Consider and act upon approval of the Minutes of the January 24, 2005 Meeting. A motion was made by Mr. Ellis, and seconded by Mr. Bullock, to approve the minutes as submitted. Motion carried 6 — 0. SWEARING IN OF ADJUDICANTS Mary Bradley, Secretary, administered oath. ZBOA Commission Meeting February 21, 2005 Page 2 of 4 PUBLIC HEARING 1. Hold a public hearing to consider and act upon a request by Terry Rowe for a variance to Section 2.5.4(b) of the Zoning Ordinance to allow an accessory building (horse barn) on a 5 acre agricultural tract without a main structure, this property being located at 1500 Kreymer in the Francisco de la Pina Survey. (ZBOA Case No. 2005-04). Thompson stated that the property is zoned Agriculture, and is five acres in size. The owner proposes to construct an accessory agricultural building (horse barn/personal stable) of approximately 1,150 square feet. Currently, no residential dwelling or main structure is on the property. The proposed accessory building complies with Section 5.3 of the Zoning Ordinance of the area requirements in Article 3 — Residential District Regulations. Toni Rowe, 2117 Shari Lane, Garland, Texas, represented the applicant, stated that a home will be built on the subject property once property in Garland is sold. Intention is to purchase horses to raise and have a building for the horses to be kept. The building will remain after construction of the residence, thereby defined as accessory. The barn will be built to the side of existing tank on the property which is 200 feet off Kreymer, and will meet all required setbacks. Troy Rowe, 2938 Jamestown Drive, Wylie, Texas, son of the applicant, stated that the accessory building will comply with regulations set forth for accessory building, and have a composite roof. A motion was made by Ms. Sargent, and seconded by Mr. Herzog, to GRANT the variance to allow an accessory building without a main structure. Motion carried 5 — 1, with Mr. Bullock voting in opposition. 2. Hold a public hearing to consider and act upon a request by the City of Wylie for a variance to Section 5.5(A) Temporary Uses of the Zoning Ordinance to extend the maximum 90 day temporary time period to three (3) years to allow for a portable building to expand office space, this property being located at 2000 Highway 78 North, Abstract No. 688-2, Tract 195 of the Francisco de la Pina Survey. (ZBOA Case No. 2005-05). Thompson requested that both item 2 and 3 be tied together, although the request is for two different sites the purpose for variance and the applicant are the same. The Board Members voted in agreement. ZBOA Commission Meeting February 21, 2005 Page 3 of 4 3. Hold a public hearing to consider and act upon a request by the City of Wylie for a variance to Section 5.5(A) Temporary Uses of the Zoning Ordinance to extend the maximum 90 day temporary time period to three (3) years to allow for a portable building to expand office space, this property being located at 949 Hensley Lane, Abstract No. 193, Tract 5 of the I. Clifton Survey. (ZBOA Case No. 2005-06). Thompson stated that the purpose of the requests is to allow temporary buildings in excess of the 90 day time limit on both of the subject properties. The office spaces are now crowded and expansion of permanent facilities are in the planning stage. Temporary offices will assist in providing services in an effective manner until permanent facilities are completed. At this time, no timeframe for when the permanent facilities will be available, however, the portable building will be utilized for no more than a three (3) year period. Public Comment Forms were mailed out to all property owners within 200 feet of the requests, and no comment forms were returned. Mindy Manson, Assistant City Manager of the City of Wylie, 2000 Highway 78 North, stated that the city is aware of the public perception and desired to review alternatives to balance provision of services and meet with our own code, at the same time provide adequate office space for employees. Providing the temporary buildings is the best alternative, cost effective and efficient for the city. The police department is overcrowded and the logical expansion is to the part of the building that is immediately next door. In order to expand there, representatives from three different departments, including the building inspection, engineering with the utility inspectors, and the public service director will be located within the two temporary buildings. The temporary building, which will be located behind the municipal complex, will house the building inspection department. The temporary building, which will be located at the service center off Hensley will house the engineering, utility inspectors and public service director. Mark Roath, City Manager of the City of Wylie, 2000 Highway 78 North, stated that the city is in dire need for expansion, the city did not have the funds to build some years back, and because of the tremendous growth that has occurred over the last few years, there is a lot of pressure on the city to provide services. Providing quality service to the citizens of Wylie without spreading the employees out all through the city was more appealing than sending one department at one location and another department at a different location. ZBOA Commission Meeting February 21, 2005 Page 4 of 4 Mr. Roath detailed the other alternatives to provide adequate office space for employees. For example, remodeling the council chambers into office space, which is not feasible because it would limit space for citizens attending public meetings by at least one-third or one-half. Another alternative was the private sector, leasing office space at another location, but the bid was not cost effective. Mr. Roath further explained the reasoning behind placing the building department, engineering, utility inspectors and public service director in the specific proposed temporary buildings. He also explained in detail the memorandum attached with the report addressed to the City Council regarding a needs assessment survey performed by a consultant, proposes four different options, and one of the options is a plan for a new facility possibly completed