CONSENT AGENDA 1. Consider and act upon approval of the Minutes of the December 16, 2002, Meeting. A recommendation was made to remove the sentence "Ms. Herrera arrived during the presentation" on page 4 in the fourth paragraph and stating on the first page under Consent Agenda in parenthesis (Mrs. Herrera absent at the time.) A Motion was made by Mr. Gibbons, and seconded by Mr. Morman, to approve the minutes with changes noted. Motion carried 7 — 0. ZBOA Commission Meeting January 27, 2003 Page 2 of 3 PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Calvin Frederick for a variance to Section 3.3.A of the Zoning Ordinance (Sign Ordinance) in order to reduce the front yard from the required twenty-five (25) feet to six (6) feet, this property being located at 504 South Jackson Street and being Lot 3 of Block 7 in the Keller's First Addition. (ZBOA Case No. 2002-21) Thompson stated that the subject property was created by the platting of the Keller's First Addition, one of the oldest residential subdivisions within Wylie. The residence was constructed with a single-car garage, as allowed by the Zoning Ordinance in force at the time of platting. The Zoning Ordinance did not specify, at that time, if the requirement for parking was to be enclosed or covered or uncovered/open. A front yard of twenty-five (25) feet was required, although the existing residence and garage were constructed thirty (30) feet from the front property line. The applicant wishes to convert the garage into a "hobby shop", and to construct a single-car carport to the front of the garage. The new carport will be six (6) feet from the front property line, a variance of 19 feet or 75 percent from the required 25 feet front yard. However, the right-of-way of Jackson Street is 70 feet wide rather than the normally required 50 feet, and the carport will be located 24 feet from the curb or approximately 14 feet from what would be a normal right-of-way (a variance of 25%). Regardless of the future improvements to Jackson, there is sufficient paved drive for two cars, one under the carport and one between the carport and the street. Board Members discussed the vested rights of a homeowner. Thompson stated that because the proposed addition is less than 50 percent of the original size of the residence, the regulations in force at the time of development apply. Ms. Alicia Frederick, 125 Kathlyn Lane, Rowlett, Texas, the daughter-in-law of the applicant, stated that the purpose of enclosing the garage is to keep the hot/cold weather away from the retired applicant in order for him to work on hobby craft items in the garage. Other residents along Jackson have added carports or never had either garage or carport. A motion was made by Mr. Morman, and seconded by Mr. LeBaron, to grant the variance. Motion passed 6 — 0. Mr. Clark adjourned the meeting at 7:25 pm to reconvene for a work session in the back of the Chambers. ZBOA Commission Meeting January 27, 2003 Page 3 of 3 WORK SESSION Thompson made a slide presentation on value of tree preservation and the City of Wylie philosophy, in response to earlier discussion by the Board Members. The presentation was supported by a handout, which summarizes the City's policy and discusses the general issue of tree preservation during development. Dunaway, Ill Location: 306 First Street, Lot 9B of Block 5 of the Original Railroad Addition Request: Variance of Section 3.3.A of the Zoning Ordinance to reduce the front yard from the required 25 feet to o feet, to reduce the rear yard from the required 25 feet to 10 feet, to reduce the north side yard from the required 7 feet to 5 feet 6 inches, and to reduce the south side yard from the required 7 feet to 6 feet 5 inches Background: The Railroad Addition is one of the oldest subdivisions within the City of Wylie. The subject lot was originally platted as Lot 9 of Block 5 and measured 65 feet wide along First Street with a depth of 125 feet similar to all other lots fronting First. The current Lot 98 was created by the subsequent sell of 15 feet (Lot 9A) to the corner Lot 10 on its north, which reduced the width of the new Lot 9B to 50 feet. This reconfiguration was accomplished by deed, and these lots have never been officially replatted and are therefore `legally nonconforming". The lots (9A, 9B, and 10) should be legally replatted in to two lots of record. With the adoption of a revised Zoning Ordinance and Map in February of 2002, the subject lot was rezoned from Single Family Residential-3 to its current to Single Family — 8.5/17, requiring dwellings of at least 1,700 square feet. Both the previous SF-3 and current SF- .5 17 Districts require a front yard setback of twenty-five feet and a two-car garage. ZBOA 2003-1 The subject lot is currently vacant, but was previously occupied by a single-family residence. Several mature trees are located on the lot. First Street is an over-sized 70 feet wide right-of-way, and an unimproved 20 feet wide alley is to the rear of the lot. The current applicant desires to construct on the subject lot a two-story single-family residence of between 2,500 and 2,700 square feet, and contends that the house cannot be contained within the required setbacks. Placement of the proposed dwelling behind the required 25 feet front yard setback will require the removal of a mature Elm tree located near the center of the lot, and the applicant is requesting a variance of the required front yard setback in order to save the tree by placing the house on the front property line. The applicant also requests a reduction in the rear yard from the required 25 feet to 10 feet, reduction of the north side yard from the required 7 feet to feet 6 inches, and reduction of the south side yard from the required 7 feet to 6 feet inches. See attached letter of request and site plan. In August of 2002, the Zoning Board of Adjustment denied a request on the same lot by a different applicant for a similar variance to the required front yard to allow construction of a house (1,800 square feet) on the front property line in order to save the Elm tree in the let's center. In December of 2002, the Planning and Zoning