Board Members present were; Board Member Bill Hiney, Board Member Jason Potts and Board Member Kelly Price. Board Member Bill Baumbach, and Board Member Karyn McGinnis were absent Staff members present were: Renae' 011ie, Planning Director, Jasen Haskins, Planner, and Mary Bradley, Administrative Assistant. ELECTION OF CHAIR AND VICE CHAIR Chair Jourdan recommended tabling the nomination of Chair and Vice Chair to the next meeting. A motion was made by Board Member Hiney, and seconded by Board Member Price to table the nomination of chair and vice chair to the next meeting. Motion carried 4 — 0. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the June 17, 2013 Meeting. A motion was made by Board Member Price, and seconded by Board Member Potts, to approve the Minutes from the June 17, 2013 Meeting as submitted. Motion carried 4 — 0. PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Carl Fontera for a Variance to Section 5.2.F.14.c parking regulations of the Minutes August 19, 2013 Wylie Zoning Board of Adjustment Page 1 of 3 Zoning Ordinance to reduce parking for a Daycare use to allow 78 parking spaces in lieu of the required. Property located at 3010 FM 544, being Lot 1 Block A of the Jacob's Addition (ZBA 2013-06) Staff Comments Mr. Haskins stated that the applicant is Mr. Carl Fontera, representative from Children's Learning Adventure of Phoenix, Arizona, stating that the applicant is requesting a variance to the parking requirements for a daycare use. The property will be constructed east of Springwell Parkway and south of FM 544. The entire property is approximately 2.88 acres, and the facility will be 25,737 square foot on one lot. The Zoning Ordinance requires one and one-half parking space for each teacher and one loading/parking space for every ten students. Based on a maximum of 500 students with 30 employees, the total required spaces would be about 100 spaces. The applicant is requesting a variance to reduce the required parking by 22 spaces for a total of 78 required parking spaces. Staff feels that some reduction in parking may be warranted for several reasons. First the average enrollment at any one time will likely be closer to 350 — 400 students and not the maximum 500 allowed. This average, by itself, would predicate the reduction of 10-15 parking/loading spaces from the site. Second, the area that is required for parking spaces, can be utilized for additional landscaping which is keeping with Section 7 of the Zoning Ordinance that speaks to maximizing green space when possible. Finally, the Staff is working on a text amendment to the parking requirements for the Zoning Ordinance, which will reduce parking requirements in line with proposed parking variance. The text amendment will be a public hearing, possibly at the end of September or early October, at the Planning and Zoning Commission with a recommendation to City Council. Seventeen comment forms were mailed to surrounding property owners. One comment form was returned in favor of the request and no comment form received in opposition. Chair Jourdan opened the Public Hearing. Mr. Carl Frontera, 3131 E Camelback Road, Suite 420, Phoenix, Arizona, Vice President for Development, Children's Learning Adventure, stated that the facility will mirror a facility in Coppell which has 69 parking spaces. A Site Plan and Landscape Plan will be considered by the Planning and Zoning Commission on September 3, 2013. A traffic analysis was performed for a facility in Houston, with a three to three a half hour drop off time frame. The maximum number of vehicles at the facility was 40 to 41 at 9:00 in the morning, thus a full 100 spaces would never be utilized. Although the facility will be licensed by the State of Texas for 540 students based on capacity and number of classrooms, the classrooms will be specialty rooms for the children to use, for instance a science room; or a mini television/radio studio, or a library and not a classroom. Chair Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Price, and seconded by Board Member Hiney, to Grant the request for a Variance to Section 5.2.C.6.c/d 78 parking requirements of the Zoning Ordinance. ZBA 2013-08 Discussion The subject property is located at 101 Hensley Lane. The property is owned and operated by Wylie ISD and within PD 2003-01. Draper Intermediate School opened in 2007 during a period of rapid growth in Wylie. While the rate of growth has slowed, Wylie continues to add citizens at a relatively rapid rate. So far this year, Wylie is issuing a single family home permit once every 1-1/2 days. This growth requires the school district to add new facilities for students. To this end, Draper Intermediate is expanding as shown on the site plan. However, there is an immediate need for two additional classrooms. Therefore, the district has a need for a portable classroom until the permanent additions can be completed. The Zoning Ordinance allows for a temporary structure to be placed on site for up to 90 days during a given 12 month period. The applicant foresees a longer than 90 day time period being needed for the temporary building. Therefore the applicant is requesting a variance to that Section of the Ordinance 5.5.A. The requested variance is to last for one year or until the completion and occupancy of the planned additions as shown on the site plan, whichever comes first. The applicant has stated that construction of the permanent facilities will begin this calendar year. The Board can approve the Variance as requested or for any time period it sees fit. The Board has approved similar requests in the past 12 months. Public comment forms were mailed to 38 property owners within 200 feet of this request, as required by State Law.No responses were received at the time of this posting. