Chairman Ellis called the meeting to order at 7:10PM. Members present were: Board Member Ms. Jourdan, Board Member Mr. Osborne and Board Member Ms. McGinnis. Board Members absent were Mr. Young, Mr. LeBaron and Ms. Herrera. Consider and act upon approval of the Minutes of the February 26, 2007 Meeting. A motion was made by Board Member Mr. Osborne, and seconded by Board Member Ms. Jourdan, to approve the minutes of the January 22, 2007 meeting as submitted. Motion carried 3 — 0 - 1, with Board Member McGinnis abstaining. Minutes March 26, 2007 Wylie Zoning Board of Adjustment Page 1 of 3 PUBLIC HEARINGS 1. This application has been withdrawn. Hold a public hearing to consider and act upon a request by Jerry Sylo of Jones and Boyd, Inc. (for D.R. Horton) for a Variance to PD 2005-44 to reduce the required lot size from 20,000 square feet to 18,955 creating a separate 5,000 square foot easement, this property being Lot 47, Block A of the Riverchase Addition, Phase 1, located at 1900 Stone Glen Drive (ZBA 2007-02). Ms. 011ie stated that at the February 26, 2007 meeting, the applicant requested the item to be tabled, and has since that time submitted a letter of withdrawal. Mr. Haskins stated that the letter was not included in the packet, but is available for the Board Members to review. Chairman Ellis opened the Public Hearing. No one approached the Board Members. Chairman Ellis closed the Public Hearing. A motion was made by Board Member Jourdan, and seconded by Board Member Osborne, to accept the request to withdraw the request. Motion carried 4 — 0. 2. Hold a public hearing to consider and act upon a request by Charles F. Flanigen for a Variance to 5.2.I.2.e requiring outside storage areas to be screened from view of streets and adjacent residential property by a masonry wall to screening using a wooden fence, this property being located at 211 West Marble (ZBoA 2007-04). Mr. Haskins stated that the applicant is requesting a variance for the type of screening used for outside storage on Nonresidential property but adjacent to residential property. The Zoning Ordinance requires masonry wall, but the applicant desires to have the property blend in more appropriately with the bordering Historic District. Chairman Ellis opened the Public Hearing. Mr. Charles Flanigen, 9390 Lakeridge Drive, Princeton, Texas, the applicant for the subject property, stated that he operates a landscaping company on the subject property, and that the fence is wooden with a cedar finish and steel posts. He stated that if the Board Granted the request and approved, he intends to replace the existing gate with a rolling wrought iron gate. The fence will be maintained and sealed approximately every five to seven years. Chairman Ellis closed the Public Hearing. A motion was made by Board Member Osborne, and seconded by Board Member McGinnis, to Grant the request with stipulation that a rolling wrought iron gate with the same finish as the cedar wooden fence be installed within four weeks. Discussion This property is Lot 13 Block H of Cimarron Estates Phase I located at 2708 Deerborn Street. Section 2.5.4.c.(2).(a) requires a side setback of five (5) feet when the accessory building is behind the main structure, and 2.5.4.e.(1) requires accessory buildings of 120 square feet or less to be constructed of metal with baked on enamel, composite masonry façade, or same masonry content of the main building. The applicant is requesting a variance to both of these requirements. The applicant is requesting a three (3) foot setback from the side yard and the use of wooden construction materials. Considerations: 1. As presented in the application the change would result in the accessory building having a material not currently allowed by the ordinance. 2. The applicant is providing for an eight(8) foot screening fence to block the view from the front street. 3. The applicant has demonstrated that several other properties within the neighborhood have similar accessory buildings with similar construction, thus keeping with the character of the adjacent properties. 4. The set back of three (3) feet represents a 40% reduction in the required setback. 5. If granted, the revised property would fully comply with the other requirements of section 2.5 of the ordinance. Public comment forms were mailed to twenty-five (25) property owners within 200 feet of this request, as required by State Law. Five (5) responses were received at the time of this report, three (3)were in favor and two (2)against. Future plans for the building include new paint that will coordinate with my residence to further enhance the aesthetics of the building.The city currently requires a 5'set back from the side property line.With the current configuration of my property there are only two viable options for this building. The first and less desirable location is on the east side of the residence but also does not fall within the cities guidelines and would only leave approximately 4" between the house and building,and the same "between the building and property line.This could also create a potential fire hazard being so close to the residence. The second and more viable solution is the one I am proposing on the west side of the driveway in the rear side yard of my property.This will create a much larger two foot setback between the building and the property line, and will leave an approximate 16 feet between the accessory building and my neighbor's driveway. In the adjoining alleyway there are already several other residences with accessory buildings that are set back lees than 5 feet from the property line, including two that are directly behind my residence(please see attached list and photos).So the addition of my building will not significantly detract from the beauty of our neighbor hood and/or city, nor will it negatively impact the property values of our community. I appreciate the attention to this matter by the board and encourage you to approve my request without prejudice. Discussion This property is Lot 8 Block 0 of Creekside Estates Phase 3 located at 1506 Peggy Loftice Drive. PD 99-32 requires a rear setback of twenty-five (25) feet from the rear of the main structure. The applicant is requesting a variance to approximately fifteen (15) to allow the addition of a ten (10) foot attached patio cover for the existing concrete pad (please see photos of proposed cover). Considerations: 1. As presented in the application the change would result in a 40% reduction in the rear yard setback currently allowed by the ordinance. 