WYLIE CITY COUNCIL AGENDA ITEM NO. 1 August 3, 1999 Issue Consider and act upon authorizing the City Manager to negotiate and award an emergency contract for the construction of sidewalk and drainage improvements on S. Ballard between Butler Street and Stone Road. »' Background As a part of the North Texas Municipal Water District (NTMWD) construction project on S. Ballard, it has been the City's intent to construct sidewalks on the east side of S. Ballard. To that end, staff has worked with the paving subcontractor on the project to attempt to optimize the timing of the concrete street work with the construction of the sidewalk in order to have the sidewalk completed prior to the start of school. In addition, the original plans for the project included improving the existing drainage ditch which runs between S. Ballard and First Street. The improvements called for constructing a concrete channel in order to accommodate the increased run-off that will be generated by the increase in pavement. One of the drainage projects approved with the 1999 Bond Election was to continue that improvement to the east between First and Second Streets. The NTMWD determined that the drainage work was beyond the scope of the water line project and eliminated it from the plans. Staff believes that the improvements are necessary to ensure the proper drainage in the area. The typical process for the advertising, review and award of bids takes approximately 6 weeks, which would delay the construction of the sidewalk and the drainage improvements until late September. The amount of pedestrian traffic on S. Ballard in such that it is critical that the construction of the sidewalks take place as close to the beginning of school as possible. The Texas Local Government Code sets out the competitive bidding requirements for municipalities. The Code provides for an exemption to the requirements in order for a municipality to make an expenditure for "a procurement necessary to preserve or protect the public health or safety of the municipality's residents". By authorizing the City Manager to negotiate and award an emergency contract for the installation of the sidewalk and drainage channel, the City Council will make it possible for the improvements to be in place as soon as possible. This action will provide for the safety of the students, parents, and citizens who live in and travel through this area Financial Considerations The construction cost for the sidewalk is approximately $30,000 and the cost for the drainage channel is approximately $20,000. Other Considerations Texas Local Government Code, Chapter 252.022 General Exemptions, grants municipalities the authority to by-pass the competitive bidding process in the name of preserving or protecting the public health and safety.
