Subject: Park board notes for next meeting
Here's the list I took at last month's meeting. As we discussed yesterday, we should give the Board responses to
the various questions at the next meeting. I put suggested responses in italics here. Also, I have attached the
agenda communication for the discussion for reviewing the parkland dedication ordinance. I will hand you a hard
copy of the draft version of the recodified ordinance today. Please read it and suggest any changes you have.
f•• Need gate at Community Park to close Park in case of missing child. Call Police for missing child. No gate
/ will be installed.
-• Eliminate head-in parking in certain areas of park, especially near library. Complete with temporary t-
poles. Need to budget for a permanent fix in the future.
I. Scooters are a nuisance. Call police if this occurs. Will be mentioned at the December meeting with the
league representatives asking them to get the word out through coaches, players, and parents.
V • Lack of practice areas. Founders Park should accommodate additional play. Other areas are Avalon
Phase I, front of City Hall, Dodd Park, large areas near WISD administration building. (I may have
forgotten a few that we discussed yesterday). Robert will contact WISD to ask if they will allow practice on
Itheir property. City may mow WISD areas if WISD cannot do so on a regular basis.
. Additional way out of Community Park for vehicular traffic. Need to budget in the future. There will be
additional access for pedestrian traffic near the tee-ball fields when the next phase of Southplace Estates,
currently under construction, is completed.
" Board wants copy of the Facilities Study. Staff will forward when staff receives a copy.
J. Board wants a list of what needs to be completed in the park system and how much it will cost. Best
answers are already available in the Master Plan and in the list of recommended projects staff completed
this past summer.

SUMMARY:
D. R. Horton has submitted a planned development, called Tradition,for City review. The proposed tract is
located east of Kreymer Lane, south of Brown Street, and west of Stone Road. The proposed development is
comprised of 456 lots situated on 158.01 acres or 2.89 lots per acre. The Planning&Zoning Board is scheduled
to review the proposal on November 16,2004, and City Council review is scheduled for December 14, 2004.
This past summer, a joint City Council,P&Z, and Park Board meeting was held to consider the same tract. The
applicant subsequently withdrew the application for development from further City consideration.
The developer is proposing to set aside 24.4 acres(+/-) as private HOA open space within the development
instead of providing the dedication of land for public parks or providing funds in lieu of said public parks to the
City. The largest single proposed open space is 3.44 acres(+/-). The remaining open space is comprised of one
HOA-controlled swim center and various smaller parcels of land adjacent to interior and perimeter streets as
shown on the site plan. Many of the lots throughout the development face these smaller parcels of open space.
Thus, in many cases,the open spaces are adjacent to the front yards and also abut the streets.
The tract also includes 13.51 acres (+/-)of floodplain and TP&L easement. The developer is not proposing to
dedicate either the floodplain or the easement to the City. However, staff has learned from previous experience
that conditions of the TP&L easement do not allow the placement of any structures,trees,benches, etc. to be
placed in the easement. Additionally,the floodplain area is not shown in the City of Wylie Parks, Recreation and
Open Space Master Plan as a potential site for any future trail systems or hike and bike trails. However,the
Master Plan does indicate that the overall general area of the tract should be considered for future development of
a regional or community park.
If the developer proposed to meet the existing parkland dedication requirements for the dedication of land for
public parks and open space or funds in lieu of, he would be required to dedicate a minimum of 22.8 acres or
$1,368,000 funds in lieu of,or some combination of both.

SUMMARY:
In order to accommodate Article VI, Section 1 of the Parks and Recreation Bylaws that states that any
amendments to the Bylaws need to be given to the member of the Board ten days prior to the meeting. The
amended changes were provided to the Board Members on October 15, 2005 meeting the ten-day requirement.
The Parks and Recreation will be amending bylaws previously approved at the September 27, 2004 meeting and
further clean up changes that were made i.e. changing Article VI, Section 1 from a ten day window to three days.
Article VIII, Section 2 of the City Charter and Section 78-38 of the City Code identify the duties of the Park Board to serve in an
advisory capacity to the City Council on the planning and development of parks and recreation facilities and the regulations governing
their use.

