Announce the presence of a Quorum.
Vice-Chairperson Jourdan called the meeting to order at 7:01 PM. Those present were:
Vice-Chairperson Ms. Jourdan, Board Member Mr. Osborne, Board Member Ms.
Herrera, Board Member Mr. LeBaron, and Board Member Ms. McGinnis. Board
Members absent were Mr. Ellis.
Staff members present were: Planning Director Renae 011ie, Assistant Planner Jasen
Haskins and Administrative Assistant Mary Bradley.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the April 23, 2007
Meeting.
A motion was made by Board Member LeBaron, and seconded by Board Member
Osborne, to approve the minutes of the April 23, 2007 meeting as submitted. Motion
carried 5 — 0.
PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by Todd Miller
for a Variance to Section 7.B.e(2) Rear Yard regulations of the 1962
Zoning Ordinance to reduce the rear yard setback from the required 25
feet to 8 feet. (ZBA 2007-10).
Mr. Haskins stated that the property is located at 629 Willow Way and is located within
the Westwind Meadows Addition. The southern side of the rear yard abuts a 30 foot
alley right-of-way. Twenty (20) feet of this right of way includes an underground pipeline

easement. The rear of the subject residence is a doublewide garage door, opening to a
driveway which currently measures approximately 56 feet to the alley and 37 feet to the
southern property line.
The applicant desires to extend the existing main structure by approximately twenty-
nine (29) feet. This would allow the applicant to remodel the existing garage into a
bedroom and use the added space as the new garage (keeping in conformance with
current Zoning Ordinance Section 5.2.B.9.c to provide two enclosed spaces for every
dwelling). As planned the new structure will be 8' from the rear property line, extending
17' into the required rear yard setback.
The addition will extend the existing main structure by 29', leaving 8' to the rear property
line, approximately 32% of the required setback in the ordinance.
Twenty-six notifications were mailed to surrounding property owners. Two comment
forms were received and both in favor of the request.
Vice-Chairperson Jourdan opened the Public Hearing.
Mr. and Mrs. Todd Miller, the applicants for the requested variance, were present. Mr.
Miller stated that the proposed expansion to the garage will be constructed with siding
on the sides, and the facing around the garage door will be bricks. This will match the
main structure.
Mrs. Miller stated that the easement in the right-of-way is a fuel easement, it is about
twenty feet from back of the proposed garage. The proposed addition would leave 28
feet to the actual alleyway.
Vice-Chairperson Jourdan closed the Public Hearing.
A motion was made by Board Member Mr. LeBaron, and seconded by Board Member
Ms. McGinnis, to GRANT the request for a variance to Section 7.B.e(2) Rear Yard
regulations of the 1961 Zoning Ordinance to reduce the rear yard setback from the
required 25 feet to 8 feet. Zoning Board of Adjustment 2007-10. Motion carried 5 — 0.
ADJOURNMENT
A motion was made by Board Member LeBaron, and seconded by Board Member Ms.
McGinnis, with the consensus from all Board Members to adjourn the meeting at
7:16PM.

Discussion
The subject property was created in September 2003 with the platting of Phase 3B of the Birmingham Farms Addition. It
is located at 1301 Columbus Lane.
The applicant desires to add a pergola over the existing patio in the rear of the main structure. Currently,that structure is
31 feet from the rear property line. The finished pergola, as requested by the applicant, would be 12 feet deep and extend
7 feet into the required rear setback. The pergola is considered an addition to the main structure and not an accessory
building due to its proximity to the main structure (less than 5 feet), even though it is not directly attached.
The applicant has provided a written statement and an example of a finished pergola. The applicant states that a hardship
exists due to main structure being built within 6 feet of the required setback with an existing 10'x10' concrete patio that
extends 4' into the required setback. In addition, the applicant states that the pergola will provide shading for the rear
entrance into the home (see attached letter and picture)
Public comment forms were mailed to twenty-nine (29) property owners within 200 feet of this request, as required by
State Law.No responses had been received at the time of this posting.

Considerations:
1. As presented in the application, the addition will, in effect, extend the existing main structure by 12', leaving 18' to
the rear property line, approximately 72% of the required setback in the ordinance.
2. The existing main structure was built 31 feet from the rear property line, while the concrete slab for the patio was
poured to within 21',thus not allowing a vertical structure to be built over the entire patio without a variance.
3. The proposed patio cover will limit sunlight exposure into the home during the late morning/early afternoon hours
reducing the heat load to the home. This reduction is keeping with the City of Wylie's goal of energy conservation.

We are requesting a variance to Section 2.5.4.c Rear Yard regulations of the Zoning Ordinance to
reduce to rear yard setback from the required 25 feet to 18 feet. The reason for this variance is that we
desire to construct a pergola over our existing concrete slab.
As the property stands right now, our backyard is approximately 31 feet deep and approximately 71
feet wide. The southern and western sides of the backyard abut our neighbors' properties and are
separated by wooden fences along the property lines. Since our home is on a corner lot,the eastern
side of the backyard abuts Auburn Drive and is separated by a wooden fence, as well. The rear exit of
our home is by a single door facing south, opening onto a concrete slab which measures 10 feet by 10
feet.
The pergola we wish to construct, over our existing concrete slab,will measure 15' L x 12'W x 10'H in
size and will be constructed of 100% Western Red Cedar. The pergola will be 18 feet from the rear
property line, extending 7 feet into the required rear yard setback. This patio covering will provide
shade from morning and afternoon sun as well as provide energy efficiency for our home.
As you can see,from the dimensions of our backyard,the required 25 foot rear yard setback does not
allow us to create a patio covering that would provide any substantial relief from the sun or reduce our
energy consumption. A rear yard setback of 18 feet would allow us to accomplish both of these goals.
