REGULAR AGENDA Regular Hearing 1. Consider, and act upon, a recommendation to the City Council regarding a Final Plat for Inspiration, Phase 2 consisting of 25 acres to establish 76 single family residential lots and 2 open space common areas for a master planned development within Wylie's ETJ, generally located north of Parker Road(F.M. 2414) and east of Aztec Trail. 2. Consider, and act upon, denial of a Site Plan for a single store 10,000 square foot retail building, being Lot 4A, Block A of the Wylie Retail Office Park shopping center. Situated on 1.151 acres, generally located southwest of SH 78 and Kreymer Lane. Public Hearing 1. Those present were: Commissioner Randy Owens, Commissioner Dennis Larson, Commissioner Jerry Stiller, Commissioner David Williams, and Commissioner Mike McCrossin. Commissioner Diane Culver was absent. Staff present was Renae' 011ie, Planning Director, Jasen Haskins, Planner, Charles Lee, Senior Planner, and Mary Bradley, Administrative Assistant. INVOCATION & PLEDGE OF ALLEGIANCE Commissioner McCrossin gave the invocation and Commissioner Owens led the Pledge of Allegiance. CITIZENS COMMENTS Chairman Smith opened the Citizens Participation. With no one approaching the Commissioners, Chairman Smith closed the Citizens Participation. CONSENT ITEMS 1. Consider and act upon approval of the Minutes from the September 2, 2014, Regular Meeting. Board Action A motion was made by Commissioner Stiller and seconded by Commissioner Larson to approve the minutes as submitted. Motion carried 5 —0, with 1 abstaining. Minutes October 7,2014 Wylie Planning and Zoning Board Page 1 of 5 Page 5 of 72 REGULAR AGENDA Regular Hearing Item 1 Consider and act upon a Site Plan for Century Business Park, Block C, Lot 1R-A developing a 6,900 square foot one story retail / warehouse facility, located at 1303 Century Way. Staff Presentation Mr. Haskins stated that the applicant is proposing to develop a single-story commercial building of 6,900 square feet for Napa Auto Parts Store. The property is approximately 0.70 acres. The subject property is part of an existing Planned Development Ordinance 2003-19. The PD was created to allow drive-through for Dickey's Restaurant which is located to the east. Board Action A motion was made by Commissioner Owens and seconded by Commissioner McCrossin to approve the Site Plan for Century Business Park, Lot 1R-A, Block C for development of a Napa Auto Parts Store. Motion carried 6—0. Public Hearing Item 1 Hold a Public Hearing, and consider a recommendation to the City Council regarding amendments to: Article 3 (Residential Standards), Article 5 (Use Regulations) of the City of Wylie Zoning Ordinance No. 2001-48, and amending the zoning from Single-Family 10/24 (SF-10/24) to Single-Family Estate District (SF-ED) as amended, related to Low- Density Residential Districts. (ZC 2014-07) Staff Presentation Ms. 011ie stated that the item is a zoning change and a public hearing. A work session was held with the Commissioners and Staff was given direction to move forward to amend the Zoning Ordinance for properties located south of McMillan Road and west of Country Club Road. The properties are currently zoned Single-Family Residential 10/24 (SF-10/24). In 2006 the city did a citywide rezoning where the minimum lot size 10,000 square feet and dwelling size 2,400 square feet. Staff is requesting the properties have agriculture use, allow house size to 1,900 square feet with a minimum lot size of 43,500 square feet; therefore creating a zoning district of Single-Family Estate District (SF-ED). Currently there are seven lots that are legally non-conforming. The zoning request SF-ED would bring a majority of the properties to conformance. Minutes October 7,2014 Wylie Planning and Zoning Board Page 2 of 5 Page 6 of 72 A brief survey was completed for twenty properties. Of those twenty, staff received five comments; two properties responded that there is no livestock but want the agricultural use, two properties responded that they have livestock and want to continue the agricultural use, and there was one response that has no livestock and does not want to have agricultural use. Primary concerns received were the type of animals allowed, the number, and the offensive smells. The subject area includes three vacant lots, and seventeen existing single family residential structures. Forty-three public comment forms were mailed to surrounding property owners. Two comments forms returned were in favor and two opposing the request. Ms. 011ie stated that within the provisions for definitions of Single Family Estate District(SF-ED), item e should be removed. Board Discussion Commissioners discussed the type of animals allowed in depth. Ms. 011ie presented the definition between a commercial based animal production and the definition allowing animals on large lots. The Commissioners were interested in obtaining comments from the public for direction. Chairman Smith opened the Public Hearing. Public Comments Mr. Marvin Fuller, 355 Donna Drive, Wylie, spoke in favor of the request, just purchased 1335 Country Club Road. Mr. Fuller requested clarification