Re: Bylaws
I am enclosing the newest version of the bylaws for your review. The Board is having to review
changes previously voted on ten days prior to the next scheduled meeting because the current bylaws
stipulate that bylaw amendments have to be given to the Parks and Recreation Board ten days prior to
the meeting (Article VI, Section 1). Due to the ten day rule the changes approved in the last meeting
would not be valid. In order to follow current bylaws you are being given the bylaws 10 days prior to the
next meeting to approve the changes you have already approved plus staff has changed a few minor
items including the ten-day rule in Article VI, Section 1. At the October 25, 2004 meeting we will have
an action agenda item for you to discuss and consider the enclosed version of the bylaws.
Sorry for the confusion, staff just wants to ensure the changes you made follow how the bylaws are
currently stated. You will be getting your regular agenda for the October 25 meeting next week. If you

AGENDA SUBJECT: Review and discuss revisions to Chapter 78 of the City Code of Ordinances with special
attention to Article IV—Parkland Dedication.
RECOMMENDED ACTION: N/A
SUMMARY:
On January 13, 2004,the Wylie City Council approved the Board's recommended changes to the Parkland
Dedication Ordinance. Section 7 of the ordinance states that"prior to one(1)year after the effective date of this
ordinance,the Park Board shall review the Parkland Ordinance and make any recommendations for revision to
the City Council."
During the past year,the Board has dealt with many issues concerning parkland dedication. Several issues
resurface occasionally. Specifically,the Board has encountered questions concerning the acceptance of
floodplain,easements, non-residential dedications, and dealing with potential Wylie Economic Development
Corporation(WEDC) dedications.
Floodplain issues involve the question of whether or not accepting land in the floodplain should count toward the
required dedication. Some areas of floodplain are identified on the City of Wylie Park, Recreation and Open
Space Master Plan as sites for future hike and bike trail systems. Other floodplain areas are not on the Master
Plan. It is anticipated that the Board would want to clarify the issue by addressing it in the ordinance.
Similarly, some developers offer dedications of land that are within one or more of the various water, gas,
electric, or private easements located throughout the City. Some easements have regulations concerning
permissible uses of land within the easement. For instance,under TXU overhead power lines, TXU does not
allow construction of any structures or the installation of any benches,trees, light poles etc. that they feel could
interfere with their easement on the land. The Board should consider addressing whether or not the dedication of
land within easements should count toward a required dedication or if certain conditions should apply to such
dedications.
The Board also dealt with at least two non-residential dedications that involved the WEDC. The question arose
that since the WEDC helps attract and develop non-residential business to the city, and it is closely affiliated with
the City of Wylie, should they be held to the same dedication requirements as any other non-residential
developer. Particularly,the WEDC receives some of its funding from the City, and the question is whether or not
to charge the WEDC funds in lieu of land dedication.
The current ordinance requires a minimum land dedication of five acres for developments up to and including
100 lots. Recently, a subdivision development containing 43 lots has been required to meet this requirement or
pay funds in lieu of to be in compliance with the ordinance. The Board may wish to consider imposing a smaller
requirement for land dedication requirements and funds in lieu of for developments of 0 to 25 lots, 26 to 50 lots,
--51 to 75 lots, 76 to 100 lots, etc.
The existing fee structure is also provided in the Exhibit. Staff is currently conducting a fee survey with other
municipalities to see if the Board would like to consider any revisions. The survey should be completed by the
date of the November meeting.

event, if the council determines that such activity or event will be conducted in such a fashion so
as not to cause disruption of the peace of the neighborhood, and not otherwise adversely effect the
safety or welfare of citizens or city facilities.
(c) It shall be unlawful for any person except members of the police and fire
departments or employees of the parks and recreation department engaged in the performance of
their official duties to be in any municipal park between the hours of 12:01 a.m. and 6:00 a.m.
unless one of the exceptions of this section apply.

Sec. 78-102. Parking.34
(a) The city parks and recreation board staff is hereby authorized to recommend areas
in which parking of motor vehicles should be prohibited, and/or hours during which motor vehicle
parking should be prohibited in any city park or recreation or community center facility.
(b) It is hereby required that signs be erected marking the no parking areas and giving
restricted hours during which motor vehicles may not be left parked. It shall be unlawful for any
person to park a motor vehicle within the designated no parking areas in any city park, or
recreation or community center facility or to have a motor vehicle parked in any city park or
recreation or community center facility other than during designated hours in which parking is
allowed.

Sec. 78-103. Feeding of animals.
It shall be unlawful for any person to feed any animal in any city park, recreation or
community center facility, except that breads, fruits, vegetables and nuts may be fed to the birds
and squirrels.

