Issue
Discuss and consider the Preliminary Plat for the Southplace Estates Phase V and Phase
VI.
Background
' The Preliminary Plat has been submitted for the Southplace Estates Phase V and VI,
which is located in the south central portion of the City adjacent to Ballard Street just
north of the Twin Lakes Subdivision). In order to meet the parkland dedication
ordinance requirements of the property, the development will need to provide 1.14 acres
(1.5 acres per 100 lots) of parkland or $38,000 (76 lots x $500) in fees or some
combination. The Preliminary Plat shows no dedication of parkland.

Article VIII, Section 2 of the City Charter and Section 78-38 of the City Code identify
the duties of the Park Board to serve in an advisory capacity to the City Council on the
planning and development of parks and recreation facilities and the regulations governing
their use.

Issue
Discuss and consider establishing a policy for the selling of items in Community and Founders
Park and changes to Section 78-150 in the Code of Ordinances.
Background
Currently,there is no clear policy on handling requests from individuals or groups desiring to sell
items, food, and beverages in the City parks and facilities. Many of these requests are from non-
profit groups attempting to raise funds for their activities. Staff has been handling requests on an
ad hoc basis, but this method does not provide a clear and consistent approach for citizens.
Section 78-150 in the Code of Ordinances allows peddling and vending of articles within a City
park if the person or entity is "recommended by the parks and recreation board and approved by
the city council to operate a concession or concessions for the sale of specified goods . . ." At
this time, the City has an exclusive contract with a concessionaire who operates the concession
stands at Community Park and Founders Park. Allowing other people or entities to sell food and
beverages at these locations appears to be in direct conflict with the contract. The ordinance and
the current method of handling requests need clarification.
