CALL TO ORDER
Announce the presence of a Quorum.
Chairman Ellis called the meeting to order at 7:15PM. Board Members present were:
Board Member Ms. Herrera, Board Member Ms. Jourdan, Board Member Ms. McGinnis,
and Chairman Ellis. Board Members not present were Board Member Mr. LeBaron and
Board Member Mr. Young.
Staff members present were: Assistant City Planner Renae 011ie and Secretary, Mary
Bradley.
CONSENT ITEMS
1. Motion and act upon approval of Chair and Vice-Chair of the Zoning Board of
Adjustment.
A motion was made by Ms. Herrera, and seconded by Ms. McGinnis, to nominate and
vote Board Member Mr. Ellis as Chairperson and Board Member Ms. Jourdan, as Vice-
Chair. Motion carried 4 — 0.
2. Consider and act upon approval of the Minutes of the August 21, 2006
Meeting.
A motion was made by Board Member Ms. Jourdan, and seconded by Board Member
Ms. Herrera, to approve the minutes of the August 21, 2006 meeting as submitted.

PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by Denese Davis
for a Variance to Section 12.B.8 of the 1962 Zoning Ordinance to reduce the
front yard setback from the required 25 feet to three feet to allow for the
construction of a carport, this property being located at 323 South First Street,
being Lot 13, Block B of the Lavon Terrace Addition, generally located south
of Butler Street and north of Stone Road. (ZBOA 2006-09)
Ms. 011ie stated that the request was previously presented and DENIED by the Board
on August 21, 2006. The property owner is requesting the same variance, and states
that the property has been deprived of access from the rear due to the construction of a
concrete ditch, therefore imposing a hardship. A drainage easement occupies 25 feet
of the rear yard.
The property has a platted 25 feet building line. The entrance to the existing garage is
25.5 feet from the front property line. The request is to allow a 22 X 20 steel carport to
remain, as constructed. The carport extends 22 feet into the front yard and five feet and
nine and one half inches (5' — 9 1/2") into the side yard. The applicant has also
constructed an 8 x 10 cover over the existing front porch area. This is a variance of
eighty-eight percent. The carport will be three feet from the front property line and
approximately fourteen feet from the face of curb.
Public comment forms were mailed to thirty-four (34) property owners within 200 feet,
and one written response was received opposing the request. The property owner
distributed a petition with eight signatures within the 200 feet boundary favoring the
request, and thirteen signatures outside the 200 feet boundary favoring the request.
Ms. Denese Davis, property owner, 323 S First, stated that the petition was distributed
to her neighbors, which could be tenants and not actual property owners. The Zoning
Ordinance does not fit the neighborhood, and the carport will enhance the
neighborhood.
Chairman Ellis stated that his personal opinion is against carports, but that the property
owner did make the initiative to obtain neighbors opinion is to be complimented, and
that the Zoning Ordinance does not fit the neighborhood, and the carport will enhance
the neighborhood.
Mr. Michael Stout, President, Mesquite Metal Products, 110 Industrial Drive, Forney,
Texas, represented the contractor for the proposed carport and distributed a brochure of
final product. Mr. Stout stated that the roof is not installed, and the trim is not
completed. It is a painted steel roof, and guaranteed for ten years, and the beams are
galvanized steel and will last a lifetime, and the product is maintenance free. If the
Board recommended shingles on the roof to match the house, the hardship and
expense on the property owner will be three to four times more expensive.

Chairman Ellis opened Public Hearing.
Jeff Jones, 321 S First, represented neighbor of the subject property, spoke in favor of
the carport and has lived on First Street since 1989. He further expressed opposition
for the City of Wylie, fighting with property owner since they are enhancing the
neighborhood. Ms. Herrera stated that any property owner that desires to do anything
against the Zoning Ordinance, should face the consequences.
Chairman Ellis closed the Public Hearing.
A motion was made by Board Member Ms. Jourdan, and seconded by Board Member
Ms. McGinnis, to GRANT the request for a variance to Section 12.B.8 Supplemental
Regulations, Accessory Buildings of the 1962 Zoning Ordinance to reduce the front yard
setback from the required 25 feet to 3 feet. Motion carried 3 — 1, with Board Member
Ms. Herrera voting in opposition.
MISCELLANEOUS
Ms. 011ie reminded Board Members to complete the Open Meetings Act, in order to
receive Certificate of Completion, and to complete before the end of the year.
ADJOURNMENT
A motion was made by Board Member Ms. Jourdan, and seconded by Board Member
Ms. Herrera, with the consensus from all Board Members to adjourn the meeting at
7:35PM.

