Board Members present were; Vice Chair Linda Jourdan, Board Member Karyn McGinnis, Board Member Jason Potts and Board Member Kelly Price. Staff members present were: Renae' 011ie, Planning Director, Jasen Haskins, Planner, and Mary Bradley, Administrative Assistant. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the September 16, 2013 Meeting. A motion was made by Board Member Price, and seconded by Board Member Potts, to approve the Minutes from the September 16, 2013 Meeting as submitted. Motion carried 5 — 0. PUBLIC HEARINGS 1. Hold a public hearing to consider and act upon a request by Kumars Poorkiyani for a Variance to Section 5.2.E.6.c parking regulations of the Zoning Ordinance to reduce parking for a Health Club use to allow 18 parking spaces in lieu of the required 31. Property located at 211 Regency Drive, being Lot 44 Block C of the Regency Business Park Phase 2 Addition (ZBA 2013-09) Staff Comments Mr. Haskins stated that the property is located on the southeast corner of Regency and Exchange Drive within the Regency Business Park Phase 2 Addition. The entire property is approximately 0.681 acres. The building is 6,400 square foot and requires 31 parking spaces. The building is divided, Minutes November 18, 2013 Wylie Zoning Board of Adjustment Page 1 of 3 4 one half is used by Crossfit and the other side is used by the property owner. The property owner is Kumars Poorkiyani, and the tenant is Chris Coker, with Crossfit. The tenant is proposing to expand their business within the building located at 211 Regency Drive, and use the whole building as Crossfit. The Zoning Ordinance requires one parking space for every 200 square foot of floor space for Health Club use. The applicant is requesting a variance to reduce the required parking by 13 spaces or 42 percent for a total of 18 required parking. Due to large easement that runs down the middle of the property, 18 parking spaces is all that will fit on the property. Staff feels that the request is unique and challenging aspects that warrant consideration, namely the large easement that bisects the property and prohibits more on- site parking. The Board cannot approve a variance to allow off-street parking or allow shared parking. Seventeen Comment Forms were mailed as required by law. Two comment forms were received from property owners within the 200 foot notification area. One comment form was in favor and one comment form in opposition of the request. Staff did receive approximately 40 comment forms from citizens who were members of Crossfit, but were not within the notification area, andl all in favor of the request. Board Member McGinnis questioned the number of parking spaces when the building was constructed. Mr. Haskins stated that the use for the building when initially constructed did not require the same number of parking spaces as the current use. A Health Club is allowed by right within Light Industrial District, and does require one space per 200 square foot of floor space, plus two more for office area. Ms. 011ie stated that when the building was constructed, the use was for office/warehouse use, and the parking requirement was one space per 500 square foot. Board Member Baumbach questioned the traffic counts for Regency and Exchange. Mr. Haskins stated that he held a conversation with the City Engineer, who stated that traffic counts are low currently. However, as Regency Business Park continues to develop, the traffic will increase. The City Engineer also stated that Woodbridge Parkway is under construction to connect to Highway 78, and at some point in the future, Regency will connect to Woodbridge Parkway. Chairman Baumbach opened the public hearing. Mr. Kumars Poorkiyani, 211 Regency Drive, property owner for the subject property, stated that the tenant has a three year lease, and has been in the current building for twelve months. Mr. Chris Coker, 816 Carlton Road, tenant for the property, stated that if the variance is approved, the Crossfit will have the entire building for two years. Mr. Coker went into detail of their layout of the Crossfit, stating that there are eight classes during the day, with approximately ten clients attending each Minutes November 18, 2013 Wylie Zoning Board of Adjustment Page 2 of 3 5 class. On average there are eight cars, and at peak time twenty to twenty-four cars. Mr. Coker stated that Crossfit is different than a global gym in that Crossfit is a one on one training, whereas the global gym is not. The business grows by clients attending the classes and referring them to their friends. In response to the comment form submitted in opposition, Mr. Coker stated that he was unaware of blocking the drive for adjacent businesses, and will approach neighbors about parking. Mr. Coker will post signs for clients stating they are not to block surrounding properties. Mr. Coker stated that if the request is denied, the Crossfit will be forced to close, as there is not available building to suit their needs. The request is not to grow the clientele ratio, but to offer more floor area. Chairman Baumbach closed the public hearing. Board Discussion Mr. Haskins stated that the Board, if approving the request, may include in their motion a time limit and for use only. Chairman Baumbach expressed concern of the parking on the street within the whole Regency Business Park Addition. The parking on the street was not directly for the clients at Crossfit, but to other businesses in a two to three block area. Board Member McGinnis stated that the request is unique, and understands the mission of Crossfit. Crossfit will not have more than 10 to 15 people in one class with one coach at a time. Board Action A motion was