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2013-08 (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions,the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Sean McGuire acting on behalf of Ladylike Shop Inc. for a Variance to Article 5, Section 5.5 Temporary Uses of the Zoning Ordinance requiring that, "Commercial activities not normally allowed in certain areas be permitted on a temporary basis for a time period not exceeding 90 days within a one-year time period",property located at 1001 N. SH 78, being Tract 93 of the F De LaPina Survey. ZBA 2013-07. Discussion The subject property is located on an 18.437 acre tract of undeveloped AG-30 zoned property, generally located east of SH 78 and north of Brown Street (just north of Racetrac Convenience Store). The property is owned by Ladylike Shop Inc. and being used for agricultural(animal grazing)purposes. In April 2013, the applicant applied for and received Temporary Use Permit for Flea Market Event to be held on last Friday through Sunday for months of June, July & August in compliance with 90-day, once per year provision of the Ordinance. The applicant is applying for a variance to Section 5.5 of the Zoning Ordinance that requires Temporary Use Permit not to exceed 90 day period, and to allow for Flea Market event be held on last Friday, Saturday and Sunday of each month. Temporary Use Defined Temporary uses shall include short-term or seasonal uses that would not be appropriate on a permanent basis. Temporary uses are identified in Section 5.1 Land Use Charts and 5.2 Listed Uses. In addition, the following uses and activities shall be considered temporary uses: 1. Fundraising Activities by Not-for-Profit Agencies. Fundraising or noncommercial events for nonprofit educational, community service or religious organizations where the public is invited to participate in the activities and which last longer than 48 hours. 2. Special and Seasonal Sales Events. Significant commercial activities lasting not longer than 90 days intended to sell, lease, rent or promote specific merchandise, services or product lines, including but not limited to warehouse sales, tent sales, trade shows, flea markets, farmer's markets, Christmas tree lot sales,product demonstrations or parking lot sales of food, art work or other goods. 3. Entertainment or Amusement Events. Short-term cultural and entertainment events including public or Page 1 of 2 Page 2 of 2 ZBOA 2013-07 private events lasting not longer than 90 days intended primarily for entertainment or amusement, such as concerts,plays or other theatrical productions, circuses, fairs, carnivals or festivals. The applicant was advised that unless minimum improvements for life, safety and welfare are met, staff cannot support an extension to the 90-day, one event per year provision of the Ordinance. Mentioned during our meeting with the applicant for public improvements include but not limited to adequate facilities for: • Parking • Fire&Emergency Access • Restrooms • Utilities • Safe Ingress-Egress • Minimum Building&Fire Code Compliance The Board can approve the Variance as requested or for any time period it sees fit. The applicant is requesting year-round uses for Flea Market event be held on last Friday, Saturday and Sunday of each month. Public comment forms were mailed to 16 property owners within 200 feet of this request, as required by State Law.No responses were received at the time of this posting. However, staff received one(1) email favoring the request, and one (1) online complaint against the business. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions,the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. But when we went to the Trade Days this Saturday afternoon, August 24, 2013, We were told where to park but was not told nor were there signs posted at the entrance that there would be a parking fee to leave the property. I find this very disturbing that their teenager employees when asked why are giving an explanation of"blame it on the City of Wylie for charging them higher fees". This can feel like extortion when trying to leave!! We have photos of the exit where the are collecting $$ and the website stating FREE PARKING!! AS OF 9pm Saturday Aug 24 the Trades Days website still stays FREE PARKING which is http://wylielastmonday.com/about-wylie-last-monday/. If you advertise FREE PARKING -then is fraud or deceptive trade violation to charge without changing or posting at the entrance so I have an option if I want to go in, before I drive in and park!! We were forced to pay $2.00 to leave the Last Monday Trade of Days Wylie property which I am very disappointed in this whole experience that I want to know how this can be corrected since the concept is a very good idea for the whole community but this type of business practice MUST not be acceptable or accepted by the community!!! Please let me know how to file to get a refund or who I can file a complaint about this business with at the City of Wylie????? I was considering a renting a booth there in the near future but after this whole experience I am afraid that the people running the Last Monday Trade Days of Wylie are not trust worthy or have no business knowledge and I will get screwed.