Commission approved a request by the current applicant to allow cementatious composite siding to be used on a residence on this infill lot, in keeping with the siding used on most of the other structures along First Street. Section 8.3 of the Zoning Ordinance provides that the Zoning Board of Adjustment may permit a variance to the requirements of the Zoning Ordinance if the variance is not contrary to the public interest and, due to special conditions of the site, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the Ordinance is observed and substantial justice is done. The Board may impose any reasonable conditions on the issuance of a variance and may amend the variance from that requested. The concurring vote of 75 percent of the members of the Board shall be necessary to reverse any order, requirement, decision or determination of any administrative official, or to decide in favor of the applicant to effect any variance in the Ordinance. This section further states that in order to grant a variance to the Ordinance, the Board shall find that all of the following have been satisfied: 1. That there are unique physical circumstances or conditions of the lot, or other exceptional physical conditions particular to the affected property; 2. That because of these unique and exceptional circumstances, the property cannot be reasonably developed or used in compliance with the provisions of the Zoning Ordinance; 3. That due to such unique and exceptional circumstances, the strict application of the Ordinance would create a demonstrated hardship (convenience, profit or caprice shall not constitute undue hardship); ZBOA 2003-1 4. That the demonstrated hardship is not self-imposed; 5. That the variance, if granted, will not adversely affect the proposed development or use of adjacent property or neighborhood; 6. That the variance, if granted, will not change the character of the zoning district in which the property is located; 7. That the variance, if granted, is in keeping with the intent of the Ordinance; and 8. That the variance, if granted, will not adversely affect the health, safety or welfare of the citizens of Wylie. Considerations: 1. Public Comment Forms were mailed as required by State Law to owners of twenty- two (22) properties within 200 feet of this request. One Comment Form, opposing the requested variance, had been returned at the time of this posting. 2. State Law vests the right to development the property according to the dimensional requirements of the Zoning Ordinance in force at the time of platting. The subject lot, as constituted by the illegal transfer by deed of a portion to the adjacent lot, is smaller than either the previous or current Ordinances allow, but the earlier changes in zoning cannot render the lot unbuildable (which would be confiscation without compensation). Some interpretation or variance of the code regulations must allow construction of a residence totaling at least 1,700 square feet and including a two-car garage on the lot. However, the applicant has not demonstrated that a compliant residence cannot be constructed on the subject property as currently (although illegally) configured. 3. Staff has suggested that the applicant replat the property in order to make it a legally conforming lot of record, and the requested variances anticipate such replatting and enforcement of the current setback requirements. However, such replatting cannot be required of the applicant because it will necessitate the approval of the owner of Lots 9A and 10 as well, and such approval had not been obtained at the time of posting. a. As currently configured and until the lots are legally replatted, owners have vested right to build according to the setbacks of the Zoning Ordinance in force when the lots were originally platted. It is now unclear what specific regulations were in place when these lots were created by platting. However, the immediately previous Zoning Ordinance, adopted in 1985, required front and rear yards of 25 feet and side yards of 6 feet. Applying these regulations, variances are required of only front, rear and north side yard setbacks in order to accommodate the proposed development. The requested front yard variance is 100 percent and amounts to a waiver rather than a variance, the requested rear yard variance is 15 feet or 60 percent, and the north side yard is 6 inches or 8 percent. ZBOA 3-1 b. If and when the lots are rplttd, all new development must comply fully with the setback regulations of the current Zoning Ordinance. The current request assumes replatting and requests variance to the south side yard setback as well as to the north side yard, front and rear yards. If replatted, the requested front yard setback is the same 100 percent and the rear yard variance is the same 60 percent, the north side yard variance will be one foot 6 inches or 21 percent and the south side yard setback is 7 inches or percent. 4. Due the wider than normal 70 feet right-of-way of First Street, the 25 feet front yard setback would locate the house 47 feet from the existing curb and street. The requested variance would allow the house to located on the front property/right-of- way line, providing a 22 feet drive, sufficient to allow a parked vehicle off of the street (although within public street right-of-way). The planned new house also anticipates a side-swing driveway, which creates a car court for additional off-street parking. First Street has recently been repaved, and it is not likely that the extra right-of-way will be required for widening in the future. 5. The existing residence to the south side was constructed with an 11 feet front yard setback and a four feet six inch north side yard setback. Records cannot confirm whether this house was located according to code requirements. The requested variance of the side yard on the subject lot will still provide a distance of 10 feet between the new house and the existing one to the south, as required by Fire code. 6. In its current undeveloped state, the subject lot provides limited revenue to the City of Wylie and Wylie Independent School District. If improvements are added to the lot, whether in full compliance to the code or allowed by some degree of variance, tax revenues will be increased. Construction of a residence on this vacant lot could also stimulate redevelopment of this aging, although stable, neighborhood. 