made by Board Member McGinnis, and seconded by Board Member Jourdan, to Grant the request until April 2016, for the current tenant, Crossfit and the current use. Motion carried 5 — 0. Discussion The subject property consists of two lots on the southeast corner of Ballard and Marble Streets and is zoned Downtown Historic District (DTH). All adjacent properties, except the church to the east, are also currently zoned DTH. The entire property is approximately 5,100 square feet, with a 4,318 square foot structure, which is a Medical Office Use (optometrist). The current Zoning Ordinance Section 6.3.E.6.c(2) requires a sign attached to a building to be no larger than one square foot per linear foot of facade with an overall maximum of 64 square feet. The purpose of the Ordinance is to reduce sign clutter and provide a cleaner, neater appearance. The applicant is requesting a sign of 109 square feet and has provided pictures that demonstrate the look of the proposed signage. Staff feels that the applicant's property definitely has unique aspects that warrant consideration, namely the large side of the building. The building is 119 feet long. There are other buildings in Wylie with similar sized large facades whose signs are greater than 64 square feet, PetSmart and Ross, among them, however these sites were developed under a Planned Development that made exceptions to the Ordinance with sign sizes being one of those exceptions. In addition, Staff has researched the Ordinances from surrounding cities and found that Wylie is one of the most restrictive in terms of sign sizes. Typically, the ratio of linear feet of building to square feet of signage is 2-1 with the maximum size being 2-3 times Wylie's Ordinance. If warranted, staff will further examine our ordinance in relation to our city's zoning objectives and other cities ordinances. CONSIDERATIONS: The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or Page 1 of 2 Page 2 of 2 ZBOA 2014-01 (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Public comment forms were mailed to nineteen (19) property owners within 200 feet of this request, as required by State Law. One comment form was received at the time of this posting in opposition of the requested variance, and one form representing three properties was received in favor of the requested variance. Adjacent properties are also currently zoned AG/30. The entire property is approximately 1.866 acres, with a 2,200 square foot residential structure and approximately 2,500 square feet of accessory buildings. The applicant is asking for a variance to allow a chain link fence in lieu of the required wood or wrought iron, as stated in the current Zoning Ordinance Section 3.4.F.12(2). Staff feels that the applicant's property has unique aspects that warrant consideration, namely the large size and somewhat rural nature of this and surrounding lots. The pictures provided show the size and rural nature of the neighborhood. Other fencing materials other than wood or wrought iron may be adequate. The intent of the Ordinance is to ensure that fencing materials are of a consistent quality and provide a certain aesthetic throughout the different zoning districts within the city. Staff has researched the ordinances from other cities and found that Wylie is one of the most restrictive in terms of fencing materials. Most surrounding cities allow a wider variety of materials for fencing, possibly relying on Home Owners Associations to provide a more restrictive requirement where necessary. If warranted, staff will further examine our ordinance in relation to our city's zoning objectives and other cities ordinances. Property located at 1404 Martinez Lane, being Lot 1 Block A of the MetroTech Addition(ZBA 2014-03). Discussion The subject property consists of undeveloped land totaling 0.311 acres located at 1404 Martinez Lane (approximately 700 ft south of SH78) and is zoned Light Industrial (LI). Adjacent properties are also currently zoned LI, except the property to the north which is zoned Commercial Corridor(CC). The applicant is asking for a variance to allow a telecommunications tower that is located 2,385 feet from another tower in lieu of the required 5,000 square feet, as stated in the current Zoning Ordinance Section 5.2.G.14.b(4). The intent of the Ordinance is to ensure that there is adequate spacing between towers to minimize electronic interference, bird flight patterns, and aesthetic issues. Staff feels that the applicant has unique circumstances that warrant consideration, namely the increasing density of Wylie's population and the increased use of mobile devises. The applicant's client feel the extra wireless capacity is warranted to serve their customers. The Zoning Ordinance gives the Board the power to issue a variance in cases like this as it states: "The Board may... Permit a public utility or public service or structure in any district, or a public utility or public service building of a ground area and of a height at variance with those provided for in the district in which the public utility or public service building is permitted to be located, when found reasonably necessary for the public health, convenience, safety, or general welfare." Additionally, staff has researched the ordinances from other cities and found that Wylie is one of the most restrictive in terms of tower separation distances. Most surrounding cities allow a wider variety of distances based on the height of the tower. Most require a separation of 1000-2000 feet for a 100' tower, as the applicant is proposing. If warranted, staff will further examine our ordinance in relation to our city's zoning objectives and other cities ordinances.
