CALL TO ORDER
Chairman Phillip Johnston called the meeting to order at 6:33PM. Present with Chairman
Johnston were, Vice-Chairman Commissioner Gilbert Tamez, Commissioner Ron Smith,
Commissioner Matt Kirk, Commissioner Ramona Kopchenko, and Commissioner David
Dahl,with Commissioner Ruthie Wright being absent
Staff present was Charles Lee, Senior Planner, and Mary Bradley, Administrative
Assistant.
INVOCATION & PLEDGE OF ALLEGIANCE
Commissioner Dahl gave the invocation and Commissioner Tamez led the Pledge of
Allegiance.
CITIZENS COMMENTS
Chairman Johnston opened the Citizens Participation. With no one approaching the
Commissioners, Chairman Johnston closed the Citizens Participation.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes from the September 20,

A motion was made by Commissioner Kopchenko, and seconded by Commissioner
Tamez, to approve the minutes from September 20, 2011 Regular Meeting, as submitted.

1. Consider and act upon a Site Plan for Brown & Burns Addition, a property
of 0.171 acres located at 109 Marble Street; southeast corner of Marble
Street and Jackson Street.
Mr. Lee stated that the applicant is Augustine Udoh of Udoh Engineering Control System.
Mr. Udoh is proposing to develop a 4,235 square foot two-story office building within the
Downtown Historic (DTH) District. The property was recently re-platted as Brown and
Burns Addition, Lot 20R,Block 1.
The proposed facility will be constructed of brick and stone with cast stone detailing, and will
be emphasized by an awning and a slight recessed entrance from Jackson Street with
diagonal corner cuts.
Although the applicant is not required to provide parking within the DTH District, he desires
to provide five additional parking spaces for not only his use but for public use as well. The
parking stalls will overlap with the city owned property to the south. The proposed Parking
Agreement will be considered by City Council on October 25,2011.
With no questions for the applicant, a motion was made by Commissioner Tamez, and
seconded by Commissioner Smith, to approve the Site Plan for Brown & Burns Addition,
Block 1, Lot 20R, a property of 0.171 acres located at 109 Marble Street; southeast corner of
Marble Street and Jackson Street. Motion carried 6—0.
Public Hearing
1. Hold a Public Hearing and consider a recommendation to the City Council
regarding a Residential Replat for Railroad Addition, Block 22, Lots 2A and
2B, generally located (104 S. Fourth Street) west of Fourth Street and south
of Oak Street.
Mr. Lee stated that the applicant is David and Jan Morgan, and the request is to replat the 0.186
lot into two residential (duplex) lots. The property is located at the corner of Fourth and Oak
Street. The property is zoned Multifamily District,which allows duplexes by right.
A Residential Replat is a Public Hearing. Sixteen notifications were mailed out to property
owners within 200 feet of the subject property. There were no comments received either for or
against the Residential Replat.
Commissioner Dahl expressed concern for lot conforming to current codes. Mr. Lee stated that
the property will adhere to all current codes within the Zoning Ordinance and Building Codes.
Chairman Johnston opened the Public Hearing.
Commissioner Smith questioned if a proposed drawing of the duplex was available. Mr. Richard
Parker, 1255 E FM 544, Wylie, applicant for the subject property, stated that the intention is to
save as many existing trees as possible. The duplex will be set back from the street and the two
driveways will be the parting lot line. The proposed duplex will be 2,600 square feet, and no
variances will be needed. Commissioner Kirk expressed concern of review of plans. Mr. Lee
stated that there will not be a Site Plan submitted for the Commission,but rather the Plans will be
reviewed and approved by Staff.

recommend approval to the City Council for a Residential Replat for Railroad Addition, Block
22, Lots 2A and 2B, generally located (104 S Fourth Street) west of Fourth Street and south of
Oak Street. Motion carried 6—0.
WORK SESSION
1. Hold a Work Session to discuss regulations of major and minor automotive repair
uses within the City.
Mr. Lee stated that the Commission directed Staff to research and compare the differences
between Automotive Repair Minor and Automotive Repair Major, at the September 6, 2011
Regular P & Z Meeting. Mr. Lee further stated that of the twelve to fifteen communities
researched most of them allow both major and minor automotive repair uses within their
Industrial Districts. In her absence, Commissioner Wright did call in and express her comments
for three separate categories; One for Major, one for Minor and one for heavy duty.
Chairman Johnston would like to see automotive minor, major and auto body shop categories.
Commissioner Dahl is in favor of one stop auto service and simplicity.
Commissioner Kirk stated that regardless of how technical major and minor repair gets, as long as
there is screening.
Chairman Johnston stated that auto paint and body is Specific Use Permit. He recommended to
have three categories: One auto (cars) repair, one for pick-up trucks (that weigh 2 tons or less),
and one for paint and body.
Mr. Lee asked Commissioner Smith if he was okay with person wanting to store and repair a
personal antique car within commercial districts and be classified as Vehicle Sales, Display and
Service. Mr. Lee encouraged the Commissioners to let Staff know if there is a request for
tweaking the text.
ADJOURNMENT
A motion was made by Commissioner Dahl, and seconded by Commissioner Tamez, to
adjourn the meeting at 7:24PM. All Commissioners were in consensus.