in the year 2007. The request for a variance for the use of temporary building will stop at 36 months and put a time limit on how long the temporary buildings will be allowed to be leased and placed on these properties. Mr. Roath stated that the buildings will be constructed out of stucco which will closely resemble the existing buildings. The temporary buildings will provide a small cushion to house additional employees, if the need arises. Realistically constructing buildings will take three years, nine to eleven months to plan, two months to bid, one month to mobilize, twelve to fourteen months to construct, one to two months to resolve any problems before actually moving into the facility. A motion was made by Ms. Sargent, and seconded by Mr. Ellis, to GRANT both variances to allow temporary buildings at 2000 Highway 78 North (ZBOA 2005-04), and 949 Hensley Lane (ZBOA 2005-05), for 36 months. Motion carried 5 — 1, with Mr. Bullock voting in opposition. Layne LeBaron, Chairman Ma Bra ey, Secretary Public Hearing Item No. 1 PI/telly of„lie ZBOA No. 2005-07 Zoning Board of Adjustment Public Hearing: April 25, 2005 Owner/Applicant: Glen Chancellor Location: 1750 McMillen Road, Tract 1-4, Abstract No. 688-5. Request: Interpretation of and Variance to Section 2.5.4e of the Zoning Ordinance regulating the exterior wall material of accessory buildings. Background: The subject property was initially created in 1993 by platting of McMillen Farms, which was later renamed by replat to the McMillen Estates Addition. This is a subdivision of rural estate lots and farms, and the subject lot is 2.1805 acres in size. The applicant desires to construct an accessory building in the rear yard of the subject lot, and is seeking clarity of the regulations and a variance if necessary to construct the structure with exterior walls of synthetic siding (Hardiplank). When initially created, The McMillen Farms subdivision was zoned as Single-Family Residential (SF-1), for lots of 10,000 square feet and larger under the 1985 Zoning Ordinance. This zoning classification was converted to Single-Family-10 (SF-10) Residential District with the City-wide revision of the Zoning Ordinance and Map in November of 2001. Larger lots are permitted in residential subdivisions. In 1999, building materials for larger accessory buildings on such larger rural lots were unregulated. The Building Official has ruled that, since the lot is zoned Single-Family-10 Residential rather than Agriculture, these current regulations apply: 1. no more than 2 accessory buildings are allowed; and 2. exterior wall materials must be the same masonry content required of the main residence (75% masonry). The applicant argues that: 1. The size of the lot complies with the Agriculture District, although it is zoned Residential, and the lot and future accessory building are agriculture in function and character, and should be exempted from the masonry wall requirement. ZBOA 2005-07 Section 8.4 of the Zoning Ordinance provides that the Zoning Board of Adjustments may decide appeals where it is alleged to be an error of law in any requirement of the code or determination of an administrative official, and may permit a variance to the requirements of the Zoning Ordinance if the variance is not contrary to the public interest and, due to special conditions of the site, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the Ordinance is observed and substantial justice is done. The Board may impose any reasonable conditions on the issuance of a variance and may amend the variance from that requested. The concurring vote of 75 percent of the members of the Board shall be necessary to reverse any order, requirement, decision or determination of any administrative official, or to decide in favor of the applicant to effect any variance in the Ordinance. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. The applicant is specifically requesting that the Board rule on the following: 1. That the lot be defined as Agriculture (based on its 2 acre size and rural character) rather than as Residential (based on its zoning), and thereby allow the exemption of Section 2.5.4.e(3) that barns be exempted from the masonry requirement for exterior walls; or 2. that, failing the above interpretation, a variance be granted to allow the accessory structure to be constructed of synthetic siding rather than masonry. ZBOA 2005-07 Considerations: 1. Under the City of Wylie Zoning Ordinance, Agriculture is normally a temporary holding district applied until appropriate urban uses can be determined. Both the previous and current Zoning Ordinances define Agriculture as requiring a minimum lot size of one (1) acre or larger. The subject lot is 2.1805 acres in size. 2. All lots within the McMillen Farms Estates Addition, including the subject lot, exceed one acre in size (the threshold for defining as Agriculture). This property could have been legally platted and developed within the Agriculture District, as was lot 10 of the Addition on its western end and the neighboring Lake Ranch Estates, and as such would allow by right the interpretation requested by the applicant. Why the area was zoned Residential rather than left as Agriculture is not currently known. 3. Other existing accessory buildings in the vicinity have metal or wood siding, differing from the masonry walls of their residences. 4. In August of 2004, the Board approved a similar request adjacent to the subject property. 5. When the current Zoning Ordinance and Map were adopted in 2001, it was the philosophy that the allowed uses and development requirements remain as similar as those that were in place by the previous Ordinance, and zoning classifications were merely converted to the new Districts. Therefore, the lot sizes within the subject subdivision with its Single Family - 1 Residential classification was not questioned but merely converted to the nearest new classification of Single Family - 10. 6. Public comment forms were mailed out to ten (10) property owners within 200 feet of this request, as required by State Law. Two comment forms were received in favor of the request at the time of this posting. 