Staff Comments Ms. 011ie stated that the applicant is requesting a variance to Section 3.F.3.a of the Zoning Ordinance to allow fiber cement Minutes October 20, 2014 Wylie Zoning Board of Adjustment Page 1 of 4 product versus the required base material of a masonry product of brick, stone or stucco. The request is to allow for the wood residential building to be renovated while maintaining the original aesthetics. The applicant is stating the current structure is not able to hold a brick exterior. A copy of a letter from an engineering firm recommends not adding brick at the second level of the structure. The applicant is also requesting an expansion for a legally non- conforming structure with the addition of a second floor landing/deck, as outlined in Section 9.4.B.2(ii). The landing/deck would provide shelter for lower unit entry. Public Comment Forms were mailed to 19 property owners within 200 feet of the request. No responses were received in favor or in opposition of the request. Public Comments Chairperson Jourdan opened the Public Hearing. Mr. Gary Taylor, 109 N Jackson, Wylie, applicant/developer, stated that the structure was a garage several years ago and was converted into an apartment. The intention is to construct two single-family apartments, one upstairs and one downstairs. The expansion of the landing/deck will provide a stairwell outside the building for the access to the upstairs dwelling. The drainage from the driveway went right into the first floor. Modifications were made to the driveway to keep the water from draining into the building. The desire is to upgrade to an higher end apartments. Board Discussion Board Members questioned the layout of the apartments. Mr. Taylor responded that the current design is poorly configured. The desire is to configure the apartments economically as well as useful for the tenant. Mr. Taylor stated that end result will be single bedroom efficiency apartments. Currently there is no dining room in either of the apartments and inside walls will be configured to allow a sit down area both apartments. All windows will be replaced with new windows. Chairperson Jourdan closed the Public Hearing. Minutes October 20, 2014 Wylie Zoning Board of Adjustment Page 2 of 4 Board Action A motion was made by Board Member Hiney and seconded by Board Member Holcomb, to Grant the variance request for Section 3.F.3.a to allow fiber cement product for property located 1204 South Birmingham. Motion carried 4 — 1, with Chairperson Jourdan in opposition. Item 2 —ZBA 2014-08 Hold a public hearing to consider and and act upon a request by Eddie Borden for a Variance to Section 2.5.C.2(c)4 of the Zoning Ordinance for properties requiring a minimum 20 foot side yard setback for accessory buildings on corner lots, property located at 701 Georgetown Drive, being Lot 16, Block E of the Westgate Phase 3 Addition. ZBA 2014-08 Staff Comments Ms. 011ie stated that the applicant is requesting a variance to Section 2.5.C.2 to allow an accessory building in a side yard setback for a corner lot. The Zoning Ordinance requires a 20 foot setback and the applicant is requesting 5 foot side yard setback. The property is located on the corner of Westgate Way and Georgetown Drive. The purpose for the setback standard on corner lots is to ensure adequate spacing between structures, and drive lanes for the maintenance of visibility triangles, and the reduction of visual clutter. The accessory structure would be hidden from an 8 foot wooden fence, therefore visual clutter is not affected. The accessory structure is 13 feet in height. The Zoning Ordinance allows for 14 feet. The applicant does have a swimming pool and a covered patio that prohibits the accessory structure from being located in another area of the backyard. Public Comment forms were mailed out to 31 property owners. Thirteen comment forms were received all in favor and no comment forms were received in opposition. Public Comments Chairperson Jourdan opened the Public Hearing. Mr. Eddie Borden, 701 Georgetown Drive, applicant, stated that the fence is 8 foot board on board cedar with an six inch border on the bottom. The accessory building will be contracted by Amazingly Minutes October 20, 2014 Wylie Zoning Board of Adjustment Page 3 of 4 Buildings, with no slab and under 200 square feet. The trim will match the house trim, and the roof will stay the same as the house. Chairperson Jourdan closed the Public Hearing. Board Action A motion was made by Board Member Hiney, and seconded by Board Member Finnell, to Grant the variance to Seciton 2.5.C.2(c)4 to allow five foot side yard setback for an accessory building. Motion carried 4 — 1, with Chairman Jourdan voting in opposition. ADJOURNMENT A motion was made by Board Member Holcomb, and seconded by Board Member Finnell, all Board Members were in consensus, and the meeting adjourned at 7:20p.m. Linda Jourdan, Chairperson ATTEST: Mary Bradley, Secretary Minutes October 20, 2014 Wylie Zoning Board of Adjustment Page 4 of 4 Wylie Zoning Board of _7471 Adjustment CITY OF WYLIE AGENDA REPORT Meeting Date: January 26, 2015 Item Number: 1 Department: Planning Case Number: ZBA 2015-01 