Recommendation

residential subdivision on an approximate 36 acre tract generally located south of E. Brown Street and west of W.A.
Allen Boulevard.
Discussion
Owner: Bill Kreymer. Applicant: Jim Douglas with Douglas Properties,Inc.
The applicant is requesting to establish permanent zoning on an approximate 36 acre tract generally located south of
E. Brown Street and west of W.A. Allen Boulevard. Annexation of the referenced Kreymer Family tract was in
conjunction with a series of comprehensive citywide annexations in 1986. Multiple tracts would eventually be zoned
for singly family development and several would retain their Agriculture designation and continue to be used for
agricultural and open space uses.
The property's northern boundary abuts Brown Street and the eastern boundary is adjacent to Eastridge single family
residential subdivision. The western portion extends to another adjacent A/30 zoned tract and the property extends
south to the existing Rush Creek and 100 year flood plain. The property has native vegetation with various groups
of mid-to large trees and has varying degrees of topography, mostly sloping towards Rush Creek. Rush Creek is a
natural tributary to Lake Lavon and a prominent feature of the terrain as well as multiple open space areas.
The applicant/owner is requesting a change in zoning to Planned Development Single Family Detached (PD-SF)
District to allow for suburban single family residential neighborhood consistent with the City's Comprehensive Plan
in preserving natural open spaces and providing pedestrian paths & connections in its design.

PD districts allows for innovation in development projects envisioned by the City's Comprehensive Plan. Further,
single family residential developments should be sensitive, compatible in scale, character and intensity with
surrounding residential neighborhoods. The prominence of 100 year flood plain, Rush Creek, open spaces and tree
canopy groups poses a challenge in following the City's standard SF 10/24 zoning district.
The current Comprehensive Plan designates Medium Density Residential for the area of this request. Medium
Density Residential category is for single family detached houses requiring minimum 10,000 square foot lots and
may be permitted to have special design standards. Adjacent single family residential properties to the east were
developed under the 1999 Comprehensive Land Use Plan requiring minimum 8,500 square foot lots.
The applicant has provided a zoning exhibit to serve as preliminary plat(Exhibit C) for this proposal as well as a list
of proposed planned development provisions (Exhibit B) that will establish additional design guidelines. (See
Attached)
The applicant has also been collaborating with Park's Department staff and the City's Park's Board in the dedication
and construction of public hike & bike trail, open spaces and other recreational amenities (Exhibit D) that will be
incorporated through the proposed neighborhood as well as open space and other pedestrian linkages.
In summary, the request to rezone property from Agricultural to PD-SF is consistent with the City's Comprehensive
Plan Land Use Map and does conform to the Comprehensive Plan's philosophy. In addition, staff recognizes the
applicant's desire to preserve open spaces and natural systems along with providing a homeowners association with
responsibility of maintenance of those areas accordingly. In light of the unique characteristics of the property and the
applicant's innovative design consistent with the Comprehensive Plan staff recommends that the Commission
approve this request along with the attached exhibits as part of the ordinance consistent with Park Board's
recommendation.
At the September 26, 2011 Parks Board meeting; the Board accepted the applicant's proposal for parkland
dedication and recommends approval subject to planned development provisions.
Notification/Responses: Thirteen(13) notifications were mailed, with one (1) written response returned favoring the
request and three (3)responses opposing the request at the time of posting.

CONDITIONS FOR PLANNED DEVELOPMENT

GENERAL CONDITIONS:
1. This planned Development District shall not affect any regulations within the Code
of Ordinances, except as specifically provided herein.
2. All regulations of the Single Family 10 District (SF-10) set forth in Article 3,
Section 3.2 of the Comprehensive Zoning Ordinance (adopted as of May 2011) are
included by reference and shall apply as provided herein.
SPECIAL CONDITIONS:
1. Maximum number of residential lots not to exceed 110 lots.
2. Lot Size
a. Minimum lot area of 8,500 square feet
b. Minimum lot width of 70 feet at the building line.
c. Minimum side yard of 10 feet and side yard of corner lots 25 feet when that
side is on a key lot. A side yard adjacent to a side street shall not be less than
15 feet in all other circumstances.
3. Minimum Building area of 1,800 square feet on 15% of the lots, 2,000 square feet
on 35% and 2,200 square feet on 50%.
4. Three-tab roofing shall not be permitted.
5. No alleys shall be required within the property.
6. Lots which back onto park land shall provide a wrought iron fence of uniform
design to be installed by the homebuilder, as approved by the P&Z.
7. The Development Plan attached as Exhibit"C" shall serve as the Preliminary Plat.
8. Existing trees greater than 6 inch caliper within the flood plain shall be protected
in accordance with City's Tree Preservation Plan.
9. Open space, drainage & floodway easement, and public hike & bike trail shall be
dedicated to the City of Wylie in accordance with City's Subdivision Regulations.
10. Maintenance of the Park Area
Maintenance of the park area will be the responsibility of the homeowners'
association (HOA).
A. HOA maintenance and responsibilities of amenities include:
a. Clean up and litter removal.
b. Landscaping installation, care, and maintenance.
c. Trimming, clearing, and removal of unwanted vegetation as determined by
the City Park Division.
d. Maintain irrigation system and test all backflow devices annually as per
City requirements.
e. Maintain playground equipment, pavilions, benches, tables, grills, trash
receptacles, concrete trail, and any other installed improvements.
Coordinate with the City Park Division prior to the selection, placement,
installation, repair, or removal of any improvement for consistency with
City park standards.
f. Maintain slopes and topography to prevent erosion.
B. City responsibilities of amenities include:
a. Perform playground safety inspections by qualified personnel.
b. Schedule pavilion reservations for the public.
