CALL TO ORDER
Chairman Phillip Johnston called the meeting to order at 6:31PM. Present with Chairman
Johnston were, Vice-Chairman Commissioner Gilbert Tamez, Commissioner Ramona
Kopchenko, and Commissioner Ruthie Wright. Commissioner Ron Smith,
Commissioner Matt Kirk, Commissioner David Dahl were all absent
Staff present was Renae' 011ie, Planning Director; Charles Lee, Senior Planner, Jasen
Haskins, Assistant Planner, and Mary Bradley, Administrative Assistant.
INVOCATION & PLEDGE OF ALLEGIANCE
Commissioner Tamez gave the invocation and Commissioner Wright led the Pledge of
Allegiance.
CITIZENS COMMENTS
Chairman Johnston opened the Citizens Participation. With no one approaching the
Commissioners, Chairman Johnston closed the Citizens Participation.

A motion was made by Commissioner Kopchenko, and seconded by Commissioner
Tamez, to approve the minutes from September 6, 2011 Regular Meeting, as submitted.

1. Consider a recommendation to the City Council regarding a Final Plat for
Aaron Davis Addition, a property of 4.390 acres located on Parker Road
950' west of Country Club.
Mr. Haskins stated that the property is not located within the city limits of Wylie, but within
Wylie's Extraterritorial Jurisdiction (ETJ). A Preliminary Plat was approved by the
Commission on August 2, 2011, and City Council on August 23, 2011. The Plat being
considered by the Commission is the Final Plat for Aaron Davis Addition.
Parker Road will be widened by TxDot in the near future, however that timeline or the
amount of right-of-way needed for the expansion is still in the designing stages. The City
Engineer recommended a 20 foot ROW dedication for the north end of the property.
With no questions for the applicant, or staff a motion was made by Commissioner Tamez and
seconded by Commissioner Wright, to recommend approval to the City Council regarding a
Final Plat for Aaron Davis Addition, a property of 4.390 acres located on Parker Road 950
feet west of Country Club. Motion carried 4—0.
2. Consider a recommendation to the City Council regarding a Replat for
Brown & Burns Addition, a property of 0.171 acres located at 109 Marble
Street; southeast corner of Marble Street and Jackson Street.
Ms. 011ie stated that the Replat for Brown & Burns Addition is combining two lots into
one. The property is zoned Downtown Historic (DTH) District. The lot totals 0.171
acres and is generally located at 109 Marble Street, on the southeast corner of Marble
Street and Jackson Street.
With no questions for the applicant or staff, a motion was made by Commissioner
Wright, and seconded by Commissioner Kopchenko, to recommend approval to the City
Council for a Replat for Brown & Burns Addition, Block 1, Lot 20R, a property of 0.171
acres located at 109 Marble Street, southeast corner of Marble Street and Jackson Street.
Motion carried 4—0.
3. Consider a recommendation to the City Council regarding a Final Plat for
Ronald Martinez Addition, a property of 0.3188 acres located on the
northeast corner of Martinez Lane and Alanis Drive.
Mr. Haskins stated that the Final Plat for Ronald Martinez Addition is located on the
northeast corner of Martinez Lane and Alanis Drive.
The property is zoned Light Industrial District. Due to the zoning of LI, no sidewalks are
required.
With no questions for the applicant or staff, a motion was made by Commissioner
Kopchenko, and seconded by Commissioner Tamez, to recommend approval to the City
Council regarding a Final Plat for Ronald Martinez Addition, a property of 0.3188 acres
located on the northeast corner of Martinez Lane and Alanis Drive. Motion carried 4—0.

A motion was made by Commissioner Wright, and seconded by Vice-Chair Tamez, to remove
ZC 2011-05 Public Hearing from the table. Motion carried 4-0.
1. Hold a Public Hearing and consider a recommendation to the City
Council, amending the zoning from Commercial Corridor (CC) to Light
Industrial (LI) on Lot 1, Block B of the Woodlake Village Addition, 12.4
acres generally located northeast of Centennial Drive and Eubanks Lane. ZC
2011-05
Ms. 011ie stated that the property is Lot 1,Block B of the Woodlake Village Addition and located
at the northeast corner of Centennial Drive and Eubanks Lane. The property is long narrow
shape, and is not directly accessible from Highway 78.
The Kansas City Southern Railroad is to the north of the property, and the City of Wylie Public
Safety Building, WalMart Supercenter and other Woodlake Village outpacels are immediately
south, across Centennial Drive.
The applicant is requesting to rezone from Commercial Corridor to Light Industrial to allow for
Office/Warehouse uses.
Fourteen notifications were mailed to property owners within 200 feet in accordance with State
Law. No responses were received in opposition or in favor of the request.
Chairman Johnston continued the Public Hearing.
Mr. C.T. Beckham, 11027 Eastview Circle, Dallas, TX, applicant/owner of the property, stated
that he has owned the property for about fifteen years. The property is long narrow strip of land
behind WalMart and the Public Safety Building, and adjacent to and parallel to the railroad and is
277 feet wide.
Chairman Johnston closed the Public Hearing.
A motion was made by Commissioner Tamez, and seconded by Commissioner Wright, to
recommend approval to the City Council, amending the zoning from Commercial Corridor (CC)
to Light Industrial(LI) on Lot 1, Block B of the Woodlake Village Addition, 12.4 acres generally
located northeast of Centennial Drive and Eubanks Lane. ZC 2011-05 Motion carried 4—0.
MISCELLANEOUS
Ms. 011ie stated that at the last Commission meeting, the Commissioners requested that Staff
review the Automotive Use Major and Minor definition and Staff is still researching and should
bring it back before the Commission on October 4,2011.