on the number of animal units, which is defined on the size of the animal and not by the head number of animals. An animal unit could be one horse, or a cow and calf or six goats. Mr. Tom Langston, 1355 Country Club Road, spoke in favor of the request and stated that he does not have livestock but enjoys the country relaxed zoning. Ms. Molisa Fuller, 355 Donna Drive, spoke in favor of the request and allows two head per acre livestock. Chairman Smith closed the Public Hearing. The Commissioners discussed animal units and agreed to incorporate Standard Practice definition of animal units. Board Action A motion was made by Commissioner Larson, and seconded by Commissioner Owens, to recommend approval to the Zoning Case 2014-07, with the following stipulations; animal per acre be listed as two animals unit per acre as defined Standard Practice, and removing Item E of Section 4 of the draft. Motion carried 6—0. Item 2 Hold a Public Hearing, and consider a recommendation to the City Council regarding change in zoning from Townhouse (TH) to Planned Development (PD-TH. Proposed single-family attached dwellings on separate lots, generally located at the southeast corner of Westgate Way and Fleming Street. (ZC 2014-08) Minutes October 7,2014 Wylie Planning and Zoning Board Page 3 of 5 Page 7 of 72 Staff Presentation Ms. 011ie stated that the applicant is Friendship Properties. The property is zoned Townhouse District and the request is Planned Development Townhouse District. The applicant is requesting to change the zoning to allow for some flexibility in the development standards within the Townhouse District. The property is a ten acre site. Primary changes are in lot size, dwelling size, and setbacks. The proposed request side yard setbacks of five feet for corner lots as opposed to 15 feet, a rear yard setback of 15 feet in lieu of 25 feet. The front yard setback remains the same at 20 feet. The applicant is proposing 15 feet alley as opposed to the required 20 feet wide alleys. In addition, the PD Conditions call for 26 feet streets width in lieu of the standard width of 31 feet. The Fire Chief and City Engineer recommend the standard 31 feet of pavement face-to-face and 50 feet right-of-way be maintained. In addition, the Fire Department recommends parking restricted to one side of the street only. The applicant is proposing guest parking spaces along the east-west collector Street. Staff recommends that these spaces be parallel and placed outside of the public right- of-way of the street instead of head in. Fifty-six notifications were mailed; with no response returned favoring the request and two (2) responses received in opposition of the request. Board Discussion Mr. Ron Nail, 2250 East Brown, applicant for the subject request, stated that he has developed several townhouses in the metroplex and desires to bring asset by constructing development in Wylie. The price of the land prohibits constructing the development to the standards in the current ordinance. The size of the width of the streets should be 31 feet. Mr. Gary Nail, represented the builder, stated that driveway length is twenty (20) feet. The parking can be revised to parallel parking. Commissioners expressed concern of the length of the driveways and narrow streets. Ms. Debbie Harris-Nail, stated that the street width can be revised to 31 feet. The community will have a Homeowners Association to regulate the development. The desire is to have the dwelling size from 1,700 to 1,750 square feet. All of the townhouses will be two story and some three story. The alleys will be 15 feet wide, and possible one-way. Commissioners expressed concern for fences blocking the visibility of vehicles in the alley. The ordinance requires 20 feet wide alleys. Ms. Harris-Nail stated that if a property owner has a fence it would be four feet. Ms. 011ie stated that the ordinance allows fencing up to six foot, and recommended that the height of the fence be spelled out in the PD Conditions. The Commissioners are considering the Concept Plan as part of the zoning request. A final Site Plan will be submitted after the approval of the zoning request. If the final Site Plan differs from the Concept Plan the zoning request would be re-opened. Public Comments Ms. Ramona Kopchenko, 1201 Lake Ranch, spoke in opposition of the request, questioned the exterior facade materials and setbacks. Commissioners questioned the exterior facade material and not noted within the PD Conditions. Mr. Nail stated that the front exterior façade material will be brick and stone with hardiboard on the back. Ms. 011ie stated that within the PD Conditions the type of exterior façade material needs to be spelled out. Board Action A motion was made by Commissioner Larson, and seconded by Commissioner Williams to table the Zoning Case 2014-08, and continue the Public Hearing until October 21, 2014, in order for the applicant to submit revisions to the street width, Section C defining brick and stone on back exterior façade material, and revised Concept Plan showing parallel parking on one side of the street. Motion carried 6—0. ADJOURNMENT A motion was made