PARTICIPATION IPATIO No one was present to speak. CONSENT AGENDA 1. Consider and act upon approval of the Minutes of the February 24, 2003, Meeting. A motion was made by Mr. Morman, and seconded by Mr. Alexander, to recommend approval of the minutes as submitted. Motion carried — O. PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Coral Watkins for variance to Section 3.3.A of the Zoning Ordinance in order to reduce the front yard from the required twenty-five feet to six (6.47) feet, this property being located at 313 South Third Street and being Lot 26 of Block I in the Bostic Addition. (ZBOA Case No. 2003-03) Thompson stated that the subject property was created in 1954 by the platting of the Bostic Addition. The residence was constructed with a single-car garage, apparently allowed by the Zoning Ordinance in force at the time. Other residences in the vicinity have single-car garages and some have carports either as part of the original construction or added. ZBOA Commission Meeting tin April 28, 2003 Page 2 of 2 The applicant reports that the existing garage is too small for current vehicles, and wishes to construct a single-car carport to the front of the garage. The new carport will be approximately six and one-half (6.45) feet from the front property line, a variance of 18.55 feet or 74.2 percent from the required twenty-five front yard. The proposal will still provide an enclosed parking space within the garage as well as an additional covered space. The variance will allow off-street parking with no encroachment on to public street right-of-way. Thirty-five property owners were mailed Public Comment Forms as required by State Law to owners within 200 feet of this request. Eight Comment ent Forms have been received, and all favoring the variance. Coral Watkins, 313 S. Third, Wylie Texas, the applicant, stated that the intention is to have two (2) parking spaces, one in the enclosed garage and the other under the carport. Ms. Watkins stated that her vehicle, a Tahoe, will not fit in the garage, but would fit under a carport. Mr. LeBaron asked if the variance stays with the structure or lot should the current residence and carport be replaced with a new residence. Thompson stated the variance is not to a code requirement such as the carport but a dimensional variance for the front setback, therefore! the variance would not apply for another structure. A motion was made by Mr. LeBaron, and seconded by Mr. Norman, to grant the variance in order to reduce the front yard from the required twenty-five 2 feet to six feet. Motion carried — O. Davidson Survey, Abstract No. 266 Request: Variances of Section 5.E of the Sign Regulations to allow 1 a sign to project from an exterior wall not within the DTH; and 2 the projecting sign to be ten and eight-tenths (10.8) square feet in size rather than the allowed four sq. ft. and to project a distance of four (4) feet rather than the allowed three 3 feet; and 3 a sign/logo monument to project above the wall distance of sixty-four inches rather than the allowed maximum of zero inches; and 4) an increase in the size of attached signage from the allowed maximum of sixty square feet to one hundred 1 square feet Background: The applicant desires to construct a new Chihis restaurant at the northeast corner of F.M. 544 and Westgate Way. The property will require the approval of a subdivision plat and a site plan prior to the initiation of construction. However, certain signs planned for the building do not comply with the Sign Regulations, adopted by the City Council on August 27, 2002, and have not been accepted by the Building Official. ZBOA 2003-04 The Sign Regulations allow projecting signs (any sign except awnings with one end attached to the building and projecting perpendicularly from the wall) only within the central Downtown Historic District (DTH). Projecting signs within the DTH are limited to four square feet per sign face and may not project more than three 3 feet from the building face. The applicant is requesting a variance to allow an illuminated neon projecting sign above the "Chili's-To-Go" entry of the building, on property not located within the DTI. The requested sign will be ten and eight-tenths (10.8) square feet (a variance of 6.8 sq. ft. or 170%), and will project four feet from the wall variance of 1 ft. or 33.3%). The sign must be mounted at least twelve (12) feet above the sidewalk. The Sign Regulations limit signs attached to single-tenant buildings to total of no more than seventy-five hundredths (0.75) square feet for each linear foot of building. The proposed building is approximately eighty feet in width, allowing a total area sixty 0 square feet for attached signs. The applicant proposes two attached signs on the front wall of the building which total approximately 100 square feet: a proprietary/ownership "Chili's" sign mounted flush against the wall of forty-four (44) square feet; and a chili pepper-shaped monument or art-work measuring approximately fifty-five 5 square feet mounted on the covered entry. This represents a variance of 40 sq, ft. or 66.7%. Section 3.l i of the new Sign Regulations (adopted August 27, 2002) provides that appeals of the provisions of the Sign Regulations shall be heard by the Zoning Board of Adjustment. Unlike other considerations by the Board, a simple majority of the