2. The existing main structure was built directly on the twenty-five (25) foot set back line, thus not allowing any addition without a variance. 3. The proposed patio cover will limit sunlight exposure into the home during the morning hours reducing the heat load to the home. This reduction is keeping with the City of Wylie's goal of energy conservation. 4. The rear of the property faces currently undeveloped county land within a flood plain, thus minimizing any impact upon neighboring residences (see pictures provided by applicant). 5. If granted, the revised property would fully comply with the other requirements of PD 99-32 of the ordinance. Public comment forms were mailed to fifteen (15) property owners within 200 feet of this request, as required by State Law. Discussion These propertys are: - Lot 10 Block E of SouthPlace Estates Phase IV located at 1300 Angel Fire. - Lots 1 and 5 Block F of SouthPlace Estates Phase IV located at 1301 and 1309 Angel Fire. - Lot 10 Block F of SouthPlace Estates Phase IV located at 1300 Sierra Blanca. Section 10.3.1(b) (1985 Ordinance) requires a side yard setback of twenty (20) feet when adjacent to a street. The applicant is requesting a variance to fifteen (15) feet in order to build a home meeting the 1700 square foot minimum of the other homes in the development. Considerations: 1. As presented in the application the change would result in a 25% reduction in the side yard setback currently allowed by the ordinance. 2. Under the 1985 ordinance a minimum dwelling size of 1500 square feet is allowed, however this minimum is not keeping with the minimum size of other dwellings currently in the development. 3. Additionally, current ordinances within the City call for homes larger then the requested 1700 square foot minimum, so this request is keeping with the City's intent for larger dwelling sizes. 4. Similar corner lot side yard setbacks are currently platted in Phase VI of this development. 5. If granted, the revised property would fully comply with the other requirements of Section 10.3.1(b) of the ordinance. Public comment forms were mailed to fifty-one (51) property owners within 200 feet of this request, as required by State Law. Discussion These properties are: - Lots 1 and 5 Block H of SouthPlace Estates Phase V located at 1301 and 1309 Sierra Blanca. - Lots 1 and 5 Block I and Lot 6 Block H of SouthPlace Estates Phase V located at 1301, 1308, & 1309 Red River. - Lots 10 and 6 Block I of SouthPlace Estates Phase V located at 1300 and 1308 Pajarito Mountain. PD 2002-41 requires a side yard setback of twenty-five (25) feet when adjacent to a street. The applicant is requesting a variance to fifteen (15)feet in order to build a dwelling of 1700 square feet. Considerations: 1. As presented in the application the change would result in a 40% reduction in the side yard setback currently allowed by the ordinance. 2. While PD 2002-41 references the 2001 zoning ordinance, which requires a twenty-five (25) foot side yard set back, platting of this property was approved using twenty (20) feet. Based on the approved plat this variance would be a 25% variation from the required minimum set back as opposed to the 40%variation mentioned in#1. 3. Under PD 2002-41 a minimum dwelling size of 1500 square feet is allowed. 4. Current ordinances within the City call for homes larger than the requested 1700 square foot minimum, so this request is keeping with the City's intent for larger dwelling sizes. 5. Similar corner lot side yard setbacks are currently platted in Phase VI of this development. 6. If granted, the revised property would fully comply with the other requirements of Section 10.3.1(b)of the ordinance. Public comment forms were mailed to sixty-two (62) property owners within 200 feet of this request, as required by State Law. Two (2) responses were received at the time of this report in favor of the variance. Discussion This property is Lot 1 Block B Woodlake Village Addition, generally located north of S.H. 78 and west of Spring Creek Parkway along Centennial Drive. Section 4.3.F.1.a(1) requires primary materials for buildings in a Commercial Corridor(CC) district be constructed of brick with at least 20 percent stone on the front façade including, but not limited to brick, stone, cast stone, decorative concrete, or stucco. The applicant is requesting a variance to this section to build using concrete with a decorative brick on the front façade only. This would leave the sides and the back of the buildings as concrete, potentially of tilt wall construction. Considerations: 1. As presented in the application the change would result in the buildings having sides and backs that do not have the required brick finish. 2. The back of the property, and thus the back of the buildings, are facing the Kansas City Southern railroad tracks and property which is zoned Heavy Industrial (HI). 3. Due to the elevation of the existing railroad tracks and the intervening HI district the back of the buildings would be partially screened from the residential properties within the Wylie Lakes subdivision. 4. The sides of the buildings, as shown on the current site plan, would be visible from Centennial Drive. 5. The applicant is proposing the use of tilt wall construction which is currently allowed only in LI and HI districts. However the applicant is proposing to use staining, scoring, or some other enhancement on the concrete walls. Public comment forms were mailed to fifteen (15) property owners within 200 feet of this request, as required by State Law.
