CALL TO ORDER
Chairman Bill Baumbach called the meeting to order at 7:03 p.m. and stated that
a quorum was present. Board Members present were; Vice Chair Linda Jourdan,
Board Member Karyn McGinnis, Board Member Jason Potts and Board Member
Kelly Price.
Staff members present were: Renae' 011ie, Planning Director, Jasen Haskins,
Planner, and Mary Bradley, Administrative Assistant.
CONSENT ITEMS
1. Consider and act upon approval of the Minutes of the September 16,
2013 Meeting.
A motion was made by Board Member Price, and seconded by Board
Member Potts, to approve the Minutes from the September 16, 2013 Meeting
as submitted. Motion carried 5 —0.
PUBLIC HEARINGS
1. Hold a public hearing to consider and act upon a request by Kumars
Poorkiyani for a Variance to Section 5.2.E.6.c parking regulations of
the Zoning Ordinance to reduce parking for a Health Club use to allow
18 parking spaces in lieu of the required 31. Property located at 211
Regency Drive, being Lot 44 Block C of the Regency Business Park
Phase 2 Addition (ZBA 2013-09)
Staff Comments
Mr. Haskins stated that the property is located on the southeast corner of
Regency and Exchange Drive within the Regency Business Park Phase 2
Addition. The entire property is approximately 0.681 acres. The building is
6,400 square foot and requires 31 parking spaces. The building is divided,

one half is used by Crossfit and the other side is used by the property owner.
The property owner is Kumars Poorkiyani, and the tenant is Chris Coker, with
Crossfit. The tenant is proposing to expand their business within the building
located at 211 Regency Drive, and use the whole building as Crossfit.
The Zoning Ordinance requires one parking space for every 200 square foot
of floor space for Health Club use. The applicant is requesting a variance to
reduce the required parking by 13 spaces or 42 percent for a total of 18
required parking. Due to large easement that runs down the middle of the
property, 18 parking spaces is all that will fit on the property. Staff feels that
the request is unique and challenging aspects that warrant consideration,
namely the large easement that bisects the property and prohibits more on-
site parking. The Board cannot approve a variance to allow off-street parking
or allow shared parking.
Seventeen Comment Forms were mailed as required by law. Two comment
forms were received from property owners within the 200 foot notification
area. One comment form was in favor and one comment form in opposition of
the request. Staff did receive approximately 40 comment forms from citizens
who were members of Crossfit, but were not within the notification area, andl
all in favor of the request.
Board Member McGinnis questioned the number of parking spaces when the
building was constructed. Mr. Haskins stated that the use for the building
when initially constructed did not require the same number of parking spaces
as the current use. A Health Club is allowed by right within Light Industrial
District, and does require one space per 200 square foot of floor space, plus
two more for office area. Ms. 011ie stated that when the building was
constructed, the use was for office/warehouse use, and the parking
requirement was one space per 500 square foot.
Board Member Baumbach questioned the traffic counts for Regency and
Exchange. Mr. Haskins stated that he held a conversation with the City
Engineer, who stated that traffic counts are low currently. However, as
Regency Business Park continues to develop, the traffic will increase. The
City Engineer also stated that Woodbridge Parkway is under construction to
connect to Highway 78, and at some point in the future, Regency will connect
to Woodbridge Parkway.
Chairman Baumbach opened the public hearing. Mr. Kumars Poorkiyani, 211
Regency Drive, property owner for the subject property, stated that the tenant
has a three year lease, and has been in the current building for twelve
months.
Mr. Chris Coker, 816 Carlton Road, tenant for the property, stated that if the
variance is approved, the Crossfit will have the entire building for two years.
Mr. Coker went into detail of their layout of the Crossfit, stating that there are
eight classes during the day, with approximately ten clients attending each

class. On average there are eight cars, and at peak time twenty to twenty-four
cars.
Mr. Coker stated that Crossfit is different than a global gym in that Crossfit is
a one on one training, whereas the global gym is not. The business grows by
clients attending the classes and referring them to their friends.
In response to the comment form submitted in opposition, Mr. Coker stated
that he was unaware of blocking the drive for adjacent businesses, and will
approach neighbors about parking. Mr. Coker will post signs for clients stating
they are not to block surrounding properties. Mr. Coker stated that if the
request is denied, the Crossfit will be forced to close, as there is not available
building to suit their needs. The request is not to grow the clientele ratio, but
to offer more floor area.
Chairman Baumbach closed the public hearing.
Board Discussion
Mr. Haskins stated that the Board, if approving the request, may include in
their motion a time limit and for use only. Chairman Baumbach expressed
concern of the parking on the street within the whole Regency Business Park
Addition. The parking on the street was not directly for the clients at Crossfit,
but to other businesses in a two to three block area.
Board Member McGinnis stated that the request is unique, and understands
the mission of Crossfit. Crossfit will not have more than 10 to 15 people in
one class with one coach at a time.
Board Action
A motion was made by Board Member McGinnis, and seconded by Board
Member Jourdan, to Grant the request until April 2016, for the current tenant,
Crossfit and the current use. Motion carried 5 —0.

A motion was made by Board Member Potts, and seconded by Board Member
McGinnis, all Board Members were in conse nd the meeting adjourned at
