Issue.
Presentation and discussion of sewer Inflow & Infiltration (I&I) study program for 1997;
Consider and act upon award of contract to perform study services and analysis to the firm
of Byrd/Forbes, Inc.
Background
Inflow and Infiltration (I&I) is the intrusion of excess water from ground water, surface water
(creeks and lakes), or high water levels from heavy rainfall events into a city's wastewater
collection system. This water increases the amount of waste water which must be treated
at the waste water treatment facility. If I&I problems are not identified and corrected, the City
may face additional costs associated with increasing sewer main sizes for capacity, and
waste water treatment plant expansions required to treat the excess volumes.
In 1994 City of Wylie commissioned ADS Environmental to perform the early stages of an
overall I&I Study which was completed in February of 1995. The work performed by ADS
Environmental included the delineation of the various sewer drainage basins along with flow
monitoring at strategic locations. The results of this study have enabled the City to identify
the portions of the system which exhibit the most l&l. City forces have performed
observation and point repairs on the obvious problems on these sections. However, more
detailed analysis is now required to further isolate and identify the less obvious problems..
Representatives of Byrd/Forbes, Inc. will be present to discuss Infiltration and inflow. They
will describe what I&I is, how and where it occurs, and the many impacts it has on a
municipality's infrastructure and ability to effectively treat its wastewater. City Staff and the
Consulting Engineer have had several meetings with Byrd/Forbes, Inc to discuss the City's
current system and to discuss the obvious needs and the results of the 1994 ADS I&I Study.
Byrd/Forbes, Inc has thoroughly analyzed the '94 ADS Study and together with Staff,
identified the next phase of investigations which need to be performed, and are included in
the scope of services outlined in their proposal.
The scope of work to be included in the 1997 I&I Study includes further, more detailed
analysis of the areas identified in the previous study as being potential or existing problems.
This includes camera inspections of manholes and sewer mains, smoke testing, and other
possible measures.

The potential cost of any required system improvements has not yet been determined. This
study will help establish the scope of future projects and cost projections for budgetary
purposes. In addition, the need for and scope of future I&I studies, if any, will also be
established. This study will give us a more detailed way to pin point specific problem areas
and develop programs to address them. Programs to address the problems identified could
include major reconstruction, minor point repairs by city forces, an on-going observation
program, and other methods.

Issue
Consider and act upon approval of an ordinance calling for a Special Election, September 20,
1997 to approve or disapprove Kansas City Southern Railroad Company's development of
an Intermodal/Manifest Rail facility and business park to be located between Spring Creek
Parkway and Skyview Lane, North of State Highway 78, and the elimination of S. H. 78
Mainline Rail operations and donation of right-of-way to the City of Wylie between F. M. 544
and Eubanks, West of S. H. 78.
Background
Council is faced with the issue of whether to call a special election to be held September 20,
1997 to allow the citizens of Wylie to approve or disapprove Kansas City Southern Railroad
Company's development of an Intermodal/Manifest Rail facility. A brief history of the project
proposal is provided after a presentation of issues relating to the special election.
A consideration of this matter raises many relevant issues and differing points of view. This
issue would be taken to the citizens in the form of a special election. Regardless of the
number of votes or the margin of the outcome, the results of the election must be respected.
One position in support of holding an election is based on a belief that this proposal
represents the kind of issue that a community only deals with every decade or so. The
informal Town Hall meetings provided an opportunity for all residents to be involved. The
number of individuals that have voluntarily involved themselves on the grass roots level on
this issue represents a mandate that this proposal is too important to be decided through the
standard public hearing, Planning & Zoning Commission and City Council Review process.
Because of the profound impact this project can have on Wylie, a position in support of an
election would say, "let the people decide" and lift the burden from the elected officials and
appointed commission members.
If an election is held, a position could be taken that the decision to conduct an election was
made only to appease a small, vocal group of individuals. It would raise the question of
whether the City Council intends to take every issue that is in any way controversial to a vote
in the future.
Another view is that holding a special election is not necessary. The City implemented a
process, through informal Town Hall meetings that were promoted by door to door handouts
and newspaper listing, and the end result was that less than one percent of the residents
involved themselves in the process.

