Page of MINUTES Wylie City Council Worksession Tuesday, December 8, 1998 - 6:00 p.m. Wylie Municipal Complex-Council Chambers 2000 State Highway 78 North,Wylie Texas Call to Order Mayor Mondy called the City Council Meeting to order, Tuesday, December 8, 1998 at 6:00 p.m. with the following Councilmembers present: Joel Scott, Reta Allen,Lavern Ramsey, Merrill Young, and Chris Trout. Mayor Pro Tern Worley was absent. Staff members present were:Mike Collins,City Manager; Mindy Manson,Assistant to the City Manager; Brady Snellgrove, Finance Director; Tobin Maples, Planning Director; Greg MacLean, Hogan Corporation, Chris Hoisted,Hogan Corporation and Barbara Salinas,City Secretary. Worksession Update of Various Capital Projects North Texas Municipal Water District Water Transmission Main Construction-South Ballard Mr. Randal Dobbs,North Texas Municipal Water District, provided Council with an update on the District's Transmission Line. Mr. Dobbs gave an explanation of the placement of Main including the size and the sequence of events. He was then available to Council for questions. There was discussion on the issue of the trees and the number of trees that will impacted with this project. Mr. MacLean, Hogan Corporation, explained that attempts to save some trees could still cause damage to the root system and also that the digging equipment required will require a 20'clearance and this may cause tree damage as well. Mr. MacLean explained that the trees lost could be replaced in the parkway/median areas. There was discussion on the plans for driveway approaches and sidewalks. Council expressed concern regarding the provision of a sidewalk for pedestrians along south Ballard. Mr. MacLean explained the problems with the lack of right of way to provide sidewalks on both sides of Ballard and estimated approximately$18-20,000 per side. Mr. Collins stated that staff will need direction from Council on the design, and the issues of the trees and sidewalks. He also suggested that we develop a plan to advise the public of the project. Mr. Dobbs concluded the discussion stating that once initiated,the project is a 6-9 month project with approximately 4 months of a one- way detour and that he appreciated the partnership with the city and working with our staff. Provision of Sewer Service to Wylie Extra Territorial Jurisdiction Mr. Tobin Maples, Planning Director, Mr. Greg MacLean and Mr. Chris Holsted of the Hogan Corporation, addressed this item. They advised Council on the availability and options for future provisions of water and sewer to specific properties, some which are currently under consideration for annexation. Wastewater Treatment Plant Mr. Collins gave Council a brief update on the status of the Wastewater Treatment Plant. Mr. Greg MacLean addressed Council and offered information comparing the existing plant capacity versus a new plant and the potential it offers existing and future development. Wylie City Council Minutes December 8,1998 Page 1 Wastewater Treatment Plant-continued Mr.MacLean stated that this project has a two and a half to three year time line and introduced the Hogan team prepared to work on the project,including Mr. Larry Fuson,Mr. Chris Holsted, and Mr. Pat Hogan, all of whom have valuable work experience to offer this project. 1999 Bond Program-Potential Projects Mr. Collins addressed this item. He stated that if it is Council's desire to hold a Bond Election in late March, Council would need to form a Bond Advisory Committee with a time line of completion by February in order for ballot language to be prepared before the special election. The Mayor stated that Council would discuss the issue of a bond election after December. Adjournment. Mr. Collins reminded Council that the Meeting scheduled for December 15 is scheduled for 5:00 p.m. As there was no further business to come before the Council,the meeting was adjourned. Citizens Participation Mr.Gary Bowland,owner Ballard Street Cafe Mr.Bowland expressed his appreciation for the job well done by the Wylie Fire Department with regard to the downtown fires on Wednesday evening and Thursday morning. He also expressed concerns for the modification of building codes for historic preservation purposes. Mr.Conrad Boyer, 1819 Blake Drive,Richardson,Texas. Mr. Boyer spoke in opposition to the annexation of his property,Item No. 2 on the this evenings agenda. Mr. Charles Janish,Owner,Janish Inc. Mr.Janish restated his opposition to annexation of his property,Item No. 14,on this evenings agenda. He also expressed concerns regarding vandalism that has had no response from law enforcement agencies, including Wylie Police Department. Consent Agenda A. Approval of the Minutes from the Regular Meeting of October 27 and November 10, 1998 and the Joint Meeting of November 17, 1998. Councilman Scott made a motion to approve Consent Agenda Item A. Wylie City Council Minutes December 15,1998 Page 14 Mr.Maples stated that the final plat under consideration is the Lakeside Estates Phase I addition. The applicant is final platting 39.529 acres in order to develop the property with 146 single family lots. He stated that the development also incorporates one city