Board in favor of the variance is required to approve any variance, and no proof of hardship is required to grant a variance. However, like all other considerations of the Zoning Board of Adjustment, Board, the decision of the Board of Adjustment shall be final with appeals being directed to the District Court. In considering a variance request, the Board shall consider the following criteria: • the variance maintains the spirit and purpose of the Sign Ordinance; • the effects of the variance on the protection of public safety and welfare and of neighborhood property values; • the type of sign; • the degree of variance; • the reason for the requested variance; et the location of the sign and existence of other signs in the general area; • the duration of the requested variance; and • such other factors as they deem pertinent to the specific request. ZBOA2003-04 Considerations: 1. Public Comment Forms were mailed as required by State Law to owners of seven properties within 200 feet of this request as required by State law. No Comment Forms have been returned at the time of this posting. 2. The requested projecting sign is a total waiver of the regulation against such signs, except within the central Downtown Historic District. Such signs are allowed within the central area to maintain the historic design character of this pedestrian-oriented retail area, but are not allowed within other commercial districts because they obstruct the view to other signs, cause confusion of messages within the public- access areas and are potentially dangerous obstructions. The requested size of the projecting sign is nearly twice that allowed within the DTH area. Alternative designs to the projecting sign and the requested size are available which comply with the Sign Regulations. The sign could be mounted flush to the wall or on a canopy/awning, if messaging is limited to the business name and logo. A smaller sign, closer to the size allowed within the Downtown Historic District, could be considered. The applicant contends that the projection and size are necessary to separate and better direct traffic to the food take-out and walk-in entries of the building, because the linear shape and small size ofthe site limit internal circulation. 3. The requested combination of sign and monument/art work on the building front exceed the allowed size for attached signs. However, both the sign and the artwork each individually are within the allowed size limit. Alternatives include the use of smaller sign and/or artwork which more closely comply with the allowed size. If located on the ground, the artwork would not be defined as signage, and the wall-mounted sign is in compliance. 4. The Board may make a decision to approve the variances as requested, to disapprove or any combination or alternative of related designs. No hardship need be demonstrated and only a simple majority of th Board is required for action. ATTACHED SIGN REGULATIONS Unless otherwise specifically provided, the regulations set forth in this Section shall be applicable to all attached signs that are allowed under this Ordinance. All signs and their words shall be mountedparallel arallel to the building surface to which they are attached, and shall project no more than twelve inches (12") from that surface, except for Projecting and Marquee signs as allowed in Sections 5. E., and 5, F. Wall signs shall not extend above the wail or building surface to which the sign is attached. Banner signs shall not be utilized as permanent wall signs. A. Maximum Sign Area 1. Attached signs shall not exceed the following area schedules: a. An attached sign located at a height of thirty-six feet 3 ' or less is limited to o.75 square feet of sign area for each lineal foot of building frontage for a single tenant building, or lease space frontage in a tenant building, not to exceed three hundred (300) square feet. multiple g b. attached sign located above a height of thirty-six feet (36') shall be permitted an increase in maximum effective area. Awning Signs Awning Sign means any awning displaying a business name or logo. Awning Signs must meet the following regulations. 1. An Awning may extend the full length of the wall of the building to which it is attached and shall be no more than six feet in height and shall not be placed less than 8 feet above the sidewalk. 2. Artwork or copy on Awning Signs shall be limited to a business name and/or logo. 3. The artwork or copyfor an Awning Sign shall not exceed 20 percent of the area of the Awning and shall extend for no more than 60 percent of the length of the Awning. E. Projecting Signs Projecting Signs means any sign, except an Awning, which projects perpendicularly from a building and which has one end attached to a building or other permanent structure. Projecting Signs must meet the following regulations. 'I . Allowed only in the Downtown Historic District (DTH) 2. The maximum sign area for a Projecting Sign is 4 square feet per sign face. Projecting Signs may not project more than 3 feet, measured from the building face and shall not be closer than two feet from the back of the curb line. 3. The height of the Projecting Sign must be at least 12 feet above the sidewalk. 