Consider Election of a Mayor Pro-Tem ADJOURNMENT Posted this the 18 day f Ma h, 1994 at 5:00 p.m. MINUTES # 1 MINUTES OF THE WYLIE CITY COUNCIL February 22, 1994 CALL TO ORDER Mayor John Akin called the meeting to order with the following Councilmembers present: Reta Allen, John Mondy, Steve Wright, Ortie Messenger, and Bud Naish. Jim Swartz was absent. OATH OF OFFICE - CHIEF OF POLICE City Attorney Steve Deiter administered the Oath of Office to newly appointed Chief of Police Dave Brungardt. CONSENT AGENDA (1) minutes of February 8 and February 15, 1994 (2) Resolution No.94-3 Declaring the Week of February 28th as Public Schools Week (3) Resolution No.94-4 Designating the Month of April as Fair Housing Month (4) Resolution No. 94-5 Declaring April 14, 1994 as Student Government Day Allen made a motion to approve the Consent Agenda. Messenger seconded the motion. The motion was voted on and passed unanimously. Akin presented Betty Stephens and representatives of each Wylie campus with the resolution naming public schools week. REVISED GUIDELINES FOR THE ADMINISTRATION OF URGENT NEED GRANT City Manager Steve Norwood explained that the State had recommended some changes to the guidelines previously adopted by the Council but that the basic requirements within the guidelines would remain. Naish made a motion to approve the revisions. Wright seconded the motion. The motion was voted on and passed unanimously. INTERLOCAL AGREEMENT WITH COLLIN COUNTY FOR ROAD MAINTENANCE Norwood explained that the basic road maintenance agreement provided for materials and labor of county maintained roads. Messenger made a motion to approve the agreement. Wright seconded the motion. The motion was voted on and passed unanimously. AGREEMENT WITH FIRST SOUTHWEST FOR CABLE REGULATION REVIEW City Attorney Steve Deiter explained that a group of cities would be contracting to review the basic cable rate structure and the cost of a group contract was significantly less expensive than if cities contracted individually. Naish made a motion to approve the agreement. Mondy seconded the motion. The motion was voted on and passed unanimously. FINAL PAYMENT TO RHODE CONSTRUCTION FOR NEWPORT HARBOR BOOSTER PUMP STATION Norwood explained that final payment had been withheld pending submission of required inspections, specifications, and operating manuals. He stated that with signed affidavits, submission of documents, and operational status of the pump, he recommended payment. Messenger made a motion to approve the final payment. Allen seconded the motion. The motion was voted on and passed unanimously. RESOLUTION N0.94-6 ACCEPTING EFFORTS TO COMPLY WITH ORDINANCE 93-57, AN SUP AUTHORIZED FOR AN AUCTION HOUSE IN A RETAIL ZONING CATEGORY Norwood explained that the ordinance required a parking agreement with First Baptist Church was not feasible due to the non-profit status of the church and proposed that Council accept a letter of agreement in lieu of the contract. Wright made a motion to approve the resolution. Naish seconded the motion. The motion was voted on and passed unanimously. STAFF REPORTS Norwood explained that sales tax receipts came in at a record $64,000 and that the $2,000,00 allocated by the county for road improvements and right of way acquisitions was being allocated for several smaller projects instead of major improvements on FM-544. Norwood stated that Collin County officials had indicated that when improvements were required on FM-544. EXECUTIVE SESSION Council adjourned into Executive Session under 551 .074, Government Code to discuss personnel regarding the evaluation of the City Manager. Upon reconvening into regular session, no official action was taken. ADJOURNMENT As there was no further business to come before the Council for consideration, the meeting adjourned. SUBJECT 3/22/94 2 Resolution Declaring Building Safety Week SUMMARY OF SUBJECT: Attached is a resolution declaring the week of April 10th as Building Safety Week. This is a program sponsored nationally by the International Conference of Building Officials (ICBO) to ensure that buildings are safe, accessible places to work, play and live by enforcing life-safety regulations by reviewing building plans, issuing building permits and inspecting buildings during construction. SUBJECT 3/22/94 4 Resolution Designating Remainder of Tree Grant Funds to Be Used at Municipal Complex & Olde City Park SUMMARY OF SUBJECT: Attached is a resolution designating the remainder of the tree grant funds for use in other projects. We estimated $7450 ($4850 in Federal dollars and $2600 in City funds) for the project but the low bid came in at $4600. An unused balance of $2850 remains. We have requested the use of these funds for other tree planting projects and have been told that the designation must be made by resolution.. March 14 , 1994 Attention: City Council Members Per your request I am listing the areas that I feel are a danger and concern in the alley running parallel with Dogwood Court and Woodhollow Court with access from Butler. These are the items I plan to bring to your attention. 1. The alley is being used as a "Cut Through" for those who do not wish to go around via Stone Road. 2. In one hour I was able to count as many as 7 vehicles using the alley who do not currently live on either street. This is every day and night. Not only do they cut through, they veer around the speed bumps making large holes in the property, they use the alley as a street which is built for minimum traffic therefore the alley has MAJOR damage. 