (2) acre tract was annexed into the City in July 1984 (Ordinance 84-38) and was zoned Industrial. Subsequent amendments to the City's Zoning Ordinance changed the zoning from Industrial (I) to Business Commercial (BC) and the current zoning on the property is Light Industrial (LI). Truck, Machinery & Heavy Equipment Sales, Service or Repair requires a Specific Use Permit within the LI zoning district. Staff research indicates a plumbing sales and distribution facility occupied the site prior to the current applicant. Metro Fleet Collision Repair has been in continuous operation and existence at the site since 1992. This date was prior to passage/adoption of ordinance amendment to the current zoning, thereby becoming a nonconforming use and structure. See Article 9, City of Wylie's Zoning Ordinance. Section 9.4 Nonconforming Uses of Land, states no nonconforming use shall be increased to occupy greater than 50% of the area and Section 9.5 states no existing structure shall be enlarged in excess of 50% of the square feet of the existing structure, unless changing the use of the structure to a permitted use. The applicant proposes a 4,800 square foot addition to the nonconforming use and structure of an existing 10,000 square foot structure, therefore maintaining a 48% increase in use and building. As reflected on the applicant site plan and building elevations, the proposed addition totals 4,800 square feet, adjoining existing building to the west with three overhead doors facing south. The exterior materials consist of metal to match existing at 16' in height with matching galvanized panel metal roof. The addition is to accommodate a new shop area for two new automotive &truck paint booths. Page 1 of 1 Page 2 of 2 The applicant has met with City staff from Fire & Building Inspections Departments and will be in compliance with City's Building & Fire Code and applicable regulations. The two acre tract extends into centerline of both Regency Drive and Steel Road. The applicant has agreed to dedicate that portion as right-of-way through separate instrument process through the City's Engineering Department. As reflected on the site plan, the applicant proposes additional landscape features along the frontages of Regency Drive and at the sight visibility corner-angle of Steel Road. The additional landscape features include trees, shrubs and fencing to provide for acceptable aesthetics on site and adequate buffer& screening of bay doors, dumpster, and service or loading areas. In summary, the site is currently a nonconforming use and structure. The applicant has been in continuous business operation at the site for the past 15 years and desires to upgrade and expand the facility by 48%, below the 50% threshold the ordinance allows nonconforming uses and structures to expand without complying with current regulations. The property is zoned LI and is located within the Regency Business Center. The City's Comprehensive Plan and Land Use Philosophy have identified Regency Business Center as a preferred location and opportunity to support commercial operations. In light of this philosophy, recent amendments to the zoning ordinance for site, landscape and architectural standards make it challenging for existing businesses in the area to conform and achieve the City's vision and goal for the area. The applicant in this case is proposing additional landscaping, fencing and buffering along the street frontages for the purpose of aesthetically screening loading and service areas. Staff recognizes that as amendments and adoptions to the Zoning Ordinance occur, transformation of existing land uses will occur over time. Through this transformation period, some businesses and operations should be evaluated on a case by case basis by the Commission, and determination can be made whether an expansion within the current guidelines & regulations meet those goals as was adopted by the Council. LI district's primary focus is to provide for industrial and commercial uses that serve regional, state, and national markets with retail, office and business-serving industrial uses as needed. LI uses include light assembly & fabrication, warehousing & distribution from previously prepared materials and parts. The applicant has submitted a concept/development plan (Exhibit A) and Planned Development stipulations/provisions (Exhibit B) to be adopted as part of this request. The Comprehensive Plan designates Light Industrial for the area of this request. This request for a PD-LI is consistent with the City of Wylie's Land Use Plan & Land Use Distribution Philosophy in providing innovative and cohesive commercial development, employment for local population, manufacturing products for region and generating private revenues through employment and sales through taxes. As reflected on the applicant's concept plan, three (3) properties are assembled to create nine (9) separate lots with office-showroom/warehouse uses and light assembly & fabrication uses. The proposed lots range from one-quarter (1/4) acre to just over (3/4) acre in size, with single-story buildings ranging from 4,225 to 9,000 square feet of floor area. Access to the proposed business campus via private drive/fire lanes from Regency Drive and Steel Road, with six (6) lots fronting the private drive. The Planned Development district shall comply with Article 4, Section 4.4 development standards with the exception of a reduction in the required twenty-five feet rear yard setback to ten feet. The Site Plan shall be adopted as a part of this Ordinance. Articles, Sections, and Figures specified herein refer to City of Wylie Zoning Ordinance. In the case of conflict,the Site Plan andlor this document shall take precedence. The Regency Steel Business Campus shall be designated as a Light Industrial district (LI)per Article 4, Section 42. 3. Section 4.3 Nonresidential Design Standards shall be adopted, except as shown on the Site Plan andlor as noted herein. a. Entrances or facades for buildings adjacent to a public street shall be oriented toward a public street. Entrances or facades for buildings located inside the campus may face the private drive or the property side. b. Service and loading areas shall not directly face a public street but may face the interior private drive. c. All mechanical units located on the roof of a building shall be screened with a parapet wall. d. All buildings shall be finished on all sides in a unified architectural concept conforming to LI standards, to provide for a consistent facade-design and roof line configuration. e. Landscape requirements shall be based on total developable area as delineated on the Site Plan, however common open space shall be provided to include a park/picnic type setting. f. Parking requirements shall be based on total developable area. 4. Front yard setback shall be 25 feet. Side and rear setback shall be 10 feet minimum. 5. Allowed use shall be as permitted under Article 5 Use Regulations, Section 5.1 Land Use Charts, Figure 5-3 Land Use Tables, Non-Residential Districts, LI and Section 5.2 Listed Uses, as defined in the Zoning Ordinance of the City of Wylie. 6. Signage shall be limited to one monument sign per street access and minimal on- building identification. 7. Provision for the maintenance of common area, campus monument signage, and the private drive through the business campus shall be established through a permanent Property Owners Association PA with mandatory participation as specified in property sales contracts. 8. No fencing on lots that face the private drive shall extend past the face of the building. Fencing materials shall meet Light Industrial zoning regulations. 9.