park and one community park. The city park will incorporate soccer fields and off-street parking to be utilized by the general public. The community park incorporates a cabana,swimming pool,and off-street parking to be utilized and maintained by the Home Owner's Association(HOA). He stated that the property is currently vacant,unplatted,and zoned PD(Planned Development)for single family uses. Mr. Maples then addressed other considerations. He explained that staff has reviewed the proposed final plat and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City of Wylie. The applicant intends to utilize temporary off-site drainage easement along northern property line during the construction phase of this development. Mr. Maples stated that staff recommends that the plat be approved for construction subject to the applicant forwarding copies of said temporary easements to the Community Development Department. The applicant is aware and has agreed. Mr.Maples explained that when this case was heard by the Planning and Zoning Commission,the applicant had indicated that temporary off-site drainage easements would also be utilized along the western property line during the construction phase of this development. However,due to an inability to acquire said off-site easements,the applicant has incorporated a permanent drainage easement along the rear property line of Lots 1-12,Block D. Mr.Maples stated that staff does recommend approval of this easement subject to the note on the plat referencing a 6 foot rear building and fence line being corrected to indicate a 6 foot fence setback only. Mr. Maples stated that the zoning encompassing this property requires a 15 foot rear building line and,therefore, should not be reduced via the plat. Mr.Maples explained that the applicant has incorporated a landscape and berm plan along the southern property line parallel to the railroad right-of-way which will be part of the improvements built during the construction phase of this development and that plans call for a three (3) foot high berm with shrubs and trees planted in clusters on 100'-120' centers. Mr. Maples stated that the applicant is aware that the PD (Planned Development) zoning encompassing this property stipulates that secondary access shall be required for the development at the time one of the following three events occur. 1) Application for housing permits have been submitted for 50% of the lots within the Development Plan of Lakeside Estates Phase I or the Development Plan of Sage Creek Phase I; 2) At the time of submittal of any additional phases within the Lakeside Estates Concept Plan, approved by City Council on November 11, 1997;3) Two calendar years beginning with the date of adoption of the zoning encompassing this property (January 27, 1998). At the November 3, 1998, Planning and Zoning Commission meeting, the Commission recommended approval of this case. Marshall Survey,Abstract No.594,Collin County,Texas. Mr. Tobin Maples, Planning Director, addressed this item. Mr. Maples stated that the preliminary plat under consideration is for the proposed Winding Creek Estates subdivision. The applicant is preliminary platting 44.531 acres of land in order to develop the property with single family residential uses. He explained that the property is currently vacant,unplatted,and located within the City of Wylie Extraterritorial Jurisdiction(ETJ). Mr. Maples stated that Staff has reviewed the proposed preliminary plat and found it to be in compliance with the Subdivision Regulations and other pertinent ordinances of the City of Wylie except for cul-dec-sac length; Specifically, Section 5.04 B (13)(b)of the Subdivision Regulations states that no cul-de-sac shall exceed 600 feet in length. Mr. Maples stated that the applicant is requesting a variance to this requirement. Mr. Maples stated that in order to ensure emergency access to this development the applicant is proposing a divided entry and two(2)emergency access easements constructed in a manner suitable fore emergency vehicle traffic,while maintaining the appearance of a pedestrian greenbelt(see letter from applicant). Mr.Maples stated that preliminary water plans indicate water will be provided by Pecan Orchard Water Supply. Preliminary sewer plans indicate sanitary sewer service will be extended to this property from McMillen Road. Mr. Maples advised that this case was previously heard by the Planning and Zoning Commission at their December 15, 1998,regular business meeting citing reasons of emergency access,divided entry and emergency access throughout the plan. As a result, the Commission recommended denial. Mr. Maples stated that staff recommends approval. Council expressed concerns regarding Planning and Zoning's reasons for denial. The developer, Mr. Steve Toplitz,Representing D-R Horton, 310 East I30,Garland, Texas,was then available to address questions from Council. Mr. Toplitz explained the"coving"concept of the proposed plat. He stated that this is a unique concept that could be beneficial to public safety concerns,citing lower speed limits due to design. He stated that there would be no intersections,nor four way stops. He explained that if the emergency