3. Another problem is the speed of these cars is far in excess of the posted speed limit of 15 MPH. When I address you at the City Council Meeting we can discuss what has happened in the past with this very situation and hopefully come to a resolution to the current situation. I will also discuss what my concerns are because of this current situation. Curtis ;gt Memorandum I DATE March 17, 1994 TO : Mayor John Akin and City Council FROM • Steve Norwood, City Manager SUBJECT : Status Report FM 544 - - Allocation of Funds As most of you know, a couple of weeks ago there was an article that appeared in the Dallas Morning News regarding 'Shifting' of funds from FM 544 to other projects within Collin County. Obviously city staff and council reacted negatively to these remarks by Collin County Commissioners. After a series of discussions, a lunch and numerous phone calls, it culminated Monday, March 14, at the Collin County Commissioners Court Meeting. In essence, there were never any funds earmarked for FM 544 from the 1983 bond program. We all agree that FM 544 along with SH 78, are two very key projects not only to Wylie, but for all of Collin County. Discussions with the commissioners centered on the fact that only $1 .7 million dollars remained from the 1983 bond program. It was also recognized that the entire amount would not be enough to pay for the necessary right-of-ways and utility relocations. The Commissioners Court was further enlightened by Mayor Akin stating that the residents of Wylie and Collin Country desired timely construction and completion of FM 544. The Commissioners Court was very much in agreement with the Mayor's comments and unanimously approved allocating $1 million dollars of the funds toward right of way acquisition. Approximately $300,000 was allocated to the upgrading of Murphy Road, south of the intersection from FM 544 to Renner 1 Road. Although this will not satisfy the total need for FM 544, it will at least 'buy us'approximately 12 - 18 months so that we can begin utility relocations as soon as possible. At next Tuesday's council meeting, I will reiterate these comments, and I'm sure Mayor Akin will articulate his views on the Commissioners Court decision. Sewer Grant - - Unbelievable Luck This unbelievable luck is not of the 'good kind' As some of you know, we were informed last week that we officially scored #19 out of the total 40 cities submitting project requests. After the regional score placed Wylie at #8, it was very strongly agreed by city staff, COG staff, along with our consultants, that we were a definite for funding. However, the state once again, surprised the City of Wylie. All along we knew the state score would drop Wylie out of the top 10 to most likely #11 or #12. Never in our wildest imaginations did we believe that we would be dropped out of the top 18 projects to be funded. The state scores are based solely on distressed factors, i.e., unemployment, poverty, etc. With Wylie being in Collin County, we were scored very poorly from the state. There is nevertheless, a very good chance that later this year, a double funding cycle will be granted; thus enabling Wylie's chances of receiving funding to be greatly enhanced. Lee Lawrence of Southwest Consultants will be at the council meeting on Tuesday night to update council regarding the status of this sewer grant. Lee will be introduced under my staff report. Sales Tax Receipts - - Indicate Major Increases As of the beginning of fiscal year 1994, we have been experiencing major increases in our sales tax collections. As you will remember last year, the city had the highest recorded sales tax receipts in history at $453,000. Through five months of FY '94, we are ahead of that figure by 25%. The February receipts total $42,982 as compared to $28,926 of a year ago. This represents a 48% increase over last years figures. It is very possible that we will see our sales tax revenues finish the year between the ranges of $525,000 and $550,000. This is approximately $100,000 over what 2 was budgeted. Police Department Activity - - February 1994 During the month of February the patrol division logged over 12,000 miles patrolling the city in response to 317 calls for services. During the month, seven accidents were investigated and all were classified as minor with no reported injuries or fatalities. The patrol department issued 138 violations along with the issuance of 100 warnings. The communications division dispatched a total of 387 calls for service of which 317 were patrol, 64 were fire calls and 6 public works calls. Building In •ection - - N. lain •f lip As was communicated to city council earlier, our single family permits continue to escalate at a high percentage. Later this month, a monthly report will be launched and forwarded to city council. This report will consist of all inspections/permits generated from Community Development. To date through February 1994, we have issued roughly 50 single family permits as compared to 56 for the entire previous year. Please keep in mind that we have not even entered the busy season which typically is from May through August. I instructed Russell to begin advertising for the new building