by Commissioner McCrossin and seconded by Commissioner Stiller to adjourn the meeting at 9:00PM. All Commissioners were in consensus. Portions of MUD is located in both City of Wylie's (19.656) and Town of St. Paul's (132.425) ETJs. In accordance with the approved development agreement; the MUD shall comply with City's subdivision Regulations and more specifically plat requirements for properties within Wylie's ETJ. The subject of this consideration is approximately 25 acres located in Wylie's ETJ & St. Paul's ETJ for 76 single family lots and two common area lots consistent with the approved development agreement. Building Bulk and Articulation In order to avoid large blank facades, variations in the elevation of residential facades facing a public street shall be provided in both the vertical and horizontal dimensions. At least 25 percent of the façade shall be offset a minimum of 1 foot either protruding from or recessed back from the remainder of the facade. b. House Numbers All Townhome residential units shall have a front stone wall plaque with resident address beside the main entry of the dwelling unit. c. Exterior Facade Material All Townhome residential units shall have a minimum of one-hundred(100)percent of the exterior façade composed of kiln-fired clay brick, or stone laid masonry units or masonry stucco, with 20 percent stone or decorative brick accent, excluding windows, doors and other openings. Glazing shall not exceed twenty-five (25)percent of the front elevation of the residence. Dormers, second story walls or other elements supported by the roof structure may be composite masonry materials if approved by the Building Official as having the same durability as masonry or stone and when offset at least two (2) feet from the first floor exterior wall. Wood, vinyl siding and EIFS materials shall not be used for exterior walls. d. Exterior Facade—Porches Each Townhome residential units shall have a combined total covered front or side entry of a minimum of 50 square feet of floor area. e. Exterior Facade—Balconies To enhance livable outdoor space, balconies shall be added to the exterior on the second floor of all Townhome residential units that have rear-entry garages. f. Discussion The City Council has declared as a matter of ordinance that the preservation, protection, and use of landmarks and historic districts is a public necessity because they have a special character or a special historic, architectural, aesthetic, or cultural interest and value and thus serve as visible reminders of the history and heritage of the City of Wylie. At its July 31, 2014 meeting, the Historic Review Commission directed Staff to move forward with drafting an ordinance to expand the boundaries of the Downtown Historic District to include properties west of the railroad. The district will encompass properties along Cottonbelt from Elliot to Brown, including properties north of Brown Street on Keefer. The purpose of these revisions is to extend the boundaries of the DTH and to establish clear and concise design standards for new and renovated structures, including but not limited to signage. As time and technology change so must our ordinance as it relates to design and function. However, it is also important to identify those areas that we desire to preserve and maintain to reflect as closely as possible the rich history of Wylie. However, the HRC was unable to hold the public hearing due to lack of a quorum. The only exceptions might be the house at 211 N. Keefer, which the tax records say was built in 1906 and the Akin house at 303 N. Keefer that was built in 1935. Most of the other houses have been built in the 1950's-1980's.Some of the houses along Cottonbelt are sadly in need of repair. Others in the proposed area are rentals that need some TLC, lawn service,and trash cleanup.A few of the houses are well kept, but certainly not'historic'. The city had the sidewalk put in to 'beautify'the area. Grass grows between it and the curb,tree droppings clutter it, some has sunk so it's not even,and cars park across it because driveways have been shortened. Keeping it trimmed has made a lot more work for any resident that wants their property to look nice. We live in one of the oldest houses in the area.There is no tax record for its beginning. An elderly neighbor said part of it was there when she moved down the street from it in 1918. It doesn't have any'historical character'since it was just an old farm-like house to begin with. It has been modernized with an attached garage, new widows and colorful,wide siding. The subject property totals approximately .588 acres in size and contains a 6,600 square foot building with multi- tenant spaces of varied commercial uses, and is platted as A&W Properties. The current zoning on the property is Commercial Corridor and allows for a variety of commercial/retail uses, as well as very limited manufacturing type uses. Pawnshops are currently allowed by right within Light Industrial Zoning Districts. There are 2 existing pawnshops operating within the city limits. One located on Ballard Avenue and approximately 2.5 miles from the