Sec. 78-104. Possession, consumption and use of alcoholic beverages; glass containers.
(a) It shall be unlawful for any person to sell, give away, possess or consume any
alcoholic beverage, as defined in V.T.C.A., Alcoholic Beverage Code § 1.04, in any city park.
(b) It shall be unlawful for any person to possess or use any glass container of any kind
or nature in any city park.

Sec. 78-105. Peddling and vending of articles.
It shall be unlawful for any person to solicit for sale, vend, peddle, sell or offer to sell any cold
drinks, cigars, tobacco, cigarettes, fruits, candies, goods, wares or merchandise of any kind or
nature whatsoever within the city park or recreation or community center facility; provided,
however, that this section shall not apply to any person, organizations, firms or corporations, or
the agents of any person, or organization, firm or corporation, or employees of any person who are
recommended by the parks and recreation board and approved by the city council to operate a
concession or concessions for the sale of specified goods, wares, and merchandise within the city
park or recreation or community center facilities of the city.

Sec. 78-106.Horseback riding.
It shall be unlawful to ride or lead a horse or pony anywhere or any place within the city park
or recreation or community center facilities, except on streets or paths designated by signs for such
purpose.

Sec. 78-107. Speed limits for vehicles.35
It shall be unlawful to operate any motor vehicle of any kind or nature whatsoever or any
bicycle or motor bike at a speed in excess of 20 miles per hour within the any city park or
recreation or community center facilities.

Sec. 78-108.Disorderly conduct.
It shall be unlawful for any person to willfully interfere with, disrupt, or prevent the orderly
conduct of any supervised play or amusement program being conducted by the city parks and
recreation department or the city sports association in any building, swimming pool, playground or

Sec. 78-109. Penalty.
Any person violating the provisions of the fee schedule, or any part thereof, commits an
unlawful act and shall be subject to the general penalty provisions of the city Code as set for in

permit, privilege or license to which the fee pertains.

Sec. 78-131. Definitions.
The following words, terms and phrases, when used in this division, shall have the meanings

No parking means an area designated for unobstructed access on a street, path or road.

Sec. 78-133. No parking areas.
No parking shall occur where designated no parking signs are placed within Community Park.
Only emergency vehicles will be allowed in these designated areas.

Sec. 78-134. Signs and markers notifying public of no parking zones.
The city manager, or his designee, shall be responsible for installing markers and, if necessary,
signs to properly notify the public of the location of the no parking zones. The proper markings
shall be one of the following:
(1) Signs shall read "no parking zones" and shall be 12 inches wide and 18 inches high.
The signs shall be painted on a white background with letters, using not less than
two-inch lettering. The signs shall be permanently affixed to a stationery post, and
the bottom of the sign shall be six feet, six inches above the finished grade. The signs
shall be spaced not more than 100 feet apart. The signs may be installed on
permanent buildings, walls or along the roadside or path of the park or as approved
by the city manager or his designee.
(2) Pavement markings shall be marked by painted lines of yellow traffic paint six
inches in width to show the boundaries of the no parking zones. The words "no
parking zone" shall appear in four-inch white letters at ten-foot intervals on the
yellow boarder marking along both sides of the no parking zones.
(3) Curb markings shall be painted in yellow traffic paint from the top seam of the curb
to a point even with the driving surface. The words "no parking zone" shall appear in
four-inch white letters at ten-foot intervals along the curbs.

Sec. 78-135. Enforcement of division.
The no parking zone provided in this division shall in no way be obstructed. The police
department is authorized to issue citations and/or remove or cause to be removed any material or
vehicle other than an emergency vehicle which is obstructing a no parking zone at the expense of
the owner of such material or vehicle.

Sec. 78-151. Public launching sites.
(a) Each of the public launching sites including, but not limited to, East Fork Park, East
Fork Marina, Avalon Park, Lavonia Park, Mallard Park, Little Ridge Park and Pebble Beach Park,
on Lake Lavon, City of Wylie, Collin County, are zoned "No Wake Areas" and will be properly
identified as such, by placement of at least two "can" type buoys displaying "No Wake" encircled,
200 feet out from the launching ramps and 200 feet apart.
(b) All public launching sites are zoned "No Swimming Areas" and will be identified as
such by placement of a sign which reads "Swimming and Bathing Prohibited in Approaches to or
on the Boat Ramps" or equivalent at each launching site.

