Hoisted, City Engineer) Executive Summary The City of Wylie Thoroughfare Plan was last updated in 2004. As part of the update to the thoroughfare impact fees, the plan is being revised to reflect the needed capacity in future roadways as well as showing the existing and future roadway alignments. The plan also incorporates the proposed changes included in the 2013 Collin County Mobility Plan. If the residential portion develops first, the developer will construct the road through to Kreymer. The development portion within the City of Wylie ETJ is subject to the subdivision rules and regulations of the City of Wylie. Hoisted noted he had received a request in writing from the applicant to withdraw this request. Council Action A motion was made by Councilwoman Culver, seconded by Councilman Wintters to accept the withdrawal from the applicant. Discussion After previous discussion with Council in a work session held on December 10, 2013,. and receiving commitment from Wylie ISD for the filing of the Failure to Attend School cases in the Wylie Municipal Court, we are now asking Council to approve the budget amendment for funds to implement a Juvenile Case Manager position with the start date of June 1, 2014. There are specific training requirements in accordance with state statutes that must be completed prior to the Juvenile Case Manager handling cases. This training is held by Texas Municipal Courts Education Center and occurs once a year, currently scheduled for July 7-9, 2014. With the Wylie ISD Failure to Attend School cases being filed with the Wylie Municipal Court beginning August 2014, it is important that we hire someone enough in advance to receive the required training to be prepared to handle these cases. Included in this budget amendment is $2,050.00 to be used from the Court Technology Fund to purchase a computer/laptop for this position and $1,000.00 to be used from the Court Building Security Fund to cover the cost of the required training. MUNICIPAL COURT DIVISION 1. Generally Sec. 34-25. Juvenile Case Manager Funding. (a) There is hereby created a juvenile case manager fee, not to exceed FIVE AND NO/100 DOLLARS ($5.00) ("Case Manager Fee"), as authorized by Article 102.0174, TEX. C. CRIM. PROC., as amended. The Case Manager Fee is in addition to any other fines, penalties and/or court costs required by city ordinance or state or federal law. A separate Case Manager Fee must be paid for each separate conviction of a fine-only misdemeanor offense. (b) Except as provided in Subsection (c) below, each defendant convicted of a fine-only misdemeanor offense in Municipal Court shall pay the Case Manager Fee as a cost of court. The Case Manager Fee does not apply to parking citations. For purposes of this section, a defendant is considered to be "convicted"if: (1) A sentence is imposed on the defendant by the Municipal Court; or (2) The defendant receives deferred disposition from the Municipal Court, including deferred proceedings under Articles 45.052 or 45.053, TEX. C. CRTM. PROC., as amended. (c) The Municipal Court Judge may waive the Case Manager Fee in cases of demonstrated financial hardship on the part of a convicted defendant. By way of example only, the Municipal Court Judge may waive the Case Manager Fee if the Judge has determined that the defendant is indigent; has insufficient resources or income to pay the Case Manager Fee; or is otherwise unable to pay all or part of the underlying fine or costs. Ordinance No.2014-10—Amending Ordinance 2005-07 Juvenile Case Manager Funding&Fees Page 2 of 4 (d) The Municipal Court clerks shall collect the Case Manager Fee and pay it to the city treasurer to be kept in a separate ledger account known as the"Juvenile Case Manager Fees" ("Fees"). (e) The Fees may be used only to finance the salary, benefits, training, travel expenses, office supplies and other necessary expenses relating to the position of a juvenile case manager who is employed by the Municipal Court under Article 45.056, TEX. C. CRIM.PROC.,as amended. The Fees may not be used to supplement the income of an employee whose primary role is not that of a juvenile case manager. (f) The Fees shall be administered by or under the direction of the city council. (g) The Case Manager Fee shall be charged and applied only to conduct that occurs on or after April 1, 2014." SECTION 3: Amendment to the Code of Ordinances, Appendix C (Wylie Comprehensive Fee Schedule), Section XII (Municipal Court). Appendix C (Wylie Comprehensive Fee Schedule), Section XII (Municipal Court) of the Code of Ordinances is hereby amended as follows: "APPENDIX C WYLIE COMPREHENSIVE FEE SCHEDULE* XII. Municipal Court Case Manager Fee (not to exceed) 5.00" SECTION 4: Severability. Should any section, subsection, sentence, clause and/or phrase of this Ordinance be declared unconstitutional and/or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. The City hereby declares that it would have passed this Ordinance, and each section, subsection, clause and/or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses and/or phrases be declared unconstitutional and/or invalid. SECTION 5: Savings/Repealing Clause. All provisions of any resolution in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. WHEREAS,pursuant to Article 102.0174, TEX. C. CRIM. