Chairman Ellis called the meeting to order at 7:OOPM. Members present were: Board Member Ms. Herrera, Board Member Ms. Jourdan, Board Member Mr. Osborne and Board Member Mr. LeBaron and Board Member Mr. Young were absent. Discussion Section 5.2.I.2.e requires an outside storage area to be screened from view of streets and adjacent residential property by a masonry wall. As shown in the photographs of the property the area is screened by a finished, quality, wood fence. The applicant is requesting a variance based on the appearance of the fence keeping with the current look of other properties in the area (see applicants attached comments). The wooden screening fence is built and was done so by the applicant without the required permits. Section 8.4(E)(4)(b) of the Zoning Ordinance provides that the Zoning Board of Adjustments may permit a variance to the requirements of the Zoning Ordinance if the variance is not contrary to the public interest and, due to special conditions of the site, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the Ordinance is observed and substantial justice is done. The Board may impose any reasonable conditions on the issuance of a variance and may amend the variance from that requested. The concurring vote of 75 percent of the members of the Board shall be necessary to reverse any order, requirement, decision or determination of any administrative official, or to decide in favor of the applicant to effect any variance in the Ordinance. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and Page 1 of 2 Page 2 of 2 ZBA 2007-04 (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Public comment forms were mailed to seventeen (17) property owners within 200 feet of this request, as required by State Law. One (1) response citing no comment' has been received at the time of this report. Considerations: 1. As presented in the application the change would result in the property having a material not currently allowed by the ordinance. 2. This property, although not within the Downtown Historic District overlay, is adjacent to the District thus keeping with the spirit of the ordinance and is not contrary to the public interest. 3. If granted, the revised property would fully comply with the other requirements of section 5.2.1.2 of the ordinance. Approved By Initial Date Department Director Article .1.1.2 specifies that all outside storage areas shall be entirely screened form view of streets and adjacent residential property with a masonry wall. The owner desires to utilize a wooden fence to screen all storage areas in view of streets and adjacent residential properties: The intent is to have the property blend in more appropriately with the bordering Historic District. This property is contiguous to the existing boundaries of the historic district. This use will provide and adaptive reuse of existing buildings and seeks to be compatible with the historic nature ofdowntown, and also provide a creative buffer for the three other properties adjacent to this property in the DTH. Section 6.3 DOWTOWN filsToRic DISTRICT (DTH); Purpose.The addition of a wooden fence vs. a masonry wall is more complimentary to the nature of the DTH. There are currently no masonry walls in the CC in which the property is located or in the DTH in any near proximity. Due to the special conditions as to the location and size of this property, and it's being adjacent to the Downtown Historic District it seems that this request is not contrary to public interest but rather more complimentary in nature.