access is a concern,they would work with the public safety departments to resolve. He explained that this design allows 12,000' lots which speaks to lot size issues. The Mayor then asked Mr. Steve Ahrens to come forward. Mr. Maples then defined the platting procedures. He explained that if the preliminary plat was approved,the final plat would be reviewed by a development team before routing back to Council for their review. Mr. Ahrens stated five reasons for Commission denial - 1) large cul-de-sac; 2) only one entrance; 3) access easements; 4) 6' side yard set backs; and 5) width of road - 27'. Mr. Toplitz addressed these concerns. He pointed out on the plat an additional emergency access entrance between lots 77 and 78. Mr. Toplitz explained that the `coving' design specifically addresses speed limits and that a wider street would mean an increase in speed creating a public safety hazard and that the design also contributes to the lot size,however,the staggering of structures would ensure privacy between those homes. Mr. Toplitz stated that they would work with the Commission and Council to provide the type of development that meets the approval of both. Mr.Maples addressed this item. Mr.Maples stated that the applicant is requesting a Specific Use Permit(SUP) on.04 acres in order to establish a private club serving alcoholic beverages. Specifically,the applicant intends to open a restaurant in an existing building and is seeking the City's permission to serve alcoholic beverages to his customers. He stated that currently the property is part of a strip center zoned R(Retail) and developed accordingly with various retail and business uses. Please note that approval of the SUP does not authorize other businesses in the strip center to serve alcoholic beverages. Mr. Maples explained that should the Planning and Zoning Commission and City Council approve the request,the business under consideration will be the only unit in the strip center permitted to serve alcoholic beverages. Mr. Maples stated that Public Comment Forms were mailed to fifteen(15)property owners within 200 feet of this request. No Public Comment Forms have been returned. Mr. Maples then address other considerations. He stated that the Comprehensive Plan recommends retail, commercial,and business uses for the property. The proposed zoning is consistent with the Comprehensive Plan and compatible with the surrounding development. He stated that although the City of Wylie is encompassed by a dry designation, state statues allow alcoholic beverages to be served subject to the issuance of a private club registration permit by the Texas Alcoholic Beverage Commission. The applicant has been issued said permit from the Texas Alcoholic Beverage Commission. Mr.Maples stated that at the November 17, 1998,Planning and Zoning Commission meeting,the Commission voted by 5-2 to recommend approval of the request with the stipulations that the hours of business be from 11:00 am to 10:30 pm and that no open bar exist(service bar only). The Mayor then opened the Public Hearing asking that anyone who wished to speak either in favor of or in opposition to the Specific Use Permit to come forward stating their name and address for the record and limit their remarks to three minutes. Reverend Al Draper,First Baptist Church,Wylie. Rev. Draper spoke in opposition to the approval of the SUP citing alcohol as mood alternating,effecting judgement and physical coordination,location of access/egress to State Highway 78. Reverend Draper urges the Council to consider the welfare of the community and family and not grant this SUP. Mike Snyder, 144 Park. Mr. Snyder spoke in favor of approval of the SUP. He stated that he owns a business in the same area and knows the applicant. He stated that the applicant has not had any incidents at the Garland restaurant and that his establishment is a good family run operation. He asked Council to consider approval of their request. Mr.Luis Gillman,Carrollton,Texas. Mr.Gillman spoke in favor of approval of the SUP. Mr. Gillman stated that he has been a customer for three years and that the restaurant is family oriented business and asked Council to consider approval of the SUP. City Manager, Mike Collins addressed this item. Mr. Collins stated that the North Texas Municipal Water District (NTMWD) has awarded a contract for the installation of a 72-inch water main to be extended from its Wylie Water Treatment Plant to Mesquite and Garland, Texas. He stated that any street in which the water main will be installed through Wylie will be completely reconstructed to its original condition, including curb and guttering, driveway approaches and asphalt paving and that the NTMWD will pay the cost of the project. Mr. Collins stated that the City of Wylie also requested, in looking at the Ballard St. route, that the cost of a four lane divided concrete thoroughfare be issued for bid. He stated that a calculation was made for the Second Street route and compared with the actual bid amount for the Ballard Street route. He stated that Second Street would have cost$448,194 less than the Ballard Street option. Mr. Collins explained the financial considerations. He