Issue
Discuss and consider the Preliminary Plat for Pheasant Creek Addition by Band D Land, L.C.
Background
A Preliminary Plat has been submitted for the Pheasant Creek Addition, which is located in the
southeast portion of the City(intersection of Troy and Vinson Roads). The Preliminary Plat
contains 292 single-family lots. Based on the Parkland Dedication Ordinance, the requirements
for this proposal would be either the dedication of approximately 4.38 acres of land or the
payment of approximately$146,000(292 lots x$500), or some combination of the land or
payment.
Financial Considerations
The payment of fees in lieu of parkland dedication would be approximately $146,000.
Other Considerations
The Comprehensive Plan does reflect park dedication in the northeastern corner of the
Preliminary Plat.
Article VIII, Section 2 of the City Charter and Section 78-38 of the City Code identify the duties
of the Park Board to serve in an advisory capacity to the City Council on the planning and
development of parks and recreation facilities and the regulations governing their use.
Board/commission Recommendation
The Planning and Zoning Commission has approved the Preliminary Plat. The City Council will
vote on this preliminary Plat at the November 13, 2001 meeting.
Staff Recommendations
Accepting the parkland dedication of 4.38 acres or $146,000 or a combination of parkland and
fees.

Development Trust.
Background
The Zoning Concept Plan has been submitted for the Bozeman Farms Estates, which is located in
the southeast portion of the City(intersection of Stone Rd. and FM 544). At this point no lot size
or parkland dedication have been established.
Financial Considerations
N/A
Other Considerations
The Comprehensive Plan does not reflect parkland dedication(other than floodplain)in this
Zoning Concept Plan.

This is a zoning concept plan that is in need of input by the Park and Recreation Board regarding
all of the Park and Open space options given by the developer.
