Hold a public hearing to consider and act upon a request by Cesar Guevara for a Variance to Section 2.5.C.2(c)5 of the Zoning Ordinance for properties requiring a minimum 20 foot rear setback for accessory buildings, property located at 103 Towngate Drive,being Lot 23, Block A of the Westgate Phase 3 Addition. ZBA 2014-05 2. Hold a public hearing to consider and act upon a request by Don Clark for a variance to Section 5.2.E parking regulations of the Zoning Ordinance to reduce the required Recreational, Entertainment, and amusement use, to allow parking spaces calculated at 1:200 in lieu of the required 1:150. Board Members present were; Board Member Robert Holcomb, Board Member Jason Potts, Board Member Kevin Finnell and Board Member Bill Hiney. Staff members present were: Renae' 011ie, Planning Director, Jasen Haskins, Planner, and Mary Bradley, Administrative Assistant. NOMINATION CHAIR AND VICE CHAIR Nominate and vote Chair. A motion was made by Board Member Finnell to nominate Board Member Hiney as Chair. Motion failed due to lack of second. A motion was made by Board Member Holcomb to nominate Board Member Jourdan as Chair. Motion seconded by Board Member Hiney. Motion carried 4-0, with Board Member Jourdan abstaining. Nominate and vote Vice Chair. A motion was made by Board Member Holcomb to nominate Board Member Potts as Vice Chair. Motion seconded by Board Member Finnell. Motion carried 4 -0, with Board Member Potts abstaining. CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the April 21, 2014 Meeting. A motion was made by Board Member Hiney, and seconded by Vice Chair Potts, to approve the Minutes from the April 21, 2014 Meeting as submitted. Motion carried 5 — 0. Minutes July 21, 2014 Wylie Zoning Board of Adjustment Page 1 of 3 PUBLIC HEARINGS Item 1 —ZBA 2014-04 Hold a public hearing to consider and act upon a request by Don Pool, Director of Operations for Wylie ISD for a Variance to Section 5.5.A of the Zoning Ordinance requiring that all temporary uses operate 90 days or less within a one-year time frame, property located at 1100 McCreary Road, being Tract 3 of the Moses Sparks Survey. ZBA 2014-04. Staff Comments Mr. Haskins stated that applicant is Wylie Indepentent School District, and requesting a variance for the use of two temporary buildings longer than 90 days or less within a one-year time frame for Groves Elementary School. The school is located at 1100 McCreary and was platted in April 2001 as McCreary Road School Addition. The student enrollment for the schools, and the residential housing in the surrounding area has experienced rapid growth. The WISD is requesting a Bond in November for additional schools, however the construction of the schools, if the Bond is approved, will not begin for a couple of years. Groves Elementary School is in immediate need of additional classrooms. The applicant is requesting a variance for two temporary buildings to last at least two years or until the completion and occupancy of additional schools, whichever comes first. Thirty comment forms were mailed to surrounding property owners. One response was received in opposition of the request. Public Comments Chairperson Jourdan opened the Public Hearing. With no one approaching the Board Members, Chairperson Jourdan closed the Public Hearing. Board Discussion The Board Members expressed concern of the location of the buildings. Mr. Haskins stated that due to the layout constraints of the school, the buildings will be placed off McCreary Road. Groves Elementary is one of the smallest schools in the immediate area, with a very small playground. The temporary buildings will not have plumbing or restrooms. Minutes July 21, 2014 Wylie Zoning Board of Adjustment Page 2 of 3 Board Action A motion was made by Vice Chair Potts, and seconded by Board Member Finnell, to GRANT the request for a variance to Section 5.5.A of the Zoning Ordinance, allowing two temporary buildings to be placed on the property for two years and the applicant is request a variance at the end of the two years, if no needed. Motion carried 5 - 0. Ms. 011ie requested the Board Members to consider changing the start time of the meeting from 7:00 to 6:00 or 6:30. The Board Members will consider and act upon possible time change at the next meeting. ZBA 2014-05 Discussion Applicant: Cesar Guevara Owner: Shalene and Cesar Guevara The applicant is requesting a variance to Section 2.5.C.2(c)5 of the Zoning Ordinance Development Standards for SF- 10/24 zoned properties that requires a 20' rear yard setback. The purpose of the setback standard is to ensure adequate spacing between structures and between structures and drive lanes for the placement of utilities, fire safety, and green space. The applicant is requesting the minimum setback be reduced to 0' to add a carport at the rear of the property. A unique circumstance may exist on the property due to the property being a rear entry property on the end of an alley. Traffic is limited to the homeowner and the utility easement was put in place during platting. Even with the unique situation of the property, staff recommends against the granting of the variance as requested because of the proximity to the utility easement and the alley. However, a 5' setback could still meet the purpose of the Ordinance for utility and drive aisle spacing. Public comment forms were mailed to sixteen (16) property owners within 200 feet of this request, as required by State Law. At the time of this posting three responses were received, three in favor of the proposed variance, and no response received in opposition. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or Page 1 of 2 Page 2 of 2 ZBOA 2014-05 (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions,the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions,the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie. Property located at 103 Security Court, being Lot 5R Block A of the Hooper Business Park Addition(ZBA 2014-06) Discussion Applicant: Don Clark Owner: Don Clark The applicant is proposing a gymnasium business which is classified in the Zoning Ordinance as a Recreational, Entertainment, and Amusement Use. The required parking ratio for such a use is listed as 1:150. The applicant is asking for a variance to reduce the required parking to a ratio of 1:200. Article 8, Section 8.4.C.4.e states that, the Board may waive or reduce the parking and loading requirements in any district, whenever the character use of the building is such as to make unnecessary the full provision of parking or loading facilities, or were such regulations would impose an unreasonable hardship upon the use of the lot, as contrasted with merely granting an advantage or a convenience. The applicant and staff feel that some reduction in parking may be warranted in this circumstance. The parking for the Recreational, Entertainment, and Amusement Use covers the gymnasium use, however the applicants business is run under a slightly different model than the typical gym, such as ASI. Many of the classes are not held at this facility reducing the number of likely vehicles on the property. The applicant also states that drop- off and ride-share arrangements would be higher at this facility than other gymnasiums, further reducing the needed number of parking spaces. CONSIDERATIONS: The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the Page 1 of 2 Page 2 of 2 ZBOA 2014-06 requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