Another position would maintain that this proposal is a land use issue and should be dealt
with as any other zoning proposal. KCS has the right to purchase land and develop the
property consistent with the City's zoning ordinance and subdivision regulations. Taking the
KCS proposal to a vote would challenge the integrity of the process. It would beg the
question of whether the City has a right to reject a land use that is legally allowable on the
basis of a subjective judgement of"liking or not liking" a particular type of business.
Another position would maintain that taking the issue to a vote would be an abdication of the
elected officials responsibility serving in a representative democracy. The local government
system is designed to encourage public participation through open meetings and public
hearings. The system is designed to gauge public opinion informally as well. Elected officials
talk with people in their neighborhood, in the grocery store, in parks and in their churches.
The system encourages citizens to talk directly with their elected official. The elected official
serves on the City Council to represent the best interest of the community as a whole. The
job is not always easy, and the judgements to be made are sometimes difficult. The City
Council must welcome all opinions and in the end, objectively evaluate the facts, subjectively
review quality of life factors that can not be measured, and make a decision.
Beginning in November of 1995, rumors circulated throughout of the City of Wylie regarding
an unknown entity's purchase of approximately 550 acres of property located West of S. H.
78 between Spring Creek Parkway and Skyview Lane. Speculation would turn to fact in
November of 1996, when Kansas City Southern Railroad Company unveiled themselves and
went public that it had purchased the property to develop a major rail facility and business
park.
A series of monthly Town Hall meetings were held between February and May, 1997. During
the February meeting, Kansas City Southern (KCS) Railroad Company officials detailed its
proposal. The development would include the construction of a multi-tract intermodal and
manifest railyard facility. Specific to the rail facility site, the mainline track would be relocated
and newly constructed and multiple spur tracks would be newly constructed on which the
manifest and intermodal operations would take place. Additional spur tracks would be
constructed to serve the properties located to the South that would be developed for industrial
lots. The KCS company represented specific noise mitigation measures that would be
constructed on the rail facility site.
Offsite, the KCS company described several rail related projects that would also be
completed. The S. H. 78 railroad mainline would be abandoned and the right-of-way donated
to the City. A total of twelve (12) rail crossings would be eliminated because the rail lines
would no longer be running over the many cross streets that intersect S. H. 78 between
Eubanks Lane and F. M. 544. The remaining rail crossings along the Cottonbelt alignment
would be upgraded with lighted crossing arms. In addition, the abandonment of the S. H. 78
mainline enables a new rail crossing to be constructed approximately 600 ft. to the West to
connect the Cottonbelt with the S. H. 78 mainline South of F. M. 544. This creates the city's
first opportunity to have a grade separation constructed at the F. M. 544 crossing.