7. Existing mature trees provide both public and private benefits, which once lost, cannot soon be replaced by new landscaping. These benefits include added aesthetic appeal and economic value as well as improved air quality and water quality and savings from energy and water conservation. For these reasons, the City of Wylie development codes encourage, but cannot require without compensation, the preservation of trees during new development. However, other mature trees are located on the subject infill lot, which will be lost to the proposed development. From the rear build line a 15 foot variance in lieu of the current twenty five foot restriction. 2. A one/half foot variance on the South side of the lot to aliow a setback of six feet five inches. Our neighbor to the South is approximately four feet eight inches off the line. A one foot four inch variance on the north side allows a setback of five feet six inches. The house on the property to the north is fifteen feet from the property line. 3. Nicholson Location: 409 Kylie Lane, being Lot 23, Block E of the Point North Phase II Addition Request: Variance of Section 2 . . b) of the 1985 Zoning Ordinance to decrease the required side yard off of an easement from 5 feet to feet Background: The subject property was created in May of 1987 by the platting of the Phase Ii of the Point North Addition. A gas transmission line runs along the south of the lot, and a 15 feet wide easement (half of the total easement width) was platted along the south property line. Subsequently, the side and rear yards (including the gas easement were enclosed by a fence and a swimming pool was constructed within the rear yard. Section 215 of the Texas Local Government Code provides that improvements comply with lot dimension regulations in effect at the time property is platted. Section 2 . . 1 b of the 1985 Zoning Ordinance, in affect when the subject property was platted, requires that accessory buildings be "not less than five feet from any side lot line, alley line, or easement line". This stipulation that side yards be measured from easements is specific to accessory buildings, and main structures may be located on easement lines (although no structures can be located within easements). The applicant wishes to construct an accessory building on the easement line in order to save an existing tree and to keep the new building 15 feet from the existing pool. The accessory building will be used for storage and not related to the pool functions. If located as proposed, it will be 15 feet from the side lot line and 28 feet from the house. ZBOA 2003-2 Section 8.4 of the Zoning Ordinance provides that the Zoning Board of Adjustment may permit a variance to the requirements of the Zoning Ordinance if the variance is not contrary to the public interest and, due to special conditions of the site, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the Ordinance is observed and substantial justice is done. The Board may impose any reasonable conditions on the issuance of a variance and may amend the variance from that requested. The concurring vote of 75 percent of the members of the Board shall be necessary to reverse any order, requirement, decision or determination of any administrative official, or to decide in favor ofth applicant to effect any variance in the Ordinance. This section further states that in order to grant a variance to the Ordinance, the Board shall find that all of the following have been satisfied: 1. That there are unique physical circumstances or conditions of the lot, or other exceptional physical conditions particular to the affected property; 2. That because of these unique and exceptional circumstances, the property cannot be reasonably developed or used in compliance with the provisions of the Zoning Ordinance; 3. That due to such unique and exceptional circumstances, the strict application of the Ordinance would create a demonstrated hardship (convenience, profit or caprice shall not constitute undue hardship); 4. That the demonstrated hardship is not self-imposed; 5. That the variance, if granted, will not adversely affect the proposed development or use of adjacent property or neighborhood; 6. That the variance, if granted, will not change the character of the zoning district in which the property is located; 7. That the variance, if granted, is in keeping with the intent of the Ordinance; and 8. That the variance, if granted, will not adversely affect the health, safety or welfare of the citizens of Wylie. Considerations: 1. Public Comment Forms were mailed as required by State Law to owners of thirty- three 3 properties within 200 feet of this request. One Comment Form, favoring the variance, had been returned at the time of this posting. 2. The accessory building will comply with all code requirements, with the exception of its location in relation to the easement. The requested arian allow the building to be placed on the easement line, or a 100 percent waiver of the required 5 feet side yard from easementsas required by the previous Ordinance in effect when the lot was created. 3. The current Zoning Ordinance does not require the setback from the easement, and the accessory building could be legally located as proposed. ZBOA 2003-2 . A windshield survey indicates that at least two other accessory buildings and a play apparatus of comparable size have been constructed within this gas easement in the immediate vicinity of the subject property. There are no records to indicate whether official variances were provided for this other construction. . The City of Wylie recognizes the significant environmental and economic values of trees, and Section 7.6 of the current Zoning Ordinance encourages but not require the preservation of trees during development. The tree on the subject property which the applicant desires to save is a small oak which was planted by the applicant.