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Resolution as if fully set forth herein. SECTION 2: Adoption of Juvenile Case Manager Code of Ethics. The City Council hereby adopts the "Code of Ethics for Juvenile Case Managers" ("Code of Ethics"), attached Resolution No.2014-04(R)-Juvenile Case Manager Code of Ethics-Minimum Standard Training Page 1 of 7 hereto as Exhibit "A" and incorporated herein for all purposes, as the ethical standards to which the City's juvenile case managers shall be held. SECTION 3: Adoption of Training Standards. The City Council further hereby adopts the educational pre-service and in-service training standards, attached hereto as Exhibit "B" and incorporated herein for all purposes, as the appropriate educational standards for its juvenile case managers. SECTION 4: Training Requirements. The City Council hereby requires that its juvenile case managers receive training in the role of the juvenile case manager, case planning and management, applicable procedural and substantive law, courtroom proceedings and presentation, services to at-risk youth, local programs and services for juveniles and methods by which juveniles may access those programs and services; and the detection and prevention of abuse, exploitation, and neglect of juveniles. Such training shall be completed at appropriate times and as opportunities for training in those areas may be reasonably accessible, as outlined in Exhibit "B". SECTION 5: Implementation of Rules, Standards and Code of Ethics. The City Council hereby directs that the rules, standards and Code of Ethics adopted herein be implemented and enforced by the City Manager, or her designee. SECTION 6: Annual Reviews. The City Council hereby requires an annual review of its juvenile case managers to ensure implementation of the rules, standards and Code of Ethics adopted herein. SECTION 7: Severability. Should any section, subsection, sentence, clause and/or phrase of this Resolution be declared unconstitutional and/or invalid by a court of competent jurisdiction, it is expressly provided that any and all remaining portions of this Resolution shall remain in full force and effect. The mission of the juvenile case manager is to assist judges in providing juveniles and their families with resources to shape the juvenile's future, and to help the juvenile connect with the community and develop into a law abiding citizen. Those persons applying this Code of Ethics shall keep foremost in mind that the City is guided at all times by the values of integrity, excellence, compassion, and respect for the dignity of every person. Standards Confidentiality. A juvenile case manager shall not disclose to any unauthorized person any confidential information acquired in the course of employment. A juvenile case manager shall not violate the confidentiality of juvenile clients unless the juvenile case manager is seeking consultation services from within the case management program or a school campus, or if the juvenile has threatened to harm himself, herself, or others, or if the juvenile case manager is providing details of any criminal activity or enterprise. Conflicts of Interest. A juvenile case manager shall be alert to and avoid conflicts of interest that interfere with the exercise of professional discretion and impartial judgment. In order to maintain the community's trust in the judicial system, a juvenile case manager should avoid soliciting or accepting improper gifts, gratuities, or loans, an should avoid engaging in business relationships that give rise to an appearance of impropriety. Competence. A juvenile case manager shall endeavor at all times to perform official duties properly and with courtesy and diligence. A juvenile case manager shall fulfill his or her duty and represent himself or herself only within the boundaries of his or her education, training, license, certification, consultation received, supervised experience, or other relevant professional experience. Respect for the Law. A juvenile case manager shall abide by all federal, state, county, and municipal laws, guidelines, ordinances, and rules. A juvenile case manager shall be familiar with the Texas Code of Judicial Conduct and the basic standards to which members of the judiciary are held. Abuse of Position. A juvenile case manager shall not use or attempt to use his or her official position to secure unwarranted privileges or exemptions for himself, herself, or any other person. A juvenile case manager shall not discriminate against any person on the basis of age, sex, creed, sexual preference, disability, or national origin. Private Life. A juvenile case manager shall behave in a manner that does not bring discredit to the City or to them. A juvenile case manager's character and conduct outside the court must be exemplary so as to maintain a position of respect in the City and in the community where he or she lives. Enforcement Any alleged violation of applicable ethical standards shall be subject to investigation and discipline by the Court administrator in consultation with the City's human resources department. In-Service Training refers to regular training a juvenile case manager receives after beginning work as a juvenile case manager. Pre-Service Training Requirements A juvenile case manager will receive no less than eight (8) and no more than forty (40) hours of pre-service training from reasonably accessible in-house sources, education institutions, applicable professional associations, the Texas Municipal Courts Education Center, or other similar resources. Pre-Service Training should include, but not necessarily be limited to: • The Role of the Juvenile Case Manager • Ethics • Case Planning and Management • Applicable Procedural and Substantive Law in Municipal Court • Courtroom Proceedings and Presentation • Case Reporting • Interagency Collaboration In-Service Training Requirements A juvenile case manager must become a Certified Court Clerk Level 1 within the first year of service. Recommendation Motion to approve, the revised City of Wylie Thoroughfare Plan. Discussion The City of Wylie Thoroughfare Plan was last updated in 2004. As part of the update to the thoroughfare impact fees, the plan is being revised to reflect the needed capacity in future roadways as well as showing the existing and future roadway alignments. The plan also incorporates the proposed changes included in the 2013 Collin County Mobility Plan. A work session was held with the Planning and Zoning Commission on January 7, 2014 to discuss the thoroughfare plan recommendations.