Background -continued
Kansas City Southern lastly described that a partnership would be formed with the City of
Wylie/Wylie Economic Development Corporation to develop 250 acres of land for a
business/commerce park. The City would have total land use control over the properties' use,
the only stipulation would be that the companies attracted to the park be served by rail.
The average attendance at the Town Hall meeting was approximately 80 persons. The City
distributed fliers door-to-door to every house in Wylie to inform the public of these meetings.
The format at each of the meetings was informal. Those in attendance exchanged questions
and answers. After the fourth meeting, it was determined that KCS officials could not respond
to many of the specific questions asked of them until further design work and technical studies
could be completed. Therefore, the informal Town Hall meetings were suspended. No further
information would be communicated until KCS made a formal submittal to the City of Wylie.
Kansas City Southern committed the company to voluntarily subject their proposal to a zone
change review process that requires public hearings and Planning & Zoning and City Council
approval. KCS would submit a formal application to develop its project in a Planned
Development Zoning district. Although the railroad industry is provided condemnation
authority under Federal Rail Corridor Law, KCS committed that it would not exercise this
authority and stated repeatedly that it would not develop its project if the community did not
want the project in their city.
A group comprised of individuals that are residents of Wylie and who live in the County,
attended each of the Town Hall meetings. The group has formed a not-for-profit organization
called the Citizens Coalition for Responsible Growth. Spokespersons for the coalition
represent the position of the group with the following statements: "There are no conditions
under which an intermodal facility would be acceptable in Wylie. While acknowledging that
abandoning S. H. 78 could be a positive, the benefit is lost if the trade off is the
intermodal/manifest facility. Further, the community has lived with the railroad and highway
conditions for the last thirty years and it can live with it for another thirty years." The coalition
states that the information provided by KCS has no credibility because the company will only
represent"what the city wants to hear" in order for the project (zoning approval)to be granted.
The group believes that the activities generated through the rail operations will increase the
potential risk of hazardous materials accidents. Also, the location of the rail facility in Wylie
will create responsibilities for the Fire Department that require resources for additional
staffing, equipment, and facilities be allocated that the city does not have in its current budget.
Further, that the city would be unable to respond appropriately in the event of a hazardous
materials spill. Lastly, the group represents that the KCS proposal would profoundly change
Wylie's quality of life for the worse. The spokespersons for the group support an election
being called. If not called voluntarily, the necessary number of signatures to require a
referendum will be gathered.

Background -continued
Spokespersons for the coalition represent that approximately 600 signatures have been
gathered on a petition that would require the City Council to take the issue of the zone change
approval to the citizens in the form of a referendum. The City's Charter requires that 10% of
the registered voters be gathered for a referendum to be called. In the absence of the
required number of signatures, the City Charter allows the City Council to place the item
before the citizens.
Financial Consideration
The Collin County Elections Administration has stated that the cost to conduct the election
would be approximately$4,500 to $5,000. This will include the preparation of paperwork, the
preparing of ballots, provide judges and conduct early voting and provide judges and conduct
the election. The school district has contracted with the County to only provide judges and
conduct the bond election on September 20, 1997. The school district will conduct only early
voting. The cost has been reduced due to sharing with the school district on election day and
also the Plano Independent School District who is also having a bond election on that date.
Other Consideration
Per Article 5.1.B of the Wylie City Charter, Council may order a special election under
conditions specified elsewhere in the Charter, or for ordinances, bond issues, charter
amendments, recall or other purposes deemed appropriate by the City Council. The City
Council will fix the time and places for such special elections, and provide all means for
holding same. A pre-clearance from the Justice Department will be required since this is a
special election not held on a uniform election date.
Staff Recomrn ndation
It is not appropriate for staff to take a position on whether to take this issue to a vote by
special election. If an election is called, staff is to insure the issue is considered based on
objective factual information.

Issue
Consider and act upon alternatives for the Kreymer Lane paving and drainage improvements
project and Award Bid for the Construction of Kreymer Lane.
Background
This project was part of the 1995 Bond program for paving improvements. The original scope
of the project included paving improvements and miscellaneous drainage improvements.
During the design of this project, it was discovered that the existing drainage facilities in the
vicinity were inadequate per the City's current drainage requirements. In fact, the existing
system needed to be doubled in capacity in order to meet the City's minimum requirements.
Therefore, the scope of this project was expanded to include not only the paving, but also
large diameter underground drainage pipes. All of the paving and drainage improvements
along Kreymer were included in the base bid package of the bid proposal.
The bid proposal form also included Additive Alternate packages for various improvements
adjacent to this project. Additive Alternate#1 was for an additional 12-foot of pavement (one
traffic lane). The base bid included a pavement width of 25-feet which represents one half
of the future four land divided thoroughfare. The additional 12-foot of pavement was added
as an alternate in case the City decided to make Kreymer Lane an undivided collector street
instead of a future divided boulevard.
Additive Alternate #2 includes the extension of sewer mains from the Wyndham Estates
subdivision into the Wylie Ranch East Subdivision. Town Hall Meetings have been held with
the residents of Wylie Ranch East Subdivision to determine the level of private participation
to proceed with this work.
Additive Alternate #3 includes the construction of drainage swales and the replacement of
some, but not all, driveway culverts to improve the drainage conditions in the Wylie Ranch
East Subdivision. Town Hall Meetings have been held with the residents of Wylie Ranch
East Subdivision to determine the level of private participation to proceed with this work.
The results of these meetings is that the city and property owners will share equally in the
financing of the improvements. The property owners will be assessed for their contribution,

