SIGN INTERPRETATION OR OTHER SPECIAL ASSISTANCE FOR DISABLED ATTENDEES MUST BE REQUESTED 48 HOURS IN ADVANCE BY CONTACTING THE CITY SECRETARY'S OFFICE AT 442-8100 OR TDD AT 442-8170. • Cof-Wylie Public Hearing Item No. 1 ZBOA No. 2003-03 Zoning Board of Adjustment Public Hearing: April 28, 2003 Owner/Applicant: Coral Watkins Location: 313 South Third Street, being Lot 3, Block 7 of the Bostic Addition Request: Variance of Section 3.3.A of the Zoning Ordinance to decrease the front yard from 25 feet to 6.47 feet Background: The subject property was created in 1954 by the platting of the Bostic Addition. The residence was constructed with a single-car garage, apparently allowed by the Zoning Ordinance in force at the time. A front yard of twenty-five (25) feet was probably required at the time of platting, although the existing residence and garage were constructed nearly thirty (29.8) feet from the front property line. The property is currently zoned Single Family 8.5 (SF-8.5) District, which also requires a front yard of 25 feet. The applicant reports that the existing garage is too small for current vehicles, and wishes to construct a single-car carport to the front of the garage. The new carport will be approximately six and one-half (6.45) feet from the front property line, a variance of 18.55 feet or 74.2 percent from the required 25 feet front yard. Most of the residences in the area were originally constructed with single-car garages, although some were built with no garages. Carports have been added in front of the single-car garages of two residences across Third from the subject property. At least two other residences along this block-length have attached carports and at least three garages have been converted to other uses with no accommodation for covered or enclosed parking. ZBOA 2003-03 Section 8.3 of the Zoning Ordinance provides that the Zoning Board of Adjustment may permit a variance to the requirements of the Zoning Ordinance if the variance is not contrary to the public interest and, due to special conditions of the site, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the Ordinance is observed and substantial justice is done. The Board may impose any reasonable conditions on the issuance of a variance and may amend the variance from that requested. The concurring vote of 75 percent of the members of the Board shall be necessary to reverse any order, requirement, decision or determination of any administrative official, or to decide in favor of the applicant to effect any variance in the Ordinance. This section further states that in order to grant a variance to the Ordinance, the Board shall find that all of the following have been satisfied: 1. That there are unique physical circumstances or conditions of the lot, or other exceptional physical conditions particular to the affected property; 2. That because of these unique and exceptional circumstances, the property cannot be reasonably developed or used in compliance with the provisions of the Zoning Ordinance; 3. That due to such unique and exceptional circumstances, the strict application of the Ordinance would create a demonstrated hardship (convenience, profit or caprice shall not constitute undue hardship); 4. That the demonstrated hardship is not self-imposed; 5. That the variance, if granted, will not adversely affect the proposed development or use of adjacent property or neighborhood; 6. That the variance, if granted, will not change the character of the zoning district in which the property is located; 7. That the variance, if granted, is in keeping with the intent of the Ordinance; and 8. That the variance, if granted, will not adversely affect the health, safety or welfare of the citizens of Wylie. Considerations: 1. Public Comment Forms were mailed as required by State Law to owners of thirty- five (35) properties within 200 feet of this request. At the time of this posting, two Comment Forms had been received, both favoring the variance. 2. The property may be legally developed to the regulations in force in 1954 when the property was initially platted. While the off-street parking regulations in force at the time of platting cannot be substantiated today, it is concluded from neighboring properties that only a single parking space was required with no regulation that it be covered or enclosed. The proposal will still provide an enclosed parking space within the garage as well as an additional covered space. The variance will also allow off-street parking with no encroachment on to public street right-of-way. ZBOA 2003-03 3. The requested variance is consistent with the treatment of off-street parking for other residences within the vicinity. Added carports exist across the street from the subject property and others exist within two blocks. 4. In January of 2003, the Board approved a similar variance on Jackson Street allowing construction of a carport six (6) feet from the front property line. In that earlier case, the garage was to be converted to a workshop and the carport was to be the only covered off-street parking. For the current subject request, the garage is to remain available for parking of an additional vehicle.