subject property. The other is located on SH 78 and is approximately 3 miles away from the subject property. Both of the current pawnshops existed prior to zoning amendments to allow only in Light Industrial Districts. In 2011,the City Council from a recommendation by the P&Z Commission adopted ordinance amendments to Section 5.2 to restrict pawnshops to LI Districts only. In accordance with Finance Code Chapter 371 § 211.0035 the governing body of a municipality shall designate pawnshops that have been licensed to transact business by the Consumer Credit Commissioner as a permitted use in one or more zoning classifications, and may not impose a specific use permit requirement or any requirement similar in effect to a specific use permit. The applicant purchased the property in December of 2013 according to Collin County Appraisal District records and states that they have been in the pawnshop business for 23 years. Page 1 of 2 Page 53 of 72 Page 2 of 2 When the ordinance was amended in 2011 there were over 20 business listings categorized as Pawnbrokers, and/or Trading Posts within a 10 mile radius of S.H. 78 &F.M. 544 (Wylie's major intersection) according to available data within the Reference USA databases. Currently there are six such uses in Wylie alone. In 2003, a variance to the landscape ordinance was granted to allow a reduction from 20% required to 19% provided. In 2007, a parking variance was granted to the subject tract to allow for reduced parking requirements (1 space) to allow for additional retail uses. The hardship presented in both cases was stated as the general vicinity moving toward retail as opposed to a warehouse market. There are currently 17 total spaces on the subject lot and according to most recent certificates of occupancy and visual drive-by, three lease spaces are vacant. Based on the active certificates of occupancy, twelve parking spaces are required, leaving a total of five available for future tenants. In 2007 a Shared Parking Agreement (Exhibit B) was adopted by Council to allow the two adjoining properties to share parking spaces. However, that agreement becomes void when the properties are no longer under common ownership. A new agreement would have to be sought and approved. Staff has reviewed the request and does not recommend approval of the requested rezoning. It is staff's opinion that a Light Industrial Zoning District surrounded by Commercial Corridor to the south, west & east and Single Family to the north is not conducive to the area nor is it in conformance with the Comprehensive Land Use Plan. My property (ID#2534869 & 25348760) is directly across the street from this location. I believe it will be irreparably and negatively impacted. My neighbor, Mrs. Mary Davis (ID#432348 or 2078582) wholeheartedly agrees and has also sent in her opposition regarding this proposed change. Our property will soon be commercial, and no worthwhile big box chain or luxury apartments will want to be directly across the street from a pawn shop. Also, my worry is that once one pawn shop goes in, other pawn shops and industrial type business may soon follow. I hope that you will take my concerns in consideration as you debate the merits of changing the zoning to accommodate such an inappropriate business in this part of town. I do not think the City of Wylie would benefit in any way from pawn shops and other like businesses lining Highway 544 as you enter our town. A Final Plat was approved in 2012 and created 63 single-family residential lots and three open space lots. The intent of the amendment is to decrease the front and rear yard setbacks for Tract A and Tract B to address builder and market demands for a deeper pad for the purpose of constructing larger homes. The applicant is proposing a decrease as follows: 1. Tract A lots front setback from 25 feet to 20 feet. 2. Tract A lots rear yard setback from 25 feet to 20 feet. 3. Tract B lots front yard setback from 30 feet to 25 feet. 4. Tract B lots rear yard setback from 30 feet to 25 feet. In 2011, an amendment was adopted to allow for a larger main north/south route to a collector street and to add alleys to prevent any direct driveway access onto the collector. With these proposed additions, the applicant cannot meet the language of PD 2000-22B that requires all garages to be side-loaded and a minimum front yard setback of 30 feet for Tract A lots and 35 feet for Tract B lots. The adopted Ordinance allowed a front yard minimum setback of 25' for Tract A lots, and 30' for Tract B lots. The requested reduction was in conformance with the current SF-10/24 zoning district front building line of 25'. The minimum dwelling size for Tract "A" remains as 2,000 s.f., exclusive of garages, breezeways and porches. The minimum dwelling size for Tract"B"remains as 2,400 s.f.,exclusive of garages,breezeways and porches. The minimum dwelling size for single-family residential in the current ordinance is 2,400 s.f. In addition, the typical lot size for Tract "A" lots increases from 10,000 s.f.to 10,200 s.f.,and the typical lot size for all Tract`B"lots has a minimal decrease from 12,690 s.f.to 12,502 s.f.
