Chairperson Ellis called the meeting to order at 7:00PM. Those present were: Chairperson Jeff Ellis, Vice-Chairperson Ms. Linda Jourdan, Board Member Mr. Layne LeBaron, Board Member Ms. Marilyn Herrera, and Board Member Ms. Karyn McGinnis. Hold elections for Chair and Vice-Chair of the Zoning Board of Adjustment. Motion carried 4 — 0 — 1, with Board Member Ellis abstaining. Minutes July 23, 2007 Wylie Zoning Board of Adjustment Page 1 of 3 PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Jackie Mcllroy for a Variance to Section 3.2.B.3 Development Standards of the Zoning Ordinance to reduce the rear yard setback from the required 25 feet to 17 feet. (ZBA2007-11). Mr. Haskins stated that the property is located at 1301 Columbus Lane and was developed in September 2003 with the platting of Birmingham Farms Addition Phase 3B. The applicant desires to construct a pergola over an existing patio in the rear of the main structure. The pergola would be twelve feet deep and extend seven feet into the required rear setback. The applicant states that a hardship exists due to the main structure being built within six feet of the required setback with an existing 10' x 10' concrete patio that extends four feet into the required setback. In addition, the applicant states that the pergola will provide shading for the rear entrance into the home. Twenty-nine comment forms were mailed to property owners within 200 feet of this request, and no responses were received. Chairperson Ellis opened the Public Hearing. Mr. Greg Mcllroy, applicant and property owner of the subject property, stated that the concrete slab was poured at the time of construction of the main structure. The pergola will be constructed out of red cedar. Board Member Ms. Jourdan questioned if most of the residential dwellings in that subdivision had concrete pads and if constructed at the time the dwelling units were built. Mr. Lee stated that the question is very important, and that approximately 90 percent of the lots have the concrete slab poured at the time of construction of the dwelling units. As planners and developers will need to be more diligent on how plans are reviewed on how footpads of the dwelling units are laid out, whether the dwelling unit will have the sun directly facing the homes. Additional requests may be coming before the Board, because of the setback constraints and that property owners are unaware of the need to obtain permits prior to construction. Chairperson Ellis closed the Public Hearing. A motion was made by Board Member Mr. LeBaron, and seconded by Board Member Ms. Jourdan, to GRANT the request for a variance to Section 3.213.3 Development Standards of the Zoning Ordinance to reduce the rear yard setback from the required 25 feet to 18 feet. Discussion The subject property was created in July 2005 with the platting of Phase 13B of the Birmingham Farms Addition. It is located at 1323 Greensboro Drive. The applicant requests a variance to the set back requirements in order to retain an existing patio cover attached to the house. Currently,the patio cover is 11.5 feet from the rear property line. The applicant has provided a written statement and pictures of their finished patio cover and similar patio covers in their subdivision. The applicant states that a hardship exists due to main structure being built within 3.5 feet of the required setback thus not allowing for a useable patio cover under the ordinance. In addition, the applicant states that the patio cover will provide shading for the rear entrance into the home(see attached letter and picture). Public comment forms were mailed to twenty-six (26) property owners within 200 feet of this request, as required by State Law. Five responses had been received at the time of this posting, all of them in favor of approval. Considerations: 1. As presented in the application, the addition extends the main structure by 17', leaving 11.5' to the rear property line, approximately 46%of the required setback in the ordinance. 2. The existing main structure was built 28.5' from the rear property line, thus not allowing any realistically useable covered vertical structure to be built over the rear entrance without a variance. 3. The proposed patio cover will limit sunlight exposure into the home during the late morning/early afternoon hours reducing the heat load to the home. In fact,we currently have 3 permit applications in process with your Building Inspection department for projects not yet started.We beg your pardon for our mistake and hope that you'll grant some leniency in consideration of our responsiveness to correcting the situation. The project in violation of your regulations consists of a guttered patio extension with shingles. It is constructed and painted to closely resemble the facade of our home.The cover's total dimensions are 17' deep by 17'wide; it extends 13'6"past our lot's existing build line. In doing so, it provides relief from the evening sun in four windows that open to our living room, breakfast room, and kitchen. We have included pictures of our project from several vantage points in the back yard.To give you a better perspective, our back yard measures 82' 6" wide.The total depth from the house to the rear fence is 28' 6". In addition to the photos of our property,you will see examples of comparable projects that have been completed in the Birmingham Farms Community. In conclusion, we would like to reiterate with sincerity that we are not responding to this situation because we were `caught doing something wrong"by City of Wylie officials. Discussion The subject property was created in October 1986 with the platting of Phase 1 of the Westgate Addition. It is located at 606 Andersonville Lane. The applicant requests a variance to the set back and building separation requirements in order to retain an existing accessory building. Currently, one side of the accessory building is directly on the side property line and the opposite side is three inches from the main structure. The accessory building is 10.2' by 6.5'. The applicant has provided a written statement and pictures of their accessory building. The applicant states that a hardship exists due to a lack of available space for storage due to a pool that was installed by the previous owner. Public comment forms were mailed to thirty-one (31)property owners within 200 feet of this request, as required by State Law. Four responses have been received at the time of this posting,three in favor of approval and one against. Considerations: 1. As presented in the application the accessory building will, in effect, not have the required setbacks for either a side yard(5 feet or 100%)or spacing(4'9"or 95%)between it and the main structure. 