stated that the City of Wylie and the NTMWD will enter into an agreement based on the following terms. The City of Wylie will make 7 equal payments on or before October 15, in years 1999 through 2004. The first payment will be made on July 1, 1999 with the total amount financed being $667,764.00 or 7 payments of$95,394. Mr. Collins explained that in order to provide options to the City Council to finance the source of funds used to pay the NTMWD, staff is recommending that the Council approve a Reimbursement Resolution. He stated that this action would establish the intent to use proceeds from a future bond election, tentatively discussed for May 1999, to finance the South Ballard reconstruction and the South Ballard Street/Stone Road intersection. Wylie City Council Minutes December 15,1998 Page 19 He stated that this action in no way obligates the City Council or a Citizen's Bond Advisory Committee to use local bonds to finance the project, and that the action simply provides an option to finance all or a portion of the project. He stated that absent any local bond funds being used, the general and utility funds would split the costs paid to NTMWD. Mr. Collins concluded that the NTMWD and the City of Wylie will host a meeting in which all affected property owners, business owners and tenants will be invited to attend and that routine communication will take place throughout the duration of the construction. He stated that the NTMWD will be the owner of the project and the contractor will report directly to the Water District and all inspections will be facilitated by the District as well. Assistant to the City Manager, Mindy Manson reported that staff would be working with the Rotary Club in application for a grant for playground equipment to be used in Olde City Park,specifically the newly acquired area. During the November 11 Student Government Day, student Council representatives participated in a drawing to determine which Council Places would have either 2-year or 3-year terms in 1999 and 2000. Beginning in 2001, all Council Places will be elected to 3-year terms from that time forward. Financial Considerations N/A Other Considerations The City Attorney has reviewed the following information and recommends that election be held consistent with the voter's intent in adopting the Charter amendments. It should be noted that during the Charter Amendment Election, an amendment to Article 3, Section 1B was inadvertently omitted. Section 1B reads: All members of the city council, other than the mayor, shall be elected under the place system. At the first general election held under this Charter, and in each odd-numbered year thereafter, three (3) councilmen shall be elected, with the councilmen filling positions 1,3, and 5. Background Automating the Police and Fire Departments can benefit the City of Wylie in many ways, more efficiency, faster response by field units, increased safety for officers and citizens, improved statistical collection, and faster reporting. E-911 Systems have proven extremely beneficial in the area of emergency response. Achieving better results in public safety service delivery requires more than E-911. With the help of a computer system including computer aided dispatch, arrest records, accident reporting, citations, incident reporting, alarms, pawned property and more, we can achieve much more. What we are getting from E-911 When an E-911 call is received,the name, address and telephone number is displayed for the dispatcher. There is no means of automatically verifying or capturing this E-911 information. The dispatcher must manually record the following call for service information; incident number, time received, time dispatched, callers name, address, phone number, nature of the call, location of the call, officer assigned, time officer arrives,time officer clears, and pforttion wantsfand the wa , stolen call. rrants advehicles,dition, logs by the dispatcher such as; TCIC NCIC request or cleared, etc. Many calls for service don't come through the E-911 line and don't have the associated benefits. All data collection is done manually and associated with it are all the normal problems you can expect to have with a manual system. The majority of our paperwork begins with a call for service. The information is manually transcribed time and time again, until final disposition. The manual transfer of information is not only difficult, but very time consuming and hard to manage. The Wylie Police Department spends approximately 70 to 80 man hours a month to manually produce the following reports: Daily activity report, monthly activity report, TCIC/NCIC use report, Uniform Crime Report, traffic accidents, impounded vehicles and release, and alarms. All of these reports could be produced automatically with a computer system in a fraction of the time. Item for Individual Consideration CAD for Police Reporting System Page 1 What CAD with E-911 Linked, will Provide With the CAD system, a call for service through E-911 will be directed into the call taker dispatch computer terminal and the telephone number, name and address will be displayed just like on the current E-911 system. However, now