Sec. 78-152. Watercraft prohibited.
(a) Each of the swimming areas on Lake Lavon, City of Wylie, Collin County, including,
but not limited to Little Ridge, East Fork, Avalon, Mallard and Pebble Beach Parks are zoned "No
Boating Area" and will be identified as such by placement of"can" type buoys marked "Swimming
Area -- Keep Out" 200 feet out and along the perimeter of the swimming area which will be further
identified by placement of a "capsule" buoy line outlining the perimeter of the designated
swimming area.
(b) In any area zoned a "No Boating Area", all watercraft are prohibited, including, but
not limited to, power boats, motor boats, personal watercraft, any motor-driven craft and any
wind- or man-powered crafts.

Sec. 78-153. Water intake structures.
(a) Two North Texas Municipal Water Utilities intake structures. The water area 300
feet in front of both water intake structures owned and operated by North Texas Municipal Water
Utilities, is zoned as "Danger Areas" will be identified as such by placement of a sign on the face of
the structures which reads "Dangerous Current -- Stay 300 Feet Away," and/or buoys displaying
the universal markings of a diamond with inner cross and the words "Danger-- Keep Out."
(b) Garland Power Plant, inlet and outlet channels. The water area 300 feet in front of
the Garland Electric Power Plant intake structure and 300 feet below the end of the outlet
structure are zoned "Danger Areas" and will be identified by placement of "can" type buoys
displaying the universal markings of a diamond with inner cross and words "Danger -- Keep Out"
on a perimeter of 300 feet on the water side of both structures.
(c) East Fork and Avalon intake structures. The water area 300 feet in front of the
water intake structures known as East Fork and Avalon are zoned as "Danger Areas" will be
identified as such by placement of a sign on the face of the structures which reads "Dangerous
Current -- Stay 300 Feet Away," and/or buoys displaying the universal markings of a diamond
with inner cross and the words "Danger-- Keep Out."

Sec. 78-154. Lavon Dam inlet and outlet structure.
(a) The water area 300 feet upstream on the Lavon Dam gate facilities is zoned a
"Danger Area" and will be identified as such by placement of "can" type buoys displaying the
universal markings of a diamond with inner cross and the words "Danger -- Keep Out" on a
perimeter of 300 feet upstream from the face of the gate facilities.
(b) Also, due to the slippery surfaces and strong water current and undertow, the
immediate shoreline adjacent to the gate facilities is zoned a "Danger Area" and will be so marked
by signs reading "Restricted Area -- Keep Out."
(c) The water area below the dam to the railroad bridge approximately 400 feet
downstream, is zoned a "Danger Area" and will be so identified by signs reading "Danger No
Floats, Boats or Wading Beyond This Point" located to face downstream and adjacent bank fishing
areas.

Sec. 78-155. Commercial marinas and/or floating concession facilities.
The water areas of marinas and/or concession areas under license agreement with the U.S.
Army Corps of Engineers on Lavon Lake are zoned "No Wake Areas" and will be so identified by
placement of "can" type buoys displaying "No Wake" encircled, as prescribed by the Universal
State Waterways marking system, on the perimeter of the controlled area and/or upon approaches
to the controlled area, whichever is more practical.

Sec. 78-156. Endangering life or property prohibited.
It shall be unlawful for any person to operate any boat or other watercraft on any portion of
Lake Lavon lying within the corporate limits of the city in such a manner as to endanger life or
property.

Sec. 78-157. Other areas.
Other areas where the city identifies a hazard to life or property may be designated as "No
Boating Area" or "No Wake Area" with installation of appropriate markings. These areas may
include future marina sites, barge areas, shoals, shoreline abutments, and other water hazards.

Sec. 78-158. Penalty.
Any person, firm, corporation or business entity violating this article shall be deemed guilty of
a misdemeanor, and upon conviction thereof shall be fined a sum not exceeding $500.00. Each
continuing day's violation under this article shall constitute a separate offense. The penal
provisions imposed under this article shall not preclude the city from filing suit to enjoin the
violation. The city retains all legal rights and remedies available to it pursuant to local, state and
federal law.