Prepared By: Renae' 011ie Project Location: 600 Woodbridge Parkway Broadstone Woodbridge Date Prepared: January 21, 2015 Subdivision Name: Addition Location Map,Approved Site Plan, Amended Plat, Exhibits: Notification List and Map Subject Hold a public hearing to consider and act upon a request by City of Wylie for a Variance to Section 3.3 of the 2002 Zoning Ordinance regarding building separation and required density, property located at 600 Woodbridge Parkway, being Lot 1, Block A of the Broadstone Woodbridge Addition. ZBA 2015-01 Discussion Applicant: City of Wylie Owner: Broadstone Woodbridge,LP The applicant is requesting a variance to Section 3.3 of the 2002 Zoning Ordinance regulation on the building separation as well as the required density. In accordance with the ordinance, all detached buildings shall be separated by 20 feet or the height of the building, whichever is greater. In this case the required separation would be forty six feet based on maximum height constructed. In addition, the maximum density allowed is 15 units per acre. However, the established development contains 16 units per acre. Considerations: Building Separation 1. Building Separation: Buildings 10 was permitted on 10/27/2008. Building 10 is approximately 46 feet in height and does meet the required separation from all other Type I buildings (3 story dwellings) 2. Building 11 was permitted on 12/08/2008 and is a Type III building (garage on ground level & dwelling above) and is approximately 26 feet in height and does meet the required separation from all other Type III buildings. 3. Separations between Buildings 10 & 11 are approximately 13 feet in lieu of the required 46 feet. Because building heights vary throughout the property, so does the separation requirement. Density 1. The gross acre for the subject property is 20.48 acres, which yields 15 dwelling units per acre. 2. The original calculations included right-of-way for Woodbridge Parkway that was ultimately dedicated as public right-of-way. 3. When the right-of-way square footage is deducted, leaving the net acres as 19.45 yielding 16 dwelling units per acre. Page 1 of 2 Page 2 of 2 ZBOA 2015-01 The property is the subject of a sale, and is typical for purchaser/seller to enlist the services of an appraisal or a consultant to verify the zoning of said property. In preparing the verification letter, it was determined that some buildings did not meet the required separation and the density was over by one unit. Staff did permit all buildings upon proper submittal of plans. When reviewing the case, it was Staff's first determination to deem the property LEGALLY NON-CONFORMING. However, upon further review and consideration the decision was made to seek an official approval from the Board to deem the property LEGALLY CONFORMING through granting of a variance. If it is the Board's vote to approve the request, this will put a safeguard in place for current and any future owners. The applicant/Owner is requesting the minimum separation be set to ten(10) feet for all existing structures and to allow a maximum density of 16 units per net acres. Public comment forms were mailed to nine (9) property owners within 200 feet of this request, as required by State Law. At the time of this posting no responses were received for or against this request. The Board shall not grant a variance to the development code which: (1) Permits a land use not allowed in the zoning district in which the property is located; or (2) Is in the public right-of-way or on public property; or (3) Alters any definition of the development code; or (4) Is other than the minimum variance that will afford relief with the least modification possible to the requirements of the development code; or (5) Is based on physical conditions or circumstances of the property so general or recurring in nature as to reasonably make practicable the formulation of a general regulation to be adopted as an amendment to the development code; or (6) Is based exclusively on findings of personal or financial hardship. In order to grant a variance to the development code the Board shall find that all the following have been satisfied: (1) That there are unique physical circumstances or conditions of the lot, or other exceptional physical condition particular to the affected property; (2) That because of these unique physical circumstances or conditions, the property cannot be reasonably developed or used in compliance with the provisions of the development code; (3) That due to such unique physical circumstances or conditions, the strict application of the development code would create a demonstrated hardship; (4) That the demonstrable hardship is not self-imposed; (5) That the variance if granted will not adversely affect the proposed development or use of adjacent property or neighborhood; (6) That the variance, if granted will not change the character of the zoning district in which the property is located; (7) That the variance, if granted is in keeping with the intent of the development code; and (8) That the variance, if granted will not adversely affect the health, safety or welfare of the citizens of Wylie.