Additive Alternate #4 is for the installation of a 4-foot wide sidewalk along the west side of
Kreymer. Any or all of the Additive Alternate packages may be added to the contract at the
discretion of the City at the time of award of the base bid.
Sealed bids were opened and read aloud on July 11, 1997. The apparent low base bidder
on this project is Tri Con Services with a bid of $608,070.80. If any or all of the Additive
Alternates are added to the base bid, the low bidder is Morrow Construction Co., Inc. The
City is required to award the bid to the lowest, responsive, bidder, based on the bid package
combination selected. The Hogan Corporation has evaluated the bids submitted and
checked both Tri Con Services, Inc., and Morrow Construction Co. Inc., qualifications, and
would have no hesitancy in recommending award of contract to either contractor. Based on
the results of the various Town Hall Meetings with the residents of Wylie Ranch East, it is
Staff and the Engineer's understanding that Council may award the contract including the
base bid and Additive Alternates #2 and #3. The Additive Alternates #1 and #4 are not
recommended at this time. Therefore, in this case, the low bidder is Morrow Construction Co.,
Inc. based on their bid of $803,724.05 (base bid plus Alternate #2 and #3). A detailed
breakdown of bid prices and alternate bid items are attached to aid Council in evaluating the
various options.
In order to incur the least amount of confusion and inconvenience to the property owners, the
contractor will be required to comply fully with the terms and conditions as specified in the
Contract documents. These items will be addressed at the preconstruction meeting and
required of the contractor:
1. Submit a detailed construction sequence plan including parking and project schedule
for review by the Engineer and Staff.
2. Coordinate through City Staff a meeting with the adjacent property owners to discuss
the proposed plan and schedule and make adjustments if necessary.
3. Prepare a form letter of notification to be used to inform affected owners of any
construction related activities which may affect access. This letter must be reviewed
by staff prior to issuance.
4. Deliver letter of notification to affected parties 48 hours in advance of specified
construction activity. A copy must be simultaneously submitted to the City and
Engineer.
5. Notify the City's Inspector as soon as possible as to any changes or problems which
may affect the progress of the project.
6. All other public utilities and services must be notified by the Contractor prior to
construction.

7. Prepare the monthly pay request and review it with the City Inspector prior to submittal
to the Engineer for further processing.
8. Coordinate with Staff and the Engineer monthly progress meetings to be held at the
site to review monthly progress and discuss any changes or problems.
9. Fully comply with all other aspects of the Contract Documents. This includes job site
safety, public notifications, etc.
10. The full and complete responsibility for compliance with the contract documents is the
contractor's. It is the City's and Engineer's responsibility to enforce the terms of the
contract. If the contractor does not or will not comply, the City and Engineer may then
enforce the terms of the contract as stated.

This project is part of the 1995 Bond Program - Phase 1. The original bond budget for
Kreymer Lane paving and drainage was $ 361,983. The low Base Bid is $608,070.80. This
includes approximately $265,000 worth of additional underground drainage facilities which
were not included in the original 1995 bond budget projection, as mentioned in the
"Background" section of this communication.
Please see the attached bid summary from The Hogan Corporation for a more detailed cost
breakdown.
As a result of the Town Hall Meetings with residents of the Wylie Ranch East Subdivision, it
was agreed that the city and property owners will share equally in the financing of the sewer
and drainage improvements. Sewer improvement costs totaled $92,415 with a shared cost
of $46,208. Drainage improvement costs totaled $52,955 with a shared cost of $26,478.

summary.