the computer can automatically verify all aspects of the call and assist the dispatcher in dispatching the call as well as inform the dispatcher of possible cautions that should be passed on to the officers responding. The dispatcher will not have to do anything manually. If a call for service is received in another manner, such as, another phone line, walk-in, or officer initiated call,the CAD system will function virtually the same as an E-911 call. The dispatcher need only enter the callers' name or address and the CAD system will display the E-911 information stored in the CAD database. The E-911 CAD system can significantly decrease the amount of time required to dispatch Police, Fire or EMS, and maintain a higher degree of accuracy while doing so. For instance, the CAD system keeps track of the status of all Police, Fire and EMS units. It tracks units available on scene, en route to assignment, out of service, en route to office, off duty, etc. When a call is received, the computer can automatically recommend the unit assigned to cover that call area or if this unit is unavailable, the closest available unit to that call will be recommended. The call will automatically be prioritized in call sequence based on the call type, for example, a burglary in progress would have a higher priority then a loud noise disturbance and therefore the burglary in progress would be dispatched first. The dispatcher would be automatically notified if the call type or location address required special department orders be followed such as, notifying the Chief of Police, Tactical team required, Dispatch EMS, etc. For a fire call, the CAD system will recommend the appropriate response plan set up according to department proto calls. The fire call information can be printed in the fire station with a remote computer printer and video terminal. Citizen and officer safety can be increased. The CAD system can notify the dispatcher of cautions that the units responding could be concerned with such as: - Construction or repairs on a street hydrant at the address - Access to call address blocked by construction - Attack dogs on-site - Guard on duty 5:00 P.M. to 6:00 A.M. -Hazardous materials at location and information regarding nature and handling of the material - Violent subject handled before at this location - Wants and warrants for caller or other subject living at the address - Any prior history at that address The CAD system can track all calls for service and time stamp every change in status for each call, such as;time call was received, time dispatched, time units arrived on the scene, and time of final disposition of call. Special timers are set on each change in status to notify the dispatcher of excessive elapsed time for each status of a call. For example, if a dispatcher puts a low priority call in pending (waiting to be dispatched) we can set the CAD to remind the dispatcher of the pending call after 10 minutes has elapsed. Item for Individual Consideration CAD for Police Reporting System Page 2 What CAD with E-911 Linked,will Provide-continued Currently, if a dispatcher forgets about such a call, the only thing to remind the dispatcher is the citizen calling back to inquire. Using the manual system, an officer out for service for a long period may easily be overlooked. When the dispatcher takes a break or changes shifts it's easy to forget an officer was checked out somewhere. Again with a CAD system, each status change of a unit or officer will start a timer. If the status of the officer is not updated in a predefined time period, the computer alerts the dispatcher with visual signals. The dispatcher then knows to check on the officer or unit in question. Management Reporting The CAD system captures all relevant information about incidents. The records' management system allows us to obtain extensive management information that we currently cannot obtain or it is time intensive to obtain it. Examples: - Average Response Time to Emergency Calls This measurement is an industry standard used for bench marking in Police and Fire Departments. With a CAD system, average response times can be easily obtained in a few minutes. Currently the only way for us to obtain this information would be for someone to go through all our call cards manually, pulling out emergency calls and then compile the times for all calls and obtain an average. Obviously it would take one person days to manually obtain this information. - Crime Incident Data For example, if someone noticed several burglaries in a particular neighborhood, they could easily run a report and obtain information concerning the number of burglaries in that particular part of the City for the last four months and look for matching MO's. A person could run an address listing of the neighborhood looking for someone living in the neighborhood with a history of burglary. Currently, this kind of research would involve manually sorting though hundreds of offense reports. As the City grows, this type of crime analysis will become more and more critical. - Call Load Data With a CAD, one can quickly and easily print out reports detailing the days and times and areas containing