The Collin County Parks Foundation Advisory Board completed review of applications and
provided funding recommendations, which were approved by Commissioners Court on
Tuesday, October 12, 2004.
On behalf of Commissioners Court, the Advisory Board gladly informs you that your
application for Olde City Park Improvements was awarded $150,115.00. Prior to the
commencement of your project an Interlocal Agreement must be executed. County staff will
mail the agreement within the next few weeks.
A total of twenty-three (23) applications with a total project cost of $22,747.921.30 and
requests for funding totaling $6,291,837.77 were received. The 2003 Open Space Bond, 1st
Series, will provide funding assistance to seventeen (17) applicants for a total of
$1,783,064.00.

1. Planned Development District
a. Purpose
The purpose of this Planned Development District (PDD) is to permit the development of
TRADITION by DR Horton, and to provide for the mixing and combining of uses set
forth herein as delineated on the Development Plan as submitted as amended Exhibit B,
herein incorporated by reference, with development standards set forth herein. Each
permitted use is planned, developed or operated as an integral land use unit while
providing flexibility in the use and design of land and buildings where modification of
specific provisions of this ordinance is not contrary to its intent and purpose or
significantly inconsistent with the planning on which it is based and will not be harmful
to the neighborhood. The detailed provisions contained in this PDD and the

3. "Commercial" (Non-Residential Permitted Uses)
Non-residential permitted uses consistent with the Development Plan as amended,
incorporated herein by reference, shall be those permitted under the Neighborhood
Service and Community Retail Districts of the Code of Ordinances as amended.

4. Residential Design Standards
a. Sidewalks
Sidewalks shall be provided along both sides of the streets unless inconsistent with
improvements designed for neighborhood parks and greens.
b. Streets
Except split median avenues, streets shall have a right-of-way of 50 feet and a paved
section of 27 feet measured curb face to curb face. Split median avenues shall have a
paved section of 18 feet curb face to curb face for each direction, providing for one travel
lane and one parking lane in each direction. Curvilinear streets shall be provided as
indicated on the Development Plan as amended.
c. Alleys
Alleys shall have a right-of-way of 16 feet and a paved section of 10 feet.
The minimum garage setback shall be at least 7 feet when the primary dwelling unit
fronts on improved green space in order for parallel parking to be accommodated in front
of the garage adjacent to the alley.
d. Entry Features
Entrances to subdivisions shall contain subdivision monumentation but no entry walls,
and shall provide rights-of-way as delineated in the Development Plan as amended,
incorporated herein by reference.
e. Architectural Style of Dwelling Units
The architecture of the dwelling units shall be based on traditional neighborhood design
styles, which may include front porches, dormers, vertically oriented windows, bay
windows and picket-style fencing.
f. Structure Materials
Cementatious fiber board with a minimum warranty of at least 50 years, stone and brick
shall be allowed as a primary façade materials. Wood accents not exceeding 5% of the
surface area of the structure shall be allowed.
g. Roof Pitch
Roof pitches shall be utilized consistent with traditional neighborhood design
architectural styles.

h. Street Trees
Cedar Elm, Chinese Pistache, Texas Ash or Lace Bark Elm if approximately 10 feet or
less in distance from back of curb, and Live Oak, Red Oak or Texas Oak if approximately
10 feet or greater in distance from back of curb shall be planted approximately every 35
feet within the parkway of the streets of the development. Yard trees shall not be

5. Non-Residential Design Standards
Non-Residential site design standards shall be those set forth in the Code of Ordinances.
6. Open Space and Neighborhood Amenities Center
a. Open Space Minimums,HOA and Park Fees
Open space and parks shall be at least 15%of the gross site area as approximately set
forth in the Development Plan as amended. A Home Owners Association shall be
created to maintain the open space and parks. Accordingly, the City of Wylie park fees
shall be waived for this PDD so long as the developer and/or owner uses comparable
funds to provide park improvements within or adjacent to the development.
b. Parks and Open Space
Open space and parks as set forth in the Development Plan as amended shall be
maintained by a Home Owners Association.
c. Swim Center
A swim center shall be provided for the development and maintained by a Home Owners
Association.
d. Public Pathways—Open Space Easements and Connections
Streets along side open space, trails and pedestrian access to open space and parks shall
be provided as set forth in the Development Plan as amended and incorporated herein by
reference.
e. Perimeter Open Space,walkways and Trail Linkages
Walkways and landscape improvements shall be provided within open space areas along
the perimeter of the development as set forth in the Development Plan as amended,
incorporated herein by reference. Linkages to trails adjacent to the development shall be
provided.
