10-24-2014 (Zoning Board of Adjustment) Minutes litt...., Wylie Zoning Board of CITY OF WYLIE Adjustment r Minutes Zoning Board of Adjustment Monday, October 20, 2014— 6:30 pm Wylie Municipal Complex— Council Chambers 300 Country Club Road, Building 100 CALL TO ORDER Chair Linda Jourdan called the meeting to order at 6:32 p.m. and stated that a quorum was present. Board Members present were; Board Member Robert Holcomb, Board Member Kevin Finnell, Board Member Bill Hiney and Board Member Andres Gonzalez. Staff members present were: Renae' 011ie, Planning Director, Charles Lee, Senior Planner, and Mary Bradley, Administrative Assistant. p.m CONSENT ITEMS 1. Consider and act upon approval of the Minutes of the August 18, 2014 Meeting. A motion was made by Board Member Hiney and seconded by Board Member Finnell, to approve the Minutes from the August 18, 2014 Meeting as submitted. Motion carried 5 — 0. PUBLIC HEARINGS Item 1 —ZBA 2014-07 Hold a public hearing to consider and act upon a request by Gary Taylor for a Variance to Section 3.F.3.a of the Zoning Ordinance requiring the base materials for residential buildings be brick, stone, or masonry stucco, property located at 1204 South Birmingham being Tract 28 in the E.C. Davidson Survey. ZBA 2014-07. Staff Comments Ms. 011ie stated that the applicant is requesting a variance to Section 3.F.3.a of the Zoning Ordinance to allow fiber cement Minutes October 20,2014 Wylie Zoning Board of Adjustment Page 1 of 4 product versus the required base material of a masonry product of brick, stone or stucco. The request is to allow for the wood residential building to be renovated while maintaining the original aesthetics. The applicant is stating the current structure is not able �--, to hold a brick exterior. A copy of a letter from an engineering firm recommends not adding brick at the second level of the structure. The applicant is also requesting an expansion for a legally non- conforming structure with the addition of a second floor landing/deck, as outlined in Section 9.4.B.2{ii). The landing/deck would provide shelter for lower unit entry. Public Comment Forms were mailed to 19 property owners within 200 feet of the request. No responses were received in favor or in opposition of the request. Public Comments Chairperson Jourdan opened the Public Hearing. Mr. Gary Taylor, 109 N Jackson, Wylie, applicant/developer, stated that the structure was a garage several years ago and was converted into an apartment. The intention is to construct two single-family apartments, one upstairs and one downstairs. The expansion of the landing/deck will provide a stairwell outside the building for the access to the upstairs dwelling. The drainage from the driveway went right into the first floor. Modifications were made to the driveway to keep the water from draining into the building. The desire is to upgrade to an higher end apartments. Board Discussion Board Members questioned the layout of the apartments. Mr. Taylor responded that the current design is poorly configured. The desire is to configure the apartments economically as well as useful for the tenant. Mr. Taylor stated that end result will be single bedroom efficiency apartments. Currently there is no dining room in either of the apartments and inside walls will be configured to allow a sit down area both apartments. All windows will be replaced with new windows. Motion carried 4 — 1, with Chairperson Jourdan in opposition. Item 2—ZBA 2014-08 Hold a public hearing to consider and and act upon a request by Eddie Borden for a Variance to Section 2.5.C.2(c)4 of the Zoning Ordinance for properties requiring a minimum 20 foot side yard setback for accessory buildings on corner lots, property located at 701 Georgetown Drive, being Lot 16, Block E of the Westgate Phase 3 Addition. ZBA 2014-08 Staff Comments Ms. 011ie stated that the applicant is requesting a variance to Section 2.5.C.2 to allow an accessory building in a side yard setback for a corner lot. The Zoning Ordinance requires a 20 foot setback and the applicant is requesting 5 foot side yard setback. The property is located on the corner of Westgate Way and Georgetown Drive. The purpose for the setback standard on corner lots is to ensure adequate spacing between structures, and drive lanes for the maintenance of visibility triangles, and the reduction of visual clutter. The accessory structure would be hidden from an 8 foot wooden fence, therefore visual clutter is not affected. The accessory structure is 13 feet in height. The Zoning Ordinance allows for 14 feet. The applicant does have a swimming pool and a covered patio that prohibits the accessory structure from being located in another area of the backyard. Public Comment forms were mailed out to 31 property owners. Thirteen comment forms were received all in favor and no comment forms were received in opposition. Public Comments Chairperson Jourdan opened the Public Hearing. Mr. Eddie Borden, 701 Georgetown Drive, applicant, stated that the fence is 8 foot board on board cedar with an six inch border on the bottom. The trim will match the house trim, and the roof will stay the same as the house. Chairperson Jourdan closed the Public Hearing. �--� Board Action A motion was made by Board Member Hiney, and seconded by Board Member Finnell, to Grant the variance to Seciton 2.5.C.2(c)4 to allow five foot side yard setback for an accessory building. Motion carried 4— 1, with Chairman Jourdan voting in opposition.