the most workload. Manpower allocation can then be made with all relevant information. Again, obtaining this information manually is very labor some and time intensive. - Accountability Reports Reports can be run detailing precise times that officers were involved in a particular activity. Reports can also be run showing exactly how much time per day, week, month or year officers spend doing various activities. This is an extremely valuable tool when judging officer performance. Increased Efficiency Agencies that purchase their first CAD system usually recognize a definite increase in efficiency. The most notable being that dispatchers spend less time performing redundant clerical duties. Dispatchers may be able to either handle more calls, or spend more time with callers, or both. Dispatchers can work faster with more accurate information and fewer errors. This state of efficiency translates into improved productivity, improved morale, less sick leave, and higher per capita workload. The computer system will assume many of the demanding clerical tasks that plague a manual system. Item for Individual Consideration CAD for Police Reporting System Page 3 Management Reporting-continued The result is clearly a new dimension of efficiency for the incident entry and dispatching process. Because of the faster transfer of information between the caller and dispatcher the call reaches the field units faster. The system gives everyone more information,better information, and it give it to those who need it in time to make critical decisions. Financial Considerations Attached to this agenda item is a one page summary of the contract pricing for the proposed CAD & Police Record Systems and the funding sources needed to finance this project. The items listed as System Components are a one time cost and the items listed under Annual Maintenance will be recurring costs for each budget year. The one time costs under this contract for hardware, software and training is $242,798. The annual maintenance costs for hardware and software support is $45,842. Note that under Funding Sources, annual maintenance costs for hardware and software is only being funded for six months in FY1998-99. The ninety day system installation period will be maintenance free and only the final six months of fiscal year will subject to maintenance costs. The costs for hardware and software maintenance for this year will be $22,921. The hardware, software and training cost of$242,798 has already been financed through the issue of Tax Notes in September 1998. The debt service on the Tax Notes are being supported by an increase in 911 fees for each customer access line classification; residential, business and trunk line. The projected increase in 911 revenues used to support 911 systems was made on the 911 customer base as of May 1998. The increase in 911 rates were approved by the City Council in July 1998 and the new rates were first billed by the phone company on their September 1998 billing. In addition to funding the debt service on the Tax Notes, $22,921 in 911 revenues are being used to fund the annual maintenance charges for hardware and software for FY1999. Other Considerations After extensive research into Public Safety Computer Systems the 911 committee has chosen the Integrated Computer System (ICS). ICS is one of the more affordable systems available. Mainly because the ICS system does not have a lot of expensive bells and whistles. ICS has focused on doing the basics very quickly and accurately while staying user friendly. For example, dispatching a call for service with ICS involves entering an address, a call type, and one key stroke. Other systems require up to 21 key strokes to dispatch a call. ICS is based locally with an office in Richardson. All of the references checked have indicated that the service received from ICS was excellent. ICS has a very good reputation in Public Safety circles and their software has been utilized since the 1970's. I personally have had many years of experience with public safety software and have consistently observed that ICS users are much more satisfied with the system than users of any other system I have experienced. For the sake of price comparison, systems with more bells and whistles (but are usually less user friendly) one can easily spend in excess of$400,000. For me ICS is an easy choice and a good fit for the City of Wylie's needs. Background In October of 1996 a Public Safety Committee was formed to address the needs of the 911 dispatch center. Several technical systems were in need of replacement or would need to be replaced in the near future. Included were the police P.C. based reporting system, the 911 system, the Dictaphone recording system, and the high band radio system. The committee would also address all statistical information that was not being captured that would be beneficial in, but not limited to, planning, staffing, strategic managing, budgeting, agendas, and annual reports. The make-up of the committee was changed with the addition of the new Police chief and its charge was changed, by the City manager, to address city wide communications as well as the phone system. In 1997 