7. The Board may approve the variance, deny the variance or approve a substitute variance less than that requested. Request: Variance to Section 4.3.A.3 of the Zoning Ordinance regulating the setback requirements for the Industrial District from the required fifty feet setback to twenty- five feet setback, and the rear setback from the required twenty-five feet to ten feet and the side yard from the required twenty-five feet to ten feet setback. Background: The subject property has been platted since 1986 as Lots 20 and 21, of the Wyndham Estates Phase III Addition, and is zoned Industrial (I). The applicant desires to replat the two lots into 1 single lot, which would cause the subject property to loose all vested rights to previous code regulations and would require conformance with the current Zoning Ordinance. The applicant requests a variance to change the currently required 50 feet front setback to 25 feet, the required 25 feet side yard setback to 10 feet and the required 25' rear setback to 10 feet. The 1985 Zoning Ordinance, under which the subject property was platted required a front yard set back of twenty (20) feet for Industrial zoned districts. These setback requirements were changed with the City-wide revision of the Zoning Ordinance in November of 2001, which increased the required front yard setback to 50 feet and the rear and side yards to 25 feet. Section 8.4(E)(4)(b) of the Zoning Ordinance provides that the Zoning Board of Adjustments may permit a variance to the requirements of the Zoning Ordinance if the variance is not contrary to the public interest and, due to special conditions of the site, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the Ordinance is observed and substantial justice is done. Considerations: 1. Comment Forms were mailed to sixteen (16) property owners within 200 feet of the subject property, as required by State Law. Two comment forms were returned, one favoring and one in opposition of the requested variance. 2. When platted, the area complied with the prevailing trends of industrial development and existing zoning regulations. However, these trends have changed, making the previous code and existing platting obsolete. 3. The subject property totals 0.367 (16,009 square feet) acres in size. It is proposed to construct a 1,500 square feet office/warehouse facility, resulting in 9% of the lot being covered. The Zoning Ordinance allows a maximum lot coverage of 50%. 4. The new construction will comply with all requirements of the current Zoning Ordinance, with the exception of any variances allowed for setbacks. Exterior walls will be two types of masonry. Landscaping exceeds the current requirement and loading areas are screened from the street. (see Site Plan) 5. In October of 2004, the Board approved a similar request within the same subdivision. 6. Request: Variance to Section 4.4 of the Zoning Ordinance regulating the exterior building material for a nonresidential use in a residential district to allow a stucco-like metal panel in lieu of the required masonry finish. Background: The proposed development is a new 45,000 square feet storage/maintenance facility for the Wylie Independent School District. The building will be constructed to the rear (east and south) of the WISD Intermediate School and Administration offices. The applicant is requesting a variance to allow the use of a Stucco covered metal panel wall system (see brochure) to satisfy the exterior masonry requirement. The Subject property is part of the Caldwell Estates Addition in the Allen Atterberry Survey. A Preliminary Plat was approved in March 2005 that replatted 51 lots in to one single lot. This Maintenance Facility is designed for Future Expansion as the District grows and maintenance needs increase. The applicant states that at the time of expansion, the metal wall panels can be removed, stored and reused on the new exterior walls, unlike laid-in-place masonry units thus saving on cost and resource depletion. (See attached letter) Section 8.4(E)(4)(b) of the Zoning Ordinance provides that the Zoning Board of Adjustments may permit a variance to the requirements of the Zoning Ordinance if the variance is not contrary to the public interest and, due to special conditions of the site, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the Ordinance is observed and substantial justice is done. The Board may impose any reasonable conditions on the issuance of a variance and may amend the variance from that requested. The concurring vote of 75 percent of the members of the Board shall be necessary to reverse any order, requirement, decision or determination ZBOA 2005-09 of any administrative official, or to decide in favor of the applicant to effect any variance in the Ordinance. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Considerations: 1. Comment Forms were mailed to seventy-five (75) property owners within 200 feet of the subject property, as required by State Law. One comment form was returned at the time of this posting, favoring the request. 2. The subject property totals 60.403 acres in size. The subject building will be partially screened from public streets and neighboring properties by the other WISD buildings. 3. The Zoning Ordinance requires that the exterior walls of nonresidential buildings be "100% masonry, including brick, stone, cast stone, decorative concrete or stucco." Stucco is defined as a masonry substance troweled on to a supporting lath material. This regulation controls the exterior finish of the wall, rather than the structural elements. The applicant proposes to use a composite material consisting of a stucco material affixed to a metal backing. The Building official has ruled that the material does not comply with the definition of masonry or stucco. 4. The material must comply with the Building Official's interpretation that it and its installation have the same demonstrated durability as masonry. The attached information includes the citations of several tests performed on the material, and it is provided a warranty of twenty (20) years. ZBOA 2005-09 5. The proposed building system provides a flexibility which allows its reuse unlike unit masonry, thus providing potential cost savings. 6.