4. ProjectingSigns shall be compatible in design, shape, and material with the architectural and historic character of the building they project from. F. Marquee Signs Marquee Sign means any permanent structure which is attached to and supported ted by a building and which projects outward from the building and contains lettering or graphics which convey a message. Marquee Signs must meet the following regulations. I . Allowed only in the Downtown Historic District (DTH). 2. Marquee Signs shall be built as an integral part of the marquee and shall be Constructed of incombustible material. 3. Marquee Signs shall be limited to 50 percent of the area of the vertical surface of each face of the marquee. 4. The marquee on which Marquee Signs are attached shall not have a vertical height of more than six feet nor exceed 75 percent of the width of the building or store frontage. 5. The Marquee shall be at least 8 feet above the sidewalk. 6. Marquee Signs may be illuminated. CITY OF WYLIE SIGN REGULATIONS Page 1 . Marquee Signs shall be compatible in design, shape, and material with the architectural and historic character of the building. G. Canopy Sign Canopy Sign means any canopy displaying a business name or logo. Canopy Signs must meet the following regulations. 1. A Canopy Sign may be attached to, or be an integral part of the face of a canopy. 2. A Canopy Sign may consist of only the name and/or logo of the business at the location of the canopy. 3. The artwork or copy on a Canopy Sign shall not ex eed ten percent of the face of the canopy, or a maximum of twenty-five 2 square feet, whichever is greater. . An illuminated stripe may be incorporated into a canopy. The stripe may extend along the entire length of the face of the canopy. The width or thickness of the stripe shall be limited to one-third of the vertical dimension of the face of the canopy. The internal illumination of a canopy is limited to the portions of the canopy face on which a-sign or stripe is permitted. The applicant desires to construct an over-sized Model Home sign which is representative of the size, design and cost of the house product. The proposed sign does not comply with the Sign Regulations, adopted by the City Council on August 27, 2002, and has not been accepted by the Building Official. The Sign Regulations define Model Home Signs as temporary real estate signs identifying a h m b ild is model home for inspection by potential buyers. Such signs are limited to a maximum imum size of eight square feet per sign face and to a height of four feet from the finished grade. Model Home Signs shall be either Ground or Monument signs, incorporating the sign face into a base and/or frame as a coordinated design unit. The monumental frame and base is included when measuring the area of the Model Home sign. ZBOA 2003-05 The applicant is requesting a variance to allow a monumental Model Home Sign with an overall area of seventy-one and one-half square feet rather than the eight square feet allowed variance of 65.5 sq. ft. or 1 .75% . The face of the sign, enclosed within the monumental frame, is proposed to sixteen 1 square feet (a variance of 8 sq. ft. or 100%). The sign and monument is proposed to stand six and one-half feet height rather than the allowed four feet (a variance of 2.5 ft. or . % . Section 3.M of the new Sign Regulations (adopted August 27, 2002) provides that appeals of the provisions of the Sign Regulations shall be heard by the Zoning Board of Adjustment. Unlike other considerations by the Board, a simple majority of the Board in favor of the variance is required to approve any variance, and no proof of hardship is required to grant a variance. However, like all other considerations of the Zoning Board of Adjustment, Board, the decision of the Board of Adjustment shall be final with appeals being directed to the District Court. In considering a variance request, the Board shall consider the following criteria: • the variance maintains the spirit and purpose ofth Sign Ordinance; • the effects of the variance on the protection of public safety and welfare and of neighborhood property values; • the type of sign; • the degree of variance; • the reason for the requested variance; • the location ofth sign and existence of other signs in the general area; • the duration of the requested variance; and • such other factors as they deem pertinent to the specific request. Considerations: 1. Public Comment Forms were mailed as required by State Law to owners of two (2) properties within 200 feet of this request as required by State law. No Comment Forms have been returned at the time of this posting. 2. The requested sign, including its monumental frame and base, is eight times the allowed size for Model Home signs. The sign face alone is twice the allowed size. 3. As proposed, the location of the sign complies with the Sign Regulations n that it be placed no closer than ten (10) feet from the front property line. The proposed location will not obstruct the visibility of vehicular traffic along the adjacent streets. 4. Regardless of whether the variances are granted, the Model Home sign is temporary and will be removed before a Certificate of Occupancy is issued for permanent residency. Z O ► 2003-05 5. The Board may make a decision to approve the variances as requested, to disapprove or any combination or alternative of related designs. No hardship need be demonstrated and only a simple majority of th Board is required for action.