the Council approved the replacement of the high band police/fire radio system with Plano's 800 radio system. In 1998 the Committee recommended and received approval from the City Council for the replacement of the 911 system, the telephone system at city hall, and funding for the new CAD and police reporting system. These 911 related systems are funded through 911 fees that are added to local phone bills. The 911 rates are adopted annually during the budget process. The committee supported the purchase of the fire records with the new CAD system. The wireless 911 fees were new and funding projections that would have facilitated the cost of the fire reporting system were not available. It was decided not bring it forward to the City Council until a more consistent funding history was available. The fire department 1998/99 budget does not currently have funding for the CAD fire reporting system or hardware/software maintenance. Currently the fire departments data collection capabilities are limited and performed manually. For example, response time averaging for the Annual Report require two personnel eight hours to calculate. The fire records system takes seconds to retrieve the same information. The ICS "Fire Records Management System" includes a number of record modules that would automate the records keeping system. The items listed as System Components are a one time cost and the items listed under Annual Maintenance will be recurring costs for each budget year. The one time costs under this contract for hardware, software and training is $82,352. The annual maintenance costs for hardware and software support is $13,643. Note that under Funding Sources, annual maintenance costs for hardware and software is only being funded for six months in FY1998-99. The ninety day system installation period will be maintenance free and only the final six months of fiscal year will subject to maintenance costs. The costs for hardware and software maintenance for this year will be $6,822. The hardware, software and training cost of$82,352 is being funded by a combination of seven year Tax Notes ($69,097), the new 911 Wireless revenues($10,984) received in FY1998 and the 911 revenues ($2,291)generated from the new growth in the 911 customer base in FY1999. The six months of annual maintenance ($6,822) is also being supported by the new growth in the 911 customer base. The debt service on the Tax Notes issued in September 1998 are being supported by an increase in 911 fees for each customer access line classification; residential, business and trunk line. The projected increase in 911 revenues used to support 911 systems was base on the 911 customer base as of May 1998. The increase in 911 rates were approved by the City Council in July 1998 and the new rates were first billed by the phone company on their September 1998 billing. The new 911 Wireless fees are set and received directly by the State which remits the revenues to the agency providing 911 local service. The City received $10,984 in 911 Wireless revenue in FY1998.The projection of new growth in 911 revenues for FY1999 is based on the increases in the 911 customer base as of September 1998. Attached are two additional financial presentations that present information on 911 revenues, capital and operating expenses and debt service requirements. Revenues from 911 and Wireless 911 are projected at$121,971 and$13,200 respectively for Fiscal Years 1999 through 2005. The revenues are base on a zero growth on the customer base existing at September 30, 1998. With an annual increase in 250 homes per year the combined 911 revenues should increase by an additional $14,640 by FY2002. This project involved the installation of about 8,500 total feet of water main at different locations throughout the City, including about 1,050 feet of 8-inch water line to be installed along Ballard Avenue. TGR's contract time began on October 12, 1998. Currently there exists an 8-inch ductile iron water line that runs under the west side of Ballard Avenue. The line is thought to be several decades old and has had frequent repairs by the Public Works Department. The purpose of the originally designed Ballard Avenue bond project was to augment the old existing line with one new main. The new main was to be northward approximately 1,000 feet to a large drainage ditch. It would have only served the lots on the east side of the street; the above- mentioned existing water main on the west side of the street was to remain in service and only serve the west side lots. In early October it was determined that the proposed Ballard Avenue water line would need to be redesigned to be aligned along the other(west) side of the street in order to make room for a new 72- inch North Texas Municipal Water District(NTMWD)transmission main and for the reconstruction and widening of Ballard Avenue. This alignment of the NTMWD line was selected per the City's request. The construction contract for this transmission main and street project has been awarded, and construction is expected to be performed in early 1999. The proposed realignment of the city line allows for the new NTMWD main, the new street, and the related