2. The existing pool and surrounding area does in effect eliminate any other space available on the lot for the current existing accessory building. 3. The accessory building does meet all other requirements, such as materials and size limitations, as set forth in the zoning ordinance. My husband and I are first time homeowners, and are learning as we go. All of this began due to our lack of knowledge;vledge; we did not realize that if you did the work yourself, that you would still needed a permit to build something like a small storage shed. We have attached photos of our home for your reference as to make this easier for you. The previous owners of our home had a swimming pool built. Between the pool and the"decking" (which is actually concrete and little pebbles) around the pool, there is very little grass or open areas. We have planting areas around the edges of the backyard which are just big enough for small shrubs and a small Oak tree. There is one small area with grass, where the pool equipment is located, which is the only area to put a storage shed. We built this shed last summer (May-June). Because of this storage area for our lawn equipment, tree trimmers, and serves as winter storage for our table, chairs, etc during the winter months; we have been able to keep our home much neater. As you can see, I have also attached photos of our next door neighbors' driveway and the side of their house. Those photos are a fine example of how my husband and I did not want our home to appear. I do realize that the rules state that a shed must be no closer than 5 feet from my home, but due to the pool and the concrete deck around the pool, we do not have an area that is suitable. We did not want to remove a wonderfully healthy Oak tree, and that would have been our only other option which still would have placed the shed too close to property lines. I know that it does appear to be attached to our home, but it is in fact not so. The roof and side of the shed is built around our home's roof and eaves. The shingles are merely woven in to the shingles of our home to prevent rainfall from coming down onto our air conditioner and because we believed it looked nicer and less obtrusive. We did speak with an air conditioning company, and made sure that there is plenty of space between the shed and the air conditioning unit so as not to cause any problems. We are willing to make any adjustments necessary so that we do not have to relocate our storage shed, as we would just have to destroy it and have no protective place for our expensive lawn equipment and backyard furniture. Discussion The subject property was created in July 2005 with the platting of Phase 13B of the Birmingham Farms Addition. It is located at 1314 Brundidge Drive. The applicant requests a variance to the set back requirements in order to build a patio cover attached to the house. Currently, a 5' x 10' patio cover exists over a concrete slab. The applicant wishes to add a 12' x 17' concrete slab with a patio cover. However,the main structure is 28'6"from the rear property line which would allow only a 3'6"extension to the current patio cover given the 25' setback requirement. The applicant has provided a written statement and pictures of their current and the proposed patio cover. The applicant states that a hardship exists due to main structure being built within 3.5 feet of the required setback thus not allowing for a more useable covered patio area. In addition, the applicant states that the additional covered space is needed to participate in outdoor family activities due to a skin condition,which requires very limited exposure to direct sunlight. Public comment forms were mailed to twenty-six (26) property owners within 200 feet of this request, as required by State Law.No responses had been received at the time of this posting. Considerations: 1. As presented in the application,the addition will, in effect, extend the existing main structure by 12', leaving 16.5' to the rear property line, approximately 66% of the required setback in the ordinance. 2. The existing main structure was built 28.5' from the rear property line, thus not allowing any covered vertical structure to be built over the rear entrance without a variance. 3. The proposed patio cover will provide a usable covered outdoor area for the applicant to limit exposure to direct sunlight as required. Due to the shallow length of my backyard, current restrictions would allow for the patio to only extend 3.5' from the rear of the house instead of the proposed 12'. I want to add the patio not only to beautify my home, but more importantly, to allow me to spend time outdoors with my family. I was diagnosed in May, 2006, with melanoma and had surgery to remove the cancerous growth. (See medical record attached.) I have since had 11 additional skin surgeries to remove pre- cancerous spots before they could potentially become melanoma. (Additional medical records can be provided.) Due to my skin issues, I must carefully minimize the amount of time that I am exposed to the sun. I want to be able to enjoy my backyard with my family and young son.