Discussion
The Applicant/Owner is Augustine Udoh of Udoh Engineering Control Systems.
The applicant is proposing to develop a 7,465 s.f. two story office building within the Downtown Historic (DTH) District
on a 0.171 acre lot recently replatted as Brown&Burns Addition,Lot 20R,Block 1. The property was part of the Original
Town of Wylie Addition as shown on maps dated November 1901 and later platted as the Brown&Burns Addition.
In accordance with Article 6, Section 6.3, the exterior facade will be constructed of brick and stone with cast stone
detailing. The design will also meet the building proportions and articulation standards as required by the ordinance
including height and width ratios; percent of transparent window treatments. The building will be emphasized by an
awning and a slight recessed entrance from Jackson Street with diagonal corner cuts.
The applicant is proposing to install a new 15' wide sidewalk along the property line at Marble. Because of the slope
of the property, a 6' wide sidewalk along with a raised 9' wide sidewalk will be installed with barrier free ramps at
an elevation of 9"— 12" above grade in order to prevent water flowing back into the building.
A Parking Agreement is under review by City Attorneys and will be considered by City Council in the near future.
The purpose of the Parking Agreement is to allow for 5 parking stalls that overlap the subject property with city owned
property to the south. Parking requirements can be met with a combination of on-street and off-site parking. However, the
applicant desires to provide some on-site parking for not only his use but for public use as well. If the agreement is
approved, it will provide 5 additional parking spaces for patrons to the downtown area.

Discussion
At its September 6th meeting the Commission directed Staff to research and compare the differences between
Automotive Repair Minor and Automotive Repair Major. In addition, the Commission asked if there should be
a category for personal automotive restoration to allow it as a separate designated category.
Of the 12-15 communities researched, most of them allowed both major and minor automotive repair uses
within their industrial districts.
Many communities like Wylie & Grapevine have incorporated safeguards in place, such as certain required
design standards associated with auto repair uses.
Allowing personal auto-restoration uses as separate category compromises the arbitrarily enforcement &
implementation of the zoning ordinance. Furthermore this category may fit in Vehicle Display, Sales or
Service.

City of Allen
Automotive repairs, major, means the repair, rebuilding or reconditioning of engines, air
conditioning systems and transmissions for motor vehicles, wrecker service, collision services,
including body, frame or fender straightening or repair, customizing, painting, vehicle steam
cleaning, undercoating and rustproofing and any use listed under "Automotive repairs, minor."
Automotive repairs, minor, means minor repair or replacement of parts, tires, tubes, and
batteries; diagnostic services; minor motor services such as grease, oil, spark plug, and filter
changing; tuneups; emergency road service; replacement of starters, alternators, hoses, brake
parts, automobile washing and polishing; performing state inspections and making minor repairs
necessary to pass said inspection; normal servicing of air conditioning systems; and other similar
minor services for motor vehicles except heavy load vehicles, but not including any operation
named under "Automotive repair, major" or any similar use.
Flower Mound
Auto repair garage means a building or place arranged, designed, used or intended to be used for
the primary purpose of providing general repair and servicing of motor vehicles. Such repair or
servicing may include reconditioning of engines, air conditioning systems and transmissions;
wrecker service; replacement or repair of brakes, shock absorbers, tires, batteries, mufflers or
upholstery; and other similar services, but excluding body work, painting, undercoating or
rustproofing, and tire retreading or recapping.
Murphy
Automobile repair, major, means general repair or reconditioning of engines, air conditioning
systems and transmissions for motor vehicles; wrecker service; collision repair services
including body, frame or fender straightening or repair; customizing; painting; vehicle steam
cleaning; undercoating and rustproofing; those uses listed under "Automobile repair, minor" and
other similar uses.
Automobile repair, minor, means minor repair or replacement of parts, tires, tubes and batteries;
diagnostic services; minor maintenance services such as grease, oil, spark plug and filter
changing; tune-ups; emergency road service; replacement of starters, alternators, hoses and brake
parts; automobile washing and polishing; performing state inspections and making minor repairs
necessary to pass said inspection; normal servicing of air conditioning systems; and other similar
minor services for motor vehicles except heavy load vehicles, but not including any operation
named under "Automobile repair, major" or any other similar use. Vehicles which are
inoperative or are being repaired may not remain parked outside these facilities for a period
greater than 48 hours.
Frisco:
Auto Repair, Minor, an establishment used for dispensing or sales of auto mobile fuels,
lubricants, and automobile accessories; the minor repair or replacement of parts and performing
state inspections and making minor repairs necessary to pass inspection; auto detailing, window
tinting, and sale and installation of radios. Uses listed under Auto Repair, Major or any other
similar uses are not included. Vehicles, which are inoperable or being repaired, may not remain
parked outside for a period greater than seven (7) calendar days.
Auto Repair, Major, general repair or reconditioning of engines, air-conditioning systems, and
transmission for automobiles, wrecker and towing service with on-site storage, collision services
including body frame, or fender straightening or repair; customizing; painting; vehicle steam
cleaning, tire retreading; insurance estimations with on-site storage; undercoating and rust
proofing, and other similar uses.