new underground drainage facilities to be installed with no disruption to the new City line. (Also, the proposed realignment will result in both sides of the street being served more efficiently by one main which will replace the existing main). The Hogan Corporation and City Staff worked closely with NTMWD and their consultant to design the proposed adjustments in a way that would ensure the best possible outcome for the City. The new street construction extends from Stone Road to Butler Street. The aforementioned existing 8-inch City line along Ballard Avenue is expected to be eliminated as the new street is built. Therefore, to maintain service to area residents, the new water line has been designed to extend from Stone Road to Butler Street, or an addition of approximately 1,300 feet of line. • Item for Individual Consideration Approval of Change Orders Nos. 2, 3, &4 Page 1 Background-continued TGR has reviewed the plans for the redesigned City water line and has submitted a request for changes . to be made to their original contract. The Hogan Corporation has reviewed TGR's request and, takes no exception to the proposed prices submitted. The urgency of the pending NTMWD construction made it necessary to proceed in this manner. The change in the contract is recommended to be made by way of three Change Orders. Change Order #2 involves a deduction from the contract of approximately $43,610.80. This corresponds to the construction cost of the original Ballard Avenue water line design, using TGR's contract unit prices. As explained above, the original design should be abandoned due to the other upcoming construction in the area. Change Order#3 involves an addition to the contract of$171,550.00. This corresponds to the cost of TGR constructing the redesigned Ballard Avenue water line from Butler Street to Stone Road. Change Order#4 involves an addition to the contract of$50,515.00. This corresponds to the cost of TGR constructing the new water line from the northeast corner of the Ballard Avenue/Stone Road intersection to the opposite corner of the intersection by crossing both Stone Road and Ballard Avenue perpendicularly. This addition is necessary due to the reconstruction of the Stone/Ballard intersection. If constructed, this item would help maintain sufficient water supply in the area because it would replace existing lines that are expected to be eliminated as part of the paving project. Financial Considerations Change Order#2 is expected to involve a projected cost deduction of$43,610.80. 'Change Order#3 is expected to involve a cost increase to the contract of$171,550. Change Order#4 is expected to involve a cost increase to the contract of$50,515. If only Change Orders#2 and#3 are authorized, there would be an expected net increase to the contract of $127,939.20. If Change Orders #2, #3 and #4 are authorized, there would be an expected net increase to the contract of$178,454.20. This cost increase is partly due to the fact that the redesigned water main is approximately 1,300 feet longer than what was originally designed (which had an approximate length of 1,050 feet). Also, the new design includes many more street crossings, connections to other mains, fire hydrants, valves and other fittings than the originally designed main. Item for Individual Consideration Approval of Change Orders Nos. 2, 3, &4 Page 2 Financial Considerations -continued , Additionally, the revised alignment (necessary to clear the new street, NTMWD main, and drainage facilities) will be more difficult for the contractor to access and is also deeper in certain locations than the original design. Furthermore, unique to the new design is the repositioning of water meters along the west side of the street, again necessitated by the future NTMWD water line and street construction. It should be pointed out that identifying the sudden necessary realignment of the Ballard Avenue water main prior to construction of the originally designed improvements results in a potential savings to the City of$43,610.80 (see Change Order#2). Funding to support the water line cost of$127,939 and the Stone Ballard Avenue intersection cost of $51,515 can be accomplished through using several different sources. The different sources of funding are outlined below by project. Ballard Avenue water line- 2300 feet: 1300 feet funded in 1995 Bond Program $36,800 1300 feet eligible for Impact Fees 72,319 Surplus funds from the 1995 Bond 18 820 $129,939 Stone Road/Ballard intersection: $50,515 Can be added to a future bond program that would be eligible under a current bond reimbusement resoution. Other Considerations In addition to the changes in cost associated with the change orders, TGR has also requested corresponding changes in contract time. Specifically, these are a reduction of 15 calendar days for Change Order#2, an increase of 45 calendar days for Change Order#3 and an increase of 15 calendar days for Change Order#4. Board/Commission Recommendations N/A Staff Recommendations The Hogan Corporation and Staff recommends that the City authorize Change Orders#2, #3 and#4, provided that the associated costs are within the approximate ranges stated herein.