Zoning Board of Adjustment Public Hearing: January 22, 2007
Owner/Applicant: Tom Allred
Location: Lot 1, Block A in the A&W Properties Addition.
Request: Variance to Section 5.2.D.3c parking regulations of
the 2001 Zoning Ordinance to reduce the required
General Office required parking by 1(one) space.
Background:
The subject property was created in July 2003 with the platting of the A&W Properties
Addition.
The subject property is located at 2801 West FM 544 and faces south. The rear/north
property line yard abuts the 100' DART railroad right-of-way while the east side is
shared with Lot 2, Block A in the A&W Properties Addition.
The development on the property consists of a 6,600 square foot building originally
intended as an office/warehouse space. As intended, the development conforms to
Section 5.2.1.7c of the 2001 Zoning Ordinance for parking. However, the applicant
wishes to lease a portion of the building as general office. As designed and configured
the property has space available but inadequate parking under Zoning Ordinance
5.2.D.3c. The applicant states that a hardship exists due to the general vicinity moving
toward retail as opposed to a warehouse market. In May 2006, the applicant added five
parking spaces to the existing plan due to interest in retail use.
Public comment forms were mailed to fifteen (15) property owners within 200 feet of this
request, as required by State Law. No responses had been received at the time of this
posting.
Section 8.4(E)(4)(b) of the Zoning Ordinance provides that the Zoning Board of
Adjustments may permit a variance to the requirements of the Zoning Ordinance if the
variance is not contrary to the public interest and, due to special conditions of the site, a
literal enforcement of the ordinance would result in unnecessary hardship, and so that
the spirit of the Ordinance is observed and substantial justice is done. The Board may
impose any reasonable conditions on the issuance of a variance and may amend the
variance from that requested. The concurring vote of 75 percent of the members of the
ZBOA 2007-01
Board shall be necessary to reverse any order, requirement, decision or determination
of any administrative official, or to decide in favor of the applicant to effect any variance
in the Ordinance. In order to grant a variance to the development code the Board shall
find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or
other exceptional physical condition particular to the affected property;
(2) That because of these unique physical circumstances or conditions, the
property cannot be reasonably developed or used in compliance with the
provisions of the development code;
(3) That due to such unique physical circumstances or conditions, the strict
application of the development code would create a demonstrated
hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed
development or use of adjacent property or neighborhood;
(6) That the variance, if granted will not change the character of the zoning
district in which the property is located;
(7) That the variance, if granted is in keeping with the intent of the
development code; and
(8) That the variance, if granted will not adversely affect the health, safety or
welfare of the citizens of Wylie.
Considerations:
1. As presented in the application, the change in use would result in the property
having one parking space less than, or 92% of, the required under Zoning Ordinance
5.2.D.3c.
2. The applicant is developing Lot 2, Block A, located immediately east, with more
parking than required for most commercial uses and a pedestrian access will be
constructed from Lot 2 to Lot 1.
3. Commercial retail businesses within this corridor are advisable under the current
Comprehensive Development Plan.

Zoning Board of Adjustment Public Hearing: January 22, 2007
Owner/Applicant: Todd Miller
Location: Lot 2, Block 8 in the Westwind Meadows Addition.
Request: Variance to Section 7.B.e(2) Rear Yard regulations of
the 1962 Zoning Ordinance to reduce the rear yard
setback from the required 25 feet to 6.2 feet.
Background:
The subject property was created in June 1978 with the platting of Phase 1 of the
Westwind Meadows Addition.
The subject property is located at 629 Willow Way and faces north. The southern side of
the rear yard abuts a 30' alley right-of-way which includes an underground pipeline
easement in the north 20' of right-of-way.
The rear of the subject residence is a doublewide garage door, opening to a driveway
which currently measures approximately 56 feet to the alley while being 37 feet to the
southern property line. The applicant desires to extend the existing main structure by
30'-10" essentially using the existing garage area as an interior room and the additional
area as the new garage. As planned the new structure will be 6'-2" from the rear
property line, extending 18'-10" into the required rear yard setback. The applicant states
that a hardship exists due to the amount of space used for the combined alley right-of-
way and pipeline easement.
Public comment forms were mailed to twenty-six (26) property owners within 200 feet of
this request, as required by State Law. No responses had been received at the time of
this posting.
Section 8.4(E)(4)(b) of the Zoning Ordinance provides that the Zoning Board of
Adjustments may permit a variance to the requirements of the Zoning Ordinance if the
variance is not contrary to the public interest and, due to special conditions of the site, a
literal enforcement of the ordinance would result in unnecessary hardship, and so that
the spirit of the Ordinance is observed and substantial justice is done. The Board may
impose any reasonable conditions on the issuance of a variance and may amend the
variance from that requested. The concurring vote of 75 percent of the members of the
ZBOA 2007-03
Board shall be necessary to reverse any order, requirement, decision or determination
of any administrative official, or to decide in favor of the applicant to effect any variance
in the Ordinance. In order to grant a variance to the development code the Board shall
find that all the following have been satisfied:
(1) That there are unique physical circumstances or conditions of the lot, or
other exceptional physical condition particular to the affected property;
(2) That because of these unique physical circumstances or conditions, the
property cannot be reasonably developed or used in compliance with the
provisions of the development code;
(3) That due to such unique physical circumstances or conditions, the strict
application of the development code would create a demonstrated
hardship;
(4) That the demonstrable hardship is not self-imposed;
(5) That the variance if granted will not adversely affect the proposed
development or use of adjacent property or neighborhood;
(6) That the variance, if granted will not change the character of the zoning
district in which the property is located;
(7) That the variance, if granted is in keeping with the intent of the
development code; and
(8) That the variance, if granted will not adversely affect the health, safety or
welfare of the citizens of Wylie.
Considerations:
1. As presented in the application, the addition will extend the existing main structure
by 30'-10", leaving 6'-2" to the rear property line, approximately 25% of the required
setback in the ordinance. By including the 20' pipeline easement the proposed
addition would leave 26'-2" of setback to the actual alleyway.
2. The requested variance is 18'-10" or 25% of the required 25 feet rear yard depth.
3. The addition must be constructed of materials to match the main structure. In
addition, Zoning Ordinance 5.B.9c states that single family detached dwellings shall
include two enclosed parking spaces which the application shows as the extension.