inspector's position that was previously discussed at the last worksession. I realize council has not officially authorized this position, I'm expecting that this authorization will be granted at our meeting on Tuesday, March 22 when we discuss the budget amendments. As you are well aware, we are in dire need of the additional inspector. By advertising this position early, we hope to have them on board at the start of the busy building season. To further illustrate some of the problems that Russell encounters in dealing with builders, be it single family or commercial, and to fulfill council's desire of ensuring that all buildings in town are built to code and are thoroughly inspected once plans are approved, attached is an ad in the Dallas Morning News by United Home Craft. United Home Craft is a new builder in Wylie who has purchased lots in Presidential Estates and Quail Hollow. The ad basically states the desire of United Home Craft to hire a construction manager but also states no construction experience necessary. I will continue to update council on future building activities. 3 Clean Up and Green Up As a reminder, Clean Up and Green Up is planned for Saturday, April 16, from 8:30 a.m. to 1 :00 p.m. The volunteers will once again be meeting at Olde City Park. BFI will have dumpsters in Wylie at two locations from April 9 through the April 17. Locations will be at Valentine Park and Olde City Park with each site having 5 dumpsters. As we get closer, I will be updating council with more specific information. Also at the upcoming Chamber Luncheon, Tuesday, March 22, the luncheon will be dedicated to Clean Up and Green Up as sponsored by the Keep Wylie Beautiful Committee. t.m-r Activi R- • •rt - - BFI Recvclin. Driv- - B Shootin•s - - No A•ditional Leads As was communicated to City Council earlier this week, three houses were randomly shot during a drive-by shooting. The Police Department has no suspects at this time. The shootings occurred early Tuesday morning between 2:00 a.m. and 5:00 a.m. Most likely, the suspects are juveniles or young adults. During Spring Break, vandalism and juvenile crimes tend to increase. This past week, the Police Department has questioned several juveniles who were reportedly carrying guns or were associated with gang members. While no formal charges have been filed, the Police Department will continue questioning and searching for leads. Either I or Chief Brungardt will notify Council when suspects are in custody. Hometown Furniture - - Construction of Sewer Line As you will remember, Council discussed installation of a sewer line from Eubanks south to Hometown Furniture. This sewer line would provide service to Hometown Furniture, Family Hair Care and a couple of other properties. You will recall that the owner of Hometown Furniture had insisted that his property had been annexed and property taxes were being paid without the receipt of City services. As the bids came in on this project, we did some last minute checking 4 and found that Hometown Furniture is not in the City of Wylie. We believe that the original intent was to annex the property, but when the legal description was submitted for the enacting ordinance, it mistakenly annexed only the vacant property to the northeast of Hometown. I assume this was an oversight. However, since we send tax bills based on legal descriptions, Hometown has never been billed by the City for taxes and they have, therefore, not been paying taxes. I am reluctant to recommend that the City approve construction of a sewer line to serve a property not in the City. We are working with the Family Hair Care property owner in obtaining an easement so they can install a sewer line at their own expense and tie onto City sewer. Budget Amendments At next Tuesday night's meeting, we will officially recommend budget amendments to the FY'93-94 Budget. We attempt to do these amendments at mid-year to compensate for oversights, increased revenues and expenditures and to adopt a budget that better reflects our financial status. The most notable amendments are in the Fire Department at approximately $22,000. This includes upgraded equipment, hoses & safety related items and additional bunker gear estimated in the amount of $3600 due to last minute increases in volunteer participation over the past month. The other budget amendments are mostly clean-up in nature. The budget will also need to reflect the market adjustments that were given. These funds are budgeted but need to be moved to the specific departments receiving them. A building inspector position is also included for approval. Overall, we are looking at increased expenditures of approximately $50,000 from the original budget but revenue increases of $150,000 from the original budget. These revenue increases are attributed to sales tax collection and building permit fee increases. I will explain the amendments in more detail on Tuesday night. Mrs. Lynne Curtis has requested an appearance before Council to request the closing of Butler alley. I've informed her that this has been before Council on several occasions, that Council is very much aware of the problem, and it has been thoroughly discussed. She has, however, requested an appearance before Council to discuss the issue. You might remember Mrs. Curtis as the mother of triplets who was opposed to once a week garbage pickup.
