Background A preliminary plat has been submitted for the Country Ridge Subdivision, which is located directly south of the Riverchase Subdivision(formerly Eastfork). The plat consists of approx. 100 acres and would contain 312 single-family lots. Based on the Parkland Dedication Ordinance, the requirements for this proposal would be either the dedication of 4.6 acres of land or the payment of approx. $156,000 (312 lots x$500). The Park and Open Space Master Plan do not reflect any park dedication in the area. Financial Considerations The applicant is requesting the payment of fees in lieu of dedicating parkland. Other Considerations The fees collected from this developer would be to enhance the western part of the City (i.e. Founders Park) see Park Zones map. The proposed subdivision does not tie directly to the Muddy Creek floodplain to the west or north. There are additional uplands to the west, which are outside of the floodplain and can be developed for housing and park access. The collector street through the southern portion of the subdivision allows access to these developable lands to the west. Much of the floodplain within the Riverchase Subdivision to the north is private open space and storm water detention, which will be accessible only by residents of this gated neighborhood and will be maintained by that Homeowners Association. This private open space does border/access and includes some of the Muddy Creek floodplain. Planning staff is very supportive of the concept of a continual public open space linkage along Muddy Creek, and we will continue to require dedication and/or access to such as we did in Riverchase, but the proposed Country Ridge does not have direct access to that corridor. We can provide maps, which better show the relationship of the floodplain and the proposed subdivision. It is likely that a combination of some land and funds could be provided. Since the concept plan cannot provide access to the floodplain to the west and north, land could be sought for a neighborhood park. Article VIII, Section 2 of the City Charter and Section 78-38 of the City Code identify the duties of the Park Board to serve in an advisory capacity to the City Council on the planning and development of parks and recreation facilities and the regulations governing their use. P.2 Board/commission Recommendation The Planning and Zoning Commission approved the PD and Concept Plan. Staff Recommendations Staff recommends accepting the dedication fees by the developer.
